from cbs news bay area this is the afternoon edition. putting the brakes on driverless taxis, the dmv's decision impacting cruise cars in san francisco. new details on the pilot accused of trying to shut off the plane midflight. court documents revealing the substance he took before hopping on the jet . israel bands fuel from entering gaza as hospitals run out of power. you will no longer see cruise cars without a driver on the streets of san francisco anytime soon. the dmv suspended some of the companies permits.

and maccabee joins us from the newsroom with what all this means in the fight over driverless taxis . >> the company is still allowed to test the thomas vehicles but only if there is a safety driver inside. the suspension suspends them from testing without a driver. they determined that the company's cars are not safe or public operation and that the company misrepresented safety information. there is no timetable on how long the suspension will last but the dmv gave cruise steps to apply for reinstatement. and in a statement they say they are looking into a crush from earlier this month involving one of its robotaxi's. a different car with a human driver hit a pedestrian who then got trapped under the cruise car. the human driver took off and is still at large and cruise said it's vehicle followed all safety protocols. they also claim that simulations show that if the

other car had been a cruise it would have avoided hitting the pedestrian in the first place. they are currently doing analysis to identify potential enhancements to the av's response. before that suspension was announced the teamsters and other labor unions were already rallying outside of the cruise san francisco headquarters . they were rallying over the potential for driverless semi trucks on highways or even cases where cruise cars have stalled out, blocking firefighters from getting to emergencies. >> they work fine if there is no engine. if there is a crash or a construction site, anything that impedes the roads, they don't know what to do. >> it is important to note that the suspension does not affect other autonomous driverless companies.

is bay pilot who tried to turn off the planes engines midair admitted to taking psychedelic mushrooms. that is according to court documents obtained by kpix. joseph emerson appeared in court about half an hour ago in portland facing 83 counts of attempted murder. he is accused of trying to shut off the engines on an alaskan airlines flight to sfo on sunday. he was off duty and riding in the jumpseat . the two pilots testified in affidavits that emerson said "i am not okay." that's when the pilots say he pulled the red fire handles and one of the pilots wrestled with emerson, and asked him to leave the cockpit. and passenger say they were in the dark about the danger they were in. >> i fell asleep with headphones in. i was right by the cockpit. but nothing woke me up. nothing was loud enough or rambunctious enough to wake me up. according to aubrey

they just kind of walked him down the aisle. the did seem calm and with it . >> after they left the cockpit emerson then went for the emergency exit. she was able to stop him by placing her hand on his. he was eventually restrained at the back of the plane. >> after we landed about five police officers came on and escorted the gentleman from the back of the plane. you know, the whole situation the entire time was very calm. >> court documents say that emerson told investigators that he was depressed and had taken psychedelic mushrooms about 48 hours before the flight . the faa released a statement saying that pilots can lose their certification for using psychiatric drugs and he has been removed from service. they are talking with the union about his status. he was next scheduled to fly this thursday. and justin on capitol hill,

tom emmer has dropped out of the republican race for house speaker just hours after his party elected him as the latest nominee. he outlasted six other candidates and after the wind former president trump that a vote for tom emmer would be a tragic mistake . he is now the third speaker to drop out in less than three weeks since members of the gop ousted kevin mccarthy from the position. republicans will have to now find another nominee. turning to the middle east israel's military says it will not allow any more fuel into gaza despite the growing humanitarian crisis . all of the hospitals in gaza say they are running out of fuel and that means more injured and sick people will go without treatment. israel says hamas has been taking that fuel for military purposes. meantime israel has yet to launch its

promised ground invasion into gaza. leaders have reassured both the israeli public and its own soldiers that it is coming. in the words of the defense minister "it will be lethal." today the idf said it had hit her than 400 hamas targets overnight. in central israel warning sirens are a regular occurrence forcing people to take shelter today video from tel aviv and other cities show the countries iron dome intercepting a number of possible rocket strikes. and during a u.n. council meeting, antony blinken called for the universal combination of hostage terrorism and the release of hostages. >> i am for everyone, use your voice, use your influence and leverage to secure your unconditional needs. >> they said that with a former

a new study shows that san jose is bouncing back from the pandemic. it is coming from the university of toronto and found the number of people visiting downtown is at 96% of the 2019 levels. in comparison oakland had a 74% recovery and san francisco was at 67% . a lot of people bring up the downtown vacancies along with homelessness and cry when talking about san francisco. but others say the doom loop narrative is not the real story. wilson walker looks at that debate. >> the bottom of it has a slightly lower temperature to set the crust and set the

living on the streets in san francisco. during our conversation he offered this assessment of the city. >> san francisco is not what it used to be i any means. i thought it used to be worse. i first got here i was intimidated, but it was a nice city. there were nice people here. there still is but it's not like, post-pandemic the city is ms . >> if you've heard this discussion, and i'm guessing you have, you know it can sound like two different realities as people offer up diverging takes and what is actually happening in san francisco. my sense is that what someone makes of the state of the city has a lot to do with who they are, what they are and what direction they are looking. are you comparing now to 2019 or comparing now to 1979. there is a lot of room for crosstalk in this debate can get very heated as it gets pulled into the gravity of san francisco politics. >> what you're getting at is something the most important

thing in american politics right now, not just san francisco. we create groups . >> jason mcdaniels, a political science professor at san francisco state says the doom loop debate and the cities angry politics are the inevitable byproducts of a city that is facing a long list of very complicated problems. >> is at homelessness, as it drug use, drug dealers, the police, the government, incompetence at the bureaucratic level, is it tech people coming in to change things? none of those are easy answers or solutions to very complicated problems. >> it has been hard times and even those who reject the doom loop idea acknowledge that there are big challenges. >> i think downtown will get worse before it gets better. >> we have our problems, of course. every major city has

loud as fans gather and thrive city. he spoke to fans who say they are ready for another title run. >> i think they are doing really well. being chris paul with the team, the dynamics that have been going on, i think that will work well all the way. we will go all the way. first alert weather, mild today but a cooldown is coming. darren peck is in our virtual view studio. a lot of people will be hanging out at the thrive city. >> it will be great weather for it. really or sunshine than anything else. marine layer, beautiful time-lapse shows you that we still have this very summer influenced pattern in terms of the marine layer. it is kind of nice when you can still see that. we are fast getting to the time of the year where we will say goodbye to views like that. as we take a look at just how widespread

that is, it is not. the marine layer is just a narrow little ribbon right along the coast and maybe streaming into the golden gate a little bit and that is about it. everybody else looking at clear skies. pretty much right at the daytime highs for this time of the year. upper 70s, inland. right we should be. low 60s in the city, 10 degrees below average. everybody else, a pretty typical day going. let's take a look at two follow systems that will mix things up. we get a wider view and there is the next storm. pretty good-looking storm coming into the pacific northwest. watch that thing try to get here and not quite make it. there will be a line of rain that will try to get down to the bay. looks pretty promising , and then it falls apart. we will look at this in a couple of different ways. here is where it will rain, this is over the next 48

hours. not really here heard their precipitation in the sierra is coming in as snow. let's come in for a closer look at that . if the travel plans that take you into the sierra, wednesday night into thursday morning, that is just enough snow on donner pass and echo summit that it will impact travel to a degree. it is really high, and it is not a lot of snow. but it is the first one and that catches a lot of people off guard. that will be wednesday night through thursday morning, early. let's talk about the chance for rain here at home. a little shower that skirts the north bay and that is it. daytime highs tomorrow are very similar to today, maybe six or 7 degrees cooler as the week little cold front comes through. we will be in the low 70s inland instead of mid to upper 70s. and you can see the influence that system will have. watch that pool of

cooler air spilled on our way . even if we are not getting the ring out of it we will get a little cooler and we will technically get a little offshore wind event from this. this gets us ahead into thursday afternoon. that is the system that skirts by, watch what it does. those are offshore winds. not strong enough to give us any fire weather concerns. i look at the wind speeds in the mountains. the rest of us have a 10 mile an hour breeze. that is fall. this is what things do here in the fall. luckily this year we haven't had to be too concerned about fire. the seven-day forecast, starting with our seven day for the inland micro climates. notice the temperature trend. seeing some of our warmest numbers. but by the time we get into tomorrow we really dipped down. then we will keep cooling down from there so we look at
