>>reporter: the city council make the decision on will finally be rebuilt, but the city is hoping that the name of it and come to a consensus on what they want. it has been a long road of rebuilding for a lot of people. he was just three weeks away from moving into his new home. >> the last thing on my mind is about updating everything. i discussed the want to go back home.--i just want to go back home. >>james: we have berkeley police searching for a murder suspect. they say man was shot in an apartment building late last night. officials say this was not a random shooting although at this point they do not have a motive and they have not identified the suspect either. this is their first murder of the year. the judge refused a request to the san francisco sheriff to

see his family. he ruled that the sheriff must continue to stay away from his wife and son of he awaits charges--while he awaits trial on domestic but abuse charges. child protective services are invested in the shares involving an incident on neglect involving his son inside the courtroom he talked about the ruling. >> i am incredibly disappointed to say the least. this had been enormously crushing the fact that i have not been able to see my family, be with my wife, or be with my son. i will continue to fight this. >>james: he will go on trial on february 24th. >>justine: decision 2012 there was a heated debate in florida last night. the gop candidates squared off in

>>erica: good morning and welcome back to the kron4 morning news we're taking a live look outside at conditions. >>erica: we have heavy fog immediately around the bay area. the good news is we have warm conditions in store for this afternoon. we will continue with this dry and whether--and mild weather pattern. we could see some showers around the bay. you will mantra that but as he take the divisibility charge you can see how compromise the visibility is outside your door. as to continue down highway 101, took out a bottle, it is less than a quarter mile the same goes for napa and potentially hazardous driving conditions out on the roadway. check out oakland their attitudes of a mile visibility right now and less of a quarter

expect more arrests very soon. >>james: , a grim discovery at a construction site in palo alto, workers found a body behind a chain-link fence. police as you can see quickly sealed off the area. the fight was being renovated at the time and they say it appears the body is that of a male and it may have been there for several days. there are no obvious signs of trauma. the house fire in oakland is being called suspicious. this happened on 28th street across from our mc qeen jr. weight. the fire was put out and about 20 minutes and arson investigators are trying to find out what started this. there are no injuries to report. >>justine: there are signs of an economic prospects-- progress however some poor housing numbers took the wind right out of the market's sails. the dow closed down. the nasdaq down

>>erica: check out your temperatures, not too shabby and most locations are dealing with upper 40's and 50's. santa rosa is sticking in the low '40's there the checkout san francisco coming in at 52 degrees, 54 for those at half moon bay. it looks like we see no '50s in the south bay as well. as the check out where the temperatures will will drop the rest of the day, by 7:00 a.m. it looks like we will stay in the '40's for most of the north bay and they begin a little bit warmer along the coastline. as we fast forward, you will see that we warm up significantly. we actually make it to the low 60s for some of the north bay area and then down the shores. and of the screen on your screen does indicate most people making it into the '60s. we do have a prayer--pleasant forecast on

out of the east bay, police are searching for a murder suspect in the city's first homicide of the year. a man was shot in the apartment building. that is will will tran is this morning. officials believe this was not a random shooting. >>reporter: they believe he was targeted, this morning here in the pit of the victim. i just talked with his friends and heavy is, he is a 35 year old. his name is kenneth warrant junior he is originally from new york city. his friends gave me a photograph to pass along. they say he was more than berkeley's first homicide victim who was a caring friend. he worked downstairs at the barbershop you can see the square building the local area he was going upstairs with the balcony and the like is he was visiting his friends open to watch the basketball game last night. he was in the process of knocking on the

door when apparently at least 30 shots were fired in his direction. as you can see there is a woman standing at the door right now i got a chance to talk with her and she said they wanted to open the door for him to so many shots rang out that the also ducked for cover. they do not know why anyone would go after him. they say he worked at the barbershop part-time and he works at the port of oakland as a longshoreman. a very friendly guy and they have no idea what was going on. he never talked about any possible enemies. coming up we will go inside the place i had a chance to look inside and i can tell you this place is riddled with bullets from the front to the back, from the floor to ceiling. they are so shaken up by what happened back with matt the very least at least the two of them were safe. they were not injured during the shooting spree that they say felt like one minute long. >> darya: passengers will
