we are just 42 days away from the election. california is taking action to prevent fake news from having real consequences. today we're talking about deep fakes. the threat they pose, the integrity of our elections, and are we doing enough to stop them? we'll have that conversation with the bay area lawmaker in joseph minutes. but first a look at your news headlines. thieves apparently hit a pot shop in san francisco. the store gave us this surveillance video today. it shows five suspects in two cars using an suv to pull the gate and break the door. this is on junis street near 32nd avenue in the sunset district. unclear what they got away with. the manager told us this is the fourth break in there. we've reached out to police for more information. now to the peninsula where a building burned to the ground this afternoon. a look from our chopper. this is in redwood

city. you can see smoke just pouring out of the shelf from that structure along poplar avenue in el camino real in the redwood junction area. it's unclear how this fire started. luckily no reports of any injuries. in oakland, the police union is blasting mayor sheng thao, calling her push to clear homeless encampments nothing more than a political stunt. mayor thao issued an executive order yesterday, urging city departments to enforce encampment rules. that would clear camps blocking public spaces, schools, businesses, and areas near highways and bart tracks. the oakland police officer association says the mayor is just trying to save herself ahead of the recall election. the east bay won't be expanded after all. the contra costa water district has been pushing for decades for the added storage. but now it's pulling back, right rising costs. the risk of a water

shortage if there is a severe drought during construction. and putting away those cell phones at school. governor newsom just signed legislation to ban or limit the use of smart phones on campus. that'll go into effect in july of 2026. exemptions will be allowed for emergencies or health reasons. newsom says too much phone time harms mental health and learning. the transformation on treasure island could include bay fc. the women's pro soccer team plans to build a training facility there. the plan needs to be approved by the board of supervisors, but the team hopes to break ground next year. it'll continue to play their regular season games at paypal park in san jose. all right, switching gears to weather. it soot first alert weather day with a heat advisory. >> yes, gradually cooler today, but then a lot cooler by tomorrow, about 10 to nearly 20 degrees in some locations, cooler tomorrow. so get ready for it, but you are still

feeling the heat tonight, still feeling the heat because we are still dealing with plenty of sunshine. but you do notice a little bit of the marine layer, a little bit of the fog is beginning to arrive. and that is just a sign of changing times out on the way. a lot of cool down will be arriving by the time we step out tomorrow. tomorrow is not going to be nearly as hot as today is. however, it is definitely hot out there. something really cool that i want to show you all. and what our current satellite imagery is looking like. look at that across the west coast of the united states. that is an area of high pressure that you could literally see the void of clouds. those clouds are rotating around the high pressure that's done, but for us in california and for the bay area, lack of clouds has led to quite a lot of heat. we will continue to deal with that heat over the next couple of hours. but again luckily, a cool down is on the way. we will continue to see again more of those cooler temperatures because that storm system will be arriving. the same one you

saw swirling across the west coast of the united states. that cold front will be making their way over the bay area by wednesday afternoon. so like i said, big change is on the way. luckily it is not going to feel nearly this hot for very much longer. again, we have positive sign of change. it is very hot out there, feeling these colors across the bay area communities and these deep dark menacing reds. and a big cool down will arrive as soon as tomorrow. we will see those temperatures cooling down overnight tonight. the overnight lows will be a lot more comfortable than those early morning temperatures were today. we will be dipping back down for the 50s and 60s, where coastal communities will be very similar this morning in

the low to mid-50s. tomorrow afternoon though, this is where you'll see the changes by tomorrow afternoon, look at our high temperatures. compared to today in the upper 90s right now. we're only going to be in the mid to upper 90s like antioch, livermore. but fremont, redwood city, mid to upper 70s, such a nice change of pace. even down into the santa clara valley, san jose, 77 degrees tomorrow compared to the 90s that you're feeling today. and it is what we would expect this time of the year and what we expect for the fall season. a season of transitions with quite a lot of those over the next24, 48, 72 hours. today again, it is very hot. tomorrow, we will begin to see those changes on the way. 65 degrees with more cloud cover for our bay area communities. and we'll be heating back up. so it kind of depends on where you are located. around the

bay, you'll be seeing more of that heat today. look at tomorrow afternoon like we were talking about. maybe reaching 80 degrees in some locations. but enjoy that one day of cooler air while you can. more sunshine will arrive. and then by friday, you are right back into the mid-90s. and an escape for some of this heat. that will be your best potential to do so. sitting in the low 60s through friday. if you want to find the beach day to get out, friday is your day to do so and for everybody over the next seven days. back to you. >> thank you. now the potential threat that they will pose to our democracy is getting the attention of the biden administration. speaking at an a.i. event yesterday in new york. he highlighted efforts to ensure safe and secure uses of the technology. the front lines

are increasingly online. >> members are working to build the global information center and undermining the democratic elections. but critically we're shaping the framework and the rules for the responsible development and use of artificial intelligence. technology that more than any other will affethe future of freedoms, online, and offline. >> reporter: blinken hopes to set a framework for a.i. moving forward. and that comes just days after they testified on capitol hill. how they are trying to combat election interference. experts from the parent company, alphabet, meta's facebook, and microsoft were all there to talk about what they've seen on their platforms. >> this year alone, we've seen a variety of malicious activities including efforts to compromise e-mail accounts of

the political actors and both on and off our platforms. they are seeking to sow discord among americans. >> a new study found most americans are worried that the spread of misinformation will have an impact on the upcoming election. lauren toms spoke to industry experts about the threat this technology will present heading into november. and what is being done to counteract it. >> reporter: you're probably wondering how i ended up here or here. and the truth is, i didn't. these are deep fakes that are made by cruising my linkedin photo. trying to spread the word of the potential harm. >> when you see something that makes your enemy look bad, it can enrage you pretty seriously. >> reporter: it is a strategy we're seeing play out in the 2024 election cycle. >> there is something

particular about images and videos that will short circuit to the emotions of your brain. people have been writing texts on the internet for as long as the internet has existed. when you see an image or video, it will feel real. >> reporter: through deep fakes and how easy it is to persuade people. >> it is not just to prepare people for the things that are happening, but that they could make the decision, instead of something happening in office. >> reporter: saying the speed of a.i. development is moving too fast for regulation to catch up. >> i'm concerned about it because this level of a.i. can do magic and create certain

situations, pictures, you know, events. and it could be done right before the major event. at least it's going to create some kind of confusion, chaos, and just to make sure that this is the impact of the event. >> reporter: hoping to get ahead of the curb by showing people how real fake content is impacting us. >> when this content will be used to trick or misinform people. it is important to be skeptical when they're looking at the image that is just a way for them to operate in this world. it is sort of like you can't believe everything you read on the internet. it's the similar kind of thing. >> reporter: technology that tricks the mind. now back in february, they ruled that robocalls using a.i. generated voices are illegal. and opening the door to fines and lawsuits against violators. and now california is

a fake video of vice president kamala harris has been viewed 130 million times on social media. it will put words in her mouth that she never really said. today we're talking about the threat of these deep fake videos on our elections. we have more on how california and tech businesses are policing misinformation. >> together, we will dominate the ballot box. this is a nice start. >> reporter: some of the deep fakes are pretty easy to spot. >> i'm tom cruise running for the president of the united states. america, you complete me. >> reporter: tom cruise never ran for president in 2020 and didn't record this ad. ♪ [ music ] ♪ i know it's

shocking, but former governor swarzenegger did not appear in the wizard of oz. but other videos aren't as obvious. >> i had four years under the ultimate puppet. >> reporter: this video that looks like a campaign ad. >> reporter: joe taught me rule number one. >> reporter: nope, it's a deep fake, and that is where hive comes in. >> usually if you see the video that looks real, you would believe what it said. but now, that's not the case. >> reporter: and it uses advanced algorithms and a.i. to detect deep fake videos. >> they don't interpret content the way that a human does. it is really looking at a pixel level basis. and there is

that signature, that water mark there and what they've figured out. >> reporter: retweeting the video, resulting in a twitter spat with governor newsom. >> the federal government, i humbly submit has failed to regulate. in the absence of the regulatory framework, they will insert themselves and a birthplace of so many technology and innovation. >> reporter: on stage at dreamforce, the governor signed three bills into law. just remove them completely where they will limit them from sharing deep fakes within 120 days of the election. >> the ability for bad actors to kind of influence elections now with widespread misinformation campaigns, this is pretty unpriest kepted. you can pass a bill that will ban political deep fakes, and see

them in some way. >> reporter: the creator of the fake harris campaign video that you just saw is now suing the state of california. he says the new legislation infringes on his first amendment right to make political satire. joining me now is mark burnman. thank you so much for being with us. >> thanks for having me. >> your bill recently passed. it would restrict posting content that is maybe deceptive, that shows a fake himmage, saying you will do something that is totally false. how big of an impact do you think this will make on the distribution of deep fakes on the internet? >> i hope it will have a big impact, that we are going after it, putting more responsibility on the social media platforms themselves to regulate this

content. i had a bill a couple years ago that went after the creator. and that is whack-a-mole, where they could be far out of the united states. but i think the social media platforms, if they want to provide the form and the platform for political discourse, they have a speedometer to make sure the deceptive images, videos, candidates, elected officials, they don't undermine their faith and democracy. >> this will only delay the deep fakes, not ban them entirely. and what is standing in the way? is it the first amendment? >> they are definitely complicated first amendment issues. for state law, there is section 230 of the federal communications decency act to restrict what they could do to

regulate the social media companies. so yeah, it is a very complicated kind of constantly evolving legal landscape as technology will change. and as people's ability, what i would lake to say, it does not give you the right to put your words in my mouth. and that is what this technology could do very easily on your iphone to create a video of me saying something totally different than something i would ever say. and that is why the landscape will need to evolve. i think the legal landscape will need to evolve as well. >> and it is shocking to see what they will go after. but what about going after the a.i. companies themselves and forcing them to eliminate the technology that will facilitate the deep fakes? >> and it is an interesting idea. i've had colleagues who

have looked at regulating the a.i. companies themselves. that would likely have the first amendment challenges. so i think we could go after them if they are creating certain illegal content. i have a different bill around the abuse material, for example. but i think in that political landscape, that would be pretty challenging and likely to face first amendment problems. my hope is these a.i. companies will behave ethically themselves, you know, hopefully we, as a society, will put that pressure on them. some of them are. some of these a.i. companies are saying no, you can't use our technology to create a deep fake of kamala harris or of donald trump. and so you know, my hope is that they behave responsibly themselves, but they're obviously going to have instances where they don't. and that is where we will have to look at new bills and new laws. >> our recent research poll shows the majority of americans are concerned that a.i. will have a huge impact on the

presidential election. are you, yourself, concerned that these deep fakes are so prolific that they could sway elections both locally and nationally? >> absolutely. and we have actually seen political deep fakes used in other countries already. we've seen political deep fakes created and used in the united states. and so they really sadly have been getting to the point where you cannot trust what you see or what you hear. so i think a part of that are new laws like mine that will put more responsible on the social media companies. i also think a part of it is just education and awareness, making sure voters and citizens are more skeptical of what they are seeing, more skeptical of what they are hearing, then hope any they will do their own research to determine the accuracy of some of these things. it's going to be a combination of both regulation and education of society to address the real
