video to youtube says it was shot just after midnight on november 3rd. take a closer look in march as one of the officers appears to shoot a rubber bullet at the protesters. right there, shooting him and a protester is filming he is screaming in pain. keep your eye right there, you see that flash, that is the shot. the alleged victim did not say when or not he was hurt this that he was shot with a rubber bullet by the police in oakland overnight after the november 2nd general strike turned violent. >>pam: let us go live to open a large business association is calling out the city saying that city leaders have failed to make the right decisions in these recent protests. j.r. stone is following the story and he joins us live with the new details. >>reporter: i have obtained a letter to the city from the downtown oakland association within the last 60 minutes. in this letter

that i have pulled up on my phone they basically call out to different groups of people. they call out city administration and the city council for the way that they have handled occupy oakland. i can tell you as you get this in a letter, they say the city council and current administration have been i eat in their handling of the latest protest and we are calling on them to get their act together. deborah is the president of the lake county community benefit district was also part of this letter says that good things are happening in oakland and that is now being overshadowed. >> as other businesses continue to grow, pandora adds 25 employees every month in their business. they are committed to oakland they will not go anywhere else. they will tell you that if they did their employees will quit because this is where they want to be and this is where they want to work. in these communities we have made a tremendous impact in

frank ogawa plaza and though we can rain has stopped the protesters to get their gear in order. some are bring up parks--some are putting up parts--tarps. the wooden pallets are the way that the protesters separate themselves from the wet ground. all sorts of structures are seemed tightly crammed together some are in better shape than others, but this one takes the cake. the shiny structure is insulated plus it has a door and you can stand up in the middle. protesters are bringing all sorts of building materials. this person was busy sorting out clothing and other things that will be given to people who needed. >> we have free clothing, tarps, hygiene products, basic things that everyone will need. it is obviously

of the issue. >> there was a train that had a break on that would not released, it took awhile for to get out of the way. we have done that we still have delays headed towards the east bay. >>reporter: so san francisco, millbrae and daly city are not as severe as the east bay? >> we are most concerned about getting the trains moving again, the train to the other direction there is less traffic that way so the delays are not that bad. >>reporter: so if you're heading to the east bay how long of a weight can the commuters expect? >> we hope to get this resolved pretty soon right now we are saying it is a 20 minute delay. >>reporter: thank you for the update. >>pam: ap genie gas pipeline ruptures in the bay area triggering a mudslide and partially closing a major interstate. this is the same line that caused last year's

deadly explosion in san bruno this time, no one was hurt but it was an inconvenience for many. this happened near farm hill boulevard near interstate 280. it happened while pg&e crews were performing a test. >>reporter: it could take another day or so before they removed the pipe and taken to the san ramon valley to find out exactly why it ruptured. pg&e says it is not completely surprised because they rerouted gas to a different line so there was no gas involved. they ran water through the pipe at twice the pressure. normally for a gas line they would go about 300 lbs., but for this when they went 600 to see the stress level. then it ruptured. >> this is good news for us, this is a success and this is exactly what we are looking for for our entire system. >>reporter: they believe that it was a dent perhaps

degrees in napa and 35 in san raphael. it will still be chilly everywhere else. temperatures will rebound into the afternoon and much like today will be a couple degrees warmer in some spots. we have low sixties for the bayshores and down in the south bay. it is very chilly along the coastline. it also be cool in san francisco, 58 degrees there, 59 in richmond. changes are coming to your forecast later this week. right now we have a couple of them sitting offshore that will drop down through the northwest. by 4:00 p.m. the rain will be approaching the coast. it will continue through the overnight hours. this continues into

your early morning commute. we still see rain in the ec and the south and later in the morning the rain becomes a little more light. we see showers lingering through friday morning. by noon, you will see light rain through most of the bay area and then tapering off into the afternoon. let us get a look at your extended forecast that will be the first of a couple of systems we will deal with later this week. tomorrow we will have sunny skies and increasing clouds. the storm moves in late thursday into friday dropping temperatures over 10 degrees. then we have a chance of showers late saturday to sunday there is a slight chance for lingering showers into monday bought--but i am leaving that out of the forecasts for now. >>pam: our legal analyst is here to explain the latest developments in occurredr. conrd murray trial. what you

think the prosecution's strongest evidence was? >> first i believe you have dr. murray trying to hide the propofol, and in the way he acted after not calling 911 right away. those are all the emotional buttons for the jury. i think a lot of people people have not talked about was that jackson was going to pay him, he had not paid him yet but he was going to be paid $150,000 per month. that is a lot of money is like i am buying you a doctor to get the propofol. other doctors had turned him down i think those are the things that the jury used ticket >>pam: i am sure that recording had something to do it. >> yes, but dr. murray did not give him the drugs that calls that to happen. >>pam: do you think if they had put him on the stand it will make any difference? >> hindsight is always

2020, i said in the beginning put him on the stand because you are losing the case no matter what the d.a. did, he could at least get up and apologize and say i love michael jackson. i tried to wean him off of the propofol and maybe get some sympathy from one of the jurors. i thought they made a huge mistake but keep in mind dr. murray told the defense team that he was not going to testify. that was his decision. >>pam: what you think the defense could have done differently? >> and then put him on the stand and i hearken back to the scott peterson case when they said we are going to prove scott peterson innocent and i thought why would to say you're going to prove anything at all? the d.a. has the burden of proof if you remember at all, they said we will prove that michael jackson injected himself with propofol, how about saying that we do not know what happened is up to the prosecution to know what happened beyond a reasonable

doubt. so i think the jury look that said there is no way that michael jackson injected himself with propofol. >>pam: so he had up to four years in prison what you think? >> and you know this judge's no-nonsense, so he faces two years, three years or four years and that is up to the judge. they will send him out to get a probation report and the judge will read that. on the day of sentencing they have a victim impact statements. judges will let three to five people talk usually, the jackson family is going to be emotional. they will get there and talk and i think the judge will give him the four years. he only has to serve 50 percent of that. >>pam: so he was served two years in prison. >> he would serve two years because this is a non- violent crime under our laws and a first of fans.

>>pam: san francisco police are searching for the person that shot a man at fisherman's wharf. this happened last night at the intersection of taylor and north point. police say the victim is expected to survive but they have no suspect in the case. police in concord are searching for two men that rocked a drive- in theater last night. police say the two men, one armed with a gun demanded money from an employee in a ticket booth but no one was hurt. will be right back with much more to come. when you're forty-six. just lots of referrals and appointments and bills that costs tons. maybe i'll keep it... it adds character... right? [music] >>pam: of a fatal shooting happened friday night outside of and an apartment complex in morgan hill. police believe they have determined a motive. >>reporter: this 14 year-old is not a gang member according to our father joseph who showed me pictures of his daughter. he said she was simply in the wrong place at the wrong time. >>pam: there is no other way

to explain except for being in the wrong place at the wrong time. she died at the hands of someone trying to be a gangster. >>reporter: a growing memorial marks the spot where his daughter and her friend were sprayed with more than 15 bullets from a rifle and a handgun. memo we believe they lived in the apartment complex in their work a crowd of juvenile on the corner and they started randomly shooting as they drove by. >>reporter: an unidentified juneau and four men are in custody for the shooting. the police say these four men all suspected members of the surreal street banks --gang. >> they were cold-blooded and they had no sense, they shot at three girls that had nothing to do with anything they were just walking by. >>reporter: bullets ripped

this case that forced entry through an exterior water heater closet and basically forced his way through two layers of sheet rock to gain entry into the house. it is not like the home owner showed up and found a front door kick in this is the case when he entered the house without an expectation people would be in there. >> police said a homeowner is cooperating and is not under arrest. maureen kelly spoke with the man who said he does not feel good about what happened. >>reporter: the property owner did not want to appear on camera but he said he did not know the man that he shot inside of the rental property. he said the suspect was armed with a kitchen knife he says he think they both startled each other that afternoon he said he went for what he had and i went for what i had which according to the police was a small caliber handgun. as for this video that shows him laughing after he does not think that taking a man's life was a joke and he was reacting to something the police officers said. he said at the time the video was shot

he was still stunned and his hands were shaking and incessantly incident who he had trouble eating and sleeping and does not feel good about taking a person's life. >>pam: this is the man that was killed a police say they arrested him back in june for selling copper from an elementary school and just last month they say he was stopped on suspicion of copper theft but was not charged for lack of evidence. his friends say that he was a good guy and did not deserve what happened to him. >> he did not have to die when he died the guided after shoot him he could call the police and did it the right way. taking his life was just too much. he was just trying to do what he had to do to survive. he did his time and he is not afraid to go to jail, but the man was out of line i think for killing him. he said that he came at him to hurt him, he would not hurt a fly. that is not him, he is not that aggressive. he

[music] >>pam: this with the scene earlier this morning after a natural gas pipeline burst. it shut down two lanes of interstate 284 hours.-- interstate 280 for hours. this is the same pipeline that exploded in san bruno

officials say the good news is that this happened report--during a safety test. dan kerman is here to tell us what might have caused this latest rupture. >>reporter: they are saying is because of the san bruno that they are testing this 3 mao pipeline in the first place. and now they are blaming an outside contractor. >>reporter: normal pressure is 375 lbs. on sunday the pipe was in ramp up to 550 lbs. and that is when it burst. it's close part of interstate 280. now pg&e suggest they believe the pipe rupture because it was previously damaged by something like a back hoe. >> all indications are that there is a dense and a doubt in the area where it failed. we will do investigations on

that and have reports within a few months. >>reporter: once the work begins they say it should be completed within two to three days and then pressured test will be conducted again. the san bruno pipe with a 32 in. upright--pipe that had a scene in it, this one was 32 in. in diameter but it did not have a seam. >>pam: now they spent another explosion happened in menlo park. >>reporter: yes they were doing test their they believe it was up and hold problem and they say once all the holes are fixed they will reroute the gas again to make sure that it can

withstand bringing the pressure back up. >>pam: and utility consumer advocacy group is blasting pg&e for the latest pipeline failure. teresa estacio reports that the group is concerned that there are more problems yet to be discovered. >> i am really alarmed by the pattern of pipe line failures after they have started the testing. >>reporter: this is the executive director of turn, news of this latest rupture on top of this, the fatal horrible san bruno explosion were eight people lost their lives has he and the agency out raged. >> the fact that they're all of these failures due to testing show that they were right for ordering testing in the first place and that pg&e was wrong for so many years for resisting this type of water testing. >>reporter: in addition
