courthouse. we wanted to assure the public that we've already begun preparations. ♪ >> welcome to "the context." good to have you with us. the former u.s. president is in miami where he will appear in court on tuesday to face federal criminal charges. this is his plane, which you can see has just landed in miami within the last few minutes. he is of course accused of hoarding secret documents after he left office and obstructing officials who tried to recover them. that is his plane. just landed in miami a few minutes ago. this is an extra ordinary event. it will be the former president's second courtroom appearance as a criminal defendant. you might remember his

arraignment in ril in a new york courthouse on state charges that he falsified business records. this is a different case. the authorities in miami, we have been hearing from them. they are bracing for possible protes by both supporters and opponents of mr. trump. we can see there his security detail waiting for him to get off that plane. of course, it is not yet clear which judge will be overseen this hearing tomorrow -- overseeing this hearing tomorrow, tuesday. but the judge has been assigned to judge aileen cannon, who is an appointee of mr. trump. he appointed her back in 2020. this of course, the scene we are looking at is the scene at the airport in miami where president

has just arrived ahead of his appearance in court tomorrow. we've got our correspondent with us. this is an extra ordinary scene, but this is the usual procedure in a case like this. reporter: yes. this is his second indictment. the second will not have the drum of the first one. but this is so different to what happened in new york back in april. he is a federal -- these are federal charges that he is facing. this is not a case of him breaking a few state laws, campaign financing. this is the united states of america saying that its former commander-in-chief should go in trial for allegedly jeopardizing national security. that is huge. not just the former commander in chief but a man that wants to be

president again, that is the front runner for the republican party's nomination. here outside the rest, this is where donald trump is expected to come after he leaves the airport. his diehard supporters are here. that would be something that will please him. these are the supporters who stand by him and believe in the narrative he has spun. which is that this iictment and the one before and the other cases against him is part of a big political witchhunt. he believes that president biden is weaponizing the department of justice in order to go after him and stop him from becoming the president in 2024. all of it is baseless and unsubstantiated but about the -- but it does not stop people here from believing that. he is set to arrive at the resort sometime this afternoon. he will be greeted by lots of supporters but of course lots of media as well. >> yes. soon we will see him walking down the steps and into his car. upon his arrival there in miami,

what do we expect them to be doing ahead of that appearance tomorrow? presumably, he might be meeting with legal counsel after two of his attorneys resigned on the day of his indictment. reporter: yeah. he will be getting together his legal team and preparing for that court appearance tomorrow at 3 p.m. it is worth mentioning that florida is really used to high-profile court cases. i have taken elected officials, former officials, former dignitaries, drug dealers, all kinds to court in florida, but nothing can quite prepare a state to go after a former president. not just any president either. this is donald trump. he is very popular here in florida. it is his adopted home state. he won it in the last few presidential elections. the reason why prosecutors want

to have the case here in florida is because they want him to face a jury in the place where the alleged crime took place. his mar-a-lago resort. where he lives, his main residency is about two hours -- is about a two hours' drive from here. will that be possible to have an impartl jury? there is not one person in the state that does not have an opinion on donald trump. i spoke to a former federal prosecutor. he said the jury having opinions is a good thing. you trust they will go off the evidence alone when presented with it. by the department of justice but forward in airtight case. a two-year investigation in which they have unveiled these accounts. 37 charges against donald trump. one against his aide. they will hope toave a speedy trial. let us what the -- that is what the special prosecutor wants. the trial might extend into

the election campaign season and even beyond the election next year. >> stick around for us. i just want to bring in professor craig green from temple law school in philadelphia. thanks for joining us. we are just anticipating president trump coming down the steps of that plane we are watching no. -- watching now. let's get a better understanding of what lies ahead for him tomorrow. can you help explain the context of this procedure, what will happen on tuesday and how it fits into the timeline for this case? >> sure, there's a technical side and a broader side. the technical side will resemble somewhat what happened in new york. to the most extent possible, mr. trump will be treated like a relatively ordinary high-profile defendant. he will be coming to face the charges of the indictment which has been publicly and sealed. formally presented to him.

he will almost certainly at that time plead not guilty. he will probably have fingerprints taken. he may or may not have a photograph taken. the only detail is the secret service, who was there to provide protection for him but not to protect them from the law, they will coordinate with court staff, as they coordinated with court staff in new york, and things will go accordingly. soon afterward, they will set a schedule for trial and for discovery. which i think could actually be quite a long time, given the nature of the documents in this case. the secret documents will require special care in being handled and there may be various lawyers. it is a verybad season for trial. he's been indicted twice but he also faces a civil jury verdict of $5 million against him in a sexual assault defamation case. i think this is absolutely unprecedented. it's always unprecedented. >> sorry to jump in. just to say for our viewers that that is president trump --

former president trump that we can now see coming down the steps of his plane. to continue with that thought, craig. >> absolutely. these visuals of seeing him come out of a plane -- he's a former official. an aspirional future official. but the fact is, no one like this, no one facing these kinds of indictments and charges and criminal liability potential -- nor even the civil liability that's always been rendered against him. this is not something that presidential candidates in the past have had or future presidential candidates have had either. i think this is really a next ordinary test -- an extraordinary test in. his strategy as it has been in many occasions is to attack the basic institutions. the new york ■courts areinfo him. the juries are in for him. the special counsel is in for him. i think this is -- the election monitors were in

for him. i think this is a very dangerous and damaging thing for such a prominent political figure, aspiring to be the leader of a country -- of the country to routinely go around at attack institutions whenever they happen to disagree with him. we have already seen for this case, that is the main strategy of trump and his team, to attack the institutions as some version of what about ism. this is a very dangerous tactic in american politics for someone who is currently the front runner and before long will seem like a prohibitive republican nominee. >> we are just watching his car pull away now from the airport. there are supporters of his of course awaiting his arrival in miami. a testament to what a huge prominent political figure he still is. as you pointed out, never before has a former u.s. president been charged with a crime, let alone one seeking to become president again. what sorts of judicial stress

testings are being thrown out by this indictment? >> this indictment is so much more serious nationally than the other because it involves secret documents and the mishandling of secret documents. there's is also an irony here. when trump was running for office, he was very critical of hillary clinton's handling of classified information. screaming things like "lock her up," would of course there was no indictment or special prosecutor -- none of these things. now when the tables have turned and there's been a special prosecutor and searches of his resident with photographs showing how the documents were mishandled and so forth, now i think he has really turned the tables on the court system as well, there will be arguments that this is not something he should have to face. . i'm not sure what they -- i'm not sure that they want to

rush the case and before the election or put it off until after the election. that will be a really important issue to keep an eye on. >> one of the challenges here for the judiciary is the treatment of donald trump is not only fair but is seen to be fair. perception is important. that's really difficult in such a polarized political environment. >> absolutely. i think american politics is not uniquely but american politics is a little bit challenged on truth making. the institutions providing basic facts are challenged in various regards. one of the favorite arguments is, everyone mishandled documents, perhaps even hillary clinton, mike pence, joe biden -- but as important for everyone to understand no one has done what trump allegedly did. no one has hidden boxes from eir lawyer for example. so their lawyer could tell the fbi there are no documents. no one is engaged in that kind of obstruction and false statements

in order to hide. there are these vignettes where trump was allegedly presenting some of these documents to political operaves or visitors at mar-a-lago and saying, look at this, is this not an amazing document? can you believe it? i should've declassified it when i was president. no one else is alleged to have done this sort of stuff. it is very important. it'll be a real test for the judicial system and for american truth making. an extraordinary judicial system dealing with the next ordinary case. we have not heard anything from the defense yet. it's not the proper time for that. but letting the judicial process move forward and not getting distracted by sort of what about ism. this really distorts and mistates the seriousness of

these allegations. the seriousness of attention with which i hope people will pay attention, as thingmove forward. >> craig, to stay with us. i want to bring in our correspondent if you are still with us. craig is talking about american truth making. but of course that involves the public and what the public think. our people responding to this indictment so far -- how are people responding to this indictment so far? >> obviously there are more donald trump supporters here than anybody else. there are a few with signs saying "lock him up." just a while ago, there was an altercation with the police. generally, florida is a republican leaning state. donald trump won it the last two presidential ections. our team has been here talking to people in different neighborhoods.

55% of them according to polls voted for him in 2020. we spent some time in little havana. a cuban-american neighborhood. there was kind of a mixed bag of opinions. one man said he was 50-50 abou it. he said i love trump, but i also hate him. i like the fact that he's a businessman but i don't like it when he speaks. if he's done anything wrong, he believes the justice system, he believes america will give them a fair trial and he will be held to account if he has done something wrong. another man said to me that donald trump was a gift from god. he said to me that he is moses. it is easy to be incredulous at that thought of opinion -- thought or opinion but there are people with deep religious beliefs and they absolutely have this strong conviction about donald trump. can there be an impartial jury of this goes to trial? if they have to decide his fate?

the department of justice -- it only takes one juror to dismiss the evidence for there not to be a conviction. we are sometime away from that. we don't know yet exactly when the trial date will be set. it could extend well into the campaign season. possibly beyond 2024. which really does plunge americainto unexplored territory . >> that's a good point to remember. but also, donald trump's been galvanizing support, saying this is a witch hunt against him. is this inn effect -- in effect driving his popularity? he's touting himself as someone unfairly targeted and using this opportunity to even raise money for his campaign. >> yes, after the new york indictment, here is a huge amount of money and he has done so again. he's actually capitalized the fundraising.

it's important to remember. there are two parts to this. he's probably got voters -- the polling shs he is way ahead of the other candidates for his party's nomination. so those supporters, for a lot of republican supporters, is already there guy. the question is does he have the american public generally backing him to win an election? there are lots of people in this country -- it is quite polarized of course. there are those against him but there are still those independent voters, women, african-american voters, young voters, the elderly, all those are different demographics, that might be unsure about donald trump. while he has republican voters generally speaking, the polls show that, that is one thing. whether or not he can get the general american public behind them to get back into the white house is another thing. >> thank you very much. we will be coming back to this

shortly. around the world and across the u.k., this is bbc news. let's take a look now at some of the other stories that have been making headlines today. staffordshire police say 49-year-old woman has been arrested on suspicion of murder after -- the wom under arrest is known to the children. more than 15,000 passengers have been hit by flight cancellations over the past couple of days because of stormy weather. more than 100 easyjet flights have been affected as well as six from british airways. now, strikes by security staff at heathrow airport due to take place on the 24th and 25th of june have been postponed as goodwill by the unite union. that is some respite for

travelers. members have now received and approved pay offer and there will be a ballot on the proposals. there are others still on the table. you are live with bbc news. we will go back to these live pictures from miami, where president trump has just arrived ahead of his second court room appearance tomorrow as a criminal defendant. let us now bring in our reporter there. we were just talking about how president trump -- former president trump is creating his own narrative around this and saying that this is a witch hunt. but the charges against him are very real. >> the charges are staggering. it is worth remembering the indictment in new york was at the state level, he was accused

of breaking some campaign financing laws. related to alleged hush-money payments to women he's accused of having an affair with. this is on a whole other level. these are federal charges. this is the united states america versus donald trump. this is the department of justice, which he wants oversaw, basically saying this man should go on trial for allegedly breaching national security. and not just a former president, but he is running to be president again, he's a front runner for the republican party against that nomination. he will go up against president biden. i think the security hazard has been tightened up this area so we are expecting donald trump to arrive at some point. he landed around 15-20 minutes ago. we know the journey from the airport here is about 20 minutes. there are lots of donald trump

supporters here, diehard supporters who are who believe in his narrative that he has been politically persecuted. they say they have weaponized the department of justice to go after him and stop him from becoming president. that is what trump says and that is what they believe. i'm not 100% sure he has arrived here. there is so much me to see. the police is coming tough down the main road. it might be that he is on his way to the resort. he will spend time in has resort this evening with his legal team. before then heading off to the courthouse at 3 p.m. tomorrow. the courthouse is around about a 20 minute drive from here as well. >> we are actually just looking at pictures of his car moving --

his convoy moving quite slowly towards you. the trump national golf resort is about two miles at most from the airport where we saw him arrive. he should be arriving with you very soon. as you say, today is going to be a day of speaking to his lawyers and making preparations for this appearance in court tomorrow. what can we expect from the procedure that will take place? reporter: he will arrive at 3 p.m. i probably will not be on the dot. he's expected to go through an underground tunnel into the courthouse. i don't think we will see him outside of the quarter or anything like that. the court is very different to the courthouse we saw in new york. this is a very big impressive glass building.

very miami. he will then be taken to the 10th floor where he will be processed like anybody else. he will then go into the chief judge's court where the charges will be laid out for him. he will then enter a plea we believe and of course he will be playing not guilty. he will then be considered under arrest and in custody. there are also questions about, will there be a mugshot? a federal prosecutor says absolutely there will be a mugshot. that is always what happens in these cases. but the mugshot will not be released, he says. if it was released, that would be a whole other scandal. he will b fingerprinted however look on the other defendants. he is expected to leave miami. not quite sure where he is going next. that is more or less how we expect tomorrow to play out. >> you've mentioned that florida's no stranger to high-profile cases.

but how has this one felt? reporter: florida is used to high-profile cases. it's prosecuted former elected officials, current elected officials, foreign dignitaries, drug dealers, all sorts. a former prosecutor says, florida is ready for this. being a former president is a very different ballgame. not just any former president. this is donald trump, who likes to get ahead of everything. we knew about his indictment because he put it out there on social media. while florida is used to high-profile cases, it is worth saying that it is also used to donald trump. he lives there. he is popular here. but the security you can imagine is incredibly well-planned outside the courthouse. there are some roads blocked off. it is not as intense as in new

york where there is a very intense car and pedestrian traffic. there is expected to be -- that is expected to be some of a nightmare for commuters. officials will work out how to try to create a security bubble around donald trump. he will have the secret service at his side the entire time when he is here and when he is in court. >> thank you very much, our correspondent there in miami, we have just seen donald trump arrive ahead of that appearance in court tomorrow. now of course donald trump has railed against this new indictment. he has said this is a witchhunt against him. but usually criminal defendants are taken into custody before an itial court appearance. they are handcuffed, fingerprinted, and photographed for mugshots.
