i am juliette goodrich. it is no secret that nationwide and around the world, the bay area can sometimes get a bad rap when it comes to crime. this doesn't help. a british indie rock band didn't have a warm welcome. instead they faced a scary encounter while stopping for coffee. the band said what is more surprising than what happened to them, the police response or lack thereof. >> reporter: the voice you hear is al greenwood, drummer for the alternative band, sports team. >> we have been to phoenix and san francisco. >> reporter: they sat down to talk with us as they got ready to take the stage in sacramento. before they even made it there , and on the

first day of their u.s. tour -- >> we stopped at starbucks for breakfast. someone said hey is that yours it is being robbed outside. >> reporter: thieves had broken their way into the van. 4 several members decided to step in. >> we confirmed these guys and the driver . one of them pulled a gun. >> reporter: that was enough to send them running back into starbucks. you would think having a gun pulled while your stuff is stolen would be the biggest surprise of the day. it is what happened next or what didn't happen that left them especially shocked. >> we told the police and their response was sorry it happened but you need to file a report.

advance a measure that would authorize her board to remove a sheriff for cause. it is now up to county voters to decide. >> with the unanimous vote the board of supervisors handed voters the scandal . the sheriff denied wrongdoing after a 400 page report alleging a dozen instances of abuse of power. she has called the entire affair of political attack and refused calls to resign . her legal team asked the board to delay the move forward but the board moved ahead setting the stage for a march vote that would give the board the authority to remove the sheriff with a 4/5 vote and the supervisors did not stop there.

the climbers. they put the search on hold due to extreme conditions but plan to continue tomorrow. today, the defense team had their turn to persuade the jury. he was defending himself in a fight that ended up with bob lee stabbed to death in a. the final day of arguments including never before seen video. a cardboard replica of a kitchen knife and a bag of sugar and a heated back-and-forth involving both attorneys. here is the latest. >> reporter: defense attorneys for nima momeni prison

presented a lensman with a possible answer to why bob lee would've had a knife before the altercation with nima momeni. the defense played footage of lee and -- allegedly consuming cocaine outside of a social club using an item that could be a knife. his brother pushing back thing bob never used a knife to consume drugs. >> he never carried a knife and never would do cocaine off of a knife. is insane. >> reporter: in the closing argument, defense pulled out what he called an exact replica of the murder weapon. an eight inch knife made out of cardboard. he questioned how a knife with a 3.5 inch blade could've punctured his chest without a drop of blood landing on the handle suggesting it could stem from faulty evidence collection.

prosecutor reminding the jury to consider common sense as they approached deliberations. the parting words to the jury, do not let him get away with it. >> he was a great man and for this person to try and traumatize us again is horrible. >> the prosecution wrapped up the rebuttal. as of wednesday, the case will be in the hands of the jury. in the morning they will receive additional restart instructions that will set the parameters of what they can consider. from there they will go behind closed doors to determine whether they will convict him of first-degree murder, a sentence that carries 26 years to life or whether to convict him of second-degree murder or manslaughter or opting to find him not guilty altogether. >> you can see all of our coverage on our website,

less than an hour left in giving tuesday. millions of people come together after shopping nonstop to celebrate generosity. with so many people in need, food banks are desperate for volunteers. we spoke with one woman about why she is helping out. >> reporter: we are here at the alameda county food bank. this time of year it is all about helping people. volunteerism inaction. this is what it looks like and more importantly it is what it feels like. everybody helping others in the community. one volunteer is sony. tell me why you decided to get started. >> during the pandemic, i started to experience cancellations and refunds and working in the negative and felt like i needed to repurpose and do something positive for the community. >> i saw the commercial

will welcome a little bit of rain. temperatures now dropping to a mix of 40s and 50s. we will not fall too far. the fog will be sparse. let's look at the forecast low temperatures which will end up mostly in the low to mid 40s. not a lot of variation. the cold spots will be in the north bay. 37 in fairfield and 38 in petaluma. temperatures will end up 5 to 10 degrees above average. similar to today. mid to upper 60s for the north bay. low to mid 60s along the coast and upper 60s down the peninsula and even around or above 70. the santa clara valley 10 degrees above normal. not a lot of change . one cooler day on

saturday resulting in passing clouds. it will knock a few degrees off the daytime high temperatures saturday. we will still be above normal. than a hint of rain . if we had a 10 day forecast, there would be a lot of these. the 10 day would also be dry through most of next week. we would keep hunting for that next chance of rain that will eventually had our way. disaster averted yesterday after bystanders jumped in and saved a woman who had driven off a cliff side. the woman drove through an intersection and crashed into another car and reversed her niece on into the water. two bystanders jumped in to save her. she was taken to the hospital and is expected to be okay. still ahead, a toy drop takes an unexpected turn. one

holiday season is a season of giving. an army veteran known as the flying santa tried to do a good paying but he said a few bad apples ruined it. this year is the fourth annual flying santa event. where -- drops presence from the sky. people then dive to get a toy. it is supposed to be kids. during one of his drops, he was disappointed by a handful of adult men who were less than pleasant. >> pushing little kids out of the way and stealing this little toy. >> no one was hurt but local residents have taken the social media to discuss their frustration. in the meantime flying santa said don't be a grinch.
