this is cbs news mornings. legal challenges. a judge pauses president trump's federal worker buyout as the trump administration heads to court over birthright citizenship. black hawk recovered. new information from the wreckage of last week's midair collision. authorities offering new clues into what could have caused the crash that killed 67 people. and super bowl lix. football fans are heading down to the big easy for the nation's biggest sports weekend. we'e going to take you to new orleans to show you how they're rolling out the welcome wagon. good morning. i'm michael george. president trump is now facing legal challenges in multiple arenas nearly three weeks into his second term. it comes as federal workers now have a few more days to decide whether to take the trump administration's buyout offer. cbs' naomi ruchim joins us now with more. naomi, good morning. this buyout wasn't approved by congress, so unions are worried even workers who take the deal may never get paid.

>> reporter: right, michael, good morning. and the group of four unions representing more than 800,000 federal employees is now suing the office of personnel management saying the offer violates federal law. union leadership claims if employees are forced out, the country will suffer a one-two punch. first, losing long-time expertise, and second, vacant positions will be open to political influence. federal civilian workers now have until monday night to decide if they want to step down under president donald trump's deferred resignation offer. a federal judge in boston temporarily halted the program as he also considers a legal challenge from unions. >> the judge is saying let's pause until i hear more. >> reporter: the white house press secretary says tens of thousands of federal employees have already accepted the offer of full pay and benefits through september 30th. >> we encourage federal workers in this city to accept the very

generous offer. >> reporter: union leaders and democrats in congress are warning them not to take the buyout. >> beware of this offer. i don't believe it's been funded. >> reporter: overnight the trump administration appealed a washington state federal judge's ruling that temporarily blocked his executive order to end birthright citizenship. >> this was not meant for the whole world to come and file on the united states of america. >> reporter: that filing came hours after another federal judge in maryland also ruled against the president's order. >> we do not have a king. we have a president who must abide by the laws. >> reporter: meanwhile, cbs news has learned that new york attorney general letitia james and several other attorneys general will challenge elon musk's department of government efficiency over its access to sensitive systems and data. one more legal challenge breaking overnight, two labor unions are suing over the trump

administration and the dismantling of the u.s. agency for international development or usaid. sources tell cbs news there are plans to slash the number of employees there from thousands to less than 300. michael? >> all right, naomi ruchim, thanks. the president is also targeting thousands of fbi agents and other bureau employees for possible firings. now, that includes those who were involved in the investigation of the january 6th riot at the capitol. a judge blocked the justice department from releasing a list of their names. scott macfarlane spoke with an agent on that list who says the bureau is in turmoil for protecting the agents' identity. >> reporter: the largest criminal investigation in fbi history has given way to potentially its largest crisis. do you think this is a distraction? >> absolutely. personally i've lost sleepover this.

>> reporter: this agent who helped arrest january 6th rioters fears retaliation from new leadership of the justice department for speaking with cbs news. >> we just have a lot of unknowns, and it feels like no one has our backs. >> reporter: trump allies at the justice department ordered the fbi to send a questionnaire nationwide to identify the personnel who investigated january 6th and make a list for leadership to review. the agent is one of approximately 5,000 names on that list. what was it like filling out that questionnaire? saying what you did and when you did it? >> it was demoralizing. we all feel defeated. and really for nothing but just -- >> reporter: the scrutiny and storm cloud hovering over fbi employees over their work on cases that yielded more than 1,000 guilty pleas and a 100% conviction rate in jury trials sends a chilling message, the agent warns. >> moving forward do we pick and

choose? do we have to pick and choose what we feel comfortable based off -- >> reporter: do you think this might scare people off in the future? >> absolutely. we're all humans. >> reporter: agents who signed court documents worry of retaliation from riot defendants. >> keep the fight. fight, fight, fight. >> reporter: or their sympathizers. >> it's almost as if these defendants that were all pardoned have been put on a pedestal of being more patriotic and more loyal to this country than the men and women who go out every single day away from their families and put their lives on the line. >> reporter: what do you make of that? >> i'm really at a loss for words. it hurts to say that. it hurts. >> reporter: a justice department official in a letter to the fbi earlier this week said agents who were simply following out their orders or

c carried out their duties in an ethical manner will not be subject to disciplinary issues, but the agents and their attorneys say they're not convinced. scott macfarlane, cbs news. president trump is clarifying his plans for his proposed u.s. takeover of the gaza strip. in a post on truth social he said israel would turn the land over to the u.s. after the fighting ends and that no u.s. troops would be needed there. trump added that palestinians would be, quote, resettled in far safer and more beautiful communities with new and modern homes in the region. but the post didn't explain if the 2 million palestinians living in gaza would be allowed to return there. and hamas is expected to release three more israeli hostages tomorrow as part of the cease-fire agreement that also calls for israel to release more palestinian prisoners. the names of the three hostages are expected ■to be madeknown today. several new developments after last week's midair collision between an american airlines plane and a military chopper near washington, d.c. that killed 67 people.

crews pulled the wreckage of the army black hawk helicopter from the potomac river yesterday. ntsb officials say preliminary information indicates the chopper pilots were likely wearing night vision goggles before the collision. after a briefing by the ntsb and faa senator ted cruz said a key automatic safety system onboard the helicopter was turned off, and sources tell cbs news faa officials considered closing a runway at reagan national airport after two close calls last summer, but it was ultimately left open. southern california edison says it's investigating whether it may have played a role in causing the deadly wildfires in los angeles last month. the utility told state regulators its equipments may have sparked the hurst fire, which burned nearly 800 acres and damaged two homes but didn't cause any deaths. but it's also said it's investigating whether an idle transmission tower may have sparked the eaton fire, which killed at least 17 people.

sentencing in a baseball gambling scandal and a prayer service turns violent. those are some of the headlines on "the morning newsstand." the spokesman review says a priest was attacked during a service at a catholic church in spokane. video shows a man sitting in a pew before rushing the alter and appearing to throw a punch at father david gains on tuesday. the priest was on his knees in prayer at the time. he was able to get on his feet before the attack. there was a struggle as others came to the priest's rescue. he was not hurt. police arrested the suspect, joshua sommers. espn says the former interpreter for shohei ohtani was sentenced to nearly five years in prison for stealing from the famous baseball star. ippei mizuhara was also ordered to repay nearly $17 million that he stole from ohtani's bank account to pay off gambling debts. he'll also have to pay more than a million dollars to the irs. mizuhara earlier pleaded guilty to bank and tax fraud charges. and the associated press says scientists used a.i. to
