but at the sheriff's department as a whole. on august 26th, 2015, 31-year-old michael tyree was waiting for a bed to open up at a mental health facility but held at the jail in san jose on outstanding warrants and misdemeanor offenses. according to prosecutors three guards, armed with batons, entered his cell and at least one of them beat him to death. the da's office says that tyree lost half of his blood volume, liver was lacerated and his spleen was almost torn in half. the three guards were charged with murder. then in 2017 the three of them were convicted and sentenced to 15 years to life in prison. five years later, a new state law passed saying for a murder conviction to stand the accused has to be considered the actual killer of a person because that could not be done the convictions were reversed. that takes us to

today in court where we show you how this case finally concluded. >> reporter: seven years after their initial conviction, two years after that conviction was overturned and just as the da's office was planning to retry their case. the three former santa clara county jail guards charged with the 2015 killing of inmate michael tyree admitted to the crime and plead guilty. >> today was a victory for the vulnerable and the voiceless. >> reporter: 36-year-old matthew ferris, 37-year-old lubrin and 40-year-old rodriguez all pled guilty to voluntary manslaughter on tuesday. for the first time, saying out loud in court they beat him to death. >> did you personally assault or aid and abet the assault of michael tyree on august 26th 2015 causing his death? >> yes.

>> santa clara county district attorney said it was important for his office and tyree's family to get that verbal admission >> because if they are accepting responsibility for what they did then we wanted them to accept responsibility which, to us, does not mean saying no contest or just pleading guilty and then coming out here and saying oh, well i pled guilty but i did not really do t. i just wanted to take this particular deal. >> as part of their plea deal all three men accepted the maximum prison sentence for the charge. >> following your sentencing in this case it will be 11 years in state prison followed by three years of parole super vision, do you understand that? >> yes, your honor. that includes time served leaving them with less than a year left to go. ever since their initial conviction was overturned the men have been out from beinned bars and on

house arrest. da rosen says the likelihood of them going back to prison to serve out the remainder of their time is low >> i am sure the judge will allow them to serve the rest of their sentence on electric monitoring. >> reporter: still, the da believes some justice has been served in getting them to admit it. none of it will bring tyree back to his family. >> i have enormous sadness about that. and, just enormous empathy for his family. >> reporter: all three men are expected back in court in october for formal sentencing. >> so in 2017 santa clara county agreed to pay out $3.6 million to settle an excessive force claim filed by his family. after his death, former sheriff smith convened a blue

ribbon commission of top down review but they turned on her and seized the jail from sheriff smith. we were told this in 2016. >> right now the sheriff has been running the jails and we have found as a commission that there were problems festering in that jail for years and years and years and nothing was done. nothing was done until the death of michael tyree. >> the panel made 100 recommendations to improve conditions for inmates. as we reported in 2016, the death exposed gaps in the main jail's old surveillance system. something that prompted sheriff smith to take matters into her own hands. >> those minutes, those last minutes of his life were absolutely horrible. >> reporter: the prosecutor showed video taken on the night of the killing showing the three deputies entering the area of his cell. the video

does not slow what happened in the cell itself. new cameras caught this huge inmate fight t. happened one day after the sheriff caused a stir for taking matters into her own hands. she went to costco and bought the cameras, charging them to her personal credit card after she learned it would take two more years and $20 million before any more cameras made it inside of the jail. >> the sheriff department ended up installing 300 cams in that jail that year. sheriff smith could not escape the growing fallout from michael tyree's death and the problems exposed in the entire jail system that led to major changes. in the end she resigned from office in 2022. now to a crime that you may have been a victim of. broken windows, valuables gone. for years san francisco has been

trying to crack down on car burglaries and they have been setting up bait cars. now, hundreds of license plate readers in the city. police data shows car break ins are down in the city one state lawmaker has a different approach to hold thieves accountable. not just in san francisco but all across the state. wilson walker explained. >> if you have proof that someone broke into a car, that should be enough to convict the person and to have accountability requiring proof that the doors were locked is absurd. >> reporter: absurd in the minds of many. it is currently the law. for prosecutors to convict someone of auto burglary they must first prove the car was locked. something that can pose challenges especially when the victims are not residents of the city. like this poor family from argentina we met last year. >> and they took our passports,

my computer. >> those tourists will not fly back into san francisco from the east coast or for asia or europe to testify that they did, in fact, lock their car. >> reporter: that was state senator scott wiener back in 2018. a couple years after car break ins started to skyrocket in san francisco. that push to close the loophole was joined by the city's then district attorney. >> common sense would tell you if you have broken glass obviously someone broke into the vehicle. >> the 2018 effort and another in 2019 were turned back in sacramento. the words of san francisco's then public defender. >> well, i mean, we are moving away from increasing criminal penalties >> when it comes to public safety and criminal justice there are swings. >> reporter: wiener says five years later things changed. his bill closes the loophole by

creating a new law unlawful entry of a vehicle. a felony conviction would mean 16 months to three years. >> so you can have strong accountability without destroying people's lives and giving people an opportunity to be rehabilitated and integrate back into society. >> you will remember san francisco police launched a significant crack down on this last august. car break ins are down 50% since 2022. a trip by the square will likely reveal there is still work to be done. >> and this bill once it is signed into law which i believe that it will be. will give them an additional tool to hold people accountable for breaking into cars. >> the bill also allows people to be prosecuted if they stole more than $950 stolen from the

san francisco. carrying 148 passengers and 14 crewmembers. the airline says it landed safely. united did not tell us what this issue was but here is what a passenger had to say after getting off of the plane. >> that is all they said, overheating, they had to shut it off. divert us to sacramento. i was wondering because they did not say we were going to get a new plane right away. what was funny to me, i left sacramento to san francisco and came back to sacramento >> she better get miles for that. >> united said passengers will be rebooked to continue their trip to rome. we checked the plane's route on flight aware and it shows that after a couple hours on the ground in sacramento it turned right back around to san francisco, arriving in the last 30 minutes. united did not say if passengers got back on the plane. all right. let's talk about more things in the sky. that is our weather. >> land that plane. >> the lack of things in the

sky. it will be a tranquil pattern. with not a lot that is going to change i want to talk about why it will be a tranquil pattern. i will bring in the map of the entire united states and show you the perspective. reason things are calm and close to normal is the heat dome. big area of high pressure. it was just dominating the weather over the western u.s. occasionally in the bay area for some of the month of july. nudged farther to the east. leading to some extreme heat along the gulf coast. our neck of the woods it is a different feature. the storm system snuck in. the heat dome lost the influence over our weather. that moved into the north of us into the pacific northwest. it reduces the weight of the atmosphere on top of this to get deeper. it disrupted the marine layer. not as much fog last night early morning. it is close enough to kick in stronger onshore winds through the depth of the atmosphere. those stronger winds helping to keep air

duality good and push the marine area inland. we feel the impacts here on the local level. let's talk about what is happening right now. a live look towards downtown. you can see the impact of the lack of fog for the moment. the temperatures have been backing down into the upper 50s in san francisco, 71 degrees in santa rosa and in concord right now. the lack of fog for the moment is expected to change as we head through the rest of tonight. the fog making a push across the bay into the inland valleys, now, forecast model data. never perfect. we anticipate the fog are redeveloping or more of a factor along the coast heading through the rest of the week. the rest of it, back and forth fog. not lasting much. the fog will go to the map of the pay area. temperatures tomorrow, warming up to about what is normal for this time of the year. north bay, mostly 80s, up

to around 90 degrees. that is above average. temperatures on the high end are 91 degrees in fairfield. not bad for this time of the year. a lot of times mid-august, talking talking about triple digit temperatures. lower 80s in the santa clara valley. around the bay area, temperatures in the 70s close to 80 degrees in redwood city. the long-term we are talking about this near normal temperature pattern sticking around for awhile. the 6-10 day out look keeps the warm air pushed farther and farther to the east. it is temporary. the cool weather will be sticking around, there are signs farther down-the-line that the cool weather will get nudged away and the heat will return as we hit late august heading into september. that is a long way down-the-line. let's just enjoy this pleasant weather pattern while it lasts the hottest spots, inland, getting to around 90 degrees. pretty much everybody within a degree or two of average not just this week, not just through the weekend but most of
