of headlights headed southbound on 101. more weather and traffic checks throughout the morning now the news. >>justine: late last night the oakland mayor jean quan tried to talk to the people that were occupying at the frank ogawa plaza. as you can see and hear, she got booed. so she quickly returned to city hall. meantime the occupy oakland camp is growing outside of city hall. hundreds of processors have returned to the plaza some of them setting up even more tense. reggie kumar was in oakland with more reaction to what happened with mayor quan. >>reporter: thursday night she told the media that she was invited to speak with the protesters. >> i am very saddened by what happened last tuesday it did not turn up we wanted to. people wore hurt and i

take responsibility and i apologize. >> i walked in many tough neighborhoods and have many friends in the crowd so i'm not worried. >>justine: author and filmmaker michael moore has taken notice of the event. he sends out a tweet saying the following. >>james: scott olsen the iraq war veteran injured during tuesday's confrontation with the police in oakland is in fair condition this morning. last night drs. david update on his condition. this is a vigil held yesterday were supporters lit candles. many holding his pictures. he suffered a fractured school after being hit with a projectile by the police. a friend of his visited him at the hospital and had this to say.

>>james: we are obviously having some problems with the audio, but we will get this sorted out. in any event, scott olsen parents are in the bay area they arrived yesterday. although he is in fair condition at this point he is unable to speak. >>justine: some members of the occupy oakland movement are seeking refuge in the occupy berkeley movement. this group that writes and sings protest songs weren't there tuesday before the confrontation with the police. occupy participants in san francisco are still on edge after rumors spread that they will be kicked out of their encampment. the raid by the police never happen. the police told us they were assembling on wednesday night in case oakland police needed extra help. mayor ed lee said the war to work with the protesters to keep justin herman plaza clean. the

when the fans were starting to go little crazy. the bottom of the 10th, and down to the last strike. burton's rbi single ties the game at 9. the cardinals end up winning 10 to 9, game 7 tonight, the first time the world series has gone the distance in nine years. fans for both teams are going to be absolutely berserk tonight. >>justine: gov. jerry brown presented a new proposal that would slash benefits for state employees. they say the state can no longer afford the current retirement system. they would be under a hybrid system that combines the traditional system with a 41 k plan. they will pay more toward their benefit and the retirement age would be released from 55 up to 67.

>> it is really important in our society that people when they reach retirement have sufficient income to maintain a decent state of living. we have to take some very strong action. the 12. plan that i am laying out does precisely that. i can tell you that there are a lot of great years left in your '70s and '80s. conditions around the bay area at this time. it is a cold start to the morning temperatures on average in the 40's. we see some 37 in the north bay location. by the afternoon we will see mild temperatures mostly city in the low '70s. by the evening we will have fifties around the bay. the big story are the cold temperatures right outside the door. they are colder than our last report. navato is at 37 degrees, 46 at half moon bay and as we work our way to our satellite picture we are free of fog so that won't be a problem. the good news is the fog will stick to the coastline so not have to worry about that bay area

satellite forced a five-year delay. the $1.5 billion mission is concur--to be a bridge between the current satellites up there and the new generation to be launched in a few years. >>justine: a person is accused of choking a woman unconscious and the suspect is still on the loose. we have a sketch to show you, this happened at 8:45 a.m. at the and the college in cupertino. a female victim was walking on campus the suspect ask her for help she agreed. as to the close to the parking garage the suspect grabbed the victim and began to choke her until she was unconscious. when she regained consciousness the suspect was been gone. >>james: the man accused of stealing a picasso piece of art in san francisco pleaded guilty yesterday. mark lugo pleaded guilty to stealing a sketch last july it is worth a quarter million dollars. he was arrested one day after the theft with aid of

surveillance video he will spend 16 months in prison. >>justine: a good samaritan was honored for her courageous actions from this fiery scene. this happened on highway 101 san francisco when a cement truck overturned and burst into flames the woman who was driving her car to school is credited with saving the truck drivers like by dragging him away from the danger. >> this the county of san francisco good for american award presented to keena williams in recognition of your hero is, when you're decisive action them bravery save the life of a fellow citizen. >> i love you, i love everybody i still cannot to help you i do not know who you are but i am a good hearted person and i prayed the whole time as i was getting you.

here in oakland is that scott olsen is in fair condition. he is improving. i will step out of the way so that you can see some of the candles that had been lit during this mitchell that was held this evening. it is not just the people in this community supporting him if people in the city, the nation in the world. the mayor's office received phone calls from all over the world as did the hospital. we spoke with a friend of scott olson and this is what he had to say. >> there really anxious and worried, and his aunt told me to make the promise that he would not be in the press any more but i don't think they will stop that. i am glad that he is doing better but i am very upset for the fact that he can go to i rack and the fine and come back and then get shot by the police. >>reporter: in the distance you can see some of the candles that were lit during

welcome back to the kron4 morning news the time right now is 4:44a.m. as the push our way into the rest of the afternoon we will see plenty of sunshine and mild temperatures mostly in the '70s. as we work our way into the overnight hours the clouds will return. the

temperatures will be in the '50s for the most part in your bay locations and '40's for the inland areas. everyone winking into a cold start this morning is currently 41 degrees up to seven rows of the same goes for navato at this current hour. as we head toward your afternoon highs, we will warm up into the '70s all around the bay area. 74 half moon bay and it looks like we would live to about 75 redwood city. the same goes for mao and you this afternoon. los gatos and morgan hill will be at one of our warmest spots. of the north bay we are expecting 75% rosa and 70 for downtown san francisco. everyone is looking for to the weekend and i have a look at where your temperatures will go as we head into the next couple days. today he will be about 69 to 70 degrees. as we work our way into saturday will see warmer temperatures. we will cool

increase. on the golden gate bridge your ride on 1 01 as usual has only a few people out there. now on to james. >>james: the oakland unified school district will wednesday night to close five elementary schools and now the focus has shifted to making this a smooth transition for the families involved. here is the map showing you the schools that we are talking about. we explain what is next for the district. >>reporter: school district officials say they will not be talking about closing any more schools until next year. right now they're focusing on making the transition as easy as possible for the families with children in the five schools that the school board decided to shut down on wednesday night. a spokesperson tells me they have to me schools in the district to serve the 38,000 students. again, they're not ruling out any cuts but they said that they will possibly not discuss this until next year. students at the

following schools will finish out the school year in june and the following year they will attend the schools. pop >>justine: here at kron4 we would to maxwell park elementary school one of the schools slated to be close and teachers and parents are expressing sadness, disappointment and anger over the planned shutdown of the 85 year old school. >> i will have to find another school that is a little farther away from where we live. the teachers are great i will have to find students that my child likes. >> i do not think it is a good idea because at the school we had a smaller class his. >> the indication from the beginning was that they already had made up their minds. >> the parents of the school are committed to be calling the school board members that instead of voting to improve our schools they voted to close our schools and destroy public education.

our morning forecast. we have a cold start the day, right outside the door you can see forties' for places like santa rosa and through navato. currently 55 degrees for downtown san francisco. as we work our way into the afternoon we are still working with a tight range of temperatures today getting up to about only 70 degrees in some areas. our warmest spots are coming in at 77. up in to the north bay we have plenty of '70s here. your seven them around the bay forecast does show a string of sunshine as an end to the next several days. clear and sunny skies and no fog. but as we head into the latter part of the work we will see cool down by thursday. the

coming through and cleaning up and they were not allowed to do that. they want to make sure that this time it will be allowed to do something like that is necessary. the biggest demand of all is that she says they can be here but between the hours of 6:00 a.m. and 10:00 p.m. at night. and there will be no overnight camping. it just for them--and just buy them being here they say you know, we are not accepting these demands. their presence alone tells you that they are not accepting this. mayor quan has been made fun of, getting criticized by national media. in fact she has not made herself readily available to the media and that is upsetting a lot of people here as well. they personally want to hear from her. those demands were made in a written statement. back to you mark.

>> darya: scott olsen the direct war veteran injured during tuesday's confrontation with the police in oakland is in fair condition this morning. he is still unable to speak. take a look at a vigil that was held last night. at least 1000 people gathered there to honor him. the former marine suffered a fractured skull when he was hit by a projectile fired by the police. the scent of a protester who has been standing atop a large wall outside of city hall as part of the occupy movement there has asked to meet with the city officials. 27 year-old sean o'kelly send a hand written note asking them to remain in the plaza in exchange he says that he will come down from the wall. police say that he can be cited or arrested when he does climb down he has been up there for nearly one week. new video at a

nashville tennessee where the police arrested about 30 occupy protesters. the move then overnight using a newly enacted policy that said a curfew for the grounds near the state capital. that is where the protesters have been camped out for about three weeks. about 20 protesters that remain on the sidewalk were not arrested. activists in cities across the u.s. are protesting economic inequality on what they call corporate greed. >> mark: stock futures are- now before the opening bell. now what a day yesterday the dow surged 400 points and closed close to 340 points. it was the biggest gain since august 11th. the dow above the 12,000 mark for the first time in three months. we
