look at your screen. here are some bullet points. she wants to make sure that there is open communication between her staff herself as well as representatives from occupy oakland. she wants to make sure that people here keep things sanitized and keep the place is very clean. they said they moved in on tuesday because they believe this was a health hazard. they also wanted to make sure there was public access for emergency workers. the biggest stipulation as she is making is that they can only be here between 6:00 a.m. and 10:00 p.m.. that is the reason why the day after the camera was broken up,

they could barricades around here and clean things up. obviously their presence here says it all. even though we did not get an official response just them being here says we are not accepting that demand and perhaps not any of the other demands. coming up we will have reaction and sound from people arrested it came back this morning. >>darya: scott olson, the iraq war veteran who was injured is in fair condition this morning, still unable to speak. about 1000 people turned out to honor him. a friend of oils and visited him in the hospital, here is what he said. >> we are happy that the prognosis is better, but i was pretty mad about the fact that he did two tours in iraq and injured but was shot by police during a peaceful protest.

>>darya: the parents of all seven are in the bay area this morning. they arrived from wisconsin yesterday. here is video from when it happened. a former marine suffered a fractured skull when he was hit by a projectile fired by police. this san jose protester who has been standing on top of a large wall outside of city hall says he wants to meet with city officials. sean kelly sent a handwritten note asking officials to allow protesters to remain in he will come down. police say that he could be cited or arrested when he does come down. he has been up there for nearly a week. in nashville, police arrested 30 occupy protesters. if the police moved in an overnight using the same policy that said a curfew

for the grounds near the state capital. there, you can see some of the protesters sitting down and refusing to leave. there were about 20 protesters that remained on the sideline that were not arrested. they acted out there for about three weeks. >>mark: a cold start to the date. james fletcher has more. >>james: here is a live look from the albany camera. visibility is pretty good. it is a clear cold morning once again. there is a possibility of a fog but it would be patchy at best and confined to the coast. most locations experiencing low temperatures. sunny and mild this afternoon.

of the bridge for the morning commute is complete. the east bay ride still looks it. the commute on 680 southbound, walnut creek from pleasant hill, there are no delays. there are no delays for 280 or 85. the north bay ride looks good with no delays out of nevada through marin county. ace train and caltrain are not reporting any delays. >>darya: the final section of the cells and guard suspension span is good to be put into place today. jackie sissel is taking a look at the bridge. >>jackie: it looks good.

this is going to be a good- looking bridge when it is finished. there is a new chunk of concrete and steel that will complete this roadway. over 1,000 t, that is why you see these cranes. we are still more than one year away from the opening of the bay bridge. the next big project will be to spin the cables.

adjusting >> just in from chevron quarterly profits have more than doubled. the san ramon company said that net income now totals $7.8 billion. compare that with 3.8 billion a year before. revenue was also up 26% to 61 billion. chevron makes $87 million a day. chevron stock is trading down 0.3%. >>mark: wall street is down

delays on the stand or approach. looking at the golden gate bridge right 101 southbound is still problem free across the stand. i will show you the marin commute in a little. in the east bay, we have not tax of any slowing. a 13 minute drive time from hercules to berkeley. 680 south still looks good. so does your ride on 580. dale little slow on the guadalupe parkway as you head north toward highway 101. your ride on the peninsula is a problem free. on the golden gate bridge, there are no delays.

people are even angrier and even more galvanized. here are a couple of protesters that i spoke to this morning about the demands that marijuana is making. >> it is not happening. we are staying. we are not going anywhere. >> many of us are out here because we have no place else to go. this country has stolen our homes and raise rents on as she is telling us to go. go where? this is our home. to tell us to get off of our streets is ludicrous. who is she to tell us to leave? >>will: you can see that they are still here. they are not going anywhere. a couple of other demands that

the mayor is making, i will tell you about those demands coming up. >>darya: are there any organized demonstrations or anything it being said by the occupy protesters? >>will: there are no organized demonstrations in fact everyone is sleeping at this time. it looks like they are there and trying to be clean, the city claimed that this was a health hazard and that is why they had to move in. we have not gotten official word from any leaders

>>darya: we will see what happens throughout the day. in the meantime, a notable film maker will be showing up to join the cause. michael moran has taken notice of what is going on in oakland. he made a statement that he is coming to oakland. >>justine: the marine veteran who was critically injured during the protests scott olson, and a raw war veteran, he was badly injured tuesday night. he is now sedated at highland hospital in oakland with a skull fracture. here is an update on his condition. >> he is awake. he still

74-76 degrees. a very tight temperatures spread. here is your 7 day around the bay. pretty easy to tell you about. nothing but sunshine area mid-70s inland. low 70's at the bay. things changed thursday of next week. inland temperatures in the upper 60s. he may very well see the first clean jobs in november fall on thursday. let's give you caught up on the commute with george. >>george: i am encouraged by what i am seeing at the bay

>>mark: a san francisco judge has blocked a lot were crying warnings on sold funds because he said it suggests that cell phones are dangerous and unregulated. a city attorney says he will appeal the judge's decision. >>darya: but a san francisco man survived a small plane crash wednesday night in a farm in northeastern oakland. the plane crashed on its approach was small airport. jefferies mob from san francisco suffered leg injuries but he managed to crawl out and walk to a nearby farm house. the faa and ntsb investigators are trying to determine the cause of the crash.
