heat wave that's forcing schools to cancel classes and has turned deadly in florida. the criminal case against hunter biden. the special counsel investigating the president's son says he plans to seek an indictment. and trouble on e street. bruce springsteen is postponing his concerts this month. what he's telling fans. good morning, and good to be with you. i'm anne-marie green. temperatures putting stress on schools and students as they return from summer break. the record-breaking heat is forcing the cancelation of classes in some areas as heat alerts or advisories persist for millions of americans. jarred hill is here in new york with more. good morning. >> reporter: good morning, anne-marie. it's not just the heat, but as you mentioned the timing here. with kids now back in school, a 2021 study found nearly 16,000 schools would need to update their hvac systems to detail

-- deal with the late summer temperatures. now frustrated parents are wondering when that will happen. a scorching late summer heat wave is taking a toll on schools nationwide. >> luke was coming home sweaty. he was telling us it was hot. >> reporter: hugh barrett says his 5-year-old son luke spent the first couple of days of kindergarten without air conditioning. now in the school in washington, d.c., has fans and window units. >> he says it's cooler. still noisy. >> they say to bring water, but it doesn't do much. >> reporter: the heat hit this eighth grader and led to a four-day weekend. schools canceled classes for the rest of the week. >> it's good for the kids, it's hard to concentrate. they're hot. >> reporter: the heat has prompted schools in at least nine states to close or let kids out early this week. in jacksonville beach, florida, the heat is blamed for the death of a 2-year-old girl found in a parked vehicle outside of a church. >> this is a great tragedy. it affects everybody. >> reporter: airport workers in phoenix are filed an osha

complaint demanding safe work conditions after this summer's brutal heat wave. >> i often feel like i'm going to faint and have caught myself briefly dipping in and out of consciousness while working on the airplanes. >> reporter: after phoenix saw a record-breaking 31 straight days of highs at 110 degrees or above this summer, temperatures are again expected to climb back to that level this weekend. and the heat is also expected to bring some severe weather. the national weather service says damaging winds, hail, and heavy rain are all possible along the east coast today. >> my goodness. all right. maybe that will cool things off a little. thank you. the special counsel investigating president biden's son hunter biden says he plans to seek an indictment in a gun case before the end of the month. catherine herridge has more on that. >> reporter: the prosecutor's status report is the strongest indication that charges are looming in the hunter biden case. the president's son had previously reached a deal for alleged gun possession by a drug

user that avoided prosecution if he abided by the terms for two years. in july, a plea agreement for misdemeanor tax charges collapsed, leaving the future of the gun deal in question. and hunter biden facing legal jeopardy. special counsel david weiss revealed his plans, telling the court "the government intends to seek the return of an indictment in this case before september 29th." harry littmann is former federal prosecutor. what's the message from this filing? >> the message from that filing is they are going full bore at him on a charge that they normally wouldn't bring so they are really playing hardball with biden. >> reporter: in august, weiss, a trump appointee, was named special counsel after prosecutors said negotiations with hunter biden's lawyers were ad an impasse. an attorney for the president's son said "we expect a fair resolution based on the evidence and the law, not outside political pressure."

this development comes as house republicans have already ramped up their investigations into the president and his son, calling the plea agreements a sweetheart deal, and they want special counsel weiss to testify. catherine herridge, cbs news, washington. a major ruling in the trump election interference case in georgia. a judge has denied requests for two of the defendants to be tried alone. lawyers kenneth chesebro and sidney powell will instead be tried together in a trial set to begin october 23rd. the ruling comes after they both filed speedy trial demands. the former president and 18 of his allies are accused of illegally trying to overturn the 2020 election in the state. all have pleaded not guilty. and we're now learning how a convicted murderer escaped a suburban pennsylvania prison as the manhunt enters its eighth day. new video shows 34-year-old danelo cavalcante jumping from the roof of the chester point

prison thursday morning. authorities said guards didn't notice he was gone for a full hour. he's been spotted since then, most recently tuesday when he was seen in a residential area. he was sentenced to life in prison last month for murdering his ex-girlfriend and is considered extremely dangerous. turning now to the war in ukraine. at least 17 people are dead after russia unleashed a missile attack that hit an outdoor market. the attack unfolded during a visit by u.s. secretary of state antony blinken who announced a new billion-dollar aid package. imtiaz tyab reports from kyiv. >> reporter: the moment a russian missile slammed into a busy outdoor market, bringing fire and death to the streets. the carnage in the eastern region is one of the deadliest assaults in months and came shortly after missiles targeting

kyiv were shot down by ukrainian air defenses as antony blinken traveled on an unannounced two-day trip. the first after the counter -- counteroffensive nearly three months ago. he arrived product liability issing aid including controversial depleted uranium munitions. >> in the ongoing counteroffensive, progress has accelerated in the past few weeks. this new assistance will help sustain it and build further momentum. >> reporter: in recent days, ukrainian forces have pushed farther south but progress is slow thanks to russian air strikes and minefields. president zelenskyy also navigates political minefields. ththis week he removed the defee minster and replaced him with the anti-corruption campaigner who's now responsible for overseeing billions of dollars in military funds.

will receive information about rescheduled dates. springsteen suddenly postponed two concerts in philadelphia last month that he promised will be rescheduled. the tour is currently scheduled to resume with shows in canada in november. on capitol hill, senator mitch mcconnell says he plans to stay in office amid questions about his health. as nikole killion reports, a fellow senator expressed doubts about the diagnosis given by the capitol doctor following mcconnell's recent health scares. >> reporter: senate minority leader mitch mcconnell dismissed questions about his health and vowed to stay on. >> going to finish my term as leader, and i'm going to finish my senate term. >> reporter: the kentucky republican pointed to a letter from congress' attending physician which found no evidence of stroke or seizures or movement disorders like parkinson's disease following two recent incidents in which he froze up. kentucky's rand paul, an eye doctor, expressed support for mcconnell but skepticis about the capitol physician's diagnosis.
