unemployment is on the rise. the golden stateis lagging far behind others in this recession. >> in the 1930's california with the promised land for the midwestern people who lost their farms to foreclosure. this great recession of 2008 has turned out to be a different story aside from a few bright spots like the bay area california's job market has virtually dried up in recent months, since may, the state has only at 11,000 jobs in the unemployment rate is climbing again to more than 12%. in fact, only nevada has a higher jobless rate. four years ago before the recession mich., and mississippi were the only states with unemployment rates above 6%. california's the 5.8%, in june of 2009 when the recession officially ended, nevada and michigan top 12%. now, nevada is still over 12 percent and so is

california. last week, the economist at ucla said that some sections of the state may not see a recovery for another five years. >> some encouraging news on the national job front, macy's says that it plans on hiring nearly 8000 seasonal workers this holiday season that is about 4 percent more than last year. the new hires who were both in the retail stores and filling on my orders. the death of a cancer patient in the east bay is being called a tragic accident. this as multiple agencies now launch investigations into the case. it happened here, in oakland, the hospital management said the patient died because of a medical error. while she was under the care of a replacement worker, the hospital has been using temporary nurses after a one day strike last week that led to a lockout. this is a picture of the patient her name is judith, she was being treated at the open facility for an

undisclosed type of cancer. teresa estacio reports that investigators say this could end up being a criminal matter. >> the california medical board and the state department of public health and the alameda county coroner's office, these are few the agencies have launched a full-scale investigations into the death of this woman, judith ming she was being treated here at this medical center in oakland when this past saturday according to the hospital, she died group-- due to a medical error that occurred by the replacement nurse. here is the cold from the medical center. >> a spokesperson the california department of health tells kron4 that due to privacy matters that cannot elaborate on the investigation however they will say that they will send personnel to conduct interviews. the agency has the authority to fine the

hospital, the california medical board has the authority to pull licenses if they find malpractice. oakland police are also involved. monday a spokesperson said that they're in the beginning stages of looking into the woman's death. >> is this too soon to say whether this will be or will not be a criminal investigation? >> i think it is too soon, is still very early in the investigation there are a lot of questions that we need answers to. >> her death took place when they have locked out regular nurses who took place in the one day strike last week. this is the of the van the various state agencies say the investigation could take six months up to one year to complete. >> and a nurse who nursemi ng before the lockout spoke with kron4 about her patient calling her death tragic and shocking. >> yes, i know this patient she was very kind and compassionate woman. i would go on her room and she would hold out her hand to me and

i would hurled her hand and be there for her and we talked a lot--hold her hand and be there for her, and we talked a lot about her illness and we go this point. i know her husband very well. >> coming up at 6:00 p.m. you will hear from a friend of the victim who said the patient's death is particularly devastating because she had been showing signs of improvement. >> an elderly man in a wheelchair was struck and killed by a hit-and-run driver this happened in santa clara on sunday. the name of the victim has died yet been released. rob fladeboe explains what happened and how the police are hoping to test the driver. >> we were literally above it. we're on the second floor. >> judging from the bags and the groceries that she saw on the street, she said that the victim may have been out shopping. >> we assumed at that point that she been coming from the store, there is a safe way down the street.

>> police said the 67 year- old man was in a wheelchair trying to cross homestead road when he was hit by a vehicle going westbound on homestead shortly before 1:00 a.m. on sunday. police believe the victim was he right about here, and that he in his wheelchair were then drag all the way up there to the next intersection some 300 ft. away. the elderly man later died hospital, police are now hunting for a felony hit-and-run driver. they have no suspect or vehicle description at this point they do believe that the vehicle sustained heavy damage to the front end and the windshield. they're asking the public for help and so is this woman who says that she cannot get the side of the mangled will check out her mind. >> it is terrible, i cannot honestly feel that anybody, or how anybody could actually have on their conscience, how does someone deal with that type of situation and will day-by-

day as though it is ok, it is all right? >> today the national transportation safety board released its final report on the san bruno explosion that left eight people dead and many more injured. the 152 page report outlines a year of investigative work on what went wrong last year in the san bruno explosion. it then gives new recommendations not only to pg&e, but also to state and federal officials. >> much of the information has gradually come out but today we get a first look at the final report, all 152 pages that blames pg&e for the relocation pipeline project back in 1956 that put the pike in the ground. i have two different pieces of paper, pink and green, this represents the pipeline it went to the ground, you can see the different sections or what is called pups when these are put

five small earthquakes have brought a different section of the region since yesterday. the latest quake hit north east which is in napa county early this morning the 3.0 struck about 2:00 a.m. this morning, and then later a 2.0 struck about 5 mi. away that was followed by 2.1 a few minutes later. then last night, a 3.5 earthquake struck the mouse from san leandro and the east bay that happened just after 8:00 p.m. last night. moments later a 2.3 hit daly city about 3 mi. from the san francisco zoo. >> new at 5:00 p.m. occupying austria we shall the process that is growing in new york city. and a case of accused police brutality caught on tape. an officer involved shooting leaves one man dead in oakland. we lifted the situation surrounding this shooting and why eyewitnesses said the police are taking part in a cover-up. and the trial for conrad murray is about

the >> and national news, the protest over wall street's role in the nation's economic crisis continues to grow in new york city. over the weekend dozens of people were arrested during the occupy wall street protests as it is called. these are photographs of some of the protesters that were taken into police custody. the protesters have been gathering for more than a week. and meanwhile video has surfaced on line in what appears to be a new york police officer approached a group of protesting women and sprang the eyes of pepper spray. are in and a reporter has a look to the video and tells us why the hacker group anonymous is now getting involved. >> this video posted on youtube has sparked a lot of outrage you can see the women protesting standing on

the sidewalk behind a police barricade when two officers in white shirts start walking quickly up to the group, look, one of him has his hand outstretched holding a spray canister, then you can see the liquid sprayed into the air at the woman turns away screaming with eyes closed as the officer read holsters the canister and walks away. a photographer that witnessed the incident put up a post with this blown up image of the officer's badge showing his last name. and now the hacking group is getting involved and has posted information about the officer including possible phone numbers and addresses and in the document they right before you commit atrocities against innocent people think twice. we are watching, expect us. in an interview with the new york times the nypd said that the pepper spray was deployed appropriately.
