wildfires as explosive winds return, threatening to turn any spark into another raging inferno. breaking overnight. it is out. the justice department releases the special counsel's report on donald trump's attempts to overturn the 2020 election. and confirmation battle. pete hegseth, trump's controversial pick to lead the pentagon, set to face tough questioning today from the senate as he makes his case for the job. and closing in on a deal. president biden says israel and hamas are on the brink of a cease-fire and hostage release agreement. ♪ ♪ good morning. i'm michael george. well, after a brief reprieve southern california faces two days of dangerous winds that officials fear could expand current fires and even spark new ones, like this one that erupted last night in ventura county, fuelled by the strong winds. right now no homes or buildings are threatened by that fire, but

the national weather service issued an only nis pds warning. that means particularly dangerous situation, because santa ana winds are expected to bring gusts as high as 70 miles per hour. to prepare planes doused homes and hillsides with bright pink fire retardant chemicals while crews and fire engines were placed near vulnerable spots with dry brush. cbs's charlie de mar is on the ground at the site of the palisades fire. charlie, where you are have the winds started to pick up? >> reporter: michael, good morning. the winds still relatively calm here in the pacific palisades, by that pds, that particularly dangerous situation you mentioned, it doesn't go into effect until 4:00 a.m. local time, so about three hours from now. there are concerns if the strong winds return, if the fires erupt that the aircraft, the helicopters and planes that have been so critical in containing this fire, may be grounded. worsening wind conditions through tomorrow now threaten the fight against multiple

southern california fires as new blazes erupt like this one in ventura county. >> we urge the public to stay diligent, to stay ready as the danger has absolutely not passed. >> reporter: on the ground firefighters have been working grueling 24-hour shifts to contain the inferno. >> it can be challenging at times. you don't sleep pretty much the whole 24 hours. >> a lot of our guys won't get too much rest because you still are averaged up. >> reporter: as high winter at times hamper the attack from the start. wyoming national guard lieutenant laura jeffrey, a combat navigator, is one of many who came for a different kind of fight. >> we are leaving our families, we are leaving behind everything to come out and do the humanitarian effort for this. >> reporter: thousands of homes and businesses have been destroyed by the fires over the past few days with the search now underway for the missing and for answers. these are just a few of those who have died in the fires. the family of 86-year-old mil

freedley is holding out hope she will be found after the fire burned her home to the ground. >> we have seen a lot of ash but no person. >> reporter: meanwhile, lawsuits have been filed against the local utility company as investigators work to see if it played a role in the eaton fire. with 15,000 firefighters now on the ground here in southern california, fire officials do feel confident that they will be able to respond if the fires do reignite. michael. >> charlie de mar reporting from the palisades fire. thank you. we are also learning new details in the investigation into what may have sparked the palisades fire. cbs's jonathan vigliotti has that story. >> reporter: as the palisades fire roared back to life this weekend there's renewed focus on what may have caused the massive blaze that has destroyed thousands of structure. cbs news has obtained video of this eight-acre blaze on new

year's eve. it is in the same area where the palisades fire later ignited. firefighters noted the connection. >> the foot of the fire started real close to where the last fire was on new year's eve. >> reporter: officials said they've not ruled out whether embers from the new year's eve sparked back up. in the first hour of the palisades fire we reported near the same location. we found the scene surrounded by police tape. it has happened before. the maui fire that destroyed lahaina was sparked by a wildfire declared out six hours earlier. this fire, the most destructive in colorado history, began when a small fire reignited after six days. 1,000 structures were destroyed. now with potentially destructive winds starting again, l.a. officials are warning residents be prepared to leave immediately. but the city has not issued any new guidelines, even after last week's chaotic evacuations. >> ahead of this latest event you have businesses that are proactively closing, essentially treating this event like it was

a hurricane or a blizzard. if they are taking those steps, why are you not implementing broader closures right now to keep your constituents safe? >> we are doing everything we can to keep angelenos safe. if there is a need for closures, that will be done, but right now we are in preparation. >> reporter: that preparation includes a massive influx of boots on the ground. more than 15,000 firefighters are now in place, compared to fewer than 1,500 when the fire started. >> all fire departments and all law enforcement agencies in the area will be prepared. >> reporter: and that preparation has already paid off with an all-out aerial assault over the weekend of water and flame retardant. we saw only one home burn but so many others were saved. john vigliotti, cbs news, los angeles. turning to the middle east where a cease-fire and hostage deal could be announced within the next day. senior israeli officials tell cbs news they've agreed to a

six-week truce. hamas would release 33 israeli hostages and israel will release palestinian prisoners. the israeli military would establish a buffer zone in southern gaza for security purposes. hamas leadership has yet to sign off on the deal. secretary of state antony blinken is expected to layout a plan for rebuilding and governing gaza after the war later this morning. breaking overnight. the justice department released a long-awaited report by special counsel jack smith on the investigation into donald trump's efforts to overturn the 2020 election. meanwhile today, the first confirmation hearing will be held for the president-elect's cabinet picks starting with pete hegseth, the controversial choice to lead the department of defense. cbs's jarred hill joins us how with all of the details, jarred, do we know if hegseth has the votes to get confirmed. >> reporter: you know, michael, it is not a geren an tee. hegseth is likely to be grilled not only on the personal

allegations against him but also on his qualifications. all the while his could-be becboss is responding to the report claiming that trump tried to use the power of the presidency to overturn the 2020 election. overnight the department of justice released a report on the federal investigation into president-elect donald trump with special counsel jack smith writing, if it wasn't for trump's imminent return to the presidency there was enough evidence to obtain and sustain a conviction at trial. the report, a final record of the doj investigation into whether trump illegally tried to overturn the results of the 2020 election. the federal government abandoned the case because of a doj rule not allowing the prosecution of a sitting president. trump on social media maintained his innocence and called smith deranged, writing, "he was unable to successfully prosecute him so he ends up writing yet another report." this comes as today trump's choice for secretary of defense will be the first cabinet pick up for a senate confirmation

hearing. monday pete hegseth, an army veteran and former fox news host, got the support of republican alabama senator tommie tuberville. >> i'm 110% behind pete hegseth. >> reporter: but senate democrats have raised concerns. >> there has never been a nominee for an office of such serious consequence who is so unqualified and unprepared in recent american history. >> reporter: hegseth is facing allegations of alcohol abuse, sexual misconduct with a woman in 2017, and mismanagement of funds for two veterans organizations from which he was let go. hegseth has denied all accusations including any claims of sexual misconduct. >> the matter was fully investigated and i was completely cleared. >> reporter: while hegseth can be confirmed without democratic votes, republicans only hold a slim majority. republican senator ernst will be one to watch. she is a combat veteran, a survivor of assault and has not
