prosecutors said they'd file charges against the maricopa county sheriff because he ignored orders to stop immigration patrols. >> all of this comes with four weeks to go until election day. team 12 was in the courtroom today. brand joins us live from the courtroom with the story. >> reporter: one of the biggest surprises is federal prosecutors filing charges so close to an election. a former federal prosecutor tells me that's protesters outside the federal courthouse. and from prosecutors inside. it's unusual in any case, but especially in an election year to go full boor all in like this. >> 28 days before voters decide whether or not to give him a seventh term in office, u.s. justice department attorneys told federal judge susan they're investigating him for

good case. >> he will also be charged as soon as this week with criminal contempt. the new legal action stemming from a federal judge's august ruling that the sheriff intentionally ignored court orders to end racial profiling of latinos. attorney and immigration rights activist daniel said a defeat in november would not make the charges disappear. >> they would not go away. there's no way to settle out having committed a crime or contempt just simply because you the sheriff behind bars for six months but the former prosecutor says, i think it's unlikely if convicted he'd get any time. >> that's leading critics to accuse the obama administration of going easy on a sheriff they clashed with for years. >> the government of the united states is protecting him for political reasons. >> paul, the democratic challenger said in a prepared statement, no one is above the

party. he won the nomination fair and square. and so i believe that i had to withdraw my support just as i can not support hillary clinton. mccain later doubled down when asked who he'd vote for saying he'd write in his old friend lindsay graham. trump took to twitter to respond saying the very foul mouthed senator mccain begged for my support during his primary, i gave him, then drop me over locker room remarks. disloyal republicans are far more difficult than crooked hillary, they come at you from all sides. they don't know how to win. i will teach them. meanwhile clinton campaigned with al gore tweeting about climate change saying it's real and urgent and america can take the lead in the world addressing it. clinton tweeted we've always had destructive hurricanes but hurricane matthew was likely more destructive because of

all around arizona tonight, outdoor enthusiasts, listen up, if you've lived here for a while, maybe you've taken one of those jeep tours in sedona or perhaps you've heard about them, changes are in store for one of the popular off roading trails up there. and the new rule is sparking controversy among the red rocks. ryan cody has the story. >> it should be open to everybody or closed to everybody. hi potentially hazardous conditions, it will be regulatelated by the national forest service. >> something had to be done. that's not in dispute. the issue is with the proposed solution. the new rule would prohibit all four wheel vehicle access to the trail except for one commercial jeep company. >> we're not creating a monopoly because those people and companies have been operating there for many years.

>> it's choosing one kind of people over another kind of people for use on public land and that's unprecedented. and i really don't think the forest service should be in the business of doing that. the company has been driving tourists around that area since 1989. the forest service says the decision to allow them to continue to tour that trail wasn't part of this process. >> those decisions as far as who would take soldier's pass, those were made over 20 years ago. we're just continuing with the c with it and had a good track record. >> for now, the people who frequent that area of town, this new law would do something terrible. >> the precedent will be created. and it will not be very long at all until other people want to exploit that precedent and do similar things. >> well, anybody who commented initially in the public comment period back in april will also be able to comment for the remainder of the month of october.

imminent. residents have been evacuated because of the potential threat of a dam failure. and luckily if you look at the satellite radar, as those folks try to clean up and recover from all of that damage, the weather's pretty nice. we're seeing clear sky conditions along the southeast coast, but just off the coast luming is another hurricane. this is hurricane nicole now a category 1 hurricane. winds are at 85 miles per hour. and the storm is nearly stationery. but eventually it will make its push to the north and then to the he bahamas as a category two hurricane with winds up to 110 miles per hour. and after that eventually weakening and pushing out to sea there. not a concern for the southeast coast. meanwhile back here in arizona, it was a toasty day in phoenix. we hit a high that was 6 degrees above average for this time of the year. today's record high temperature at 102. tonight we're going to recover nicely. those over night lows dipping. 61 to 68 degrees. we'll see clear skies out there.

10. the sun is back up at 6:30 in the morning. and we'll have another warm day. 90 to 95 putting us above normal. nice and sunny. the winds should be light from the southwest between 5 to 10 miles per hour. the western u.s. looking pretty good in our main weather feature right now is a dry westerly flow. so that dry air coming in from the west, typically leaves us nice and sunny, and over all just really nice weather conditions. however, the pacific is pretty active. we've got a number of areas of low pressure that will be pacific northwest. but as of now, it looks like those storms are going to stay well north of arizona and our weather pattern stays pretty dry for the next seven days. tonight across arizona, 33 in flag staff. 44 in prescott. tomorrow, payson, topping at 77. 72 at the grand canyon. still warm out toward lake havasu city with a high of 94. and tucson at 93 degrees. our 90s will stay strong pretty much all the way through the weekend. not much change.

in this game. he left another 100-yards out there. and that same pass route that he screwed up in the red zone. he did it again. but i'm changing the name of that play so he can't screw it up any more. >> yeah, bruce aryans has often used the media to call out his players in the sound bite you just heard, he was criticizing david johnson after his league best 157-yard rushing day and two touchdown performance he's also been very critical of campbell. he had his best game of the year last thursday against the 49ers. posting two sacks, one safety, and one interception. he was both disruptive and dominating. aryans looks to push his players buttons through the media. he's looking to get their max level of play. even when a player plays well in the case of david johnson. he doesn't want that player to get satisfied. instead you find him prodding players like johnson to push harder and give even more.
