power. many struggling without clean water. while two new storm systems form in the atlantic. and new details about what caused the deadliest wildfire in the u.s. in more than a century. good morning, and good to be with you. i'm anne-marie green. we begin with new evidence against donald trump about how he allegedly tried to overturn the 2020 presidential election. in a court filing unsealed yesterday special counsel jack smith argues trump resorted to crimes as he sought to remain in power. and why his case should go forward despite the supreme court's ruling on presidential immunity. jarred hill is here in new york with more on this. good morning. >> reporter: good morning. that's the big thing here, right, this filing shows some of the special counsel's efforts to tailor this election interference case against former president trump to fit within the supreme court's immunity parameters, also giving more detail about the intensity with come trump allies told him there

was no proof the election was stolen. new revelations in former president trump's federal election interference case. special counsel jack smith in a filing unsealed by a judge alleges trump resorted to crimes, acting not as president but a campaigner to try and stay in office nearly four years ago. >> we will never give up. we will never concede. >> reporter: the 165-page brief is part of the special counsel's attempt to salvage the case after last summer's supreme court ruling that presidents have issues immunity for official acts. >> the brief attempts to outline all of the evidence the prosecutor has to show that the actions of the former president were in his capacity as a private candidate. >> reporter: according to the brief then-vice president mike pence had warned trump at least nine times to give up his fight to stop the certification of the 2020 election results, saying he could run again. still, prosecutors argue trump went ahead with an alleged pressure campaign on pence. >> if mike pence does the right

thing, we win the election. >> reporter: the court documents allege that when trump was told pence was in danger on january 6th he replied, "so what?" and when advisers asking him to, a message to calm the crowd and stop the riot, he refused. prosecutors also say trump's allies sought to create chaos, including one unnamed trump supporter who encouraged protests, urging make them riot. on line yesterday, trump called the filing falsehood ridden and an attempt to interfere with the 2024 presidential election which is now just 33 days away. you know, speaking of the timeline, this case will not go to trial before the november election, and if trump wins, it probably will get shut down in its entirety. >> of course. jarred hill in new york. thank you. president biden will head to florida and georgia today to survey the damage from hurricane helene. the death toll has topped 180 nearly a week after the storm made landfall.

new before and after satellite images offer a look at the extent of the damage in towns near asheville, north carolina, one of the places hardest hit by helene. running water may not be restored for days to 150,000 people. cbs' skyler henry reports from asheville. >> reporter: it is astounding, the scope of helene's path of destruction, especially in western north carolina. >> the united states, the nation has your back. >> reporter: president biden got a firsthand look flying over a region where roads have washed away and basic needs like food and water are in short supply, while floodwaters may have receded, the level of desperation keeps rising. >> in a moment like this we put politics aside. our job to help as many people as we can as quickly as we can. >> reporter: that includes the search for the hundreds still missing. what's that process been like in terms of working with search-and-rescue crews? >> very painful. you know, it's just like -- we

have these first responders who are working so hard, and you know, they all live here, too. >> i can't overstate how much worse this is than anything that's ever happened. it's catastrophic. >> reporter: in this once-vibrant now devastated river arts section of asheville the 12 bones smokehouse once drew throngs of barbecue lovers including former president obama. owner bryan king says it's not just the physical damage, helene's emotional toll is staggering. >> you're hugging and crying, and -- just happy that they're okay. and so -- yeah. it's just -- the whole thing is just unimaginable. >> reporter: and since we've been in asheville, some progress. power to certain parts of the city are starting to come back. this roadway is now open in both directions. it's a main thoroughfare in town. utility crews are working as quickly as possible to restore services. skyler henry, cbs news, asheville, north carolina.

forecasters are keeping an eye on two storms brewing in the atlantic ocean. hurricane kirk is a category-three and is expected to grow into a major hurricane. tropical storm leslie has also formed in the atlantic and could strengthen into a hurricane by the weekend. as of now, neither storm is deemed a threat to land. we know have official word on what caused the devastating maui wildfire last year. investigators say the fire erupted from an earlier brush fire that was sparked by downed power lines. crews battling that earlier fire believe they had extinguished it, but hours later it was rekindled by strong winds. 102 were killed, and thousands of buildings destroyed in the historic town of lahaina. the findings from the federal and maui fire department investigators could help determine liability. the $4 billion settlement deal is tied up in court. overseas now, explosions rocked the capital of lebanon

this morning. heavy smoke was seen over the central beirut. israel says it conductsed a precise air strike targeting a building near parliament. at least six were killed. this after dozens of missiles were lawned tuesday. of the near00 missiles fired by iran, israeli defenses shot down almost all of them. not without the help of u.s. destroyers based in the eastern mediterranean. but some missiles did get through like the one that smashed this car leaving twisted m metal and obstruction outside of tel aviv. the israeli military has vowed to strike back. "we have the capabilities to reach any point in the middle east," said the head of the armed forces. "our enemies, who have not understood this yet, will soon understand." that message being carried across the northern border today. israeli military video shows

a small partial eclipse was visible in hawaii and several countries in south america. a record-setting heat wave continues out west, and another guilty plea in the death of actor matthew perry. those are some of the headlines on the "morning newsstand." "usa today" reports a california doctor pleaded guilty for his role in the ketamine overdose death of "friends" star matthew perry. dr. mark chavez pleaded guilty to conspiring to distribute the powerful anesthetic yesterday in los angeles federal court. he is the third person to admit wrongdoing and agree to cooperate. two others have also been charged. pery was found dead in his pool last year. the medical examiner said ketamine was the primary cause of death. the "los angeles times" says a heatwave in california is smashing records, and it's expected to break even more. temperatures topped 100 degrees throughout the state yesterday. palm springs hit an october record high of 117. millions of people are under extreme hurricane warnings and ad -- heat warnings and

of the most valuable private companies in the world. shanelle kaul has your cbs "moneywatch" report. >> reporter: u.s. stocks inched higher wednesday amid growing tensions in the middle east. the dow gained 39 points. s&p 500 gained about 1 point. trouble at bank of america. over 20,000 outages were reported on wednesday from customers trying to use the bank's app or website. some customers said their account balances were not visible, while others said they were seeing a balance of zero. bank of america says the issue has largely been resolved. a new round of funding has given openai the startup behind chatgpt a big boost in value. the company's valuation now sits at $157 billion. this after it raised $6.6 billion from backers like

here's a look at the forecast in some cities around the country. ♪ schools and offices are shut town for a third straight day in the south of taiwan as a typhoon made landfall. the storm came ashore packing winds of 78 miles per hour near its center with gusts hitting 101 miles per hour. the national fire agency reporting at least two deaths, two people missing, and more than 120 injured. back home, tennessee authorities are looking into possible crimes after a historic tragedy. 11 workers at a plastics factory were swept away by floodwaters from helene last week. some were rescued, others died or are still missing.

cbs' manuel bojorquez reports with one worker. oh, my god. >> reporter: this is video robert jarvis took last friday as water started to rise outside the tennessee plastics factory where he worked. >> within three minutes it went from here to here. >> reporter: despite the threat of flooding, his market initially told employees they could not leave. he says it wasn't until the plant lost power and the water kept rising they were finally told to go home. what were the conditions like? >> it was -- water was up to my waist, and everybody was in panic mode not knowing what to do. we're looking for instructions on how to get out of here. we had no evacuation plan whatsoever. >> reporter: six of his co-workers are missing after a truck they were in tipped over in the raging floodwaters. one employee has been confirmed dead. others say they survived for hours by clinging to these yellow spools manufactured at the factory until they were rescued, according to local reports. >> innocent people, they shouldn't have died died.
