two different stories in a tech ceo's murder trial. the question from the jurors. >> and i respect their decision. >> district attorney pamela price admits defeat for the first time after a land side recall. hello, i'm sara donchey. imagining friends, family, or anybody going out on the water to enjoy themselves and not making it back to shore is chilling and disturbing. we're reporting on a deadly boating accident in the same place. our helicopter was overhead after the latest accident this afternoon. you can see a boat on its side on the beach. we were told five people were on board when this boat capsized in the ocean near salmon creek. one person was killed, the other four rushed to the hospital. just it this past weekend, there was a vigil for four family members and their friend when they died when their boat capsized in bodega

bay. the 13-year-old was the only survivor. that accident happened just a couple days ago. where officials are doing what they can to warning people about the dangers. >> reporter: pat patterson rushed to salmon creek. when he got there, he saw rescue crews pulling poem from the water. >> and the helicopter flew two survivors to the hospital. it happened before sending crews out. confirming five people were thrown into the water. and the other four were pulled to safety. >> we are still conducting on

how the accident occurred. >> reporter: this is the third boat to capsize this month. police responded to two other accidents that left at least five people dead. and that rough weather was likely a major factory. and the best way to know your capsize is to understand the conditions. >> and it is how well they will fare in larger swells and individual skill sets that will come in to play with how experienced they are and how well they could operate that boat. you know, if conditions are too dangerous or if you don't feel comfortable, don't go out there. >> reporter: the conditions on the water have been rough this past week. he expects them to get worse. and the recent accidents should be taken as a warning for anyone thinking about going out on the water. >> and you need to get back in

before the wind picks up this afternoon. >> this is the eighth death, as we mentioned they were taken to the hospital, expected to recover. wrapping up his third day of testimony today, he tried to convince the jury he was defending himself, but they left jurors with some questions, presenting those very questions to momeni. our lauren toms breaks down the day in court and how both sides are faring when it comes to convincing that jury. >> reporter: sara, what is now coming into question in this case is the credibility of the defense witnesses including nima momeni. but it's the prosecution that stands with proving their case that momeni deliberately attacked bob lee

beyond a reasonable doubt. a task that's proving more difficult with a lack of tangible evidence. >> bob was completely anti-violence. he was about empathy and about lack of violence, about preventing violence. >> reporter: bob lee's family poking holes in witnesses called by the defense including the defendant himself, nima momeni, who lee's brother says can't be trusted on the stand. >> and he's trying to rewrite the history, but it's not true. >> reporter: in a unique twist inside the courtroom, the judge allowing all 17 jurors to submit questions for momeni to answer within the scope of the law. questions including whether momeni was intoxicated and whether he gripped the

knife. even sew it leaves many questions unanswered, including how the knife could have ended up in his hand. it puts the credibility of his testimony in doubt. >> and the knife just appears on main street. nobody has testified about him taking it or handling it. that is a huge hole if you want to show intent. >> reporter: jurors probing momeni about his self-defense training. one juror asking momeni if he is familiar with a common practice of twisting the wrist to force a knife wielding person to drop their weapon. he said he did twist lee's wrist, however, an autopsy didn't show any bruising or injuries consistent with that statement, throwing doubt into momeni's version of the violent altercation. >> and in california when you assert self-defense and you

provide some evidence, that is another thing they have to disprove. they had to prove he had the intent to stab bob lee. >> reporter: one thing they did not question momeni on is the upbringing in iran after they fled the country, leaving his father behind. and as this case gets into the emotions of everyone involved, telling me that her kids should not have to grow up without a father because momeni grew up without a father, digging into the burden of this case as they seek justice for their loved one. >> and as she has all along, you can find the very latest on

unions and make some reductions. and we may need to lay some people off. >> reporter: they will meet tomorrow to talk about the budget. >> an election that seemed to be about pucking the status quo, including a recall. and steadfast in not acknowledging what you see right here that she had lost her bid to stay in office until now. john ramos explains. >> reporter: pamela price expressed anger. in the end, she was gracious in defeat. >> and while the outcome is not what we hoped for, i respect their decision. >> reporter: they talked about the vote in 2022 that sent a crusader into the job of chief

prosecutor in the county. >> and in january of 2023, i took office. since then, i fought to bring change and help to a broken criminal justice system. >> reporter: from the outset, it was controversial as price refused to apply traditional sentencing enhancement for violent crimes and sometimes seemed more interested in pursuing cases against law enforcement officers themselves. in fact, even after the election when it was clear she was in trouble, price announced charges against nine officers and civilian workers regarding the death of maurice monk at the santa rita jail. at the press conference, supporters demanded those charges stand once price is gone. >> and our sheriff is too willing to cover for her staff. it is imperative that d.a. price's successor follow through the cases that our district attorney has filed. >> reporter: price talked about the things she accomplished,

including diversifying the office. she streamlined the operation and procured more than $5 million from the state. and she seemed proud of her unit, which she said exposed decades of prosecutorial misconduct. >> and it is important that the work continues beyond my tenure. >> reporter: in the end, the focus on finding fault gave her an image of being soft on criminal. and they would like the board of supervisors to keep an eye on price's office until she leaves. >> and while she is still remaining that we do not wish to see her vindictive action against anyone. we want to see

a smooth transition. >> and no one is sure when that will be expected. after that, they will appoint a replacement to fill the office until a new election in 2026. and daniel lurie will be sworn in as san francisco's mayor in less than two months. they will help guide his transition. and also on the transition team, michael tubbs who is currently a special adviser to governor gavin newsom, and former san francisco fire chief, white. we spoke to willie brown about his take on the city's future. >> i've got to believe his interest will not be to be the next governor or the next president. if that happens, he's got a good shot because quality people will work with him. >> and daniel lurie is really

light. it won't be an all-day washout. by 10:00, the steadier rain is moving up. it will spread across more and more of the bay area from 10:00 p.m. to 10:00 a.m. on wednesday. steadily making their way further south. you see yellows understand kateing for the north way and dripping down, making their way across the oakland hills and the interior parts of the east bay. but the cutoff line will be the southern end of the bay. not much activity until we get into wednesday afternoon, from 10:00 a.m. to welcome and 10:00 p.m. moderate to heavy rainfall to the north. this will all retreat farther to the north on thursday with lingering showers, but then it surges back across the bay area on friday. timing on that one is still up in the air. but what we're tracking is the potential for substantial

amounts of rainfall recover all. let's take a look down towards san jose, and the official forecast is 1.7 inches of rain. what happens if they miss us to the north? and if they get directly towards the south bay, it's over the rill. of possibility for san francisco, where even in that low end, between now and next monday and that boom amount is possible. but really that eye popping number is in the north bay over the course of the next seven days. and even if most of the moisture will miss us, there will be enough to santa rosa and it is over a foot of

rain just in the course of the next seven days, where there is the wind factor with this as well, and it will be accompanied by 25 to 30 miles an hour winds and 40 to 50 miles an hour gusts along the coast, where this will be a snow maker for the high sierra. picking up a food and a half to three feet of snow in elevation. so tricky, if not, dangerous conditions along the u.s. 50 and i-80 corridors. and that it may be significantly slowed down. the seven-day forecast, an everyday thing for the heaviest rain. again, that one on sunday might get pushed back to monday. we will keep you updated through the rest of this week. tomorrow is mostly
