demonstrators in another city are going to new heights. >>pam: at 5:00 p.m. president obama says that congress is dysfunctional and the american people cannot wait. today he announced his own housing initiatives that will allow homeowners better still current on their mortgage to refinance my hollow--how low their home values have dropped. >> we are not going to wait for congress, we want to save people money, make government more efficient and help the economy. >>pam: president obama made las vegas where the worst cities hit with foreclosures in the nation. california and the bay area are also at the top of the list. our team coverage begins with grant lotus and he shows us how bad the situation is.

estacio continues our team coverage. she talked with local mortgage experts whose said news coming out of the obama administration really may help homeowners who are stuck in a rut. experts claim that the new plan will help borrowers. >>reporter: this will help boroughs with little or no money in their home and they can gain access to current level rates. the refinancing program has been extended until the end of 2013. it was originally scheduled to end in june of 2012. the changes also mean that the process will be streamlined by way of a new appraisal acquired in the financial-- refinancing process. new appraisers cannot refinance because their home are under water. for many more--more kids brokers this is good news.

that there are about 65 to 70 tents. it has been just a little over 1 weeks in san francisco opd came in and forcibly remove the tenants. every since then they have been letting the campsites growth. the city has been giving them orders, like here is one from the fire marshal. notice there is one telling them there should be no more open frames--f lames. they say they also got a letter telling them that can thing is not out in the public parks as you can see, they're not listening. so for the time being, these tents are staying right where they are. >>pam: in san jose protesters are getting kicked out of their encampment except for this man, this morning as the final thing from being moved from the plaza and then climbed up a wall outside of city hall and he is refusing to come down. right

news a 15 year-old student was shot and wounded this happen at her north carolina high school. cape fear high schools, knocked down parents recall, and the police have not figure out why and how this happened. >>katherine: as word spread that a student had been shot worried parents gathered around a school they were

not sure why and the students were not released four hours. police swarmed in the area they did not know where the shot came from and they wondered why someone wish to the teenage girl sitting outside eat lunch. it happened without warning a lot of students did not realize the someone had been shot. >> from what i understood, they were at lunch and the girl was shot they did not hear anything but like a firecracker and then they saw the girl fall. it was not very dramatic for the kids around, they did not start screaming or anything there were kind of calm. >>katherine: students were eventually evacuated. the local middle school was on lockdown for two hours. students were searched and scanned with metal detectors before leaving. a superintendent later suggested that the bullet may not have been fired by anyone on campus. an assistant principal and a security officer were only a few feet away when it

happened no one saw anyone approached the girl and no one was hurt. authorities were wondering if she was hit by a stray bullet followed by a hunter, or a drive-by shooter. >>katherine: the 15 year-old girl was shot in the neck, tonight she is in stable condition. her parents say that she is responsive and can answer questions by nodding or shaking her head. the doctors are trying to figure out if the bullets can be removed safely. police in texas are looking for a serial rapist they say he is targeting women related to a specific a sorority. police just released this surveillance video of the suspect. this was taken back in april. they believe the same man sexually assaulting four women in their homes of the past several months. the unusual connection is that all the women were of the same sorority but they have not been college in years, they're in their fifties.

deputies in florida are searching for two escaped were charged with murder are considered very dangerous. 12 ft. wall, or a 12 ft. fence lined with a razor wire to escape. nearly 30 people in indiana were injured, you are looking at the man that was driving the vehicle. troopers say that he opened alcohol containers and refuse to take a sobriety test. he was booked into jail and released on $10,000 bond. >>jacqueline: temperatures are much cooler out there today. we will see a big shift in the wind and that will lead to fire concerns. we will start with coastal and north bay fog. into the

the decision of the defense to make their case. he could go to the jury by the end of the week. joining us to talk about this controversial and high profile trial is our legal analyst hello michael. now feels like the prosecution had a really daming case do you agree? >> i do agree. people who are uneducated about what goes on in the courtroom, they wanted and then they think you know the jury is headed to a guilty verdict. panel which prosecution witness do you think had the most damaging testimony? >> there were a number of them first to start with dr. murray klein about the propofol. he never told the e.r. doctor or the emt why not? that is a big question that will go unanswered in

the trial if he does not take the stand. the other thing, i know this is an emotional button, but jurors often go emotional. that is when one of the witnesses said he could have been saved. can you imagine? that even puts more of an emotional wrench into the defense. you also have witnesses, a doctor in particular who said in the end it really does not matter if michael jackson reached up and injected himself it does not matter because you dr. murray put him in that situation. you walk out of the room had you been in the room, you may have saved him. >>pam: did the defense scored any points during the prosecution? >> they got a little bit but not much. now they will start picking up the witnesses as they did today. there are 15 witnesses in one week, that is a lot that

mean that they moved quickly. the most important witnesses in my opinion that they will have would be dr. murray's patients. they will bring some of them in and they will tell a nice doctor he is and how caring he is. >>pam: what is the standard for proving involuntary manslaughter? >> the jury has to have a moral certainty of the charge, they have proved that he fell below the standard. he has to be without a reasonable doubt. >>pam: will dr. murray take the stand? >> should he take a stand? yes he should. but i've talked with people on his team and he will not take the stand. they should make him want to. even though the jury has an hour and half of him by way of tape, they need to hear from him. i not

police say a van carrying two people ran a red light and struck a car. someone in the man was arrested for suspected cocaine. the victims of the crash are said to be in serious condition with nonthreatening like injuries. the alameda corner says that this 51 year old was hit and killed while riding his motorcycle on interstate 580 on saturday. this was the scene shortly after the crash, police arrested the driver who crashed into lopez they say the driver did it on purpose and we have more. >>reporter: here is the picture of the suspect he is 31 years old and he will make his first appearance in court tomorrow when he arrives he will be charged with murder and not manslaughter. according to

lawyer she wants a new attorney to be covered by tax payers. the judge agreed to discuss the matter in private. the victim michelle lee was found murdered in alameda county on september the 17th. as the bond is currently being held without bail. and the coast guard continues to search for a missing kayaker who disappeared in the bay on sunday. this 500 had just beaten cancer after two years of chemotherapy. he was out and join his new life kayaking on sunday when he was caught in a wave of a tugboat. it flipped the kayak and after a series of searches and several hours the crews turned up nothing. they believe that it was unlikely he was able to survive however today they continued to search the water try to find him. more trouble in the water in san francisco, this boat washed ashore at baker beach. you can see it in the circle. a

vehicles were arrested on suspicion of the you why. it happened early this morning police say a van was speeding south on 10th street when it ran a red light here in the intersection of 10th and howard and broadsided a sedan. the sedan was then spun out, it hit st. joseph's church. two people were in the van, six people in the sedan none of them were wearing seat belts. all of them were hospitalized with serious injuries. police said the girl that was paralyzed was sitting on someone's lap in the backseat of the sedan she was literally tossed around inside the car. police say that 20 your old driver of the van also had cocaine on him, they said he did not have a license or any identification on him. he may have been involved in a hit and run that occurred before that in the area of the they cannot tell because
