this live picture near frank ogawa plaza where the demonstrators had gathered again, they have been meeting and marching we will talk about this in just a moment ago we want to show you what happened early this morning. this was the scene as oakland police officers came in to clear the protesters out of frank ogawa plaza. they had been handing out eviction notices over the last few days. the protesters were not happy about this, they took to the streets this morning. most of them did leave peacefully but there were about 35 arrested. i should say there were 33 arrests. and grant lodes is here to show us exactly how the events unfolded this morning. >>reporter: for the second time in the last three weeks the city of oakland move in a kick out the occupy protesters. the tent city has been removed again in a pre-dawn raid. this time the police tactics were different and so were the results. >>reporter: just after midnight on monday, the

police convened outside of oracle arena. at 2:30 a.m. the occupy protesters got word of the raid, some of them packed up and move out of the frank ogawa plaza makeshift tent city. but at 3:00 a.m. hundreds of them rallied playing music, chanting and showing support for the movement. around 4:00 a.m. the first officers arrived in downtown oakland. the next hour brought in another raid,-- wave. the police brought a bullhorn epic--enforcing the protesters to move out. >> i am going to stay in the arrested. >>reporter: around 6 a.m. the police moved in by that time most protesters had left the area or were protesting peacefully away from the 110th that

remained. people that refused to leave were arrested. >> i have to report their no injuries to the officers or citizens, no reported use of excessive force, and no resistance will be disassembled the camp. >>reporter: this is the only guy that stayed in his tent, he was one of 32 people arrested, it is far more peaceful than the one on october 25th. >> we came to this point because occupy oakland i believe took a different path from the original movement. we have repeated violence and this week and murder, we had to bring this to an end before more people were hurt. >>reporter: over more than 30 people were arrested in only nine of them were oakland residents. the mayor says they are welcome to protest at frank ogawa plaza but tense and the overnight camping will not. >>pam: we continue with j.r.

stone hit on the front line with the protesters within the last hour they have been marching in rallying outside of the downtown public library. j.r. stone, what is happening now? >>reporter: we are right outside the oakland public library, we have not seen any marching, but here we have a rally going on. as i can off into the distance, you can see some of the officers in the distance. i want to get back to the rally that is going on. you can see all the people showing up. many people were upset that the camp was taken down early this morning. as for numbers, it is hard to say right now it is at least a few hundred people and it been only 5:05 p.m.. keep in mind that last time they had a rally outside of this library was last month when the camp was taken down. again, that was the first time that the camp was taken down we saw numbers like this but i do not think we saw as many people this early in the

evening as we are seen tonight. i know because i was at that even just like i am at this even as well. in the distance you can see that the speakers are talking in letting their view points out and everyone is listening. it is very likely that there will be marching later on down the street toward city hall. i will be with them and give you updates, but i want to take you right now, as we spoke with the police chief earlier today how when jordan about how the process will be handled by officers and this is what he had to say. >> the difference is we will reopen and the plaza almost 24 hours sooner, as you recall last time it took two days for the plaza to be reopened. in addition, because of the anticipated crowd that is here, we have set in place the mutually-- their request to have officers here is the crowd became unruly or decided to do some property damage. we

will have officers arrest people that are breaking the law. we want to strongly discourage that type of behavior. we are here to facilitate free speech and peaceable assembly but if people are coming here to break the law and cause property damage and we intend to arrest them. we have also enlisted the help of our community monitors to help work the crowd to make sure that there is nonviolent and peaceful demonstration and we expect that to work in our favor. >>pam: as we have been reporting the oakland police did move in on the camp in the predawn hours. this is video of them removing the scores of tents. there were arrested but no reports of violence. you can see them methodically moving through the in canada. dan kerman is in the area of 14th and broadway were all this has been censured for so long, dan what is happening now? >>reporter: right now we're

waiting for the protesters to arrive at this location but zoom in here there is frank ogawa plaza. the barricades are gone, the plaza was opened at 4:38 p.m. this afternoon. people are moving about freely in the plaza. it was for 30 a.m. and the police took down the barricades that had been up since this morning. the gates came down and people as i mentioned moved freely about the plaza. but you'll notice a very heavy police presence. there are police surrounding the plaza in all corners and all facets. they are letting people know that they're here to facilitate a protest and facilitate a march and a rally but they will not put up with anything illegal. as you look around the plaza more closely there are still sprinklers on and the place is basically a muddy mess. so marchers who are coming to the plaza will have a wet and muddy time once they arrive. again, the plaza is

now opened as you can see. we also have some other bystanders moving about and then the marchers and protesters should be here within the next hour. when they do, we will bring it to you live on kron4 news. reporting live at 14th and broadway and dan kerman with kron4 news. >>pam: this has been a test for kron4 assistant-- police chief. maureen kelly shows how the city and the crew spent most of their day cleaning up. >>reporter: here you can see a small army of city workers swarming frank ogawa plaza in order to clean it up and score it down once again. in the background, you see this coming from a power washer as crews blast the cement. you can see the workers in this shop are

wearing a white hazmat suits, mats and gloves to protect themselves from things like human waste and other contaminants. debris and then leaves or raked up and bag up and tossed into garbage trucks. >>reporter: as you can see the tents as well as other personal property will be stored by the city until they are retrieved by their owners. >>pam: meanwhile there are some protesters camped out at snow park. this is a few blocks away from the frank ogawa plaza. protesters have been evicted from here before and they have been repeatedly told that camping is not allowed there. so far the mayor has given no specific timetable for their removal. in san francisco, threats of violence has led

to the cancellation of the uc regents' meeting. they say they gathered credible information that some people have been threatening violence at the next meeting. this is from the occupy cal movement where people believe the police used excessive force that is under review. the students and teachers were planning an attack as a form of retaliation. we will take you back out live right now, this is in downtown oakland outside of the oakland public library where the protesters have gathered again, they are now deciding what their next move will be. there is some speculation that they will march from the public library to frank ogawa plaza that was cleared early this morning. stay with us as we continue to cover the occupy protesters around the bay area. we have the latest videvideo information on our web

obama as national health care plan. this sets a stage in the showdown of the presidential campaign. president obama has nine more votes to worry about next year, the supreme court says that they will hear oral arguments about president obama as health- care overhaul. this could shake the political landscape just as voters are about to decide if president obama is going to serve another term. the white house says that they are plate pleased to hear it thate court will be reviewing this. many republicans oppose it this from day one. they argued the government is overstepping its authority and law is opposed all of president obama as a prospective opponents. 26 states join to flout a challenge with federal courts a split in the rulings. the central issue is the requirement that people buy health

insurance or face a penalty. besides from ruling on that the supreme court will also decide if the rest of the law can take effect. >>catherine: this is interesting but it has been years since the supreme court set aside so much time for hearing a case. five and a half hours of arguments they say that is instead of the usual one hour. those arguments will be in march, a decision is expected in late june. unless the so- called super committee strike a deal by thanksgiving the pentagon is one of the departments that will be hard hit by automatic cutbacks. the committee is supposed to be figuring out a way to make more than one trillion dollars in cuts. defense attorney leon panetta warned congress that a hit to the pentagon could mean production stopping and civilian layoffs. one proposal would mean $300 billion in higher taxes. the president of the charity at the center of the child sex abuse case involving penn state has resigned. he says

>>pam: you are looking at a live picture of protesters back in the streets of oakland j.r. stone joins us and he is walking with the protesters and has the latest. >>reporter: i can tell you that we just got back to frank ogawa plaza. as you can see this area that was cleared out early this morning some people have put

down some of the pink on the grassy area that is very muddy. a much different situation when i walked in and around five minutes ago. the majority of the people are in the distance at the amphitheater in there. i want to walk down to 14th and broadway because one thing that really stood out to me, the difference today from last time the camp was cleared not only is it that open, but there are some officers out here but they look much different than they did last month when they clear the camp out. you can see some of the officers in the distance, and you can see that they are in plain clothing. last time they clear the camp, they were in full riot gear. a much different situation as we walked back towards the protesters. you can see officers out here in plain clothing. this is a much different techniques for a much different look to the oakland least department this evening. right now i'm walking down towards the theater where the meetings are held every evening. that

is where we haven't least three, four, maybe 500 people out here and basically they have not had any problems. we have just marched appear in the last 50 minutes or so, there has not been any destruction or anything of that nature. this is a peaceful protest. pam, back to you in the studio. >>pam: thank you for giving us an update protesters are back at frank ogawa plaza. we do not know what they're planning to do, do you have any sense of what the plan is for this evening? >>reporter: know, it is hard to say. there was not even talk of that march, but we knew it was likely to happen and it happened earlier than it did last time. i want to try to walk down here in give you a shot to show you all the people that are out here this evening in this area. while i walk down there to get the shot, i want to go to a sound bite and we spoke with a

gentleman earlier and he was upset with a lot of the protesters and came out and really the only sort of confrontational part of the evening that i have seen was when the men drove up in front of the library and began to shout, this is what he had to say. >> this has been on my hard for a while. i have even spoken with people and friends that visit me about the cops. and i do support those. >> what is your name? >> i do not want to talk. >>reporter: back out here you can see the hundreds of protesters at this point back in frank ogawa plaza. this is a peaceful protest and we have not seen in the arrest in this march.

>>pam: still reporting on our menu reporters in the area. and our team coverage continues now. >>reporter: just about 10 minutes ago hundreds of protesters filled the street as they made their way across a broad way and that in to frank ogawa plaza. for the most part, people were chanting and shouting and yelling we are the 99%. there were holding signs saying the occupy oakland the adjutancy they have made their way back into the plaza. for the most part, i notice that it was pretty peaceful. the street of police officers were blocking the street to make sure that no cards will go through that you can see now, 14th street has been reopened. i want to mention that earlier in the show, we told you that the barricades had been removed. we do know that there were barricades on the street over here. some of the protesters, we

saw them they were carrying them and here is just one of the barricades that was left by one of the protesters. we do not know exactly what the plan is, as you may have heard. but back in frank ogawa plaza i know that there are police blocking the area. we will continue to monitor this story that has to concede there are more people making their way into the plaza. >>pam: this is video of the people gathering at frank ogawa plaza at this hour. hazzig manyud tells us why oakland tax payers will be footing the bill for this morning's actions at the plaza. >> the cost will have to be covered by the city of oakland this was a plan the event not an emergency response. >>reporter: oakland tax payers are left holding the bag again to remove occupy oakland protesters from frank ogawa plaza. this time

around the fact that this was a non emergency situation means that oakland tax payers will have to cover the cost for mutual support from other law- enforcement agencies. the monday morning in diction alone will cost a pretty penny. >> the estimated cost of the between $300,000 to $500,000. >>reporter: it was mayor jean quan decision to allow the protesters to return after the eviction on october 25th. i asked the mayor if she believed an apology was in order? >> i think that oakland is not the only city that has had to constantly move, or continued to move the encampment. if you look across the country, and we even know that we may have to go and remove the encampments again. this is

an international and national movement. this is their tactic, we are trying to get the movement to move on literally to something different than encampments. >>reporter: so no apology to the taxpayers? >>pam: again this deal going on at frank ogawa plaza right now where the, i am sorry this is a live picture were the occupy protesters have gathered, and live rally is going on in we will continue to follow developments. caltrain is under attack for safety issues under the rail--the bay bridge project. they say concern started 2008, but information from a whistle- blower lead to a worker

named wilds officials say his data reflected no problems with the concrete filler but other test gave different results. officials say that wilds failed to get his equi improperly tested to conduct the tests. they say since they have found out about these fabrications they have taken steps. >>reporter: caltrain officials say an internal review of the wayne wilds worke shows his fabrication on several test and caltrans said they went back and retested the sections. >> we went back and did forensics review of the data. the data that that individual collected was handed off to an engineer

and the engineers evaluated all of that information to make sure it was sound. >>reporter: in addition the acting director after their be back of measures to make sure is the information is accurate. >> this is one verification test that is done at the there are dozens of tests to make sure the structure is built the way that we wanted to be built. >>reporter: the technician was involved with other structures throughout the bay area. >> we have rectified one situation and we have gone back and look at other two inmates to the they were safe as well. >>reporter: some bridge experts question if caltrain has it all the steps necessary to ensure safety on the massive retrofit project in light of the actions. one lawmaker has already announced plans to hold hearings on the issue. in the meantime, officials said the $6.3 billion project is still on track

for completion in 2013. in oakland i am teresa estacio with kron4 news. >>pam: caltrain officials revealed that they fired a another employee over the weekend, the boss of technician the wayne wi-- dewaine wilds could they see this employee was fired for having state property at his home. and presidential hopeful herman cain is continuing to lose support as a new witness steps forward to support the sexual harassment claims against him. this is the former boyfriend of one of her mccain's accusers. he is coming ford after herman cain in a statement that he did not know his girlfriend, the girlfriend sharon. at a news conference today, he said that he had an in-depth conversation with herman cain.

are in front of frank ogawa plaza. as you can see as you're indicating it has been the occupied unit let me show some video to show how many people are participating in this march and rally at frank ogawa plaza. as you can see, there are hundreds of people walking down the street from the library down 14th street into frank ogawa plaza. some people are carrying signs that say reoccupied. some say we are the 99%. they were chanting, let's go oakland. there are no barricades, they just walk right into the park and this was a dramatic difference from the last time the park was rated when they took down the tens. later thatb evening there were barricades up and this time the police said they would take down the barricades and the tents and they did just that. one thing that will not be tolerated is lodging,

noticeable differences. i walked out on the corn on the street to show some of the differences as you see some of the protesters in the distance, there is a general assembly meeting going on. right here, you can see some of the officers in plain clothes at this evening. that is much different than what we saw last time the camp was taken down. last time the camp was taken down, this area was closed to the protesters and when they got back, the officers were in riot gear. but now these are much different times, many of the officers are joking around and laughing with the protesters this is a sign that this may be a very peaceful evening. i'm walking to the other side of the plaza, a section that was covered intense--in tents just 24 hours ago. this is what looks like right now, this is a section

that was closed off for so long. but as you can see this theory that was completely taken down. some of the people in the distance will have set up and put some of the items back here, one of the questions is how many people can set up with items like this? will there be more can thing? everyone in the city and the police department say no. we did talk with the police department for a while earlier this afternoon. the chief spoke of this specifically and how they will do it, take a listen. >> the difference is that we will be open the plaza almost 24 hours sooner. as you recall last time it took two days for the plaza to be reopened. in addition to that, because of the anticipated crowd that is here, we have set in place a mutual aid request at an earlier time to have sufficient officers here should the crowd become unruly or intent on causing

property damage. we intend to have sufficient officers here to arrest people who are breaking the law. we want to strongly discourage that type of behavior. we are here to encourage free speech and freedom of assembly but if people are coming here to break the law and cause property damage we intend to address them. we have help from our community monitors to help us work the crowd to ensure that there is a peaceful and non- violent demonstration so we expect that to work in our favor. >>pam: de are, what are the protesters saying at tonight's rally? >>reporter: this is a general assembly they talked earlier at the library basically giving their viewpoints talking about how they feel about the issues, they talked about the fact that their camp was taken down many of them are angry over that. as i speak, i

apologize it has gotten dark in the past hour or so. cut but right here, this is where everyone is set up. you can see right outside of city hall. again they are discussing the matter, this is an open mike. basically what they do is ride up and you be your turn to speak. they have had a number of speakers tonight. i know we had a couple of reporters down there in the midst of things. i have heard some people speaking about some of the activities that will go on the uc-berkeley tomorrow. a number of the protesters out there protesting the school cuts and what not, they have anything going on tomorrow and many of them are very vocal about that. there are a number of different issues that they're speaking about right now in this assembly area. >>pam: j.r. stone is reporting live for us and after the police moved in early this morning the city of oakland kicked off a massive cleanup effort. here

you can see some of the 80 public works crew members clearing the frank ogawa plaza of debris that was left behind by the protesters. police held the protesters back behind the barricades while the work was underway. maureen kelly was their but tensions arose between those for and against the occupy encampment. >>reporter: an angry confrontation between occupy protesters and one and that showed up to visit the show his support for the city's move to clear the plaza of tents it is the men in a white shirt that reads open across the front and this is what his hat read. he is a home owner and longtime resident that is fed up with the protests. as you can see he is carrying a break, he hoped to help to volunteer in the cleanup effort but he was kept on the other side of the barricade along with others who got in his face over his position. the man in a plaid shirt had just been cracking his knuckles, watch as the

man in the black sweat shirt move that guy back a few steps trying to keep the peace but the anger was still present. >> this guy has been trying to kill me for the last half an hour. >>reporter: the confrontation continues and the police from the other side of the barricade and watched, someone ripped a sign from the man had and then he walked away. >>reporter: now police tactics were different this time around dealing with occupy protesters this is an ongoing conflict issue that is costing the city millions of dollars. just after midnight on monday police from around the bay area convened in alameda county outside of the oracle arena. add to 30 a.m. occupy oakland protesters got word of the raid. some packed up and move out of frank ogawa plaza. at 3:30 a.m., other protesters, hundreds of then rallied at 40 and broadway playing music, chanting and

showing support for their movement. around 4:00 a.m. the first officers arrived in downtown oakland. the next hour brought another wave, police in riot gear set up a perimeter using a bullhorn in forming protesters that they will clear out the camp. some people disregarded the warnings. >> i think i will stay here and be arrested. >>reporter: around 6 a.m. the police moved in the at that time most protesters left the area or raw processing peacefully away from the 100 tents that remain. people that refuse to leave were arrested. >> i am happy to report that there were no injuries to officers or citizens. there was no excessive use of force. and there was no resistance in the tents.

acting director for caltrans says that many steps have been taken to ensure that the bridge and other projects are safe. >> we have an issue with one in a ploy and falsified tests on three structures not related to the bay bridge. we have looked at all of the structures, one of the was actually identified during construction so we rectify that situation we have gone back and look at the other two and determined that they're safe as well. the situation with the bay bridge, we went back and look at the test performed by all of our technicians on the bridge and there were no issues and the structure was built as to plan. this is not just under one test, there are dozens of steps taken to make sure that the structure is built the way that we anticipated being built and that we are confident that it will perform the way it was designed to reform. >>pam: officials also announced that they fired the technicians boss but they added that his firing
