>> reporter: police documents reveal he had three prior contacts with her before the shooting. encounters he says he doesn't recall. >> i am sorry. i don't remember her. >> reporter: further questions focused on a bag found inside the patrol vehicle at the time that held unauthorized and unsecured weapons. guns a sergeant cleared him to use but that sergeant couldn't provide documentation of the approval. >> i felt that i was in policy on everything else. >> reporter: it is important to note the role of the police department in this investigation. they say they are focus is to get more facts and information surrounding this incidentb and the allegations --ind and the allegation -- incident can the allegations. he did decide to resign.

>> all right. thank you. the former suspect in the freeway shootings case is trying to get his gun back. this time he has new ammunition. a second expert agrees that his weapon cannot be linked to the shootings. team 12 has more on why we have not heard about the second expert till now. >> reporter: yeah. the report is attached to a new court filing by his attorneys seeking to get his the case fell apart after the expert couldn't match bullets to his weapon. the attorneys say the second expert should be a death blow to the case. >> reporter: he was the only suspect in the freeway shootings that terrorized the shootings in the summer of 2015. after his arrest the department of public safety said bullets

traced to his pistol butthexpert concluded they could not be linked to the gun and last april a judge dismissed the charges and then in august the judge rejected his request to get his gun back. they said the investigation was still active but now there is a second report backing up the first expert and concludes the bullets can't be linked to his gun. his attorneys say the findings are the nails in the investigation. the attorney said wednesday the second expert's report was nothing new. >> we paid for this report. it was requested as a review, we were aware of it. it is nothing monumental. >> reporter: he was jailed for 7 months before the charges were dropped. he is suing for their alleged
