the office of speaker of the house of the united states house of representatives is hereby declared vacant. >> historic house vote. for the first time in u.s. history, a house speaker is removed from office. what's next for the house and kevin mccarthy. and gag order. a judge issues a stern warning to former president trump in his new york civil trial. what prompted the judge to issue the order. good morning, and good to be with you. i'm anne-marie green. we begin with the breaking news of another mass shooting at a school in america. this time the shooting happened last night outside a residential building at morgan state university in baltimore. they say five people including four students were shot and wounded. naomi ruchim is joining us from new york with what we know right now. what's going on? >> reporter: anne-marie, yet again students are shaken by gun violence on their college campus.

somewhere that is supposed to be safe. the shelter-in-place order has been lifted, but whoever is responsible is still at large. >> two calls for shooting now -- >> reporter: calls of an active shooter at morgan state university in baltimore, maryland, came in just before 9:30 last night. >> the entire city of baltimore's heart aches for the morgan community. >> reporter: authorities say five people, four of them students ages 18 to 22 years old, were shot, though their injuries are believed to be non-life-threatening. >> the bullets hit the glass behind my head. >> we tried to get out of the way. everybody tried to get out of the way. lay down, run. >> reporter: the university's president said shots erupted just minutes after students and families had left a coronation ceremony. the historically black university is set to celebrate its annual homecoming in just three days. >> i just saw everybody running and heard the shots going off. >> reporter: police were seen searching rooms at a residence

hall near where the shooting took place. so far they say no suspects have been arrested. >> for those who decided to come on this jewel of a campus and inflict this pain and trauma on their community, we're going to find you. we won't stop. >> reporter: a shelter-in-place order on campus was lifted just after midnight. meanwhile, concerned parents were asked to meet with police at a nearby safeway parking lot. classes have been canceled for today. local atf and fbi officials were also on the scene to help police in the investigation. the university's president says he will hold an emergency meeting later today to assess any possible changes to this week's planned homecoming festivities. anne-marie? >> it's sad to hear. naomi ruchim, thank you so much. for the very first time in american history, a speaker of the u.s. house has been removed from office. kevin mccarthy was ousted by a vote of 216-210 following a push

from some members of his own party. skyler henry has a look at how this historic vote went down. the office of speaker of the house of the united states house of representatives is hereby declared vacant. >> reporter: in a dramatic showdown, the house ousted kevin mccarthy from his job as speaker, making him the first speaker ever removed by a house vote. mccarthy spoke tuesday evening announcing he will not seek another run at the position. >> i will not run for speaker again. i'll have the confidence to pick somebody else. >> chaos is speaker mccarthy. >> reporter: mccarthy's key gop rival, matt gaetz of florida, sparked the historic move by forcing the vote on the motion to vacate. >> the reason kevin mccarthy went down today is because nobody trusts kevin mccarthy. >> you all know matt gaetz. you know it was personal. >> reporter: the now-former speaker angered right flank members of the party by working with democrats on a funding bill to avoid a government shutdown.

before the vote, mccarthy said he was prepared for the outcome. >> keeping government open and paying our troops was the right decision. i stand by that decision. at the end of the day if i have to lose my job over it, so be it. >> reporter: moments after the vote to remove mccarthy, his close ally, patrick mchenry of north carolina, was named speaker pro tempore. over the weekend the country narrowly avoided a govovernment shututdown, but t that fix w wa tempororary. the clock is ticking. that short deal runs out in 43 days. skyler henry, cbs news, capitol hill. the house has canceled all floor votes for the rest of the week, and that means north carolina representative patrick mchenry will be the temporary leader at least for a few days. mchenry is a nine-term republican who leads the house financial services committee. if you're wondering why he's the man in charge for the time being, back in january kevin mccarthy provided the clerk with a list of names who would serve if his seat became vacant.

mchenry was atop that list. for more on the historic vote and where the u.s. house goes from here, make sure to watch "cbs mornings." john dickerson will break down everything you need to know. day three of donald trump's civil fraud trial gets under way in a few hours, and the former president says that he intends to be there again in person. things got testy inside the courtroom yesterday after trump put up a social media post attacking the judge's principal law clerk. the judge imposed a gag order along with a stern warning saying he would not tolerate personal attacks on his stuff -- staff, and ordered trump to delete the post. hunter biden pleaded not guilty to federal gun charges. president biden's son is accused of lying about his drug use on a form to purchase a gun in 2018. the plea comes months after a deal to resolve a long-running investigation fell apart. this puts the case on track toward a possible trial next year while his father runs for re-election.

meantime here in manhattan, jury selection resumes in the trial of disgraced cryptocurrency mogul sam bankman-fried. he's accused of stealing billions from ftx customers for hs own personal gain. michael george has a look at the first day of the trial. >> reporter: the attorney for sam bankman-fried arrived at the federal courthouse in new york tuesday as the judge began the day questioning potential jurors. the 31-year-old sat t at the to of thehe cryptocurrerency indus when there was a frenzy for digital currencies during the pandemic. prosecutors say he embezzled billions from ftx customers for personal use, risky investments, and campaign contributions. >> right now this looks like the biggest fraud in history after bernie madoff. >> reporter: the former billionaire is accused of moving massive sums of money from ftx to alameda research to prop each other up. when ftx investors tried to cash out they couldn't.

bankman-fried was asked about the ftx collapse at a conference last november. >> were you truthful with us today? >> i -- i was as truthful as i -- as, you know, i'm knowledgeable to be. there's -- there are some things i wish i knew more about. >> reporter: bankman-fried has admitted making poor decisions. his lawyers are expected to argue he did not deliberately steal anyone's money. tuesday the judge told bankman-fried it would ultimately be up to him whether he testifies in his own defense. the trial is expected to last up to six weeks. michael george, cbs news. california's newest senator is officially on the job. former union leader laphonza butler was sworn in yesterday by vice president kamala harris. she's just the third black woman to ever serve in the u.s. senate. butler was appointed by the governor following dianne feinstein's death last week. it's not clear if butler will run for the seat in next year's race. meanwhile, the body of senator feinstein will lie in

all tour" starting next month. the concerts kick off in california and end at new york's madison square garden. a texas representative is describing the terrifying moments he was carjacked at gunpoint. and thousands of health care workers are expected to walk off the job today in the latest strike to hit the country. those are some of the headlines on the "morning newsstand." "the new york times" reports kaiser permanente workers are poised to strike this morning. more than 75,000 workers are threatening to hit the picket line for three days in some places. they're demanding a pay increase and more staffing. union officials say that it could be the largest strike by health care workers in recent u.s. history. kaiser provides care for 13 million people in eight states. our cbs new york station reports a suspect has officially been charged with kidnapping 9-year-old charlotte sena. craig ross jr. is charged in the disappearance of 9-year-old sena who vanished while riding her bike.

>> reporter: tonight this shocking image is raising new questions about the safety of self-driving robo taxis. you can see a woman pinned under a cruise av in san francisco leaving her hospitalized in critical condition after firefighters were able to free her. >> the patient was transported within ten minutes of the arrival of of the first rescuers. >> reporter: video from the cruise vehicle reviewed by cbs news shows the woman crossing against the light and getting hit by another vehicle. she is then launched into the path of the self-driving car. cruise says it braked aggressively to minimize the impact. san francisco police are investigating. >> the real question in this investigation will be could a human driver have detected the person in the road more quickly than the autonomous system could have. >> reporter: cruise says its cars are involved in 65% fewer collisions than ride shares driven by people, but in august cut its bay area fleet by 50% after two accidents on the same day.
