the head of a major insurance company gunned down in the streets of new york. an emotional trial near the end as the family of a slain tax ceo hopes to find justice. from kpix, this is the late news with sara donchey on cbs news bay area. >> people who have been living at a northbay encampment are staring down even more uncertainty. in a matter of days there encampment is getting shut down and cleared out. a landmark supreme court ruling led to governor newsom ordering suites across the state. since that executive order we've seen crews clearing encampments in san francisco where in october they reported their tent count was down 60%, hitting its lowest level since 2017. in east bay that there have been sweeps in oakland and berkeley. and the main water agency banned camping

your creeks, rivers and waterways and now napa is taking steps to clear and encampment at kennedy park. people asked to move to a fenced area starting next week. andrea nakano visited that encampment today. >> reporter: two things started to kick start this effort to remove the encampments at kennedy park. one was a supreme court decision that gave leaders the ability to do so. the other is a $15 million state grant to clear encampments and offer additional services. the residents are nervous about having to make another move they don't want to make. >> we do what we can, you know. >> reporter: after living on the streets for 4 1/2 years eric finally found a place to call home at kennedy park. it is an area with about 25 separate encampments. some have created fenced yards and built makeshift

homes. >> we have our own areas and do what we do. hang out and support each other. >> reporter: word of the city of napa closing the encampment has been spreading. the city says it has started helping people take their personal items to storage units in order to move them to a temporary camp just yards away on december 9th. it has also offered shelter but people like eric prefer to live on their own. >> i just like my freedom. i don't think i would feel free there. i'm forced to be around people i don't like or want to associate myself with. >> reporter: now eric, his girlfriend and their kitty will have to find a new place to live before the temporary location closes in four months. eric says he wishes he was still in his home in american canyon and had his job. for him, a divorce

turned his life upside down. he feels homeless people are unfairly targeted when they have nowhere else to go. >> we are homeless, we are not monsters. being portrayed to be something i'm not is what i don't appreciate. why would you look down on somebody because they are homeless. you don't know what that person has been through in their life or what their circumstances are. >> reporter: the city of oakland is about to play a game of musical chairs as it plays out how it will replace its recalled mayor. it looks like it could have multiple people step into and out of the job in a matter of months. last month oakland yours voted to recall mayor sheng thao after less than two years in office. she said to leave december 17. nikki fortunato bas will take over as interim mayor but then it gets complicated. that is because she won a seat on the alameda county board of supervisors so the council will need to find someone to fill her seat. they

will then serve as mayor until the special election and swearing in of a new mayor. at this next story is difficult to process. it is difficult to even believe. two very young children were shot as they were inside their school today. tonight, those little boys who are just five and six years old are in extremely critical condition according to the local sheriff. the suspect was at an elementary school in the town of palermo for a meeting with an administrator when he suddenly took out a gun and started shooting. he later turned the gun on himself. >> as we were gathering the children into the cafeteria -- >> reporter: deputies raced to a school for reports of an active shooter on campus. >> our patrol officer located a handgun near that individual's body and secured the firearm. >> reporter: the gun man found dead after opening fire at

feather river adventist school. he hit two young boys ages five and six and then turned the gun on himself. >> the two children were transported to local hospitals and their currently in extremely critical condition. >> reporter: the suspect made an appointment to tour the school and told administration he was exploring the possibility of enrolling a family member. they are investigating whether or not that was a ruse to get on campus. >> he did meet with the school administrator. i'm told the meeting was cordial and there was not anything about the meeting that gave rise to concerns. >> reporter: the fbi joining the sheriff's office in the investigation. >> my heart goes out to the parents and communities affected. no father or mother should have to endure what happened today. please know that we are working hand-in-hand with the full force of the fbi to assist the sheriff's department in any form they need.

>> reporter: the district attorney says there will be resources available for the people impacted. >> that will be going on for weeks, obviously months. not only the children that were injured but those children that saw their classmates gunned down in front of them. >> there is an all-out manhunt in new york tonight after someone gunned down the ceo of the largest health insurance company heard this happen just outside of a hilton hotel this morning in manhattan. bradley blackburn has the latest on this. video of the incident might be hard to watch. >> reporter: the brazen attack on the ceo of united healthcare was caught on security cameras outside the midtown hilton hotel early wednesday morning. >> it appears the suspect was lying in wait for several minutes. >> reporter: 50-year-old brian thompson had served as the head of the largest private health

insurance company in the country since 2021. he was heading to the annual investor conference when the suspect wearing a mask and carrying a gun approached him, shooting thompson in the back and leg. >> every indication is that this was a premeditated, preplanned, targeted attack. >> reporter: the gun man can then be seen trying to un-jam his gun before shooting again and then crossing the street and fleeing uptown on a bike. >> based on the evidence we have so far it does appear that the victim was specifically targeted. >> thompson was alone and did not have a security team with him. he was rushed to a hospital where he was later pronounced dead less than half an hour later. this driver says he tried to capture a photo of the suspect after witnessing the incidents. the shooting took place hours ahead of the annual christmas tree lighting,

triggering a massive police presence in the area. >> it is always disconcerting but it does not scare me away from the city. >> reporter: investigators are going through a cell phone recovered at the scene to determine a motive. flags were lowered it health -- the united healthcare outside of minneapolis. >> thompson's wife said he had been receiving death threats just before the shooting. day one of deliberations wrapped up with no word in the trial of the murder of bob lee. now it is up to the jury to weigh 21 days of testimony and thousands of pieces of evidence to decide the fate of his

killer. his wife is pushing back claims made by the defense during closing arguments. >> hearing his last words and watching him literally die on the streets is the most heart-wrenching thing. >> the family of bob lee hopeful for the light at the end of a long tunnel as they anxiously await a verdict from the jury. but now that all testimony has concluded, bob's former wife is pushing back on the defenses last minute video showing him holding an object to inhale cocaine outside a social club hours before the fatal stabbing. it is an item that the defense claims is the murder weapon. >> the knife that he was holding, it was something bob used for years, i should only hope that in the evidence it

will come up. >> that possibility that the item in his hand is unlikely to come up in jury deliberation as it was never mentioned inside the courtroom. when pressed wife the defense attorneys only brought up the theory that lee had the knife at the tail end of the trial, they said it is all part of their strategy. >> she is making up evidence. if it was a collar pin then they would have found it on him. >> i think it was a huge moment in the case, showing that he actually had possession of what everyone in that room knows is a knife. >> as jurors take 21 days of testimony and thousands of pieces of evidence to decide the fate of nima momeni, a judge has instructed the group to work together to come to a unanimous verdict. >> this is a very difficult job. this is a jury that was asked hundreds of questions over the

the search is on for two people who crashed an suv off the side of a cliff. this happened early sunday morning in malibu. chp says the suv fell about 1000 feet and crashed. they say the man in the front passenger seat managed to get out but did not report what happened to police until the next day. he told investigators that two other men were inside the suv when it rolled but were not inside when he climbed out. >> i did not want to speculate why he didn't call. the reason he did call was because he was unable to get a hold of them the following day. we were unsuccessful in talking to anybody. >> the license plate was from out-of-state and they are working to figure out who owns the car. not a lot to complain about when it comes to the forecast. pretty nice. >> especially for everybody running preholiday errands. the

rain has not been a complication for over a week now. let's get into the details of how things are going to evolve. a live look outside from the mark hopkins hotel. fog spreading out tonight but overall, calm and very dry. a mix of clouds and sunshine tomorrow. a slight cooling trend on saturday, otherwise very few changes in the seven day. beyond that timeframe is when the next chance of showers will come in. there is still much uncertainty but the models are narrowing in on next friday and saturday for decent chances of showers. things do look promising from a large scale perspective that maybe things will shift enough to send that next chance of showers towards us. air quality will be something we have to

monitor. it was in the moderate category across the board today. a little wind shift will kick in late tomorrow, stir the atmosphere enough that we will see a slow improvement to our air quality through the weekend. it won't be great everywhere but it should be better, especially for the second half of the weekend. looking to the east, singing a hint of fog in the distance, temperatures are a mix of 40s and 50s, mostly in the 40s by tomorrow morning. the fog won't be a huge factor for the morning commute. the futurecast does show that patchy fog trying to spread in from the central valley, from the east, finding cracks in the train. but it won't last very long. it should be gone by 9:00-10:00 at the latest. temperatures across the board will be in the low to

mid 40s, 47 in oakland and san jose, 40 degrees for cooler spots in the north bay and then we warm up to the mid to upper 60s for the north bay, around the bay, low to mid 60s, upper 50s and low 60s along the coast. temperatures east of the oakland hills in the 60s and 70 degrees for san jose and morgan hill and awfully close in los gatos. the seven-day forecast does not include too many changes. beyond that is when we start to have a little more turbulence to the weather patterns. a little closer to normal as we head into next week but average high temperatures in the upper 50s as we had towards mid-december and forecasting highs largely in the 60s. even at the cost staying at

southern california a storeowner in venice is turning a petty crime into a clothing line after he was targeted by a shoplifter. i can't say that i've ever said that sentence before. we see his very creative response to the big problem of retail theft. >> we heard the hangers clang and we were like, what was that? >> it dates back to december 28th of last year when this man walks into the store, steals a sweatshirt and another small item and let's himself out. fast-forward to one year later and that same thief is now the star of elitist collection called wanted. >> wanted for committing burglary in broad daylight. you could barely see the details. >> it is a collection that has
