oakland has been battling retail theft for years now , and a huge tool to fight it was within reach. why the city just blew his chance at millions. the salesforce boss says dream force has been a perfectly safe so why is he taking a jab at city hall? it is definitely the most affordable oceanfront home in the bay area, but how did it get there? from kpix, this is the late news with sara nolte on cbs news bay area. hello, i am sara donchey. seems like every city in california has begged for help with what we are about to talk about. and in the bay area, this is out of control. retail theft , business owners have told us they feel helpless. police departments have said they want to do more to stop it. the thing is, that costs money, money that cities and

police departments mainly don't have. the state finally said we got this, we can help. they are dishing out $267 million to communities in law enforcement agencies, at cities big and small, jumped at the chance. like san francisco , where this just happened, police say someone smashed in their car into the front of the cvs on portola drive , would be thieves, they said, who didn't make off with anything but the cops, sfpd, got more than $50 million from the state to try to keep things like that from happening. and the lapd is expected to get about the same amount, and they have the same problems. thieves plowed one car right to the front of this smoke shop and left in another, with stolen loot. small cities got money, too. like kalinga, less than 18,000 people live there. the lawn is police department? they got money. they are a small city north of bakersfield. university didn't get a dime? oakland. and it is all because they missed the deadline to apply for the money. and andrea nakano reports some of

the cities critics say this one is embarrassing. >> reporter: here at the community garden in west oakland, seneca scott started a grassroots movement to ring safety back to the town. he founded neighbors together , oakland. when he heard that oakland missed out on millions of dollars to combat retail theft, he was extremely disappointed. >> everyone i was telling, when comes to oakland, excuses, metaphorical. >> reporter: the city of oakland missed the deadline, saying the economic and workforce development department failed to submit documents in time. >> no joking matter. we are in a curious time for oakland. public safety is far and away the number one issue, and to miss something that would put millions of dollars at a time where we have a budget deficit over $300 million, it's inexcusable missed opportunity. >> reporter: in a statement,

the city says obviously this outcome is unacceptable. the city and department are reviewing everything that happened to ensure it does not happen again. and will take appropriate action. >> this news comes as many business owners, like robbie, car, have been left frustrated by the increasing crime, his 7-eleven store was hit twice just last month. >> is a humble request to the city of oakland , city of oakland council members, oakland city mayor, please do something. please take a strong action. >> other business owners, the co-owner of jones barbecue is trying to remain hopeful, and that maybe funding will come from other sources. >> business is down quite a bit. because of the crime. but, again, it , all roads lead back to just trying to stay optimistic. >> for scott, he is running out of patience. he says city leaders and not just economic workforce development department need to be held

accountable. >> this is an inexcusable missed opportunity. watch city council in how to take accountability for basically not doing their jobs that we need them to do right now. >> reporter: so speaking of accountability, we reached out to mayor sheng thao's office this afternoon for her reaction to ask if she takes any responsibility for this. we also wanted to ask specific questions about the application process, what they did, what they didn't do. so far, no word back. salesforce ceo marc benioff says dream force has gone off without a hitch so far, in spite of his threats to pull the conference from san francisco. but he is still taking a jab at city hall tonight. he tweeted out that san francisco has been incredibly clean, beautiful, and safe for the last three days . he wrote that it is great the city put his best foot forward but he added it is important to ask why the city can't be this clean and safe everything all day. the

chronicle reports mayor london breed is pushing back on that, telling reporters that san francisco is changing and things are getting better, she says. right now the threats to both the conference have been threats and there have been no announcements about dream forces face for next year. across the bridge, berkley's plans to sweep a homeless encampment outraged the people who live there, who say they have nowhere else to go. but they sought help and now they are celebrating what they call a small victory as they try to navigate a tough reality living on the street. kelsey thorne talked to one man who is now breathing a sigh of relief. >> reporter: leon l dray doesn't have a home . right now he says he moves from encampment to encampment around berkeley every night. but before that, he lived here, at the encampment on eighth and harrison for over a year. >> when i got here, i have nothing, it was me and my dog. and let's just say , i met people down here. >> leon says many of those

people still live here ? that is why, when he heard the city was trying to sweep the encampment, he got mad. >> where are we going to go? around the corner? maybe down the street over here? that's what's going to happen. >> reporter: to try and stop this week, some people contacted lawyers. the lawyers were able to get a judge to put an injunction in place, barring the city from sweeping the encampment until at least september 27th, when both lawyers representing the city and those representing the encampment will have their day in court. lawyers for the city are arguing the encampment is a health risk . but lawyers for those in the encampment say the city hasn't provided an alternative location for people to go. nor resources for those who have disabilities. leon told me many of them are keeping a close eye on the case, but remain confident they will be able to stay. >> yeah, i feel confident. i ain't worried. if anybody else

would ask, i don't see no worried faces over here. >> reporter: out of all the places he lives, this encampment has actually been one of the best. he always felt safe and felt like everyone who lives here looks out for one another. he says he just wishes the city would do the same. >> pretty much, leave us be. it's home here, and this is kind of like a good place to be at. so they need to back off. >> reporter: we reach out to the city for comment but have not heard back. this injunction only impacts the encampment, rather, at eighth and harrison. a federal judge in texas just built the biden administration another blow with another willing declaring daca unlawful with the white house expected to appeal, the case go to go all the way to the supreme court. jocelyn moran talks with one san jose dreamer who is worried she may someday be forced to leave the only country she has ever known.

>> i don't remember the trip here. i just, one day i was in mexico, the next i was in l.a. and now i am in san jose, california. i have been living here for the past two years. >> reporter: came to the u.s. with her family when she was just three years old. she has been protected from deportation and has had a work permit is inferred action of childhood arrivals program, better known as daca. >> i graduated high school, that is when dr. came out. if not i probably would've gone back. >> reporter: the program allowed her to work legally, she now has her own nonprofit that focuses on supporting people like farmworkers. daca has taken its hit in the last few years. while florez is still a daca recipient, she thinks about others who haven't been able to apply. >> i am always thinking about the high schoolers that graduate these past few years, where they aren't able to apply. >> reporter: applications have been blocked since 2021, when a texas judge found daca unlawful. the same judge ruled that the biden administration's revised version of daca was

still unlawful. existing daca recipients have been and are still able to renew their daca applications. they are still protected even under this new ruling but this is likely to go to the supreme court. >> just reminding us that oh no, you're unlawful, that is not right, that shouldn't have been done this way. it is not that we don't care, but in a way, we feel numb to these . because imagine someone reminding you like oh, you know, so you are depending your life on this piece of paper and we are going to take it away. we don't really think it's good. >> there is definitely fair. >> reporter: an immigration attorney with nonprofit san jose, daca recipients talk with a lawyer. >> to see if there are other pathways. there are definitely people to qualify for other types of status. >> reporter: we talked over the last few years, she has been sharing her story and advocating for the rights of

immigrants and farmworkers. what is needed now is immigration reform. >> we start fighting for citizenship. because that is what we deserve and that is what we were promised. >> reporter: document protects 5000 80,000 people here in the bay area. well, as a bay area oceanfront real estate goes, this is as close and as inexpensive as it gets. but the commute? might be a dealbreaker. and this is the type of thing the state is spending hundreds of millions of dollars to stop. the brazen theft that turned violent when a store clerk tried to intervene. i am doing great. >> to what extent will this ordeal stop you from going back into the earth? >> the answer to that question, from the cave or who nearly died a half-mile down. about a mile up, this is our view . you can see the fog in the distance, making more progress as it goes farther and farther inland, we've got a

tonight, we have been talking a lot about retail theft. plaguing stores up and down our state. and this is what a shop owner in la's chinatown had to deal with and someone busted into still there stuff but attacked the 60-year-old woman working there. joy benedict has the shocking video. just a warning, and might be difficult to watch. >> reporter: with the fling of a door, a brazen robber came in fast, grabbing items off the shelf of the store in chinatown. but watch what happens when the clerk tries to intervene. this 60-year-old woman is punched in the face. >> it's a shame, it is heartbreaking to see something like that. she is one of the nicest people. >> reporter: the clerk has worked at his store for 20 years, and she was just trying to stop the theft. >> overpowered her, took the items but also punched her which is totally unnecessary. >> reporter: just before noon on thursday, when the man approached the door wearing a

ski mask. the clerk ran over to try to change the door but he overpowered her, breaking in and snatching products out of the front window. >> he walked to the window, slid the door open, grab the item that he wanted to steal, and she was trying to tell him to stop so he throws her off. >> that wasn't enough, when the thief jumped behind the counter, she got up, tugging on his clothes, that is when he punched her. others in the area came to help, and she went to the hospital. >> she is coherent, she is talking, but her eye, her left eye is swollen shut. so the doctors are waiting for this one to go down before they can do some scans to see if there is internal damage. >> reporter: this store owner isn't wearing for advocates services, he is offering a $5000 reward for any information that leads to a conviction of this thief >> he knew, he came yesterday and he scopes the place out. he attempted to take it yesterday, i stopped him. >> reporter: now he wants this guy caught before he attacks

this video was posted last december, it started to go viral now. you can kind of see why. the structure is pretty amazing. it seems to have been built with driftwood, wooden planks, tarps, and buoys. it even has different rooms and obvious signs that somebody was probably living there. there is a bed with shoes, tables, punching bags, hanging on the side. it is amazing that anyone to listen the first place because you need some serious skills. the cliffside is so steep it looks very hard to climb unclear if the structure is still standing today and how long it was therefore but we are definitely looking into that. >> survived the atmospheric river onslaught from last year? >> i was going to say, what happens when a large wave comes? not the place i would want to be. speaking of which. >> this is a severe thunderstorm, looks like a monsoon in atlanta, what is happening here? >> just a torrential amount of

rain in a very short amount of time, on top of an urban landscape that cannot absorb it. cars and trucks, sheets of rain. that is just wild. >> i have seen video of the dorms being flooded, water in people's homes. anytime that happens that can be really catastrophic, even if they are not heard . water in homes is never a good thing. >> water on the roads is always dangerous because it takes only 18 inches of water to float a vehicle. it only takes six inches of moving water to sweep a vehicle away. so wrote you think you are safe to cross? nope, that is something to keep in mind. hopefully we don't have a repeat of last rainy season. way too soon to tell about that. we are grateful for the weather we have had. >> fantastic, another day of near average temperatures courtesy of this of air that is just off to our north , at ground level, keeping the marine layer rather short and keeping our temperatures very close to average. we are going to see this little ripple taking shape off the coast and that will allow the marine layer to get deeper and our temperatures to cool off as we

finish the work week and headed to the weekend, one more day of near average temperatures. this is the 10 day outlook for concord and we are going to spend about four days, five to seven degrees below normal through the first half of next week, even once we climb back up, we are going to be talking about near-normal temperatures again by the time we finish off summer and head into fall. the autumnal equinox is a week from tomorrow, a week from friday. the amount of smoke being produced by those fires . yes, still, there is haze on the horizon today. fires have been producing a little more smoke compared to the past couple of weeks. some of that will continue drifting down. the majority is going to remain concentrated near the sites of those fires. the worst dark air quality is going to get is the moderate category. that is where we were in the east bay today. i think it is more likely it focuses on the north bay as we head for the next

several days as the winds are going to be shifting about a mile up in the atmosphere, pushing that smoke into the north bay valleys. it is not going to be enough to cause significant breathing issues but you may notice it hanging out as you look into the difference. temperatures right now, down to 59 degrees already in santa rosa. opposite the fog, has already swallowed up downtown, it is spreading far across the bay. that is going to be the case as we head through the rest of tonight. really a significant inland push to the fog and low cloud cover. inland is not going to last that long, it will be gone by eight or 9:00 or so. backing up to the coast about midday but along the coast i don't think you're going to see much more than maybe an hour or so of sunshine. even that, be thankful for that on friday and saturday because you won't even see it on sunday. temperatures tonight, dropping down a little further, upper 50s and low 60s. high temperatures , very close to normal friday afternoon. 60s along the coast, 60s and 70s around the bay. upper 70s for the north bay valleys. mid to upper 80s , for the hot spots, but even the hotspots will be short of 90 degrees. the a's

start their last homestand of the season, it is a 10 game stand, it will last a well . the padres in town, temperature at game time, in the mid 60s. cooling off as the fog spreads across the bay. seven-day outlook, not much of a temperature drop as we head for the weekend into early next week but the temperature drop will be more noticeable farther inland, several consecutive days of highs only in the mid-to-upper 70s. that is not bad at all for the last days of summer. we finish summer wednesday and thursday with a return to near-normal temperatures. the fog, once again, is just going to be widespread along the coast. our two of sunshine tomorrow, saturday, and then june bloom in september, or august in september. >> august has extended for a while. >> 47 days. >> like i said, we don't have we have mild pretty much. vegas hotels are known for having cameras everywhere and tight security, allegedly. but one phone call could have been all it took to bring a huge

this is going to upset a lot of fans. the oakland a's could be officially out of here after november. the las vegas review journal reports that is when mlb owners are set to vote on the teams biggest relocation plans. they need 75% of the owners to agree to the move. but the league is also hinting that oakland could have a shot at an expansion team, might be a longshot. an ownership group would need to show up with a check for $2 billion. that is the expansion fee, and a plan for a new stadium. what say you, matt lively?

all lost so the giants had sole possession of that third wildcard spot. if only sara donchey, the season could end today and the giants could swoop in. >> yeah, doesn't work that way. as i'm told, i'm not really sure. all right, matt, thank you for your confirmation. okay, i am told you cannot move a muscle in a vegas casino without a camera watching you . movies have been made about how hard it is to beat the house. turns out all you may need to do is call the help desk. a group that reports on cyber attacks claims the hackers that paralyzed mgm resorts just hopped on and 10, picked an employee, and made calls fishing for login credentials . they went on to cripple the company's computer system, shutting down casino slot machines, atms, even stopping guest room keys from working. who are the hackers? still unclear but cbs news cyber security expert says they might be closer than you think.

>> we have built up this kind of mythology around ransomware operators being eastern europeans or russians hiding under the skirt of putin and the kremlin. there are also americans involved in these most recent attacks. even if you are able to get some of these folks, another one is going to pop up right behind them because they have been able to demonstrate that is a very lucrative profession that cybercrime pays and pays very well. just a few days before mgm, the company paid those hackers a cool $15 million to get their systems online . meanwhile, some guests have complained that they aren't getting any updates from mgm but the company did release a new statement today saying it continues to work diligently to resolve the cybersecurity issue and thank people for their patients. extreme patience in some cases. when we saw the chp escorting a horse home we had questions. what the writer did that led the officer holding the reins.
