adults. pearsall was shot in the chest, and the da is announcing the 17-year-old suspect is facing attempted murder charges. holding back on escalating the case to adult court, for now. tonight we spoke to an attorney for his take on the decision. a tempted murder, assault, robbery. >> reporter: san francisco district attorney announcing these charges on tuesday against an unnamed 17-year-old from tracy in the weekend shooting of ricky pearsall. the wide receiver shot in the chest during an attempted robbery. ivan gold says these charges mean severe penalties even for a minor >> these charges can carry above 10 years. there was a gun involved, this minor could be charged as an adult. >> little information is known about the teen, largely due to legal protections for minors, gold says a high profile case paired with national pressure to combat crime in the city may

have led to a more severe charge. >> the high profile case. this case will be watched throughout the country. they do not want to appear soft on crime, the san francisco district attorney's office. this case will be an example. ordinarily, a robbery, assault t is assault with a deadly weapon not an attempted murder charge. >> reporter: for now, the case will play out in the juvenile court system and jenkins says her office does not have the power to charge the suspect as an adult without filing a motion and receiving approval from a judge. which could still happen. >> attempted murder is one of those charges. so, again, it was for consideration. we have to look at the facts, we have to look at the minor's history and a number of things to make a determination of if we think it is appropriate, i don't have all of the information yet to be able to make that determination. >> as serious as the charges

are, san francisco resident greg owens says such a young person should not be tried as an adult. >> to condemn him for the rest of his life. it is t is detrimental. he can use what he has been through to help others not go through it. >> reporter: at the end of the day it is a lose/lose situation, he is keeping pearsall and the teen in his thoughts >> i feel sorry for the player. definitely prayers for his family. and also for the kid as well. 17 years old, doing something like that, that is a decision he has to live with for the rest of his life >> vern glenn is here now with more on what the team's general manager had to say for the first time he spoke out. >> reporter: i have known john lynch for a long time, he hit all of the right notes talking about his first round draft pick including this sobering message. >> we all need to be better to each other. hopefully this,

jules. pearsall walks out with the captains and the first responder who attended to him. monday night football, national tv, everybody watching. september 9th. also pearsall's 24th birthday. >> reason to celebrate. so many ways. all right. we will see. we will see if the prediction comes through. >> all right, vern, thank you very much. on to the heatwave. boy, you could feel the heat today. plane inland areas hit with triple digits across the bay. it did not stop golfers from hitting the greens and practicing the swings in san jose today. across the bay in concord. some people have a different idea how to beat the heat. this pool was packed with people for good reason. we have more now on what to expect around the bay area and how long the heat is going to last >> it is a 3-day heatwave. we made it through day one, hopefully through days two and three, lasting through thursday. that will be something we are keeping our

eyes on. today was a hot one across the bay area. only getting hotter and hotter from here. this afternoon, we saw high temperatures inland getting into the upper 90s, concord and fairfield, both reaching the triple digits, san francisco, many of us were feeling the heat. especially with a lack of wind. yes, it got very warm out there. 88 degrees. for those of us without air-conditioning that is very hot. that is the reason that we do actually have a heat advisory that will remain in effect throughout the next three days. for san francisco, warming in effect through tomorrow at 7:00 p.m. tomorrow afternoon's high temperatures will be very warm, even though it might be a degree or two cooler than what we felt today. 80 degrees, that is still hot. for those of us without air-conditioning, heat safety will be top priority. for inland areas, though, heat advisory will persist through thursday at 11:00 p.m. these

are wednesday's high temperatures, 102 in antioch. 102 in livermore. middle to upper 90s. down near morgan hill, again, heat advisory will persist throughout the next three days. or, two days i should say. we made it through the first day. hopefully everybody does practice heat safety. light, loose-fitting clothing will be top of mind as we step out over the next couple of days. those will be the things that we all have to keep in mind, jules, as we step out, tuesday, wednesday, thursday, gradually cooling down by friday and into the weekend. great news for those of us that have weekend plans, anybody that has to work outside for the next couple of days, heat safety is top priority. >> all right, thank you. now, to a case cbs has been following for years. a man known as the pillowcase rapist could move into a california neighborhood after the santa clara county court approved his release from a psychiatric

hospital. christopher hubbard admitted to sexually assaulting nearly 40 women in the 1970s and '80s. using pillow cases to muffle his victim's voices. he was first sentenced for assault in 1972. then, released in 1979 and moved to the bay area. where he assaulted at least a dozen women. he was sent back to prison but released again in 1990. since then, he has been in and out of prisons and hospitals. but in 2014 a bay area judge allowed him to be released, yet again, and move to a neighborhood in southern california's antelope valley. we dug up a cbs report on how the whole thing triggered major uproar from neighbors who said they feared for their safety. >> no one will be able to sleep, no one will be able to live comfortably any more because of there. >> he will attack again. he will not leave witnesses behind next time. >> when he eventually moved

into the rural neighborhood neighbors would protest outside of his house and posted signs urging him to stay away. cbs reported in 2017, he was ordered back into a psychiatric hospital for violating the terms of his release. >> a northern california judge on friday revoked the 65-year-old's conditional release after his treatment team said he failed five polygraph tests, withheld important information and refused to participate with treatment in quote a meaningful manner. >> the only thing that is unusual it usually happens to probationer and parolees, not released sexually violent predators because they simply don't get released. >> last year the santa clara supreme court found him suitable for conditional release again. now, a hearing is set for october if he can move out of the hospital and back to antelope valley. a rash of copper thefts is upping the pressure on local leaders to take action. there is a push to crack down on

people stealing the copper wires and the scrap medal dealers buying them. some businesses say the problem has gotten so bad it is making them lose their internet and phone service and hurting their bottom line. >> somewhere. >> owning this store for 30 years, long enough to have a manual credit card machine. something he is actually needed, once again, because of all of the internet outages >> you can not take credit cards, can not take phone calls. i am old fashioned. i have the old machine still. i can still take credit cards and then when the internet comes back up, i can run them through. it does make the day longer. a rash of copper thefts is causing other major issues. back in june, copper thieves cut the lines for the 911 call center. all 911 calls were

routed to the sheriff's department for a week. on august 20th, two weeks ago, a man was found dead in an underground vault, suspected of being electrocuted while trying to steal copper wires >> we are serious about tracking down and prosecuting those individuals who are responsible for copper theft. >> contra costa county supervisor held a press conference with local leaders to address the issue. saying it will take a regional approach with the police departments and the da's office to get the problem under control. >> you are hurting and effecting your neighbors. people that live in the community. when we don't have power and internet we can not function as a business very well. >> something knowing all too well. he says about 65% of his customers pay with credit cards and many have just walked out of the store when he told them the internet was down and he could not run their card. >> very frustrating. especially when you pull in and see wires laying on the ground and the pole is chopped up. >> i wish they would stop and

. a driver killed and another injured after two cared plunged off of a cliff near san francisco's ocean beach. it happened just before 5:00 close to the cliff house. they went through a cement barrier at a parking overlook, ending up several yards down a rocky cliff. one car stopped just above the beach. we still don't know why both cars went over the cliff. sfpd and the park police are investigating. a legacy business in san francisco torched in a fire is now facing even more hard ships. great wall hardware has been in the city's park side district for more than four decades. we spoke to the owner who says he has evidence that the fire was flow accident. >> this is about the extent of the main fire. it was back here. and, you can see it is quite hot.

>> he is trying to rebuild his family's business after a fire. all of it burnt to a crisp. >> now, he is focused on the reason. >> there goes the guy. >> he is showing us this surveillance video where at 3:35 a.m. on august 25th, a man walks up to the store and looks at the display. >> i have all of my camping stuff, it was summertime. i have all of my camping displays, charcoal, lighter fluid, all of these combustible materials at the front window. he walks under the camera and he proceeds to light. >> 10 minutes after the man first walks up to great wall hardware. you can see the flames erupt. >> when i saw the footage it was even more painful because the guy just walked up to my store, lit my store, and walked away. less than two minute encounter. >> sffd says the fire is still under exprgz it could be for

weeks or months. sfpd did not respond to our questions. but, an investigator was at great wall hardware tuesday afternoon. albert says the police have been investigating several burglaries that happened after the fire. >> it took stuff from the hardware store, easily marketable on the black market, i would think. >> letterman, multitools, flashlights. power tools. >> this is it. >> it is a family-owned small business. just like us. we have been going through a lot. >> reporter: this couple own the beauty network, a small business in the nearby richmond district. they say unfortunately the burglaries don't come as a shock to them. >> on my block everybody, every shop has gotten broken into. >> for now, albert is hoping to get the word out about the plan he believes started the fire. destroying the business, his family has owned for the past 41 years. >> it was just to get a kick

out of it. man, go start a camp fire on the beach. other things that you can do. so, i am determined to get this guy off of the street f. he can do this to me, he has done it to other people. i don't want him to do it to someone else. >> reporter: sfpd has not responded to our request for comment on the burglaries >> when i drive home to the east bay tonight, will it be a nice warm night still? >> yeah, pretty warm night. the winds not doing all too much in terms of cooling us down. it is going to stay warm all night long. >> okay. >> unfortunately, the heat will only build from here. if you have anything to do tonight, yes, it is probably the best time to do it, you are not dealing with the excessive heat we have been seeing during the day time. had is the first of three days that the excessive heat is going to climb. right now, though, temperatures are cooling off. they are in the middle 70s in the inland locations now. middle 60s around the bay and middle to lower 50s, closer to the

coastal communities that are dealing with it. you see it in the distance. a little bit of the fog, the fog cooling us down overnight. so, the coastal communities dealing with fog, cooler conditions, you might want to open your windows overnight tonight. the heat will build inland. there will not be all that much recovery when it comes to the overnight heat for the inland locations. an area of high pressure, known as a heat dome, will begin to build to our south. another area of high pressure to our north. both of those in combination are working together to bring us excessive heat all of the way through thursday. you will notice on the west coast, an area of low pressure that will can cool us down by the end of the week and weekend. fire danger will persist. dry and hot conditions will stick around. tonight, though, it will be a mild one across the bay area. like i said, our overnight low temperatures will be in the middle to upper 60s inland, middle 50s along the coast. again, the window open weather. it will be in store. tomorrow afternoon, though, we are going

to be noticing the high temperatures, warming up inland. inland locations are going to be well above 100 degrees from fairfield to concord to antioch and livermore. while san francisco will be in the lower 80s. we might be a degree or two cooler than yesterday. the risk for heat-related illness will climb and climb from here. so, wednesday, that risk for heat-related illness is slightly higher across the bay area. as the areas you see in red, inland, those will be the highest risk for heat-related illness and excessive heat continues into thursday. the areas in purple have a higher chance for heat-related illness. thursday afternoon will be the peak of the heatwave. over the next seven-days we will continue to see the heat building. again, not necessarily everyone seeing the same type of heat but a three-day heatwave, it will subside on friday into the weekend of weather ahead of us. more seasonably across areas

near the bay. it depends how hot you are going to be getting and if you have air-conditioning, if this heatwave will impact you as much. upper 80s today, middle 80s tomorrow, middle to lower 70s as we step out through the weekend and next week. it will feel a lot more comfortable out there, vern, get ready for it. it will be a hot next couple of days ahead of us. we will all have to practice the heat safety and prepare for the heat. it will continue. i am not necessarily loving it. here in san francisco, the first time in my life i never had air-conditioning and it is weird and i don't like it >> and loving it. >> here we go. straight ahead in sports. what do you see what the a's did again. and the 49ers. just put the rest of the nfl on notice fe
