intentionally shut off in the bay area amid high fire danger, why some locals say a work-around for public safety power shutoffs could put everyone at risk. >> there's far more risk of a fire starting. plus it's the last thing you want to see if you're looking up at a skyscraper. >> it was very, very scary. >> the dangerously close call in the heart of an east bay city. >> announcer: from kpix, this is the late news with sara donchey on cbs news bay area. >> hi. i'm sara donchey. tonight voters on both sides of the aisle are trying to imagine how our country and our state will look in the next few months when president-elect donald trump retakes the white house. we'll have more on the presidential race in a few minutes. but first there are developments in some of the more closely watched races here at home, everything from mayoral races to recalls to propositions. let's start in san francisco where philanthropist and levi strauss heir daniel lurie is holding

the lead in the mayoral race over incumbent london breed. ballots are still being counted in the ranked-choice race and the city is expected to release its next batch of results tomorrow. he has a healthy lead now with more ballots to be counted. across the bay it looks like voters decided to send two powerful east bay leaders packing if these results hold. this is what they look like now. this is the recall for oakland mayor sheng thao. voters have been backing this one by nearly 2-1 with 100% of ballots counted at 65.2% of voters saying that she should lose her job immediately. an overwhelming majority of voters are also backing a recall for alameda county district attorney pamela price. the numbers, very similar to what we saw with the recall in the city of oakland. nothing is official yet, but if mayor thao is recalled, there will be a special election in the spring and until then

oakland city council president nicki nicki fortun ado-bass will be the acting mayor. former san jose mayor sam liccardo it's projected has won the district's 16th house seat to represent a big part of the silicon valley defeating assemblyman evan low. it looks like one of the most closely watched state measures, prop 36, will pass in a landslide. votes are still being counted, but 70% of california voters said yes to reclassify certain thefts and drug possession crimes as felonies. as you can see, a big defeat there for the no side. our kevin ko spoke to a store manager in the south bay who says he thinks that the tough on crime measure will send a message to thieves hoping to target his shop and others. >> reporter: inside the smoke shop in east san jose you'll

find dohan who moved here from oakland a year ago. >> we used to get a lot of people who would steal stuff would steal and run away and you couldn't really follow them. >> reporter: he wants more accountability across the board whether for criminals or government officials representing him. >> i would like to be safe when i come to america and my family to be safe. that's all i care about. >> reporter: that's something san jose mayor matt mahan said he heard loud and clear. >> i just kept hearing the same stories of people feeling like their government is failing to deliver on getting people indoors to safe and dignified shelter connected to supportive services and breaking cycles of addiction and retail theft. >> reporter: that's why mahan, locally supported prop 36, against governor gavin newsom who spoke out against it just last week. >> it's funded and unfortunately, it may impact some existing drug treatment

and mental health services. >> i hope that this spurs us to make those necessary investments just because we have a shortage of beds not meaning we should do nothing. it indicates we need to stop leaving people on the streets to suffer and far too often die on our streets. public safety, keeping our community safe, simply is not a partisan issue. it's not a democratic or republican issue. it's about finding what works. >> reporter: under prop 36 prosecutors will be allowed to charge someone with a felony instead of a misdemeanor if they were convicted of it twice before. it's the same elevated punishment for people possessing drugs, but they will be given a choice to enter treatment. in little saigon workers like dohan are hoping prop 36 sends a message. >> i'm glad that law came up that would get them in trouble for doing any bad stuff. tonight local trump supporters are soaking in his big win over bay area native

vice president kamala harris. the president-elect declared victory last night. >> look what happened. is this crazy? we're going to fix our borders. we're going to fix everything about our country. we made history for a reason. >> in the east bay some trump supporters celebrated his victory on a highway 24 overpass near lafayette. one of them has been hanging banners and flags here for years. she told us trump's victory left her speechless. >> the garbage people won. we know how horrible that is. you don't want to get out of bed and so we don't want to be mean, but we're going to celebrate. >> but things look and feel very different for local harris supporters. some told us they are scared about their future. >> i woke up thinking i was going to wake up from a bad dream and then i realized it was actually reality. >> at howard university in washington, d.c. some harris supporters were in tears as

they watched her concession speech. >> i spoke with president-elect trump and congratulated him on his victory. i also told him that we will help him and his team with their transition and that we will engage in a peaceful transfer of power. >> our kenny choi was there in d.c. and talked to her supporters as reality started to hit. >> reporter: the vice president's staunchest supporters disappointed but looking to continue what they say is their fight for justice after listening to the vp's concession speech. >> i've been holding back tears. it was the first time i felt myself welling up since the results came in. i think they were healing words and unifying words and uplifting words and i couldn't have asked for something more unifying in the face of a very divisive election. >> reporter: plenty of tears and hugs all around. harris'

supporters reiterated the message of a peaceful transfer of power respecting the laws of democracy and the electoral system. as we mentioned, some votes in some of our local races are still being counted. for all the latest election results, go to our website, kpix.com or download the free cbs news app. strong winds and dry conditions have firefighters on alert tonight. pg&e cut power to thousands of customers across the bay area, mainly in the north and east bay, to reduce the fire risk, but the utility just told us a couple minutes ago they're going to start restoring power in alameda, contra costa, and santa clara counties. zoe, a lot of people probably looking forward to that. the fire threat is pretty high now, isn't it? >> it's only getting lower from here, though. the winds have significantly quieted down from earlier, about 5 to 15 miles an hour compared to 25 to

45 miles an hour earlier. that's the reason all of our red flag warnings are going to expire at 7:00 a.m., but i would not be surprised if they expired a little sooner because we'll be seeing continued better conditions the next couple hours. if you want to step out tonight, a warm jacket is definitely necessary, temperatures across the bay area in the mid- to lower 50s. it's definitely going to be one of those autumn nights you have to bundle up and definitely bundle up into early tomorrow morning as well as we are going to continue to see those temperatures get cooler and cooler, but unfortunately, those winds are going to be the bigger issue as we step out overnight. i have some really great news. pay attention to the direction of these winds because today and yesterday they've been coming from the offshore direction and it's the reason that our fire danger has been so high, bringing in all that dry air from the continental united states and drawing it closer to the coast, but i have some good news. our onshore flow will return. look

at our wind direction. it's going to shift over the next 24 hours from that offshore direction to the onshore direction. it's going to take all of the moisture from our coastal communities, pick it up and take it closer to the coast. that is really great news. there is going to be more moisture on the way over the next couple days and that is the best news of all when it comes to fire danger decreasing. so that's good news. again, it's only going to get better from here. power should be restored to everywhere by tomorrow afternoon hopefully. >> that is good news. we did send our andrea nakano to the oakland hills where some people told us tonight they're worried a work-around for power shutoffs could put them all at risk. >> reporter: up in the oakland hills red flag warnings are posted along the ridge line. residents in the area have been dealing with strong winds all day. the. >> when i was coming up, there were trees down. it was blowing really hard. all the trees were like leaning and back up.

>> reporter: but they have also had to deal with the power being shut off in their neighborhood. >> power went out about 7:30 or 8:00 this morning and the forecast is that it was going to be restored by 7:00 a.m. tomorrow. i got an update now saying 10:00 a.m. tomorrow. i don't know. we'll see. >> reporter: mark higgins has his generator going to power up his essential appliances. when it comes to fire safety, he's more concerned about the chorus of generators buzzing in his neighborhood. >> the reality is with everybody running their generators around here, there's far more risk of fire starting from the generators than from pg&e's power lines. i actually don't think it's very safe to have them shut down on the power the way they do. >> reporter: higgins moved into his home about five years ago, so he didn't deal with the oakland hills fire in 1991, but the home that was originally on his property was destroyed. >> they use this street as sort of the fire break, i believe. there's one house, they call it the miracle house down

there, that survived, but aside from that, everything on this sideburned. >> reporter: his newly built home has sprinklers and a fire resistant exterior. even before he moved in he read through the fire report and found out what happened and what has been done to prevent it from happening again. fire danger is always a concern, especially when offshore winds are in the forecast. >> it's something we all are dealing with so much more and it just feels like in the past five, six years it's become so much more front and center of what we have to think about. coming up, a path of destruction in several southern california neighborhoods. and the last thing you want to see when you're looking up at a skyscraper is a chunk of glass falling down toward you.

former san jose city councilman omar torres resigned just before he was arrested for sexual assault of a minor. torres is accused of molesting a family member back in the late 1990s. that is separate from another investigation in which police say he sent explicit texts to a minor. >> we are absolutely horrified by these allegations. council member torres will be receiving due process. absolutely justice will be served in this case. >> torres is in custody with no bail and heads back to court

november 14th. if he's convicted, he could face up to 24 years in prison. attorneys in the trial of the man accused of killing cashapp founder bob lee are trying to have the case thrown out of court. that's what happened today. they made a move for a mistrial, calling into question how key evidence in the case was handled. our lauren toms has been in the courtroom and brings us the latest tonight. ♪ >> reporter: the defense today taking a swing at declaring a mistrial after a witness misspoke, attorneys arguing that comment could have tainted the jury, this coming just moments after the prosecution said they rest their case against nima momeni, but this trial is far from over with many stones left unturned as the defense gears up to make their case that momeni acted in self-defense when he stabbed bob lee.

the family of bob lee told us outside the courtroom they believe the momeni family tried to cover up evidence of the stabbing in the days and weeks after it happened. lee's brother saying the evidence speaks for itself. >> and i think that the whole family, the whole momeni family, really worked together to cover up this crime from like selling the car to leaving off phones. it's crazy how much these people worked together. they're as crooked as the tower they live in. >> reporter: his words come after the lead sfpd detective testified momeni's brother-in-law googled how to erase an iphone days after the stabbing. that same witness on wednesday said to the courtroom he didn't believe momeni ever had an option to post bond. those few words opened the door for the defense to motion for a mistrial claiming it could have tainted the jury. >> that's not something we

were hoping to do. we didn't want the jury to hear that. we thought that was improper. >> reporter: attorney shannon dugan who was inside the courtroom said the jury should never know whether a defendant is in custody or not. >> it is criminal law 101. the jury is not allowed to know that or consider that. it could prejudice them. >> reporter: that motion denied by a judge, but it wasn't without another hail mary by the defense who motioned to acquit nima momeni alleging a mishap in the chain of custody over some of bob lee's dna. that motion, also denied. the prosecution then rested their case, turning the table for the defense to call their witnesses, one of whom will be momeni himself. >> personalizes the defendant and it just is seeing the whites of their eyes. now if the defendant doesn't testify well, it also gives the jury more reason to feel comfortable with convicting them. >> reporter: now we are expecting momeni to take the

stand next week, but his testimony could come as early as tomorrow as defense attorneys tell me their client has been eager to tell his side of the story. >> to watch all of lauren's reports on the momeni trial, head to our website, kpix.com. dangerous fire weather is putting us on alert in the bay area at the same time we are seeing major destruction from high winds, santa ana winds, causing a wildfire to explode in southern california, the so-called mountain fire. it's been torching homes in ventura county with little warning. the fire started around 9:00 a.m. in the community of somas outside thousand oaks. within two hours the flames hopped the freeway and into the camario heights neighborhood. people could barely get out of their houses before the fire closed in. at least two people were hurt. 10,000 people are out of

their homes because of this fire. this is kind of the worse case scenario when you have these winds and very little warning when a fire sparks up. fortunately, i think people were able to get out with the exception of those injuries, but that's not a good thing at all. >> it's so scary, but luckily in the bay area we have avoided a majority of that wildfire danger because today was the worst of it and it's only going to get better overnight. there is more moisture arriving, some great news on the way, but we will continue to see that area of high pressure that impacted us at least the next couple hours. luckily, it's not much longer than that. we can actually see this area of high pressure directly from space. let's walk closer to it, see what's going on directly here in california. again, high pressure is the reason that we are dealing with the fire danger, the lack of cloud coverage the reason we're dealing with it. like we talked about, the strong santa ana winds will continue for southern california and it's the reason they will continue

to deal with even more fire danger through tomorrow afternoon as well, but look at us. we don't have that fire danger anymore because we're looking at a storm system on the way that's going to bring more cloud coverage as we step out for the later parts of the upcoming week. that high pressure system will begin to depart. low pressure system arrives and we'll see quite a lot of changes and a lot more cloud coverage is on the way later this week into the weekend, so good news when it comes to not having to worry about fire danger much longer. 7:00 a.m. tomorrow morning all this activity is going to expire, no longer going to red flag warnings in effect and much quieter conditions are on the way, especially into this weekend. now we're still dealing with the offshore flow. it's the reason the red flag warnings don't expire until the overnight hours. the offshore flow is continuing to draw in some drier conditions. overnight not getting much relief from dry air, but the coolest thing to see is the change in wind direction over

the next 24 hours, not just on the wind direction, but the increasing moisture as well. let's look at the onshore flow that will increase. look at winds changing from the offshore direction, turning around getting into that onshore direction drawing in all the moisture from the ocean and bringing it further inland. this is what it looks like when it comes to our dew point. the more moisture in yellow and green will get brought onshore by the winds and decrease our fire danger by as soon as tomorrow afternoon and into friday and saturday even more cloud coverage will arrive. look at our dew points by friday afternoon. they'll be in the 40s, 50s, 60s. it's going to be much better than the teens and 20s we're seeing over the past couple days. it's something we'll keep a close eye on, but overnight tonight you are going to want to grab a jacket as those temperatures dip down to the 40s from our inland locations all the way to the coast. a warm jacket will be necessary, especially across the north bay with 30s in the forecast. by tomorrow afternoon we'll be

warming up to seasonable, maybe 2 to 4 degrees above average. either way it's going to be a lovely thursday afternoon to enjoy the weather, 70s from our inland areas to here in san francisco, gorgeous weather. it's the reason we live here in california in november, 70s. what is better than that? we're going to stay pretty seasonable over the next seven days as well, which is really great news, especially if you have any outdoor plans this weekend, really no weather issues other than a little bit of cloud coverage arriving saturday, but it's really not going to do much in terms of bringing us any sort of moisture. it's not until monday next week we do have the increased chance of seeing widespread shower activity. that's really great news. we need the moisture, does come on veterans day. if you have outdoor plans on monday for the maybe day off you have, you might have to change those plans to indoors. until then it's going to be very, very nice weather, fire danger continuing to decrease after today and get ready for more cloud coverage and a

this business at the nba champs. jayson tatum attacking his old olympic coach steve kerr, much to do about nothing had. fast forward third quarter warriors by 11. steph curry was heating up, hit four three's in the midst of a 12-0 run. boston responded with its own with the aforementioned tatum, 17 of the team's 41 in the third quarter, cut the lead to one. celtics grab the lead with eight to play, now up four. oh, my gosh, he threw it down, boston by six. golden state down one. draymond green found curry under the basket. final minute dubs up four. curry drew a crowd, gave the rock to buddy hield and he hit from deep, seven-point game. golden state beat the champs 118-112 and that's how they improved this

to care for all that is you. we told you about a couple scary incidents in downtown san francisco when glass started falling from skyscrapers, sounds like something out of final destination. it happened again. this time it was across the bay. today in downtown oakland pieces of shattered glass rained down from a broken window in a high rise near lake merritt near 19th street and broadway and the glass came crashing down right on top of a white tesla shattering the back windows. thankfully, no one got hurt, but a man who saw it all happen told us it could have been a lot worse because a woman was inside the car. >> i was it ten feet away. the window started falling out and landed on the car. there was a lady in the car, too. thankfully, she was okay. there was a bang before it fell, so i
