will take you inside the courtroom for today the emotional hearing. [music] >>pam: this is the dramatic surveillance video from last night showing the shooting of seven people including a child. the video shows one of the victims falling to the ground, people running and shooting. police say more than 50 shots were fired. grant lodes is there on the scene. >>reporter: let us take a close look this is so dramatic in chile. it is like something you see out of a moving. keep your eye on these three people, these three guys allegedly the group of people that shot a huge group, you can see two of them running off and this guy he sort of sticks around and continues to fire shots. i want to show and other angle, see the people near the white truck that is as they move in and fired a shot in the crowd that they're shooting at right

there you can see them standing around and then when the shots started they disbursed. you see a couple people return fire. i have slowed the video down. those are the three people, and there is the group that got shot at allegedly. and that i rose under the vehicle for protection. a couple shots are returned as people on the ground return fire. you can see the shots right there. this is just an unbelievable scene. you really get a sense of how chaotic it was. once the shooting starts it went on and on. dozens of shots fired. police set is 50 bullet shell casings were found on the ground. >>pam: let's go live to open dan kerman is standing by live at the hospital where the youngest victim is recovering tonight. >>reporter: good evening, friends of hiram lawrence

have been coming in and out of the hospital all day long. he is the youngest victim he had a gunshot wound to the head. we are told that he is in a coma at this point. two other people are also in critical condition. this went down while filming a rap video and this parking lot. >> we are following up on leads and have identified persons of interest. >>reporter: oakland police chief howard jordan says his investigators made some progress in trying to track down those responsible for this recent filing shooting. it wounded seven people and three critically including a one-year-old child. you can see bullet holes here as well as the remains of blood on the ground. oakland police say it appears that a music video was being recorded at this location

when the shooting occurred. >> the incident is still being investigated. >> they are not as cooperative as we would like to be. >>reporter: the lead investigator handling this case says it will be a lot easier if the people at the scene will work with the oakland police. >> we want to get some cooperation coming from not just the victims at the scene but the witnesses. >>reporter: this video appears to show the men hoodies firing guns, chief jordan says this is a limited piece of evidence because it does not reveal the identity of the shooters. >> even with this video we still need eyewitnesses to come forth and provide us some information. >>reporter: we are back live at children's hospital in oakland where the one- year-old child, the youngest victim is recovering. a little earlier today maureen kelly spoke with his father. >> here's a picture of the baby that was injured in this attack. hiram lawrence

is just one month shy of his second birthday. it is believe that this surveillance video taken about an hour before the incident shows the father holding the young boy. those are his legs dangling, the father confirms that the young boy was in his arms when the baby was shot. the fathers injuries are minor, but he has been here all day being supported by family and friends crying as he hugged well-wishers. i spoke with the data was too distraught to appear on camera he asked everyone to keep his son in hit their prayers he said the boy is all he has. >>reporter: earlier today police were joined by the mayor and pastures from the community. they said the police in america have their jobs to do but the community must also take responsibility and step forward and help to find a shooters in this case.

releasing new information in a violent black friday robbery in san leandro. the victim chris marlowe was shot in the neck after being approached by a group of men. he went home from the hospital today. meanwhile, san leandro police released watson's picture today they said that he was the shooter and is still on the loose. his pictures on the right, his alleged accomplice tony phillips was arrested on friday his pictures on the left he appeared before a judge today. j.r. stone joins us live as the police continue their investigation. >>reporter: we are learning that the victims had gone inside of wal-mart looking for a video game but it was sold out so they can outside empty handed and were in the parking lot smoky a cigarette and that is when the shooting happened. it happened a matter of feet from where i am standing near that stop sign the suspect walked up there with a fight and when they tried to rob them of jewelry and money, i do want to go to the video because this is

maximum sentence of four years for the death of michael jackson. tonight is not clear how much time you will serve the prosecutors are pledging that they will try to make sure that he does the full time and they want him to do it in state prison. right now he is at the l.a. county jail. this is booking photograph that was taken after he left the courtroom. the judge called him a dangerous man and he and no hesitation in giving dr. murray the maximum punishment. >> dr. murray created a set of circumstances and became involved in a cycle horrible medicine. >>pam: the defendant showed no affection while the judge said he deserved no mercy. >> dr. murray neglected his patient repeatedly lied. he violated the trust of the medical community and he has absolutely no sense of fault and is and remains dangerous.

happen. leaving court today michael jackson's brother jermaine said however much time dr. murray spent behind bars is should be longer. >> it should of been one heard the years it is not enough. >>catherine: the judge set a date in january for the prosecutor's request for restitution for the jackson family. they're asking for more than $100 million although it is not likely to contain much of anything he was deeply in debt when he started working for michael jackson and the singer died before dr. murray could collect his salary of $150,000 per month. >>pam: joining us now is our legal analyst michael cardozo. dr. murray did not testify during the trial, should he have testified during the sentencing? >> no he should not have, to my mind, the judge had made his mind about what he would do with dr. murray. i know because i talk with people on the defense team. they're hoping that the

maximum he would give was three years that the midterm for this. i thought you know forget dr. murray appeared he starts talking he would tell the judge i did not kill him, i am not sorry for this because i did nothing. the defense team thought if he gets up and says that to this judge in for some strange reason if the judge is thinking about three years that will push him right into four years. so it would not let him get up at the sentencing, they did the right thing. >>pam: were you surprised by the harsh comments by the judge? >> i know a lot about this judge from talking with my friends down in l.a. and know i was not. now i know at some point he has to put on the record why he is giving him the aggravated term because the four years is the most that he can give him and under our laws in mandates the judge put on the record why are you doing this and he did more than just put it on the record, he really as i said he

really gave the exploration in his comments. >>pam: so what is the reality of his term? >> he is going to serve two years. you know this is l.a., so we heard about all the starts and shoved out the back door at the l.a. county jail. that is what the prosecutors were talking about. the judge said i would like to plead in state prison the laws in california mandate that i cannot because we of overcrowded our prisons. we have put too many people that do not belong in prison there. i think he will go into the county in they will put him out the back door and put him on house arrest and that is when the d.a. will go to court and screamed bloody murder about that. pam >> is an appeal still like the? >> it is likely but it will not be successful. >>pam: thank you so much. >>jacqueline: visibility is remaining affected by fog .
