how it could cost house speaker kevin mccarthy his job. trump trial. the former president says he'll be in court today to fight back against a case that's threatening some of his biggest real estate holdings. and california's new senator. we are learning who will take over the seat left vacant bay -- by the late dianne feinstein. good morning, and good to be with you. i'm anne-marie green. we begin with a battle brewing in our nation's capital, but unlike most d.c. shutdowns, this one involves members of the same party. not long after helping pass a short-term bill to fund our government, representative matt gaetz is threatening to try and oust kevin mccarthy this week from his role as house speaker. mccarthy is saying bring it on. cbs' jarred hill has the latest from new york. this is interesting. good morning. >> reporter: yeah, this is something right here. so florida congressman matt gaetz is saying that mccarthy breached agreements that he made with republicans in how he went

about averting the shutdown. speaking of which, the last-minute deal is really just a short-term fix. >> stop playing games. >> reporter: president biden had some tough words for house republicans after congress passed a spending bill late saturday narrowly avoiding a government shutdown. >> enough is enough is enough. this is not that complicated. the brinksmanship has to end. >> reporter: the short-term bill will keep the government funded until november 17th. it includes $16 billion for disaster relief. but aid for ukraine was dropped from the final legislation. >> we cannot under any circumstances allow american support for ukraine to be interrupted. >> reporter: with the shutdown crisis over for now, conservative florida congressman matt gaetz is leading the charge to oust house speaker kevin mccarthi. >> i do intend to file a motion to vacate this week. i think we need to move on with new leadership that can be trustworthy. >> reporter: gaetz blasted the

speaker for working across the aisle to pass the stopgap funding measure, but mccarthy says it's gaetz who's trying to work with house democrats in his efforts to remove mccarthy from leadership. >> i'll survive. you know, this is personal with matt. bring it on. let's get t over with h it and s start gogoverning. >> r reporter: house republican are split over the potential move. >> i think he is in trouble. >> it's an absolute waste of time. >> reporter: with republicans holding a narrow majority, gaetz would need some democrats to vote in order to remove mccarthy. so far at least one democrat has said that they would vote to oust mccarthy as leader if that vote actually does happen. meanwhile, even though ukraine aid was cut from this short-term spending bill, mccarthy said that he would be open to more funding, but he wants border security to be tackled first. >> all right. something tells me that will just add to this fight. jarred hill in new york. thank you. former president donald trump will once again be in a manhattan courtroom today. this time he's voluntarily attending the start of a civil trial that threatens some of his

biggest real estate holdings. skyler henry has more. >> reporter: former president donald trump hit the campaign trail in southeast iowa sunday and went on the attack. >> every time the radical left democrats, marxists, communists, and fascists indict me, i consider it a great badge of honor. >> reporter: last week judge arthur engoron ruled trump and the trump organization repeatedly overvalued properties and lied about his net worth, all while pursuing favorable bank loans. trump denies this. >> claiming you have money that you do not have does not amount to the art of the deal. it's the art of the steal. >> reporter: new york attorney general letitia james is seeking a quarter billion dollars and a ban on trump-running businesses in new york. >> it is absolutely possible that at the end of this trial it will be devastating for the trump businesses. >> reporter: cbs news legal contributor jessica levinson

says while the financial hit to the family business may be significant, the outcome may not impact trump's political ambitions. >> there's very little possibility that this could affect the president's re-election chances. >> reporter: the judge has indicated that this trial could take months. he also said that he would look to try to dissolve some of trump's companies which could force the former president to lose control of some of his assets like trump tower in new york. skyler henry, cbs news, wahington. breaking overnight, california governor gavin newsom is naming democratic strategist laphonza butler to fill the vacant seat of the late dianne feinstein. his office released this video announcing the move. butler is the president of the political organization emily's list and an adviser -- was an adviser to kamala harris' presidential campaign. feinstein died last week at the age of 90. she will lie in state at san francisco city hall on wednesday. a funeral service is planned for thursday.

late night tv is back. tonight talk shows return after five months following the end of the writers strike, and hollywood actors have more talks planned today to try and end their walkout. tom wait takes a look at where those talks are at and where other air strikes across the country stand right now. welcome to the "late show." i'm your host stephen colbert. >> reporter: late night is back. after a five-month hiatus the network shows will air new episodes on monday. they were one of the first casualties of the writers guild strike which ended after a tentative deal with studios. but many productions remain halted until the screen actors guild can strike their own deal. actors are hopeful as studio executives plan to attend when talks resume. las vegas hospitality workers are also hoping for a deal in the coming days with casinos on the strip. they voted to authorize a walkout if no agreement is reached. >> we're going bring the best damn contract --

>> that's right. >> reporter: as more autoworkers joined the picket line this week, the biggest health care strike in u.s. history may start wednesday. >> workers feel powerful, and they do have a lot of power now. >> reporter: almost 400,000 u.s. workers have gone on strike in the past year. usc economics professor larry harris says the boost from covid stimulus funding and increased retirements are keeping the labor market tight. >> the unemployment rate is low, and so workers are feeling confident that they can strike for higher wages. >> reporter: in a big blow to striking workers here in california, governor gavin newsom vetoed legislation that would have provided unemployment benefits to those on strike. but governor newsom said the state cannot afford it. tom wait, cbs news, los angeles. we are learning more about a deadly tanker truck crash in illinois. officials say friday's accident may have started when another vehicle tried to pass the truck. the tanker ran off the road, jackknifed, hit a parked utility trailer, and overturned.

about 4,000 gallons of toxic ammonia leaked out killing five people. several others were hospitalized. hundreds of people had to be evacuated. and take a look at this newly released security video showing an suv crashing into a new jersey police station. authorities say a man deliberately drove the vehicle into the station last month shortly after he drove into the garage door of a nearby home. police say one officer narrowly escaped being hit by officers arrested the driver. there's no word on the motive, though. a rescue operation is under way in northern mexico after a roof of a church collapsed during sunday mass. police say about 100 people were in the church at the time. at least nine people were killed. about 50 were hospitalized, including a baby and several children. rescuers searched the debris and brought in dogs to help find possible survivors. turkey says its warplanes struck about 20 suspected kurdish rebel targets in northern iraq.

fall at the steep cliff, but next thing you know the entire mountainside collapses. one driver threw his car in reverse, and thankfully no one was hurt. well, tough new gun laws went into effect in connecticut, and a girl vanished in a state park. those are some of the headlines on the "morning newsstand." cbs new york reports on the search for a missing 9-year-old girl last seen camping with her family in northern new york. charlotte sena was riding her bike around a loop in a state park saturday with other kids when she decided to ride one more loop by herself. authorities say her parents began looking for their daughter and called 911 when she did not return. police say it's possible she was abducted and issued an amber alert. her bike was found on the path where she was riding. the "associated press" says connecticut enacted its most sweeping gun-control law since the sandy hook elementary school shooting. the legislation signed earlier this year by democratic governor ned lamont took effect yesterday.

here's a look at the forecast in some cities around the country. ♪ after more than three years, millions of americans are once again opening up their wallets to pay student loans. matt pieper has today's cbs "money watch" report. >> reporter: stocks finished mixed on friday reversing some earlier gains to close out a gloomy month of trading. the dow lost 158. nasdaq gained 18. s&p losing 11 points. borrowers are back to digging into their pockets. millions of americans with student loans need to now start resuming payments. a pause began in march, 2020, as part of a series of pandemic-related economic relief measures. and while it was extended several times, it is now over, and it comes after the supreme court struck down president biden's plan to cancel up to $20,000 in debt for many borrowers.
