>> one of the three phoenix police officers targeted by an out of control driver outside a phoenix q.t. store early yesterday morning has been released from the hospital. but is still recovering from a concussion. after being thrown in the air after being hit by the car. it's still not clear what even motivated the suspect. 44-year-old marc laquon payne. we're live outside the q.t. with the developing story. >> reporter: that q.t. store has reopened for business. you can actually see the boards that cover the windows that were smashed when one of the officers was tossed several feet into the air and hit that glass. the suspect, marc laquon payne, sits in jail tonight without a bond. hanging his head and barely able to stand, 44-year-old marc laquon payne made his first appearance before a judge, facing several charges after he was caught on camera, slamming his car into three phoenix police officers. >> i need for you to please

>> marcrc payne. >> reporter: he appeared wobbly and did not speak during the rest of his appearance but had to be asked a second time to stand up. more details about payne, who ishomeless and was intoxicated at the time of the event. police are still investigating a motive. according to the documents after the collision, payne began fighting one of the officers, knocki back. that officer was unable to subdue payne with his taser but a second officer was able to deploy his taser and payne can be seen dropping to the ground. he faces a long list of charges including attempted murder, aggravated assault and resisting arrest. >> i am going to order that you be held without bail in this matter. >> reporter: and payne's nextcourt appearance is on tuesday. we're live in phoenix, 12 news. >> thank you, charlie.

5:00. the lawyers for leslie merit, jr., filed a lawsuit against the state of arizona and maricopa county. they claim their client was wrongfully accused in the i-10 shootings investigation. merritt was held in jail for several months until charges were formally dismissed against him in april. arizona dps says it still considers merritt a suspect in their investigation. a 1-year-old boy is rushed to the hospital after falling into a backyard pool at a ho this all happening in a neighborhood near gilbert road and hunt highway. according to fire investigators, that child was breathing and alert after the accident. they believe the little boy was able to get into the backyard through a doggy door and then into the pool area. a worker injured after falling 20 feet from a ladder at an industrial building near 16th street and university here in phoenix. this video from phoenix fire and rescue crews shows how they

then bring him to safety using a backboard. it's still unclear just how severe his injuries are. phoenix police have arrested a valley pastor and now he is facing charges of child molestation. investigators say he led a small congregation here in the val valley. >> we're live at the church where he worked near 27th avenue and indian school. >> reporter: the crimes are too graphic to even talk about. in my detailing his crimes against at least five children that went to this church. pastors are supposed to be the good guys, people you can trust. the 49-year-old pastor jose morales apparently lived a double life. he's accused of impregnating a 13-year-old girl and marrying a 10-year-old girl in mexico. >> he played on his spiritual position to accomplish that,

disgusting. >> reporter: morales' church was closed when i stopped by and they didn't return my calls. don seltzer, a volunteer says he hears stories like this all the time. >> using your place of authority overwhelm the child with their own intelligence and power and spirituality. >> reporter: court documents indicate it took the first victim years after the incident to come forward. she told her mother she was cutting herself as sexual abuse when she was just 12. the reports shows at least 5 victims, one of them police say morales married at 10 and impregnated at 13 or 14 years old. >> they're a victim. they are not guilty, but they feel the guilt anyway. they feel the shame and the guilt. >> reporter: the crimes are too graphic to mention. even more disturbing, morales admits he's relate to some of

dance step has changed a little. >> back in august she woke up and started complaining that she had pain in her legs. >> reporter: at first doctors told the parents that she was just experiencing some growing pains. but when the pain wouldn't stop, doctors decided to do a biopsy. >> about 24 hours later, they came in and said she had cancer. >> reporter: avery was diagnosed with ewing sarcoma, a rare form of bone >> they said i was going to lose my hair, get my leg cut off. >> reporter: she endured six rounds of chemo, but in the end, doctors found the tumor in her leg had died, but avery still faced the possibility of amputation. >> that's why she was in a wheelchair. she wasn't allowed to walk because after big hole in her leg. they were afraid it would break. >> reporter: even that wouldn't

>> dancing and stuff, and when i couldn't walk, i hopped on my leg. >> reporter: doctors came up with an ingenious fix. they removed her tibia and replaced it with an arm bone from an adult cadaver. >> they did an arm bone in my leg and so arm/leg, so i put it together. >> reporter: avery is now in remission. >> i just want people to know it's not going away, and if people aren't willing to talk about it, we're not going to get funding for it. >> reporter: gold is the color of pediatric cancer awareness. seems only fitting for this golden girl. >> the adults, they get all of the money, and when they get all of the money, they get to live. and when the kids don't get the money and they don't live, then they don't get to grow up. it's not that fair.

florida's east coast, pretty rare. julia responsible for snapping trees and power lines and spawning tornadoes. let's give you a look at what's going on right now with this particular storm system. we'll widen it out so you can see a big shot of the united states. take a look at all of that green there off the east coast of georgia and south carolina. we have tropical storm warnings that are in effect there mainly off the coastline. that's kind of where we're anticipating the strongest then most of the rainfall happens to be also for the most part off the coast. you can see charleston there getting hit with pretty heavy rainfall. again for the most part which is good, a lot of this really heavy stuff is out over open water. so that's going to be the trend. the storm will continue to track to the north and to the east again with most of the moisture staying out over open water. but there is still going to be that threat there along

coastal areas of south carolina, as well as georgia. the potential we could see tornadoes and very gusty winds. meanwhile back in phoenix, it was a great day. 98 degrees. we were below normal this time of year. today's record is 112. that happened in 2000. 76, that was our low this morning. not bad, a little cooler than we should be this time of year. it should be pretty comfortable out there the rest of the evening. we'll be in the 90s for the most part. we'll transition into the 80s as we head closer to hour. tonight, 64 to 73. cooler than average overnight lows. that is all thanks to the low pressure system passing to the north of us right now. it's not doing much other than the fact that it's cooling us down. 90 to 95 tomorrow. that too will be below average. lots of sunshine and winds coming out of the southwest at 5 to 10 miles per hour. here's a look at the rest of the state. we'll dip into the 30s around flagstaff, grand canyon, chilly, tomorrow a great day. 84, plenty of sunshine there.
