>>justine:the morning as we take a look at the ongoing growing occupy protest that are still going on in the bay area. more people are starting to gather at justin herman plaza in san francisco. you are also looking at the scene at the plaza in oakland protesters vowed to take it back and they did. 700 gathered near city hall to discuss what they're going to do next. we have some developing news out of san francisco, we will get to that in just one minute. but first, i am justine waldman. >>james: i am james fletcher and support of those protesters who had a few

council members are writing late last night in support. we will hear about that coming up a little bit. for the most part last night protest was a peaceful one. you can see it here in the video the fence surrounded the grassy area at the plaza where the encampment was taken down just one day before. for now, the mayor of oakland and oakland police are promising not to move against demonstrators and as the crowd gets violent. >> i want some time to open up the channels of communication. we have decided to have minimal police presence in the plaza over the next day or so so that we can try to open up the dialogue here. people have to remember why we had to close it to begin with. that is because of the sanitation issues and other safety concerns. whatever

happens, it can not deteriorate from what it was before. as the mayor of the city i have divided opinions on some things. we do not always agree on tactics, i know you guys do not like the fact that the things day-by-day and situation by situation. the gates were put up more for the public's safety. we were going to allow them back in as soon as the clean up with finish. >>james: they say the grassy area where the protesters camped out is not a biohazard and they have to make sure is clean up properly. they say protesters are risking their health by city or sleeping on that ground. >>justine: scott olson and i

rock war veteran veteran-- iraq war veteran was injured last night. this shows him sitting on the ground after being hit by one of those projectile missiles. people stayed around to help him. you see the cops threw tear gas into the crowd and olson was bloody and dazed he served 2 tours in iraq with out any injuries. his friend spoke out about this. >> i think it's crazy how you can go and serve the country and then come back

and get injured like this. >>james: yes today mayor ed lee said that laws against camping in justin herman plaza will be enforced. he said trash and lack of bathrooms is why protesters need to move out. still, many protesters and i believe they should be blamed for the sanitation problems. >> most of these conditions already existed down here and we are trying the best of our ability to mitigate them. rats are an endemic problem in san francisco. the city has a right to be concerned about rask but they do not have a right to blame us for it. >>james: the mayor says the he will kick the protesters out of justin herman plaza but he will not say when that will happen. we have seen oakland police assembling in various parts of the city. first in treasure island now south of the city at the dog patch.

and in the locations. will be sitting in the low to mid '70's. your temperature is right outside the door are in the 30's, '40's, and '50s. as we work our way close to a.m., take a look at that purple on your screen. temperatures are close to the 40's there. as we advance the clock closer to lunchtime you will see all that green filling in on the map indicating temperatures in the '60s for most locations. as we fast 4 to 3:00 p.m. we will be in the low '70s but the '60s mostly along the coastline. here is a quick break down of exactly where those temperatures will go neighborhood by neighborhood.

to a high fire danger in the north bay in the east bay hills. what everyone will notice this morning is how cold the temperatures are. it is a little bit warmer through oakland currently sitting at 52 degrees. as we head into the afternoon we will bring the temperatures for the most part in the '70s. we have a couple of 60 degree temperatures out there for places like half moon bay. as we head up in the north bay we will see a lot of temperatures in the '70s. there is no change from yesterday and places like navato and fairfield. as we can to the next seven days we will have clear and

inside a very heated meeting last night. >>reporter: tense moments inside of the school board meeting in oakland many people were frustrated because it took so long to get to the public comments about the school's closing. when they did get their chance to speak they were not afraid to voice their concerns. >> it is obvious to the city of oakland that these beautiful children of lake view that these children are fighting for their rights they're walking to school to long already. they do need --do not need a walking school bus, they need a school. >>reporter: 5 elementary schools were on the chopping block. that means about 1000

students would be impacted and will need to transfer to other schools in the district. >>james: this morning, the cost of college is soaring. a new report shows the average yearly price tag for attending and in state university jumped to more than $21,000 this fall. yesterday president obama outlined programs that he hopes will help graduates with their student loans. >> other countries are hustling to out educate us today so that they can compete with us tomorrow. they want the job of the future. i want you to have those jobs. >>james: the president aims to speed up a plan that was already in the works one of his measures would push up the start date for a loan repayment program that is based on income. >>justine: as decision 2012 approaches we take a look at the white house campaign strategy. while republicans are fighting to find a challenger president obama

houses for people that have survived this earthquake. flood waters in thailand have flooded bangkok. government officials say relief will be continued to be based at the airport. more than 600 prison inmates have been evacuated from the area. thailand says that bangkok would be submerged in more than 5 ft. of water. it has killed 373 people and affected more than 9 million people. officials say they could take more than one month before the water recedes. >>james: we have a live look at occupy san francisco, this is a justin herman plaza. the encampment is still there despite inclination from the mayor and the police chief that they may some point in the future move in to clear out

area on the plaza in oakland. >>reporter: there had been officers here on the ground patrolling and walking around being vigil of the area and circling around. in the meantime, protesters here have been awake. they have been wondering themselves if they will do it at all tonight or when they will do it tonight, they have been up and around and walking around the area. some people were playing drums and supporting one another to keep it up be. at this point is very peaceful. >>james: described to me the size of the in camera, justin herman plaza is fairly large are we talking about the entire plaza or

just a corner? >>reporter: just the corner of it, here is the theory building. if you are facing the ferry building you would just go right here, that is where it is all set up on the right-hand side have the hotels and usually have the ice skating rink on this side, that is all clear. the protesters are really on this side. i walked over here to the side of the street because there are quite a few people. most of the crowd last night was right here in the center facing this ferry building but a lot more people are over here towards the other side of the encampment. you can see the large crowd over in that area. like i said for a while, you had a big group just kind of in a drum circle hanging out waiting to see if in fact if the police will enforce them to put down their tents, so it is just a wait-and-see holding pattern right now.

>>james: so this morning is at less tense. >>reporter: yes, it is a little more relaxed. people are just wondering if that something will happen. in the meantime some people said they would just practice civil disobedience but that is about it. there is no notion that they would do anything violent. it seems that people are little more relaxed. >>james: you mentioned earlier that you saw a few police officers circling the area are are they on bikes? >>reporter: they are on foot patrol, there were about five officers standing in the area and then they just kind of walked around. they are in their regular officer uniforms. they're just patrolling and they seemed relaxed and walking around and around. we know that there were a couple of

supervisors out here last night that were here talking to the people. some people think that because the supervisors were out here last night that maybe it has deterred something happening but still, they do not know, they also heard reports about how they mobilize on treasure island and the dog patch area. it's a feeling that some people here feel like they have mobilized to much to do nothing. the >>james: we heard from the see that this could be a biohazard that is why they wanted them to clear out. but the protesters say that they are doing their best to clean it up. you are there, do you see a lot of trash or are they doing a great job in keeping it clean? >>reporter: i think they're doing the best they can to keep it clean. i see people putting things in garbage

cans, but when you just look at this at a glance, it does not look very organized i guess. i hear some people cheering right now, you can see them right there. they're kind of rallying or there together in that area. i see people, like you can see these people right here, they look like they are possibly picking up, setting up a tent or taking it down i am not sure. but i see people throw their trash away, they are collecting the trash and putting it away. so i see that kind of behavior going on out here. >>james: that was yole with her eyes on the scene and we will keep you posted. >>justine: the san francisco mayor says that belongs will be in force on the plaza. protesters do not believe that they should be blamed

video shows him laying out on the ground. there were a group of people starting to crowd around him. and then some stayed behind at some point you will see something tossed into the crowd. watch, that is an explosion they believe is another canister of tear gas that an officer threw into the mix of people that were trying to help colson--olsen. he has been taken to hospital he is in critical but stable condition his friend spoke out at city hall yesterday. >> i think it is absolutely unconscionable that some of our citizens can go overseas and protect our citizens just to come back and have our own police injured them. >>james: as i said olson is in stable but serious condition and will follow his recovery. >>justine: we will turn our attention to traffic and

weather, erica is following both the morning. >>erica: good morning, we have a nice clear shot over downtown san francisco. it is a cold start to the morning we are seeing temperatures currently in the 30's as we work our way through the afternoon we will see plenty of sunshine and clear skies. for the most part we are free of fog. just to prove how free of fog we are i will show our satellite picture. as we work our way through the rest of the morning we may see some patchy fog on the coastline but it will not affect the visibility. now this will be what matters to most people as they stepped outside the door. we see most temperatures in the 30's, '40's, and '50s out there. it is about a couple of degrees cooler than the last report. we are at 39 degrees for half moon bay,

49 degrees for those in oakland, and 53 degrees for antioch and 50 for those in mountain view. by 8:00 a.m., you can see that we still hold on to a lot of the 40 degree temperatures up to the north bay and the same goes for our inland areas. it is a little warmer for those on the coastline and down into the south bay. as we advance, you can see a lot of green on your screen that indicates temperatures in the '60s. by the afternoon, it will be in the '70s. we do hold on to the '60s for the coastal locations. i will break down those numbers for you neighborhood by neighborhood. you will see a lot of '70s out there, a couple of 60s along the coastline for places like happened day.--places like half moon bay.

p >> darya: good morning one minute before 5:00 a.m. and our top story is the bay area protesters kept by sticking together as the police moved in to take them apart. 48 hours ago, kept the police broke up the camp in open but be protesters came back. now san francisco protesters are anticipating a raid by the police the kron4 news at 5:00 a.m. starts now. see if we can get at communication back. there has been some police activity this morning in a different location they seem to be staging maybe the launch of a raid, but it did not happen. we also had a supervised the san francisco meeting in the early hours this morning let us go back to will tran. >>reporter: there is a lot of nervousness in the air, people are coming to us and asking us if we know what time the rate will take place the answer is no. if they do not get any answers from us, they go to the police officers and asked them what time they will come. many people did not get much sleep. they're keeping a close eye on the street see if any police officers will be coming here. i saw many police officers are moment ago standing near me. it looks as though they have left the scene. while they were here they were not wearing any riot gear or helmets. they did not have any batons. if

the raid did not happen at least not what we saw in oakland. they are hoping that things will be peaceful but no promises were given. just being in open as well as san francisco even though these are two occupations, there is a little bit of difference here, it is calm and not as tents or ready to explode. i can say that now because nothing has happened but we will have to wait and see. just by looking at how the police officers are standing and talking to each other, they're keeping their distance. >> darya: it was a another strange early development this morning people saw police gathering of treasure island in look like they were staging something and you have been waiting there and they never showed up so maybe there were called off or something? >>reporter: the police officers that we ask perhaps

are you in relation to the protesters in the video? >>reporter: i did not see the video but it is hard for me to tell back until you 48 hours after the franklin police into the plaza and took down the encampment, some of the protesters albeit a small number have returned. there are about half a dozen or so occupy protesters set up inside of the plaza. as you said, they have been given the order that they cannot sit overnight apparently they have decided that they will not obey the order and so far we have not see any police action. i can tell you that there was a fence around the plaza and part of the fence is laying on the ground over here. it was taken down last night by the protesters who entered the plaza. obviously the protesters out here this morning are defined that

order. no word from the officials or the oakland police department what they will do or will not do. but right now it is very quiet out here. but the people are defying the order to stay off the grass. >>james: you are in the location where we saw a lot of people tearing down the fence. i do not see a lot protesters have the basically cleared out? >>reporter: yes they have. i just got word a couple of minutes ago that some of them may have taken bart over to san francisco because they got word that there would be some possible action taken over in that area. so they left this protest to go assist the occupy san francisco protesters. but right now it is very quiet. i do not see any police presence at all right now. >>james: thank you very much for that and we have eyes on the ground at both

locations and will let you know of anything it develops. in the meanwhile protesters say they will hold a strike where the students will lead and form a march downtown we will have the very latest on that as a becomes available. in greece, the entire city of workers and students do not go to school and did not go to work. >> darya: >>darya: there are five oakland elementary schools that will shut down at the end of this year. here is a list of the schools set for shut down. district officials say that this move is needed because of declining enrollment and a drop in state funding. the closures will save the district about $2 million a year. the district expects to eliminate about 30

>>james: here is a quick check on the markets. the dow futures are up more than 200 points. this comes after european leaders agreed to expand the european bailout fund. this is what we saw yesterday on the dow, u.s. stocks finished solidly higher. the s and p added about 13 points. there were reports that china has

the usgs shake map which is a tool that they have of to illustrate how far the earthquake was felt and how strongly it was felt. it is color coordinated. it goes from the very light blue and around the epicenter all the way to read. the lighter the color, the less the shaking. in the red, extreme shaking and heavy damage. right now, it is very light blue, almost teal. some very light shaking, nonexistent damage. as a color spreads out, that is how far out people reporting they felt the earthquake. from west of san francisco, down south to piedmont.
