this is "cbs news flash." i'm shanelle kaul in new york. the associated press reports that ohio voters rejected a proposal that would have made it more difficult to change the state's constitution. the vote comes ahead of a referendum this november to amend ohio's constitution to protect the right to an abortion. espn is getting into the gambling game. the sports media brand signed a $2 billion licensing deal with gambling company penn entertainment to rebrand penn's current sportsbook under the name espn bet. and mourners gathered tuesday as the funeral for singer sinéad o'connor was held in her hometown of bray, ireland. o'connor died last month at the age of 56. for more, download the cbs news app on your cell phone or connected tv. i'm shanelle kaul, cbs news, new york.

it's wednesday, august 9th, 2023. this is the "cbs morning news." breaking overnight, voters in ohio reject a measure in a special election in what's seen as a victory for abortion rights. we'll get reaction. alabama arrest. three men charged in that wild riverfront brawl as authorities search for more suspects. and check your mega millions lottery ticket. there's a single winning ticket for that $1.5 billion jackpot. we'll tell you where it was sold. good morning, and good to be with you. i'm anne-marie green. we begin with the results of a closely watched special election in ohio that could have an impact well beyond state borders. yesterday voters rejected a measure that would have made it harder to amend the state constitution. it's a move some believe paves the way for a vote to pass abortion protections in ohio later on this year. jarred hill is in new york to explain a little bit about what this all means. good morning.

>> reporter: good morning. yeah, ohioans delivered a resounding rejection of this measure. that plus some really solid voter turnout, especially for a special election like this one, shows how much of a driver the issue of abortion is now and could be come 2024. >> the majority still rules in ohio. [ cheers ] >> reporter: a major win for supporters of abortion rights in red-leaning ohio. >> voters were not fooled by this unprecedented, dishonest attempt to silence our voice. >> reporter: last night voters rejected a measure called issue one, maintaining the simple majority threshold to pass constitutional amendments. that's 50% of the vote plus one. instead of the 60% supermajority state republicans supported. it comes ahead of a vote in november where ohioans will decide if their state constitution should include protections for abortion access. >> we don't want to see a really radical abortion amendment put

in our state constitution. >> reporter: according to a recent poll, 58% of ohioans are in favor. it will be yet another test of america's temperature on the issue over a year since the supreme court ruled abortion access isn't a federally protected right, rather a decision for the states. >> it's really going to set the tone for the 2024 elections when we have a presidential election as well as many other states wanting to address abortion rights. >> reporter: ohio once again at the heart of the political debate. let's start local and go national here. state republicans in ohio are now putting their attention on defeating that november ballot measure which would actually potentially enshrine abortion protection in the state. meanwhile on the national level, a cbs news poll shows the democrats are more driven by the issue of abortion than republicans are. president biden put out a statement saying that democracy won. back to you. >> very interesting. jarred hill in new york. thanks a lot.

police in montgomery, alabama, say more charges are likely in that wild fight on that dock that was all caught on video and went viral. yesterday three men were arrested. omar villafranca has details on the dramatic footage. >> reporter: a viral boat side brawl that was all hands on deck. video taken by eyewitnesses show damien pickett, co-captain of a large riverboat, asking a group to move their pontoon so the riverboat could dock in its assigned space. they refused and attacked pickett, wrestling him to the ground while punching and kicking him. pickett's co-workers and others rushed to his aid, including 16-year-old adam rudolph who jumped into the water and swam to help. once the riverboat docked, the fight escalated. one woman was pushed into the river.

this man uses a folding chair as a weapon and hit this woman. multiple people recorded the brawl, including christa owen. >> i wanted to make sure that the police knew when it came to the end who threw the first punches. >> reporter: today authorities have charged three white men with third-degree assault and are looking to question the man who was wielding the chair. >> we did examine if there was enough to file hate crimes charges on this case, and we've looked at what it takes to elevate this to a riot. we've worked with our local district attorney, and it did fit the criteria for that. >> reporter: montgomery's first black mayor, steven reed, says his city shouldn't be marred by this latest incident. >> this is not indicative of who we are. so i think it's important for us to address this as an isolated incident, one that was avoidable. >> that was omar villafranca reporting. the u.s. supreme court has sided with the biden

administration's crackdown on so-called ghost guns which can't be traced. ed o'keefe has more on the ruling. >> reporter: police nationwide say ghost guns are a big reason why violent crime has spiked in major cities in recent years, and they've been used in school shootings in california, maryland, and elsewhere. ghost guns can be bought on line, , some made e with a 3d d prininter. most don't carry serial numbers, making them harder to track. the supreme court with conservative justices roberts and amy coney barrett joining the three liberals in the majority let it stay in place. the rules were introduced last summer in response to the growing wave of violent crime and seek to treat ghost guns like other firearms. >> simply treats them as firearms under the gun-control act where a person has to appear in person, present identification. pass a background check. >> reporter: tom chittum helped draft the regulations.

>> increasingly what we've seen is criminals turn to the internet, order these kits from the comfort of their home, assemble them, and have a firearm that is not easily detected by law enforcement. >> reporter: atf figures show the number of ghost guns recovered more than doubled from 2020 to 2021. police say it's led to violent crime like this incident in new york last month when a 25-year-old man on a scooter allegedly shot up six locations across the city using a ghost gun. opponents of the new regulations argue in federal court atf doesn't have the authority to make changes to gun laws, it's congress that has to do that. the case could drag on for years. the white house says it's pleased with the ruling and will continue to use every tool at its disposal to keep fighting gun violence across the country. ed o'keefe, cbs news, the white house. overseas now, ukraine is accusing russia of targeting rescue workers in a missile attack. ukrainian officials said russia struck residential buildings with two consecutive missiles within 40 minutes of each other monday.

the first to draw rescue crews to the scene and the second to kill or wound them. nine people died and more than 80 others were wounded. ukraine says most of the wounded were police officers, emergency workers, and soldiers who rushed to help people. secretary of state antony blinken renewed a call for the release of niger's president and his family. last night on social media, blinken wrote that he had spoken to niger's democratically elected president mohamed bazoum. he's been under house arrest since a military coup two weeks ago. earlier blinken said he was worried that russia's wagner mercenaries could take advantage of the instability in niger. back home now, a los angeles judge sentenced rapper tory lanez to ten years in prison for shooting and wounding hip-hop star megan thee stallion. the 31-year-old canadian rapper was found guilty of three felony charges last year for shooting megan several times in the foot during an argument in 2020. yesterday in court, lanez said

"the new york times" report the maker of the diabetes and weight loss drug wegovy says that a new study shows that it cut the risk of heart problems. danish company novo nordisk says that the drug slashed the risk of serious heart issues by 20% in a trial of more than 17,000 overweight and obese adults with cardiovascular disease and no history of diabetes. the study could help persuade insurers to pay for the drug and costs about $1,300 a month. "the hill" says an online crowdfund to assist marine veteran daniel penny with legal fees has raised nearly $3 million. the 24-year-old has pleaded not guilty to manslaughter and

negligent homicide charges in the choke hold death of a man on a subway train in may. penny says that he was protecting himself and others after jordan neely threatened people and acted erraticalli. he was homeless and had a history of mental illness. penny's legal team says any left over money will be donated to mental health charities. ten small and mid-size banks renewing concerns about the health of america's banking system. the dow lost 158 points. the nasdaq was down 110, and the s&p 500 lost 19 points. americans have been swiping their credit cards more than ever. the new york federal reserve bank says for the first time credit card debt in this country topped $1 trillion in its second quarter. researchers attribute the $45 billion spike to strong consumer spending and higher prices due to inflation. this as overall household debt loads were largely unchanged. espn has signed a $2 billion sports betting deal with penn entertainment. the ten-year deal includes rebranding a barstool sports book app as espn bet this fall. the new app will be promoted on espn's platforms, and the deal also includes access to espn programming and talent. it comes as sports betting is rising in popularity.
