morning in new details as well we are learning about an officer involved shooting that left a man did in san jose early yesterday morning. as rob fladeboe reports they said the shooting may be related to earlier reports of gunfire in the same area. >> shortly before 6:00 a.m. monday some copley's reporting that there was a man on the sidewalk with a gun outside the central county vocational high school in south san jose. for police confronted the man near the intersection of hillsdale where the man made a threatening gesture towards the officer who then shot and killed him. >> so, to officers basically approach this individual with a handgun the individual does place some kind of threat and one of the officers discharge his fire on a shot the suspect the suspect when data was later pronounced dead at the scene. >> about an hour-and-a-half before the officer involved shooting police were called here to a location about 1 mi. away from the school due to earlier reports of shots

avenue please see that a man stole an officer's gun during a struggle. the officer fired on a man although he was not hit, one officer eventually struck the suspect with his car, that man was treated for his injuries. >> now this happened at the mason hammer restaurant on washington avenue sunday night. workers there told the police that the man was acting weird and paranoid and the police said try to question him and he began to struggle, the police pays him and then cuffed him. emergency personnel rushed the suspect to the hospital where he later died. also, the santa cruz county sheriff's office is investigating the discovery of a woman's body monday afternoon it was found about 100 ft. below a railroad trestle. detectives are investigating whether the woman who appears to be in her 40's fell from the truffle. the woman's

to corporate greed to union busting everything under the sun. no particular cause in mind. this is similar to the protest that we have seen from around the country most recently with seen it in san francisco. a. to lead protests has taken place at the federal reserve bank around san francisco. also on wall street we have seen for a month now, we have also seen it in san jose, sacramento we have seen it all over the place. right now, they have tents set up, they have a media center set up and they said they will sit out here until their demands are met with and not sure exactly what those demands are. >> what kind of police presence to you see out there? >> 0. no police presence but for the most part is very peaceful out here, it is 5:00 a.m.. the people

seem to be extremely well organized and it looked like they are in for the long haul right now. >> thanks a lot jackie and that is an open and as you know the occupy watching movement has been spreading to dozens of cities all across the country starting center last month, on the left you can see leo from protests in boston, a police arrested more than 50 demonstrators last night from the occupied boston movement after they ignored warnings they had an official encampment set up and they would not move. on the right, that is video of the process going on in downtown chicago yesterday. they rallied for better education, affordable housing and more jobs and that police excited about 200 people for staging a sit-in in the street. and a group of homeless people and their advocates have been occupying three hotels in san francisco since yesterday afternoon. this is all part of a plan for a call to action providing

housing for the homeless. coming up after the break well live report on one of those hotels that is being occupied. >> keeping a close eye on wall street would be a hangover after yesterday's huge gains, right now the dow is down around 30 points. one day after the dow jumped 3% up yesterday. and the s&p 500 jumped 86 as the europeans promised a solution to the debt crisis by the end of the month. but today investors are watching and waiting on slovakia. they're the only one that still need to approve the expended bailout funds. it is expected to be close vote. >> and president obama jobs bill appears dead in the water right now on the u.s. senate as republicans oppose the amount of spending and the tack on millionaires. president obama has been campaigning for his measure that is expected to come to a test vote in the senate today which may not pass. it

the cathedral, hill hotel is to the part of a plan to call for action in providing housing for the homeless since yesterday was world homeless action de. on the group homes, not gills are planning on occupying over 10 vacant buildings with more than 70 housing units. now we are live in san francisco details now where are you? >> i am here on geary street. and according to one activist that just part of the building these are the two buildings that the have occupied possibly a third although i have not seen any moving here and then even a fourth one that is cathedral hill and that is from the video that showed just now which is on the corner of gary and van ness. it is been pretty quiet throughout the night, there is an officer on the corner, he has been vigil and he said that it has been pretty quiet as far as the activists that are in there right now, they say that there are about maybe a dozen people sleep in each

building here. they say they will be here until, they were not really clear what they were born to do what they're not there would be here all day or indefinitely according to one of the activist, they said that police officers cannot come in until they get permission by the owners to actually go into the building which is the california pacific medical center and they have had these buildings for a couple of years because they plan to knock them down and expand some of their medical facilities and offices, so that the plan for these buildings the course activist judges really trying to highlight the point that there are so many people in san francisco for homeless and that maybe these kind of buildings can be used for housing as opposed to doing some medical office. i hope to talk with someone on camera about what they're planning to do, how long they are planning to stay here but until now it has been pretty quiet. >> we will check back with you, and will be right back as the kron4 morning news continues.

check on traffic. >>george: things are quiet right now. the valley transit authority, despite late night problems in trumbull, is running normal service this morning with no delays. they are on track this morning, so are other transit agencies. around the bay area, we are not tracking any hot spots. on the bay bridge, it is like and easy westbound headed towards the lower deck of the bay bridge. on the san mateo bridge, the right is equally good. on the golden gate bridge, we saw crews setting up, they are in the process of reconfiguring the lanes. they are at the north end of the bridge adding a fourth southbound lane. there are no delays through marin county. let's look at east bay traffic and pick up the right on highway 680 into the san ramon valley, it is delay free. the ride on

interstate 580 westbound still looks good from livermore to castro valley. south bay traffic, there are no delays for 280, 85, 87 or 101. the north bay ride looks good southdown with no delays from the navato narrows to central san rafael. >>darya: the time is 5:20 a.m., parents and the oakland unified school district met with officials to discuss a possible closure of lake view elementary. it is one of the five schools in oakland on the chopping block. parents are not allowing school officials to have their way without a fight. >> we should stick together and fight! it is a lie, it is plain and simple. >> a lot of parents, including myself, i will pull them out of oakland unified school district and put him somewhere else.

>>darya: parents are arguing that lake is one of the safest schools in the city. the deputy superintendent said they have too many schools open for a district of this size and the funding is not there. >> we have about 100 schools. with 38,000 children, trying to find all of those schools, those resources are spread very thin. >>darya: the deputy superintendent said the five schools slated for closure including lake you have low enrollment and all of the closures would save the district $2 million. a similar meeting will be held tonight at lazear elementary. the board will make its final decision about these school closures on october 26th. >>erica: the fight has carried over to our facebook fan page. parents and viewers are weighing in on this. i asked, is there anything the kids and parents can do to keep the schools open? take a look at

protesters camping out in downtown oakland overnight. they held a demonstration yesterday. there are not leaving. jackie sissel is live in oakland with more. what exactly are they mad at? >>jackie: it is very similar, it is actually a brother protests to the occupied san francisco and occupy wall street. corporate greed, wall street greed, a lot of different causes. as you can see, there are dozens of tents set up out here in front of oakland's city hall in frank a call-up plaza. we have a video from is a day when the protests started. hundreds of people took to the plaza yesterday. they were protesting just about everything imaginable from corporate greed to wall street greed, union causes and as i said, this is pretty much a solidarity protest to the protests that

you have seen popping up around the country. you have seen occupy wall street and the san francisco protests in front of the federal reserve bank. that has been going on for over two weeks. in oakland, they are planning to stick this out for the long haul, for the foreseeable future. you can see them setting up tents. they have a media center and kitchen set up. they are not going anywhere. so far, it has been peaceful. no police or anyone out here causing any problems. that is the way they want things. it looks like they will be here for a while. >>darya: we have seen different ways that cities have handled this. do we know how the city of oakland plans to deal with this? are they going to let them stay? >>jackie: that is unknown. right now, there are no issues. we have not heard from city officials or oakland police how they will handle the situation. as i said, there are dozens of tents. i know that the

occupied san francisco protest was coiled from setting up tents. they were on sidewalks. this is a public plaza, a grassy area. you can see city hall and the background. they may not have a big issue with people setting up tents as they did in downtown san francisco hom. >>darya: i bet they are appreciating your lights at 4:00 a.m.. >>jackie: if i turn them off, you will not see anything. indicated that the apple co- founder died of respiratory arrest as a result of pancreatic cancer that's spread to other organs. the death certificate was released yesterday by the santa clara county public health department. he died at his home in palo also at the age of 56. there was no autopsy performed. >>darya: new details on the shooting spree last week. a limestone quarry has now reopened. last wednesday, shareef allman opened fire on co-workers at the lehigh southwest cement plant. three were killed, seven others were injured in the shootings. after an extensive manhunt, allman was founded the next day and shot and killed during a confrontation with sheriff's deputies. >>mark: one of the largest gay-rights groups is leaving its post. the quality california announced that

the toll plaza of the bay bridge, the westbound ride is a very light. on the san mateo bridge, things are looking better. you can see the condensation is clear. you'll have eight wet ride for the mid a crossing. a 13 minute drive time eastbound or westbound. your golden gate bridge ride looks good. no problems for this outdone commute from marin county. we have picked up a little slow in coming out of antioch into its work on highway 4. a the westbound is completely clear. your ride on 58680 looks good. slow coming from dublin to livermore. south bay traffic also looks good. the north

bay ride is a problem free from 101 through marin county on the southbound side. >>darya: a new bicycle rental program is launching in san francisco today. it is the park ride a bike rentals. they will have five bike rental sites around the city. there are two locations in golden gate park, fort mason in union square. the rentals are $9 an hour for a regular bike, up to $35 an hour for a fourth person by. >>mark: the first two weeks of the nba season are officially canceled. commissioner david stern wiped out a total of 100 games following seven hours of negotiations that failed to produce a new labor deal. this is the first nba work stoppage since 1998-1999.
