10:06 pm
mary lacey exonerated the ramseys and started a search for a single killer based on her faulty interpretation of actual science. now others are left trying to figure out what's next. understanding the dna evidence in the murder of jonbenet ramsey means understanding this. everywhere we go we leave little bits of ourselves. >> really talking for 15 to 30 seconds is enough to ec front of you. >> reporter: that reality challenges one of the central tenets of the dna evidence in the jonbenet ramsey case. one made public when former district attorney mary lacey exonerated the ramsey family in 2008. saying there's no innocent explanation for genetic material found on the girls underwear and longjohns. >> my guess is that if we took your shirt and did some dna testing on it at the level of sensitivity in this case we
10:07 pm
well. >> reporter: the exoneration letter said she concluded foreign dna on jonbenet's clothing could not have gotten there inadvertently. something our experts say is just not true. they say there are plenty of reasons the dna on jonbenet's clothing could be innocent. reasons that have nothing to do with murder. >> you shed 40,000 cells per hour. you are leaving your dna everywhere. wherever you go physically. leaving it discounted that possibility when she issued her letter examined dating the ramseys and concluded the dna must be the killer's. >> that was a leap to claim that there couldn't be an innocent explanation for what was found. >> reporter: how did lacey's conclusion differ so much? lacey was long known to support the theory that an intruder not a family member killed jonbenet. something our experts believe could have led her to succumb
10:08 pm
we like to see puzzle pieces fitted together. >> reporter: confirmation bias can invest -- how an investigator interprets evidence. >> we believe data which confirmed the hypothesis and think of explanations to refute data which do not support your hypothesis. >> reporter: case in point, these never before seen e-mails . they show after preliminary tests found the presence of unknown male dna on jonbenet's longjohns, an investigator in lacey'sff bosses didn't see the need for additional testing. >> sounds like they get a result they were looking for and decided to to quit while they were head. >> reporter: the lab i provided her with a report showing the unknown dna was likely part of a master of genetic material from more than two people. but that was never before made public until now. she issued her exoneration in spite of the confusing dna results. exoneration the family still
10:09 pm
just last month ramsey lawyer lynnwood used the exoneration to challenge news reports suggesting it could be a family member who killed jonbenet. in a tweet would said in 2008 boulder d.a. publicly exonerated them in an apology. dna evidence conclusive end of story. and another tweet he said, this is a dna case. plain and simple. >> no it is not. it's clearly not. we have a question profile that is very small. profile is extremely complex. the one thing this case is not, it is not a dna case pure and simple. >> the problem with the ramsey case is not that we don't have enough opinions. >> reporter: stan garnett stopped short calling on new testing of the dna but our experts say if he did scientists could isolate out
10:10 pm
what the dna might mean in this case. >> not going to say what we're going to do. what i will tell you and assure the public is any reasonable effort that can be done to evaluate the evidence and evaluate whether charges can be filed is being done by my office with the boulder police and will be in the future. this case has had so much interest, so much intrigue over the past 20 years. everyone seems to have an opinion and tonight we want yours. do you think that jonbenet case will ever go to 12news.com/your voice right now. take part in our live interactive pole. the final results minutes away here on 12 news at 10:00. tried to kiss me and then i pushed him away. tried to kiss me again. he asked me when my contract was up and then tried to kiss me for the third time. fox news anchors megyn kelly and gretchen carlson both opening up this week about
