4:13 am
the protests are not happy with the situation they say they were taken by surprise at least that is what they told our reporter. there were given notice at about 2:00 a.m. that they would be evacuated, were effected that is when the police can iii and began to remove the protesters we will have more on this breaking story coming up in just a minute. for over 60,000 california foster children,

4:16 am
will be very chivvy are there. we have a freeze warning in effect until 9:00 a.m. this morning and that is mostly along the delta pretty far east in the delta as well. we are talking about antioch, pittsburgh and central valley is feeling as well. for your current temperatures, you can see that it is very chilly out five. we have 31 in santa rosa, 32 navato, courtesy to san francisco, 37 in half moon bay. you can see what the freezing temperature warning is in effect. in the meantime, for our afternoon hunch your expecting 61 in redwood city, 60 in oakland, and 59 in hayward. pushing north you can see more chilly temperatures. and for your
4:17 am
kron4 seven day around the forecast you can see that cold weather will continue to plague us through thursday also into the weekend it looks like it should loosen up just a little bit. the los should start breaking 40 degrees and the highs should start breaking 60 degrees pretty quiet weather as we head into next week. good morning america. >>erica: the morning dad and i have any major hot spots in the traffic area but the chp is giving with a fatal accident on east bound 580. i will show the traffic now often just one minute. but we have no place to speak of your the bay bridge toll plaza is pretty quiet and a handful of cars making their way out of oakland toward san francisco. traffic is moving well up the incline and across the upper deck and over at the san mateo bridge we are good to go in both directions. no delays at the toll plaza itself making its way towards the high-rise section. here is a live look at the golden gate bridge it shows a few cars,
4:18 am
so there is a nice and easy ride. i was a key at the traffic maps a few moments ago and we have not seen any delays whatsoever coming out of arnold torres highway 37 and down to the waldegrave. on to the traffic map fatal accident to see if we have been dealing with this since the 3:00 hour. by now, the accident is not blocking any of the traffic lanes. the corner has been called to the scene but the police have to conduct an investigation this could shut down some made with the next few minutes may be the next hour. i want you posted if i hear anything of the sort. >>justine: more now on our breaking news story the police are taking down the occupy sf in kama at justin herman plaza. yolie is on the scene where she is already witnessed several arrests, have things developed much since we talked last? >>reporter: not so much it has been more of a standoff. protesters are
4:19 am
holding their money from of the police department and the police department is holding their lunch. they're making it clear for the city workers to take down the camp and that is just beyond their line. it is right here with the palm trees are, right below there is where the encampment was. it is nullo--is now long gone. you cannot even make out what is what any more. it has been flattened out so much. >>justine: i guess since we last reported there were some 200 tents and he said the police have taken them down from about 2:00 a.m.. and you could see a very heavy police presence and all the protesters are still standing in the middle of the street right now. >>reporter: it is going to take them quite a while to clean up that area. they do not even have the power washed system out because they're still picking up
4:20 am
small many items. they spoke with one protester from alabama he cannot yet to be a part of the occupation and he said you know, people have collected quite a bit of stuff. they have made this place their home. they nudges seven sleeping bags and bags of clothes, they have several items to make it as comfortable as possible for themselves and try to collect that within five minutes is impossible. you are dealing with a lot of times in the area not just in to you can take into kuwait. there is just so much, there are so many items but they have to get rid of. it will be a while until they cannot that area. >>reporter: from the sounds that we are hearing it sounds like it is pretty high energy out there it is a really tense between police and protesters? >>reporter: not as intense as it was my first arrived. i was just after they had come in and basically one
4:21 am
people and people were getting upset because they saw other people being corralled in between to police lines and being arrested. people in the corral were shining-- shouting out center where she got of the police would not let me deny give me enough time. it is hard to say exactly what happened because i arrived right in the middle of that so you know, i know that was when it was most intense. at this point it seems a little bit relaxed only in the sense that people have had a chance to gather themselves for a moment. >>justine: so you have not seen more rest coming from the police take away a few people but not lot more. >>reporter: right. >>justine: now we're going to do is cover some other

stores. i saw a little bit of your video of what the in camera and look like right now we will play that cranky so much family. >>james: a high-speed rail project plan to connect the tires that california is losing popularity with voters it is designed to lead sacramento, los angeles and san diego. holders approved the project back to detonate at the time the price tag was estimated to be about $43 billion and was supposed to be completed in the year 2020. now, the project might not be done until 2033 and could cost $98 billion as more than twice the original estimate. a new poll says 59 percent of voters would reject the plan with the new estimate and 37 percent of those that approved it back in 2008 said that they would change their votes if it appeared on the ballot today. despite the change in attitude they say this is what the state needs to compete in the 21st

century. >> we are being out competed right now today all over the world but particularly in asia on countries that are building roads, bridges and building high-speed rail. we used to be the leader. if we did not catch up pretty quick, we will be in second place. >>james: high speed rail authority estimates that this will create more than 100,000 jobs. attorneys for barry bonds to try to keep the former star out of prison. dan asked the judge to grant probation instead of prison time citing his work with charity as one of the reasons. the judge has from time to think about this he will be sentenced for obstruction of justice later this month he was convicted earlier this year for being evasive when questioned by a grand jury about taking steroids. the obstruction conviction carries a possible maximum sentence of 10 years in prison. federal guidelines recommend a sentence of 15 to 21 months. time for a

4:29 am
4:30 am
4:31 am
>>justine: recess now when
4:32 am
you came around a corner with the police chief and that officer grabbed you had to react to what was happening? >>reporter: i am sure he went to talk to his leaders to get a situation on what is going on i did not even see him anymore look for keys produce a more enduring a leading the charge. he is out clearly came out here 1:30 a.m., we've or side-by- side walking the more information of a sudden you see a whole bunch of officers starting to supplant, not as walking briskly and with the clinton down the side of the side one who has when i started running i felt i got a little too close and losers could to some of the police officers and one officer actually push me back to her because he did not no. i was a meal or a front of the occupation. once i shall do my media-that is when he'll let me and said get over here! and that is when he allowed to go on the other side. it looks like they
4:33 am
have this attrition under control. you can see that they have with their batons talent and their hands are at this side but it looks like it is still building up. the occupy protesters are still in the middle of market street and probably knocked to the side of sidewalk. it looks like they're getting a little bit closer to the situation seems to be under control for now. >>james: briefly for those that just joined us, explain what prompted this act on the police. what was the that calls them to rush and encircle the protest to the ec in the middle of the street? >>reporter: for release 30 to 45 minutes after their camp was taken down in the middle of market street were that curve happened, everyone knows about that. what happened was at around about 28 minutes after 4:00 a.m., or for whatever reason they decided--they decided to move the market a street toward twin peaks. the police officers did not want
4:34 am
that to happen. and they have hundreds of police officers are out here. you can see them in riot gear and the surrounding streets. there are hundreds of police cars surrounded parked out there. and for their security all eyes must be on the occupy protesters. and they started moving down in this direction is the essence since it was unauthorized and they started moving in a quick movement with some of their steffan and hands and that is when the officer's daughter racing down the sidewalk. james, you live got a gun went off and they started to do is print or something like that. they ran over and got quickly in line. the county officers here, they know exactly what they're doing i am sure that they have practiced this many times we have to shoulder some of the officers are moving back to formation, back to where they should be before of this took place at around 20 minutes after 4:00 a.m.. there are still people in the middle of the stream very defined here as you can see that guys i talked with
4:35 am
the chief a little bit earlier and i asked him what you plan to do it? it looks like a lot of the occupy protesters that are not leaving at the very is a shouting and his police officers may be getting into their faces and he says we can handle that. in but if they start getting physical with these officers and then all bets are off. we can see some of them are standing on in other news event. excuse me, that seems to be one member of the media i concede-, but the guy with a beard-i know who that is. live looks at the have the situation under control. we talked with the police chief to recap about 30 arrests, he cannot give me a hard number but he said about 30 arrests, two of them were for aggravated assault. they decided to move in about three hours ago because they broke off communications. the city tried for days if not weeks to get a hold to these guys to correspond. they said there is a place in the mission that you can move to they have said over and over we are not going anywhere. when the jazz
4:36 am
broke off communication their e-mails were not returned, phone calls were not returned and that is when it decided probably late yesterday afternoon they moved in swiftly and in cockney know, i've never been anyone >>justine: know about paddy wagons that come in when they make all of those are rest? the ec that is all set up for the police to handle these things on the scene. >>reporter: i do not see any wagons, but when i drove down to get to the police chief i saw about 40 or 50 cars. i am sure the bulk of the rest are going. that is why we do not see those wagons here, but i can tell you maybe they will make more arrests. there are plenty of police cars and police vehicles in the surrounding streets. the next tree is mission, they have that she blocked off as
4:37 am
well. if you come down here, you have to drive down spear and then hop onto power to reconnect with the embarcadero. they have hundreds of police officers not just here but also in the surrounding streets. >>james: for those unfamiliar with the area was in the surrounding area? is it mainly commercial are their hotels? do you see anyone coming out in the street to check out what's going on? >>reporter: here is the height, the tourist that are staying there may be looking out the window to check out what is going on. and then you can see market we are basically in the financial district. there is the regional occupation on the left of your screen. they allow that for quite some time. that was ok. it looked like as he some structures there at this particular time. and as the
4:38 am
show you his view, down markets with the castro towards twin peaks. it is called in that direction. people are starting to move about but as far as here at the end of market, that is the embarcadero, the ferry building any 50 the one gentleman has his shirt off and he is being in the face of the police officers. it looks like the police officers are keeping their cool so long as they maintain containment and they are not touched by the occupy protesters. their remaining patient at this time we see a lot of police officers on the side over here for whatever reason facing the crowd. even though it has not gone out of hand there is no need to run at this point, you better believe that they have set up a wall to make sure that all eyes are on the occupy protesters and there probably keeping a close eye on their hands and the situation to make sure that there is no sudden movement. there are allowing protest to go on. i did talk with the police chief and i asked him how long
4:39 am
will this continue? how long will they be able to step in the middle of market street in do what they're doing right now? he says as some where we have to move in because we moved it already in the encampment. we have to move in for traffic purposes. this is a very busy street, and who tried down here, they turn the corner and then hop on to the embarcadero. sometimes they even make a u-turn and come back to market street. this is a very important juncture in and he did not give me a timetable but there will come a point when the morning moves on the added traffic start to pick up. i am sure they will move in and say enough is enough. you will be arrested if for anything else trespassing. >>justine: we will take a quick break on the kron4 morning news and be back with our breaking news story right after this.
4:40 am
4:41 am
4:42 am
4:43 am
and >>james: we are back with our breaking story we have live coverage of the sf and kamen that was rated early this morning by hundreds of police officers. well, what is going on right now looks like we have some police officers bench over? will can you hear me? i guess we do not have audio from the scene, but it looks like they're in the process along
4:44 am
of arresting someone. now can you hear me? >>reporter: a couple of minutes ago for whatever reasons there were occupiers that were put down to the ground. there in the process of being arrested at this time while they're on the ground they were shouting at the police officers are your resting me? i understand in the middle the street. it happened so quickly we do not know exactly what prompted the officers to arrest what ice-t is to protesters at this time. but for whatever reason he is being led away right now. he is shouting and the police officers that were standing here as well as his colleagues and fellow occupy protesters say that you've been led to a crumbling a van near they brought out what looks like to be more than any event. it looks like it may be a bus. in may be the one that they transported the police officers in, but also to arrest people. one is being brought up to his feet and led away from the scene as well. he is not resisting, he is not out of control. i
4:45 am
also got an answer as to why the police officers started sprinting down market street in the maybe 20 or 30 yds. the reason why according to one officer is because the occupy protesters for whatever reason started moving down market street towards twin peaks. the only moved several feet but it is their job according to the police officers to do what he calls to circumvent to make sure that they are surrounded and then occupy as it did not have a packed to leave this area to area it seems like they wanted here in the situation either to diffuse it, to talk out of this, to stand down or if they do not there will be eventually arrested. the fact that they started moving down in this direction, that broke containment by the police officers and they were not ready for that and that is when they have to sprint ahead of the protesters and get in front of them and basically with their batons told them to get back over here. that is the reason why, i have said this before
4:46 am
but they use their batons not an aggressive manner but just to push me back but crucial to send it back in it only until i showed my medium-that he would allow me to break through this containment to be where i am currently add to the live shot. and as she does look like a look people that refused to leave a street, market street have been arrested. as far as this section, all of the police officers are in the middle of the street. >>james: it looked like all the protesters are going there was a big number in the middle of the street did most of them just dispersed and the only arrested those that stuck around? what happened? through >>reporter: it looks like there is a bust over here that is moving in i am not exactly sure what is on the other side there is a bus that they brought in may be to make more rest. it is a sheriff's bus. they have either brought more police officers to the scene or they're using that to make an arrest. they are right
4:47 am
here, only a few feet away from the police officers getting into their faces and again, i did get a chance to talk the chief and ask him what he planned to do? he says if they get in their faces, that is just a part of the job. but if they touch a police officer or do something that is when they will have to do some little bit more aggressive. in the meantime they're just standing there letting the occupy protesters yelled at them holding signs a few feet away from their faces. it looks fine is pretty calm right now but as far as the number of occupy protesters continue made over the past 20 minutes or so, there are so many more occupy protesters here but now looks like they're walking down market street and for whatever reason maybe they're just leaving here. i do not know why the officers are not trying to get in front of the occupy protesters but they are
4:48 am
letting them leave at least on the side walk peacefully for now. i will get answers as to why they're letting them go as opposed to the occupy protesters that try to leave and move down market street. >>james: maybe that is the determining factor the to move on the sidewalk of the cannot block the street. thank you very much will be but you give to get more from the scene. >>justine: we have video to show what occupy sf looks like. the have been reporting that the dp w and the police cruise have moved in and flattened it to the ground. they are taking all of the people stuff, their tents and their belongings. they have been living here for months. our executive producer is telling us that 50 people have been arrested. 50 occupy sf protesters have been arrested since 2:00 a.m. this morning when the police moved in. we are monitoring the situation and two of the arrests were for aggravated assault on a police officer. we will take a quick break from our breaking news coverage and
4:49 am
move on to weather. good morning then. >>reporter: good morning justin, i feel for everyone out there. it is a very cold morning outside this is the walnut creek camera, it is clear, is the only reason we are able to see the headlights coming down highway 24. we have some freezing temperatures this morning and this afternoon can expect similar conditions to what we had yesterday. it will be sunny but very cool. we can expect in a the clear and cool evening tonight as well. maybe not quite as cold as we had this morning in the morning before that but cold nonetheless. we have a freeze warning in effect until 9:00 a.m.. this is mostly affecting the delta area. >>reporter: take a look to your current temperatures.
4:50 am
>>reporter: here are your high temperatures very similar to yesterday. >>reporter: here is your kron4 seven day around the bay forecast and coal to the trip will set in and around --cold temperatures will continue through the weekend. >>erica: the morning dan i deny having hot spots to tell you about it is a great
4:51 am
time to leave her house right now. it is a little bit cold out there but we are not looking at any major delays for your ride around the bay area. at the bay bridge toll plaza, traffic is moving in the westbound direction out toward san francisco there is no weight at the toll plaza flats and traffic is moving well from all three of the approaches. sent here bridge writers problem free in both directions, no problem getting to the bridge in either direction of the nimitz freeway or the 101 this morning. as we take that to the golden gate bridge, you could see a lot of space in between cars. traffic is moving at the limit coming out of marin county. i wanted to get back to the traffic map to update you on a single accident and of the following. car and this is right in livermore, a federal accident and multiple accidents and sitting on the shoulder right now in the chp in the corner on the screen this is not producing any slowdown whatsoever. however i do not know of distinctly has shut down lanes of later on to
4:52 am
kick up their investigation. with time right now is 51 minutes after 4:00 a.m., we have to take a quick break but we will be right back, stay with us.
4:53 am
4:54 am
4:55 am
>>justine: we are on top of breaking news in san francisco, the police have not taken down the in camera at justin herman plaza.-- taking down the encampment at justin herman plaza. we
4:56 am
are hearing that the police have arrested 50 protesters and that includes two protesters for aggravated assault on an officer. the video that you are looking at right now was taken at about 2:00 a.m. when the police officers moved in and started their raid. we have several crew is on the scene mantra of the situation for us. we have live pictures showing us what is happening at justin herman plaza. we can see dozens of police officers in full riot gear standing on market street try to keep protesters out of the street. they're also trying to clean of the in camera. they will bring in more equipment is prewashed in make it more usable for the public. again, 50 occupy sf protesters arrested, two were arrested for aggravated assault on an officer. this all went down about 2:00 a.m., right nothing seemed to look peaceful with the police holding their ground in the middle of the
4:57 am
street. the protesters were allowed to go into the encampment before the raid ended their belongings and leave. we have been following this for a couple of days now. there were trying to come to an agreement between the city in the protesters to remove --relocate the occupy and can't get to a place in the mission that did not happen in this morning the rate went down. we have team coverage and live coverage of this breaking news story when you're kron4 morning news comes right back.
4:58 am
4:59 am
[music] >> mark: we begin in san francisco the last and largest occupy camp has been broken up overnight. police moved in on occupy san francisco protesters and their encampment at 2:00 a.m.. on the left your looking at video of the encampment on friday. he was the scene this morning as the protesters were pushed out by the police. will tran
5:00 am
was caught up in the scuffle as well. that is the video on the right-hand side. but a school to will, he has been live on the scene throughout the morning and he joins us with the latest. >>reporter: i spoke with the police chief a few minutes ago, he is still here and he says there have been about 70 arrests and that went up from 30 when he gave me that number at about 4:30 a.m.. this latest incident called the police officers to mobilize and make more arrests. you can see that they brought out a bus from the sheriff's department and on the other side, they have people pressed up against the bus very calmly and they are getting arrested and it looks like they're escorting them want to the bus. in the latest number according to the chief is approximately 70. this is still a fluid situation. maybe five minutes ago, we shall do on the air that we saw a lot of people starting to walk down the sidewalk. they were not interrupted by the police
5:01 am
officers. there were allowed to leave the scene, however we saw about one dozen or two dozen police officers the on their motorbikes and they started to fall them just to make sure that perhaps they did not cause any damage, or chaos in the financial district. even though maybe we saw 20, or 25 protesters leave this area that are being monitored by about a handful of police officers on their motorcycles. next to them they were trying to keep a close eye on the situation. in the meantime, here is market street they're not allowing any of the occupy protesters to be on market street. we see a lot of them on the sidewalk and the walk there would be to show exactly what is taking place. a lot of the occupy protesters are still here with sleeping bags in their hands. a lot of signs just maybe a few feet away from the police officers of the yelling in the confrontation more portly the intensity that we saw throughout the morning, especially after the raid took place at 1:30 a.m., the intensity has died
5:02 am
down considerably. but the officers are still here and according to the police chief at some point this morning, if they continue to be here and more importantly they try to get on to market street they will be arrested again. >> mark: i apologize, we lost a shot there, but we will try to go to his coverage as the police raided the occupy encampment in san francisco. >> darya: jackie is a justin herman plaza and that is a part of our team coverage that we will get to in just a few minutes right now we want to get a look at the weather. it is another cold start to the day let us get the details. >>reporter: this is the golden gate bridge. let me walk you through what we are expecting on the weather front today. i will start off by saying that there is a freeze warning once
5:03 am
again. it is mainly confined to the delta and of course the sacramento and central valley from 1:00 a.m. until 9:00 a.m. this morning. a lot like yesterday we have free conditions that are in effect. as we switched to the temperature maps, fairfield are in the middle of the freeze warning is about 20 degrees right now. it is cold there and in antioch but not as bad. down in san jose we have 38 degrees, and livermore is awfully chilly. the main places that we will seek frost is in the inland valley locations to the east and the north. that is where we are expecting to see some of our cold temperatures this morning. concord broke the record, the old record was 32 degrees yesterday and they got down to 31 degrees. here is where we see the temperatures this afternoon. we have 62 for san jose, 60 for oakland, 59 for hayward. we have generally upper fifties to
5:04 am
