>>pam: new details on the case involving a man accused of shooting a teenager last year. today the judge said the primary suspect it will stand trial for attempted to murder and other charges. they say he fired his gun during an argument near a high school in april of last year. this is footage from the scene. the teenager participating in the track meet at the high school was hit in the head and still has not recovered from the injury. kelly pled not guilty to all the charges and he is due back in court next month. eight u.s. soldiers have been charged in the death of a fellow soldier in afghanistan. back in october, daniel chin was found dead in a guard tower apparently from a self- inflicted gunshot wound. the army said an officer and seven enlisted men face various charges including making false statements, maltreatment and involuntary manslaughter. the charges are essentially hazing. his

a close eye on the weather and the wind. right now is very, the temperatures will start to slide and was the wind picks up the temperatures we hope will get warmer. places like fairfield i believe this will happen there. we have 47 in fairfield, 50 in oakland and 50 at half moon bay. there is a freeze morning in effect for a portion of the north bay where that are expected to get into the 20s overnight tonight into tomorrow morning. so again, 20 degree readings there, freezing fog likely and that will lead to the slick roadways. you definitely want to bring your pets inside do not leave them outside in the weather like this. for the rest of the bay area the temperatures will be a little bit warmer. take a look at the wind as it picks up this is at 1:00 p.m. is hard to justify temperatures getting down to 32 with the winds up like that. the also see breezy

and the occupy oakland protesters is now underway. we have learned that the use of force investigation will include incidences' involving the oakland mutual aid partners. >> there have been dozens of incidents with demonstrators and for the most part, the police have been professional. >>reporter: professional yet violent scenes like these clashes between opd officers and occupy oakland protesters in recent weeks has led to the city hiring an independent investigation team of retired police officers led by thomas frazier to judge whether or not excessive force has been used by the oakland police. >> the first thing we have to do is really have a lot under investigation because there is a lot policy that goes back, way that. mutual

fellow protesters he suffered a serious head injury after an officer hit him with a tear-gas canister. this was october 25th almost two months ago. on november 3rd, check out this guy. he is also a military veteran he appears to be defying the police officers. and this looks like a scene out of the movies. police were given an order to use tear gas and beanbag bullets to control this crowd. a small group of protesters set fires and try to occupy an empty building in oakland. and remember this, our own jeff bush was barely able to talk as he tried to do a live shot. he had to get out of the way because the teargas was getting to him. at least one prominent protesters is not by the fact that this will actually be an independent police investigation. comment on

pulled his gun to it is high us go live to teresa estacio with the latest. >>reporter: , the officer involved shooting took place at the hilltop shopping center just up the street from the shopping center and down the street from the extended stay. that is exactly where this entire incident started to unfold. >>reporter: it all started here wednesday afternoon at the extended stay facility up the street at the shopping center in richmond. authorities say a man with a gun in his waistband a threatening gesture and that is when the police were called in. >>reporter: we arrived on scene, the officers attempted to catch the suspect. the suspect attempted to flee. and then he into the marriott and from what i believe he still had a fire arm with him. the officers tried to get to the

suspect him before he went out of the building and then a shot was fired. to access that >>reporter: was it one officer or two officers that fired a weapon? >> we have one officer that fired a weapon. the only thing that i know about the suspect was that he was a black male about 22 years old. the 22 year-old is reportedly at the hospital with a 9 like for a new in a dream. >>reporter: police investigators with internal affairs have been at the scene for most of the day. the officer involved in this shooting is on administrative leave while the shooting is examined to make sure that all the right steps were taken especially since the shooting resulted in injury and at several public places with innocent people around. >>reporter: you are looking at a live picture of the courtyard marriott in richmond. the police are still out there on the scene, and a part of the

parking lot where the shooting took place is still take off by crime scene tape with investigators still going over the entire decade--entire thing in a teasing together their case. >>pam: monte ellis will work and to witness to rent a guard with the golden state warriors is being accused. the plaintiffs said in late 2010 the player sent her at least 61 unwanted text messages that included phrases that set a sexy, and i want to be with you. her attorney says that he sent her a graphic photograph of his genitalia. she is also suing the team, the owners and general manager. we spoke with the woman's attorney who explains why.
