how much longer we have to put up with the heat. >> and this is a problem. it threatens the fabric of everything we need to do in san francisco. >> why sheriffs say they need to be able to use them. she gained international attention after taylor swift wore one of her designs. now she is helping niners fans tibet their own custom fit. >> i will wear red and gold all the time right down to the earring. from kpix5, this is the late news with sara donchey on cbs news bay area. >> i'm sara donchey. we have not been able to say this much this week but tonight it has finally cooled off. enjoy it while it lasts because the excessive heat warning has been extended again through saturday. seems like we traded places with southern california. this is what it looked like at the santa monica

11:08 pm
the heart of the issue there. the sheriff requires that everyone who agrees to wear an ankle monitor as an alternative to jail must consent to warrantless searches while a federal judge has decided that violates the right to privacy and freedom. now the mayor, the city attorney, the district attorney, they all say this is not in the interest of public safety and a threat to a criminal justice reform tool . >> as you heard, that will mean potentially more people have to be incarcerated because the court is not going to have this option. >> first i want to note that it is not the federal court order that requires the sheriff to stop operating its program. as a result of the disagreement with the court's order. >> reporter: a staff attorney with the aclu of northern california brought the case on
11:09 pm
behalf of three defendants. >> the problem here is that the sheriff is seeking to assert warrantless search authority in circumstances where a criminal court judge found that condition is inappropriate and unnecessary to supervise the individual who is being released. so as you noted in your question, roughly half of the people who are currently released on pretrial electronic monitoring are not facing any violent charges. >> reporter: while 50% may be serious and violent felonies, we still have a large degree of our fentanyl dealers on ankle monitors. >> reporter: so the program is on hold for now. and the sheriff says his department is making room. >> we anticipated increases not just based on this decision. >> reporter: those already
11:10 pm
enrolled in the program will remain on it. ankle monitors attached unless their case is revisited. as for the city's appeal of the ruling that has already been heard. though there is no time line yet for when we should expect some kind of decision. >> the public defender's office is criticizing the decision. they told us the sheriff is choosing to sacrifice a valuable tool for public safety rather than comply with the federal order. there was a lot of activity at uc berkeley as crews set up for espn's college game day this weekend. that show is coming to berkeley for the first time ever as the bears take on eight seed miami. the broadcast kicks off saturday morning at 6:00. the university says fans should get there early. bart announced early morning rides. you can see the departure times listed here. they are scheduled to reach the berkeley station at 5:00 a.m.
