department why a deputy union leader arrested then cleared says the sheriff arrested him as retribution. >> today you are vindicated. ♪ from kpix, this is the late news with sara donchey on cbs news bay area. hi, i'm sara donchey. what happened on 280 in san jose last friday night is simply painful to talk about. a little boy just 6 years old sprinted on to the highway. he was hit by a car near leland avenue, rushed to the hospital but he died. today, that little boy was identified by the santa clara medical examiner. his family said he had special needs and often ran off. tonight, there is a memorial off of the highway to honor his memory. king's family told us he had a caregiver who stepped up to the plate to give him the support he needed the most. she spoke with us tonight. >> reporter: this memorial behind me for 6-year-old king

is just steps away from where he lived. it is where some of his final steps were. but king spent a major part of his life at a nearby daycare which his dad tells me was the only one that would accept him. >> that is him right there with his long hair. >> reporter: he knew king. >> he is just the most loving kid you could think of. >> reporter: she looked after the 6-year-old for the past four years at little league daycare. when he was two years old she was with him five times a week for almost 12 hours a day. once he started going to school, she would take him there, pick him up and bring him back here. >> i have not moved anything. there is, there is his area. this is his backpack from his last day of school on friday. i picked him up from school. packed up -- his stuff is in there, his sweats that got wet because he ran into a puddle.

kid loved puddle. obsessed with water >> it was a wet night this past friday when king was hit and killed while running in the middle of i-280. kings family and friends tell me off camera king was autistic. nonverbal and loved playing outside. especially in water. his family had child locks in their home because king would occasionally try to sneak outside to play. something that solice said he did in school. she believes it was king's way of communicating. as he was still figuring out how to peek to the world through his disability. >> i would get reports from the school every day how many times. child, what can we do? how do we get him not to run away. parents put the locking up on the door. not like you can handcuff the kid, though, you know. not many things for him. my heart was broken. i felt like i lost my own kid. >> king died just a couple weeks before his seventh

birthday. these are not the candles his family was hoping to light in honor of him this holiday season. his parents are also grappling with another reality. trying to figure out how to pay for king's funeral expenses. it has been another wet day after a weekend full of very eventful weather. that caused more than a couple problems. if you are outside at all you felt and heard it. the rain, the winds particularly fierce. it unsurprisingly took down lots of trees and knocked out power in some places. a part of state route 9 is closed after this landslide that happened around redwood road in saratoga. detours in are place. they are expected to open up the road again near wednesday. really big shock on saturday afternoon when a rare tornado hit scotts valley in santa cruz county. before that everyone in san francisco got a

wake up call when a tornado warning went out just before 6:00 a.m. blaring over people's phones led to a lot of confusion, obviously not something that we deal with. paul joins us with more on san francisco's first ever tornado warning. >> reporter: tornado warning in san francisco even though it did not result in a tornado. no tornado warning for scotts valley but they were under a thunderstorm warning and that kind of tornado can spin up and then dissipate within a couple of minutes. essentially between radar scans the storm that prompted the tornado warning for san francisco was a longer lived event. let's talk about the details here about how it all shaped up. there is the weather, the radar scan from 5:52 a.m. a minute after the tornado warning was issued. this area off shore. it is a hook echo in the planes. tornado alley. you would see it on the back left side of the lower left side of a thunderstorm as it is making its way across the landscape. this is embedded within an area of heavy rain. cloud-to-ground lightning strike and turbulence inside of the storm t. is what

is happening inside of the storm. look inside, like an x-ray, using the radar to see the way it is moving. red away from the site in santa cruz mountains, green is towards it. that is the area of rotation that was tracking towards the coast of san francisco. it was a long-lived area of rotation. lasting as it made its way onshore. this is a velocity scan at 6:00 a.m. as it was making its way over the richmond district on the way. it was weaker at that point but present. now, the tornado warning justified based on the signature. the problem is, it was a huge tornado warning. the entire city of san francisco and northern san mateo county under the tornado warning. the only spots need to be under it the north western half of san francisco. everybody else, straight line winds, a thunderstorm warning would be appropriate. another problem was after the storm, rotating part of the storm moved out over the bay, it fallen apart. that is what is left of it

right there. at that point, the national weather service put on twitter that the threat had passed. it is accurate. the tornado warning went until 6:15 and did not cancel it. they allowed it to expire. everybody's phones were blowing up for eight minutes after the threat had gone through. the number of people that were just scared to death by there thing and for how long they were scared unnecessary, even though the tornado warning was warranted given that strong area of rotation making its way towards the western portion of san francisco. tonight, no such drama. just fog. we will talk about that and how much it will last in a couple of minutes. sounds better, paul, thank you. when bob lee was murdered on a san francisco street last year the case led to a serious debate that got national attention about who was to blame for crime in the city. but, pretty soon it became clear that this case was personal. tech consultant nima momeni was charged with his

murder. the trial focused on drug use, and tech culture. now, the jury has reached a verdict. lauren toms will be there for the reading in court tomorrow. >> reporter: sara, just before 4:00 this afternoon we did get word that the jury in the bob lee murder trial has reached a verdict. we do not have any indication of what that verdict may be. it is expected to be read at 9:30 tomorrow morning. this comes after 21 days of intense testimony in seven-days of pain-staking deliberations by this jury to come up with a unanimous verdict. now, he has been charged with murder in the first degree with a knife enhancement, carrying 26 years to life in prison. a judge instructed the jury to consider lesser charges including murder in the second degree and manslaughter. as well as not guilty or an acquittal. now, we are expected to see members of

bob lee's family including his former wife, his brother oliver, his father and possibly his two teenage children. now, we can also expect to see nima momeni's mother, present throughout the trial and throughout jury deliberations right alongside us reporters anxiously awaiting this verdict. now, we could also see and possibly hear from momeni's sister. we have not seen or heard from her since show took the stand many weeks ago where she gave critical testimony that could help guide jurors into whatever verdict they ultimately came to. we did see some text messages not only between her and her brother but also between her and bob lee which she thanked him for handling a situation with her brother hours earlier. in her words, with class. we saw text between them in which she calls

her brother psychoand a lunatic, specifically when he consumed cocaine. and at one point she did tell him that she scares her. now, we do not have any indication of exactly what is going to come down tomorrow morning at 9:30. but i assure you we will be standing by bringing you every update, sara? >> lauren is right, we will have live coverage of the verdict with live reaction and expert analysis tomorrow morning. find all of the coverage of this trial on our website and on the free cbs news app. right now to a new development for a bay area sheriff's department in turmoil. san mateo sheriff has been fighting accusations she abused her power. now they are calling for a civil rights allegation. last month the sheriff announced that the union head had been arrested for time card fraud. but he insisted he was innocent. >> i look forward to the

district attorney's review of this investigation. i am confident i will be vindicated. >> that was back in november. today, that is what happened when the charges were dropped. he told us the deputy should not have been arrested in the first place. >> there was no crime committed here. at all. i am sorry it took our involvement and four weeks later. i wish the wheels had slowed down and had been submitted to us in the normal courts. we would of arrived at this point without an arrest in the middle. >> the deputy says that the arrest was an act of retribution. >> holding back tears and embracing his family, san mathey io deputy mateo embraced his family. >> another attempt at

retaliation from sheriff corpus. >> reporter: the sheriff's office arrested tapia for felony charges of time card fraud, grand theft and obtaining money by false pretenses. his daughter said he was charged for one day before his birthday. >> proud of him standing strong throughout his struggle and continue to fight for his members ruers he is president of the deputy sheriffs that are critical of sheriff corpus. it came after a 400 page report by retired judge. commissioned by county supervisors. concluded using homophobic slurs, harassed and intimidated foes and had a romantic relationship. >> i am calling on you sheriff corpus to resign. you are a sheriff that we can not trust. >> we renew our calls for you

to resign immediately. >> reporter: sheriff corpus issued a statement that reads in part, while the criminal investigation has concluded a separate internal review will take place that is standard protocol when an arrest involves an employee. it will be conducted by a third party investigator to ensure it is a fair process. the da's office says the sheriff's office conducted a warrantless arrest of tapia. >> those that understood the gravity of what that meant. what line was crossed when our sheriff ordered the false arrest of deputy tapia. this is a good man right here. >> mr. tapia. today you are vindicated. >> the da told us he is not making a judgment right now on if the sheriff had probable cause but that will be a focus of a civil suit. a new a.i. model wants to enhance the met averse. how you can make it more life like.

that drone mystery in the skies of new jersey and elsewhere is moving across the country even to our state. now trump is accusing the government of knowing more than they are admitted. they are flying near his golf course. he accused biden administration of a cover up. >> they know where it came from and where it went. for some reason they don't want to comment. i think they will be better off saying what it is. our military knows and our president knows. and for some reason they want to keep people in suspense. >> national security council spokesperson pushed back saying

the sightings are for lawful commercial drones, hobby drones and misidentified stars, even. there is no national security or public safety risk. today, the fbi and new jersey state police warn people not to take matters into their own hands. they are worried people may try to shoot them down and some of the sightings may be small planes. back here in the bay area some, relief tonight for people where power is back on for most neighborhoods. thousands of people there spent three days in the dark after the storm knocked downpour lines. taking a live at the pg&e outage map. there are localized outages sprinkled around. stretching down from the north bay to the south bay. along the coast. in san francisco dealing with trees, toppled down. some residents told us this weekend's storm felt different. >> driving through golden gate park in the rain can be soggy.

do it when it is windy it can be dangerous. saturday's storm brought down huge trees all over the park. jim lives nearby and says he usually avoids the wooded areas here all of which are reaching the end of the natural life spans. >> i will not, i will not walk through here. >> during a storm? >> yeah. i don't want to get clocked. >> reporter: one pine tree fell here tearing a hole in this fence. on the hill over looking the field it looked like a bomb had gone off. giant eucalyptus fell over, their shallow root balls exposed. a number of pines simply snapped off at their base. just across the street another downed tree caught the attention of a man, a city gardener that lived in the richmond district since 1961. >> we have been here for a few big storms. i never seen this many trees, large trees all

down at once like this. i would say lately, the last few years things intensified much higher winds. but, you live out near the ocean. you will get that for sure. 30, 40 mile-an-hour winds not unusual. >> reporter: the storm took out more than just trees. peter says the high winds blew out one of the windows of his 100-year-old house. >> there was a door swinging open and the cats were all upset. it cracked on that way and half of the window fell out. >> just from the force of the wind. >> no trees or anything like that. >> reporter: for most it is done when the rain and wind stops, there are always the unlucky few stuck dealing with the storm's effects for awhile longer. >> you know, we talked about this on friday at 11:00. i have to say the winds with this storm which were straight line winds which is what was responsible for the downed trees rather than a tornado that did not happen in the

city. they were so loud >> yeah. 60, 80 mile-an-hour gusts across the city. that will do damage as a weak tornado and on a widespread basis. power outages now settle into a calmer pattern for the next several days. hope that does not repeat itself any time soon. >> let's take a look at the big picture pattern. the reason for calm weather ahead. a hill of air in the atmosphere. building towards us and nudging it farther to the north through the west of the week. that is a temporary change. we are seeing the rain rolling in. travel this weekend, a lot of folks will travel the weekend before christmas. might be complicated because of the arrival of the next storm system. we will get into details on that in just a moment. looking above the fog. this is the view from sales force tower. >> mixture of 30s and 40s. cool spot in concord and warmer locations in oakland and san francisco. but, the temperatures will not change a lot. only dropping down to the 40s as we head through the rest

of tonight because of the insulating influence of the low cloud cover and fog that is so widespread. in fact, it prompted a dense fog advisory that goes through 9:00 tomorrow morning. it is in effect for essentially all the bay area but for the highest elevations of the oakland hills, mount diablo. it will be a factor for the morning commute. allow for extra time. simulate that on the map. the fog will be remaining. by the time we get to 10:00, 11:00, we will see the fog shrinking. some of the forecast indicates we will not get rid of it entirely until lunchtime tomorrow. putting the breaks on the warm up for awhile. we will warm up. we will end up a few degrees above average. to the middle 60s. 65 degrees in san jose. that is a good half-dozen degrees above normal. around 60 degrees east of oakland hills, around the bay, mix of upper 50s to near 60s along the coast and

temperatures in the north bay. for napa and on up. we will see the next rainmaker headed our way eventually. let's take a look at the daily rain chances and we will keep them at 0 through friday. then, the first system moves in on saturday. the question mark at this point is how much shower activity lingers. sunday will be the drier half of the weekend. does not look like it is entirely dry. i will find an alternative for outdoor plans, flexible with the plans. do not cancel anything yet. another system moves in, lawn going up there, monday night, tuesday, it is christmas eve, looks like another substantial rainmaker will head our way. adding up the rain that falls on saturday, sunday, monday, the weather prediction center estimate is a quarter of an inch and san jose and livermore to an inch to two inches of total rainfall for parts of the north bay. more to come on christmas eve. let's take a
