watch as he whips out a cell phone. a book, a kindle, a cell phone. lucky for him he's still in one piece. >> no way. [ laughter ] >> deborah: and that's live, this is kron4 news at 11:00 with a developing story. two years behind bars. that's the sentence for johannes mehserle, who was convicted of involuntary manslaughter for the shooting death of oscar grant in 2009. but mehserle is getting credit for time already served, which means he could be free in less than a year, and that has a lot of people outraged in oakland. protesters held a rally, but when that wrapped, many of the protesters took to the streets, and that's when police stepped in. the demonstration lasted almost three hours. scores were arrested, and there was some damage. our team coverage tonight starts with kron4's jonathan bloom.

>> well, pam, we are standing in the middle of what has become an empty street. you can see that police have really cleared things out in just the last half hour, have completely packed up and gone home. let's look at some video from a little bit earlier this evening when you can see that police were arrested scores upon scores of protesters. a few minutes ago, police told us in all, they will have arrested well over 100 people who were marching with this protest as it left city hall and made its way towards the bart station. the protest never reached the station. police surrounded those protesters and started arresting them. they declared it an unlawful assembly, and those protesters who did not immediately scatter, were one by one picked up and taken over to the curb where they were sat down, lined up, and one by one arrested on charges of trespasses and other

such misdemeanors. police say that a lot of people didn't resist arrest. they went along with it. some of them shouted obscenities, but nobody struggled. there were just so many police and frankly they outnumbered the police many to one. the police were prepared this time. they had police officers stationed all over the area of oakland where they thought if protesters might march, and they were very good at heading off the different groups of protesters. one group went to the courthouse was turned roon almost immediately. this group was surrounded by dozens and dozens of officers and every single one of them who did not immediately scatter was put onto a bus from the sheriff's department and taken to jail with their hands tied behind their backs. this protest was put down pretty quickly, but it was not put down without incident. we road along with oakland police officers in a story

crime scene following rocks being thrown at officers. kron4 news. >> oakland police and city officials kept citizens abreast throughout the evening about the situation on the streets and despite a smattering of vandalism, officials say that they were pleased with the response to the protesters. >> what we asked early was that people would express and manifest that passion, that anger, and that pain and disappointment in a fashion that was nonviolent and nondestructive of our community. and i might say that clearly for the most part in a city slightly north of 400,000 people that that was honored. and there are a small group of people who went across that line. >> this has to stop in this city. i heard the reporters, this happens the same way -- every time. i'm not going to say no more

deals, but we're not going to a long leash any more. >> we move now to downtown oakland where things are quite quiet right now. >> well, we're at east 18th street and 6th avenue, and this is the heart of where that protest ended up, where all those people were arrested. right now, you can see people in the neighborhood are cleaning up all of the debris that was thrown all over the street, they're packing it into garbage cans. we watched them push a dumpster back down the alleyway, and there's a gentleman over there, a huge wad of crime scene tape that has been wadded up. he's taken that down from some of the buildings and collecting that. so things much calmer here right now. the police presence has cleared out of here and now people in the community, the people that live here are cleaning up the debris that has been left behind. kron4 followed the protests this evening and has more. >> reporter: before all of these

arrests, the rally over at the plaza early in the evening was actually pretty peaceful. there were about 350 people at that rally and after 6:30 when that rally ended, that's when a group of protesters decided to match through city hall and apparently going to that bart station where oscar grant was shot and killed, and along the way, we saw some destruction, some storefront windows that were broken, we saw some car windshields that were also broken and we saw a bus had its windshields, two windshields actually broken by some of the protesters. oakland's police will be charging these protesters with unlawful assembly. some of these protesters were throwing rocks at officers and at one point, somebody threw a brick, and hit a police officer in the chest. now, we understand there have been no major injuries regarding protesters and police officers. in oakland, kron4 news.

>> one more reminder of the protests, and the arrests that took place this evening, i can show you here in this street, two pairs of those plastic disposable handcuffs that officers use to make those many arrests this evening. reporting live in oakland, kron4 news. >> aps we've mentioned tonight's protests started with a peaceful rally. kron4 was there when things took a turn. >> we're on 14th and oakland. this is the epicenter of a lot of destruction when the verdict came down in july, and as we take a look around here, we can show you these were some of those businesses where there was a lot of destruction. the foot locker, they're all boarded up. there hasn't been any problems in this area, no destruction to businesses here. earlier when the rally was here, people have moved out quickly into the street. they did block off 14th and broadway for a little bit, but as you track here, you can see traffic is moving -- take a look

here, you can see traffic is moving. the officers have moved on. after the rally, people moved into the streets saying justforce oscar grant, and they quickly dispersed into other areas. we haven't seen the problems here on 14th and broadway that we saw in july. businesses did board up just in case, but there haven't been any problems here and police have moved on. kron4 news. >> it's not clear if the violence that broke out just after 6:00 as the crowd was dispersing at the square was spontaneous or whether it was instiigated. oakland police have their eyes on certain instigators here, who may be the same people to blame for the trouble back in july. as a result, the chief says he has equipped many of his officers here with cameras so that they can identify these folks, and possibly hold them

accountable later. 16 of those individuals have been photographed and identified in his work and his officers have quote introduced themselves to these people and warned them that they could also be held responsible for the trouble that broke out again this time. in oakland, kron4 news. >> and you're looking at a live picture at one of the many police buses that had been in the area of 6th avenue, eastbound 17th and east 18th streets in oakland. these buses were loaded with protesters who were arrested this evening. more than 150 protesters were arrested and taken into custody, taken to the jail for processing. we'll have more breakdown on the numbers of who those arrested were, who they are, in the coming days as oakland officials work out the demographics and logistics of

was not the only decision made by the judge today in regards to johannes mehserle. the judge also threw out the gun enhancement charge. we were in los angeles. we hear what happened today in court. >> reporter: the judge said his decision to sentence mehserle to two years in prison was based on the evidence. he said when the jury convicted him of involuntary manslaughter, they were making the point that they believe that he mistakenly pulled his gun. he said, because there was no intent to pull this gun, there was insufficient evidence for the gun enhancement. as a result, the judge dismissed the gun enhancement, which could have given mehserle an additional ten years in prison. the family of oscar grant was not pleased. >> we're talking about murder. and if a man goes to prison killing a dog, and he gets four years, then, of course, two years is not enough.

>> this is america, don't expect real justice. we may want it, but it doesn't necessarily happen. >> reporter: grant's uncle was one of five family members, including his mother, to give emotional testimony earlier in the day. they talked about how their lives have changed since grant was killed and now johannes mehserle should be given the full 14-year sentence. later, mehserle addressed the judge, saying quote, with all my heart, i am sorry for taking oscar from there. i do pray they can find it in their hearts to forgive me. but grant's family wasn't buying it. >> a delayed apology is no apology. had he made an apology on that platform, there was no legal restraints against him, it would have been accepted. >> oscar grant's family showed their disgust with the decision by walking out during the middle of the judge's statement. they later said that they are going to look to the u.s. department of justice as they continue to seek justice for

oscar grant. in los angeles, kron4 news. >> earlier in the day, oscar grant's grandfather spoke out, asking supporters of his grandson to stay peaceful tonight. here's what he had to say. >> i know everybody's angry, and no one's no more angry than i am, and his mother. but the thing is, you've got to let god take it over. we can't solve nothing by tearing this city up. we got to be level in the head, you know. two wrongs don't make a right. and you can't solve nothing with violence. my grandson is gone. violence is not going to bring him back. these buildings that these people destroyed in the last rally that we had down here didn't do anything to my grandson. so, and this building is not going to bring him back. don't tear somebody's business up. if you angry, do it the right way, the legal way. come up with a ballot, let people vote on it, try to find

much cooler out there today, and the cooler weather continues through the weekend with rain on sunday. so tomorrow, temperatures inland not too bad. we'll be in the low 70s, but elsewhere in the 60s, and the cooling continues into sunday as a pretty strong storm moves in. let's take a look. the clouds that we've been seeing streaming in. a little bit of a spinning down here, it's kind of hard to see, but that's the storm that's going to be driving down to the south, and maybe even a chance

for some sprinkles in the south bay. you can see very well defined, lots of moisture, that's going to move in on sunday, and it's going to bring some pretty can't rainfall with it, as well. 5:00 in the morning on sunday, moderate rainfall. and 7:00 in the morning, look at this band of very heavy rain showers. the orange there on your screen. so the heavy rain will push down all the way to the south bay by 9:00, and, as a matter of fact, bay area wide we're seeing moderate to heavy rainfall. so the rainfall is going to be pretty strong, but you'll notice by 11:00, turning showery, a couple of lingering areas of moderate rainfall, and into the afternoon, tapering off very quickly, that main band of rain is going to have most of the action. 3:00, a few lingering showers, a few more into sunday evening. a look at your around the bay forecast, the main event this weekend is that rain, up to .75 inches of rain in the north bay valley, 2 inches in the mountains. you were also going to be seeing drying conditions into monday.

but another chance of showers into tuesday, slight chance in the north bay. it could clip us. the good news is a drier weather pattern is setting up behind that so we shouldn't see rain for a while. in sports, sharks mans cannot watch joe thorton for a couple of games. gary tells you why, and the warriors try to start the season 4-0 at home for the first time in 20 years. gary's up next w [ son ] my parents have always lived in the states.
