now at 11:00, the suspect the world is watching might have difficult days ahead. why police are so confident he is the man who killed a healthcare ceo, plus what we're learning about his mysterious ties to the bay area. and why the man accused of a deadly drunk driving crash into a security booth was able to walk out of jail today. and it's been an uphill battle for firefighters taking on this massive inferno in southern california. why conditions are shifting in their favor. >> the point of what we do is to provide access to your soul. >> plus, a san francisco church known for its focus on psychedelic drugs is getting ready to shut its doors. why they feel like they are being targeted. from kpix, this is the late news with sara donchey, on cbs
1:39 am
news bay area. hi, i'm sara donchey. we're half way through the week and the rain is moving through the area. you might be seeing some of it already. it won't be done with us immediately. as promised, paul, right on time. it has been a few weeks since we've seen this much rain. we know we need it. what can we expect with this season? >> this particular one will be a decent amount of rain. it won't fall long enough in any particular spot to lead to a flooding threat. it is leading into half of the area. let's take a look at the traditional image. let me drop the map out of the way. there we go. the rain is moving into san francisco. it has been falling longer and a bit more heavily in the north bay. we'll zoom into that part of the bay area. now this radar view, because the radar beam is a mile aboveground level, by the time it makes its way into the area, it is more intense. it's coming down at a good clip.
1:40 am
same thing for the higher elevations of marin county, and pacifica as well. all of this will continue pushing across the bay area as we head through the rest of tonight. it's making good progress. moving along at a good clip, which means the flooding threat will remain very low as we head through the rest of tonight. the rain tapering up in the north bay at 3:00 in the morning. tapering off as we head into the presunrise hours. not much shower activity for the rush hour, but lingering off and on showers as we head through the rest of the day thursday. keep the umbrella and rain jacket handy. it will be a real mixed bag of weather. mix of clouds, sunshine, and some left over showers. and there's more rain to come. the next system is going to be more powerful. the one that moves in friday night into saturday is more likely going to direct an atmospheric river. a low end atmospheric river on our 1 to 5 scale. mostly beneficial rain fall. the outside chance of
1:41 am
localized flooding. we'll talk more about that, add up the rain through this progression of systems coming up. >> lots to discuss, paul thank you so much. the murder of brian thompson captivated the country. it seems like everyone shared their take on the suspect. former prep school valedictorian, luigi mangione. according to the police commissioner, shell casings they found at the murder scene match the gun they found on mangione. not even a day ago, his lawyer said he had not seen any evidence to suggest his client did it. tonight, he told cnn he still has some concerns with what the cops say they do have. >> those two signs in and of themselves have come under criticism in the past, relative to their credibility, truthfulness, accuracy, however you want to do it. so, that's why as lawyers, we need to see it. we need to see how do they collect it? how much of it matches? i don't want to get
1:42 am
technical, but fingerprints, ridges, different things like that. we would have our experts take a look at that. >> tonight, we have more on what police say pointed them in mangione's direction and what prosecutors might do next. was the suspect at the scene of the crime when united healthcare ceo, brian thompson, was shot and killed? the nypd says yes, and that they have forensic evidence to prove it. >> we were able to match that gun to the three shell casings that we found in midtown at the scene of the homicide. we were also able at our crime lab to match the person of interest fingerprints with fingerprints that we found on both the water bottle and the kind bar near the scene of the homicide. >> nypd investigators say they grabbed that water bottle and wrapper near a starbucks where they saw the suspect on surveillance video a half hour before the murder. the nypd
1:43 am
also said they found a cell phone. >> we did have a fingerprint on the cell phone recovered. >> the chief of detectives says they are still examining that piece of evidence. richard -- >> prosecutors are confident they have a solid case. but what they're doing is they are showing what they have with further evidence. they'll try to find a 3d printer. if they can find a picture of him using a cell phone that time matched, they will present that. >> law enforcement sources say mangione had a spiral notebook with him, where he wrote about considering using a gun over a bomb to carry out an attack, because it was targeted, precise, and doesn't risk innocence. mangione's attorney said he will plead not guilty and is fighting his extradition to new york. ted simon is a philadelphia defense attorney. >> who loses by that
1:44 am
extradition not happening or not happening quickly? >> council has the benefit of spending more time with his client. learning more about the case. learning more about the circumstances, and provide a greater opportunity to developing a full defense. >> also today, cbs news confirmed that mangione's mom did file a missing person report with san francisco police. a person close to the investigation told cbs news she did that days before the deadly shooting. to the south bay, a man accused of killing a san jose community service officer in august has been led out of jail, according to the san jose mayor. juan is facing a murder charge accused in a dui crash that killed 34-year-old, and injured veronica. they were working as community service officers doing traffic control on monterey road. a judge let the suspect out on bail. he was apparently given some restrictions, but the mayor's
1:45 am
office did not have details on that. he was convicted of drunk driving in san matteo county in 2014. san jose police gave us a statement saying that previous warnings about the dangers of drunk driving did not stop him from killing fam. it stands with the da's office and objecting to his release. we reached out to the da's office for comment, but have not heard back yet. it has been five days, san francisco jurors have not decided the fate of the man accused of murdering cash app founder, bob lee. we heard from his attorney at the hall of justice today. >> this is one of the longer deliberations that i've dealt with personally. but that doesn't mean anything. you know? who knows what it means. sometimes you get a decision in ten minutes and sometimes it's a lot longer. so, i mean listen, is there a lot of evidence in this case? a little bit. they are doing their job. >> if they don't reach a verdict by the end of the day tomorrow, the judge will allow any juror to opt out of the
1:46 am
trial if they want to. but if that happens and an alternate has to be chosen, deliberations have to reset. if there aren't enough alternates to fill the jury, the judge will have to declare a mistrial. 20,000 people have been forced out of their homes as the franklin fire still burns through malibu tonight. firefighters are hoping their luck will change. the winds should calm down tomorrow. that is what firefighters really need, because the winds turned this fire into something of a blow torch. nine homes have been destroyed, six more have been damaged so far. that number could go up. the problem though that a change in wind direction could push the fire into places that have been spared so far. we'll keep our eye on that. still ahead at the san francisco church, you can swap out the crosses for magic mushrooms and the religious doctrine is all about tripping out. >> we provide cannabis,
1:47 am
mushrooms, to our members. >> nothing to do with drugs at all is forcing them to pack up and leave. you know that age old saying, don't eat yellow snow? you shouldn't eat brown snow either, just ask these people on the east coast that are covered in it. and this dog is a professional escape artist. why a second story window and darts were not enough to stop him from escaping again.

1:49 am
it is safe to say that the tech and startup culture has shaped san francisco over the past few years, but long before
1:50 am
that, it was the counterculture movement of the 60s and 70s that was the city's legacy and psychedelics played a big part in that. we dug through our archives to show you why. >> in the 60s, a mind blowing experiment called lsd rolled into town. >> there's nothing you can do about it. my advice is to sit down with your kids and ask them what they're learning, why they take it. >> an unprecedented number of young people flocked to san francisco and thanks to psychedelics, saw the world in a different light. >> at the center of all of that was this legendary neighborhood. >> in recent weeks, influential news media dedicated hate, lately with stories of rung away youngsters swept up in drugs, sex, but the bulk of the material deals with barefoot people causing a threat to normality. >> at one point, the hate was even home to a psychedelic
1:51 am
bookstore, which kpix covered in 1967. >> one of his first stops is usually the psychedelic book shop. the hub of hate ashbury. >> it is the center of a psychedelic community. >> when it first opened in 1966, it was a place for people to buy and use psychedelics and enjoy art and literature with a trippy theme. fast forward to 60 years later to another psychedelic haven in san francisco. this time, a church that provides people with cannabis, mushrooms, and dmt on the basis of religious freedom. psychedelics are illegal, but they passed a resolution in 2022 making them low priority for law enforcement. the church is called, zye door, it's known as the magic mushroom church. people pay $5 to become a member. the pastor tells us they are getting ready to close over a battle with the city.
1:52 am
you might think that has to do with the substances, but the complaints focus on something else entirely. the pastor spoke with andrea about that. >> this building on howard street is a home of the church of am brosia. it's not your typical place of worship. >> we provide cannabis, mushrooms, and dmt to our members. >> the church has roughly 120,000 members. they come to this location in san francisco or the other in oakland to buy their sacrement. it enlightens his members. >> the point of what we do is to provide access to your soul. our faith is that these tools allow you to access what you truly are, and that's where you can get all the answers you need in life. >> pastor hodges says he is now forced to close the san
1:53 am
francisco location due to run-ins with the planning department. >> we've been going through a lot in san francisco. the planning department has been rough on us. >> pastor hodges says the planning department mandated two structural fixes. one was to replace a sliding glass door on the second floor, which they did. the other was to replace boards that were put up on the windows for security purposes on the ground level. a project that he says would cost a couple thousand dollars. >> if we had the money to spend to make the modifications that they are currently asking for, we have no guarantee they wouldn't find another problem. >> the planning department disputes the pastor's claims that says the property has three open code violations that include electrical and plumbing violations. a complaint from the department also says alterations to the building were made without a permit and without the department's approval. in a statement sent to kpix, planning department chief of staff, dan wrote, we made significant strides to
1:54 am
reduce process and fees for small business of all kinds in san francisco and the church of ambrosia is no exception. we work closely with the church for the last six months to legalese their occupancy and no structural work is required. our staff is currently reviewing architectural plans they submitted last week, so today's closure announcement was surprising. as of now, the church says december 28 will be the last day it will be open for business, but the hope is, to return to the city in the future. the oakland location will remain open. >> over the years, we have seen bay area cities crack down on churches offering cannabis products. in 2019, a native american church in the eastwood shopping center was ordered to shut down over permitting issues. church leaders insisted the first amendment gave them the right to offer cannabis for natural healing. >> we sell cbd products, and we
1:55 am
sell, take for donations, medical cannabis. >> a security guard stands outside and checks your id to see if you can come outside. >> san jose took action against two other churches with lawsuits claiming they were fronts for illegal dispensaries. they had alters, pews, and pictures of jesus inside. both have since closed. paul, a wiseman once told me, don't eat yellow snow. >> that's good advice. >> i thought i would run into it more as a child. i thought it would be a problem in colder places. it's like quick sand, where you assume it's everywhere. >> i grew up into plenty growing up in minnesota. >> i wonder why. in maine, they will need to revise the phrase to do not eat brown snow. >> i think that would also be self-explanatory. >> look, it's a little bit more nuance. a paper mill in the town of humford had mechanical problems and it
1:56 am
caused residual black liquor. residual black liquor is a by-product of the paper making process and it caused brown snow to fall in some parts of the town. initial tests from the state show it is not hazardous, they say, but it is a skin irritant. so, if you saw this and thought, i immediately need to rub this all over my body. >> yes, because who doesn't see a field of freshly fallen snow that is beige. and think, i'd like to be a part of that. >> i assure you, there is someone out there. >> it's a long season in maine if winter goes on and on. it's why every stephen king novel is set in maine. it drives you insane. around here, winter means rainy season and despite the 12 day dry stretch to start the month of december, we'll be seeing rain moving in. technically an 11 day dry
1:57 am
stretch. let's turn on some labels so you know where we're looking. the rain beginning to fall in san francisco. it has been falling for a little while in the north bay. it is continuing to make more and more eastward progress and this is going to move across the entire bay area as we head through the rest of tonight. this is the first of a few different rain chances that will be heading in our direction. let's take a look at the future cast simulation of what the radar is going to look like as we head through the rest of tonight and through tomorrow and into friday as well. we'll track that heaviest rain pushing quickly across the bay area, it will be tapering off by 2:00 or 3:00 in the morning. so that fast movement means our flooding issues are going to be at a minimum with this first band of rain. plus the fact we've been dry for two weeks. that rain exits to the east, still lingering off and on showers as we head through the day on thursday. not a total washout. keep the umbrella handy. it will be a mixed bag of weather and we can't rule out a shower at any point in the day. i think we should get into a dry break as we head through thursday evening and more rain
1:58 am
is likely to develop as we head through late thursday night. future cast over doing the intensity of this first band of showers. showers will be most likely on friday along and north of i-80 before beginning to spread out across more and more of the bay area, just before the sun goes down. this next chance of rain does look like it's going to be a little more substantial. more on that in a moment. adding up tonight and tomorrow's rain on top of what has already fallen. a half an inch to an inch of rain fall. a quarter of inch has already fallen over the past couple of hours. this is a soaking rain event, but not enough to lead to flooding. a few inches around 5 ,000 feet to close to a foot of snow to the south of u.s. 50. they are not done. just like we aren't done with the rain chances. they will have added up to a foot and a half to 3 feet of snow and the snow line will
1:59 am
fluctuate. u.s. 50 and i-80 looking like they will be a mess. travel in that direction is likely going to be pretty hard to do overall. let's add up the rain that will accumulate in the bay area over the course of the next five days. that is the three rain chances headed our way. and again by monday of next week, and the higher end of the spectrum, close to 5 inches of rain. that's the weather prediction center's estimate for santa rosa. 4 inches of rain for san louisiana fell. rafel. close to 5 inches of rain in santa rosa. shouldn't be enough to cause issues. some of the rain -- that's a nice, soaking rain event for spots that have been running a rain fall deficit. let's check out the seven-day forecast. we have a couple dry days at the end of the seven-day forecast. tuesday and wednesday of next week. temperatures for everybody consistent. doesn't matter if you're along the coast, along

the bay, farther inland, we'll be in the upper 50s and low 60s with those every other day rain chances headed our way into early next week. time for a check on sports. >> we have straight ahead in sports, what are the 49ers thinking is the eve of the biggest test yet? we have a stunner in college football, and the warriors, the saying, houston, we have a problem, never seemed more appropriate. what happened? a 15 game win streak vanished in seconds.
2:01 am

2:03 am
well, this game was a good example of things happening, but not the right things. >> i bet you the warriors had a quiet flight home back from houston. just got away from them. just one of those things. decision making, sara, empty possessions, and turnovers that cost the warriors tonight. it's back to the regular season, because well, the early season, nba cup run for them is over. look at this red floor.
2:04 am
wow, after 37 point first half, the warriors won the third. one point lead in the fourth. then they started hitting shots. steph curry, wide open. splash. warriors up 4. under ten to play. jonathan had 20. here's a corner pocket three. 3:37 left, warriors by 7. key moment, did curry shoot it too quick? 9 seconds left on the shot clock. 12 in the game. instead of calling a jump ball and let the players decide the outcome, they gave the rockets two foul shot. look at the reaction. i feel you. warriors didn't get a good look at a shot as time ran out. first rockets win over golden state since february of 2020. 15 straight losses, but 91-90 win for houston. rockets advance to play oklahoma city next round and the warriors play host to klay thompson and the dallas mavericks on sunday. here is coach. >> i wanted to go to las vegas.
2:05 am
we wanted to win this cup and you know, we aren't going because of a loose ball foul 80 feet from the basket with a game on the line. i've never seen anything like it in my life, and that was ridiculous. thank you. >> got to agree with that. nfl and the 49ers, are they favored at home? slightly, but it's a new rams team than the last time. so is cooper, and the 49ers, no trent williams, thursday, isaac, drake, nick all listed as questionable. of those called to step it up, leanard floyd with the pass rush with five sacks in the last four weeks. he had 2 and a half. this current sack leader has to be the next man up now. >> i have to finish the job. you know it's going to be hard
2:06 am
to keep it. >> it is crazy with him being one of the older guys and how many different teams he's been to. he's one of the hardest workers. he loves football. he plays so hard. the numbers come. >> less than three weeks ago, cal quarterback, fernando mendoza won the big game, felt on top of the world. >> we're bowl bound, and we retain. let's go. >> then the business side set in. mendoza will enter the transfer portal, skip next tuesday's l.a. bowl game, even the back up quarterback is hurt. the bears may have to throw in a third stringer. it's a kick in the gut for that program. the bears have north carolina on the schedule next season and bill belichick agreed to run the tar heels as their new head coach. just when you think you've seen everything in sports, we go
