daca ruling. a federal judge declares the obama-era program preventing undocumented immigrants from deportation is illegal. what the implications are for hundreds of thousands of young people. good morning, and good to be with you. i'm anne-marie green. the escaped murderer was recaptured after eluding hundreds of searchers for two weeks. he's now in prison out of philadelphia. this is the new mugshot of danelo cavalcante. he was caught yesterday by a team of tactical officers with search dogs in a wooded area of pennsylvania, about 20 miles away from where he escaped. jarred hill is in new york with the latest on all of this. good morning. >> reporter: good morning, anne-marie. cavalcante did not go back to that jail that he literally climbed out of. instead, a maximum security prison. authorities are saying that they caught him after two weeks thanks in large part to a dog and the element of surprise. after convicted killer danelo cavalcante was taken into custody yesterday in chester county, pennsylvania. >> our nightmare is finally over, and the good guys won. >> the search for danelo cavalcante is over. >> reporter: the clean-shaven 34-year-old was captured about 20 miles from the prison that he escaped from two weeks ago, breaking out by scaling a wall. police say the final standoff was put into motion when a home burglary alarm was tripped just after midnight within the search area. about an hour later an aircraft using thermal technology picked up a heat signal, then just before 8:00 a.m. tactical units surrounded cavalcante. he tried to escape with a stolen rifle, but law enforcement released a k-9 to hold him. cavalcante sustained a dog bite injury to his scalp which was treated on the scene. authorities say 4-year-old law enforcement dog yoda played a key role in the capture. >> the dog subdued him, and team members from both of those teams immediately moved in. he continued to resist but was

forcibly taken into custody. >> reporter: the 14-day manhunt paralyzed the philadelphia suburbs. temporarily closing businesses and schools. now residents are expressing relief. >> just exhale. it's nice. >> reporter: police say cavalcante was cooperative when interviewed. his preliminary hearing is scheduled in two weeks. cavalcante is starting his life sentence now for brutally murdering his ex-girlfriend. anne-marie, he could be facing additional charges related to this escape. back to you. >> all right, jarred hill in new york. thank you. well, last night president biden made his first remarks about the house republicans' impeachment inquiry. mr. biden brushed off concerns about the probe saying "i'm focused on the things the american people want me to focus on." cbs' nikole killion has more. >> reporter: house republicans huddled behind closed doors wednesday ready to move full speed ahead with their impeachment inquiry against president biden, unilaterally authorized by speaker kevin mccarthy. how do you justify this

impeachment inquiry without holding a full house vote? >> easily because nancy pelosi changed the rules. >> reporter: despite saying earlier that he would hold a vote, the speaker pointed to former speaker nancy pelosi's decision four years ago to announce an impeachment inquiry into then-president trump. it took five weeks until the house voted. >> the resolution is adopted. >> reporter: prompting the trump department of justice to declare that impeachment inquiries are invalid unless the chamber takes a formal vote. >> this is completely impeachment theater. there is no additional power that the republican congress has. >> reporter: the chair overseeing the probe into the business dealings of mr. biden's son and associates countered. >> we are following the money, and we will see where that leads us. >> reporter: the white house continued to insist there is no evidence of wrongdoing by the president. >> this is a political stunt. >> reporter: nikole killion, cbs news, capitol hill. utah republican senator mitt

romney says he will not run for re-election next year. the 76-year-old former gop presidential candidate said it's time for a younger generation of leaders. he also cited a dysfunctional house of representatives as another reason for retiring. romney was the only republican member of congress to vote to convict then-president trump at both of his impeachment trials. a federal judge has again ruled that the daca immigration program is illegal. the obama-era program prevents hundreds of thousands of undocumented immigrants brought to the u.s. as children from being deported. it also allows for them to work legally. the judge did not order an immediate end to the program. current applicants will be able to keep and renew their protection, but no new applications will be allowed. the biden administration is expected to appeal the ruling. hurricane lee is making its way across the atlantic ocean on a possible path toward new england. the category-two storm is expected to pass just west of bermuda today.

it's forecast to then weaken as it moves north where it could make landfall along the coastal new england and eastern canada over the weekend. a hurricane watch is in effect for portions of maine, and a tropical storm watch for a large area of coastal new england. a federal judge has blocked part of a public health order that suspended the right to publicly carry a firearm in new mexico's largest city, albuquerque. as lana zak reports, the governor is facing a wave of lawsuits after issuing the temporary ban following several recent shootings. >> reporter: in new mexico, gun culture runs deep, so a temporary ban where to carry them was bound to cause an uproar. >> people were angry. >> reporter: mark abramson is a gun shop owner. >> i cannot fathom how this is anything other than an attention getter. >> reporter: the judge's ruling halts governor michelle lujan grisham's 30-day suspension on carrying arms in the county

where crime rates are high. she cited a public health emergency after three children were fatally shot recently including 11-yea -ye-year-old f was killed. >> i have to take a stand where i'm ignoring that we lost an 11-year-old. another child. >> reporter: nationally firearms are the leading cause of death for children and teens. but the county's democratic sheriff, john allen, feels that the governor's act was unconstitutional. >> there's not enough law enforcement to go around and enforce this order when we're supposed to be going after criminals on the street and not after law-abiding citizens. >> reporter: what are the solutions? >> the solutions is multifaceted. you have red flag laws, you implement with your senators and representatives other laws that they think might help bring down gun violence. >> reporter: the catholic archbishop for the area has counseled families ravaged by gun violence. he supports the temporary measure. >> we have to be courageous, we have to do something about this

testify yesterday but never took the stand. paxton is accused of bribery and misusing his office to help a real estate developer who was under fbi investigation and hire the woman. paxton denies any wrongdoing. his lawyers begin presenting their defense today. the "anchorage daily news" says the husband of alaska representative mary peltola died in a plane crash. the ntsb says eugene peltola jr. was the pilot and the only person on board a single-engine plane when it crashed yesterday. it happened in a mountainous area of southwest alaska. officials say he had flown a hunter and equipment to a remote location before the crash. the investigation is under way to determine the cause. and the "associated press" says north carolina republicans are in a budget standoff because of gambling provisions. differences between house and senate republicans over expanding states-sanctioned gambling is delaying passage of a budget that was supposed to be

enacted by july 1st. one proposal calls for the legalization of video gambling machines statewide and the authorization of more casinos. democratic governor roy cooper said it was outrageous that casinos were holding up the budget. still to come, a rare meeting of tech titans. industry leaders including elon musk and mark zuckerberg weigh in on the future of artificial intelligence. ship free with a fishing vessel during high tide failed. there are also reports of several cases of covid on board. it's feared the vessel could potentially be stuck for days. tech titans met on capitol hill to discuss the future of a.i., and a potential autoworkers strike is going down to the wire. shanelle kaul has your cbs "money watch" report. >> reporter: stocks mostly rose wednesday after consumer data revealed inflation accelerated in august for a second straight month. the dow lost 70 points. the nasdaq was up 39, and the s&p 500 gained 5 points. america could be on the brink of another big labor strike. the united autoworkers leader says his members are prepared to streak against the big three detroit carmakers friday if a deal is not reached by tonight. the initial job action would be limited and targeted, but eventually expand if talks don't improve. the union is seeking higher wages, expanded pensions, and shorter hours.
