but the immigration and custom enforcement agency said they were forced release him. i will give i a background on binh luc. first of all, he was arrested in 1996 for robbing a san jose chinese restaurant and a wholesale business. he had a gun at the time. in 1998, he was convicted of those crimes and sent to prison. when he was done with his prison term in september 2006. that is when he was taken into custody by i.c.e. and he was sent to be deported. however, in december of 2006, i.c.e. had to release him because they failed to secure the documents needed from vietnam to send him back. i.c.e. is saying today the supreme court ruled you can only hold someone so long if you don't get the necessary documents you have to release him.

binh luc man suspected of murdering people in this house was released in december of 2006 due it a paperwork snafu. he was arrested early sunday morning near haze and website in san francisco. residents was telling us it was a war zone. s.w.a.t. team officers descended on that resident saturday afternoon. >> i didn't now what was going on. i was terrified and shooken up. i didn't know what was going on. i didn't know if it was a bomb threat or what. >> on saturday they had haze blocked off. it was a s.w.a.t. team out here and guns out and banging on the door trying to get in. i guess they got in and made their arrest. they was out here for about hour or 2 hours. they still had s.w.a.t. cars out there. >> did you see them leave with

someone? >> no, i had went back in the house. >> reporter: you're looking another little bit more youtube video of s.w.a.t. teams surrounding that area. they were there for several hours before that arrest was made which was saturday night sunday morning about 12:30 a.m. investigators were back at this orange house again today processing more evidence but there's still plenty of questions, still involve. we still do not know how these five people were killed. the medical examiner's office has not released that. we do know there was blunt trauma. there was a sharp edged weapon used. police will not confirm whether that means one weapon or two weapons. police also are not saying if binh luc suspect was wanted in connection of this. however that doesn't mean he won't also be charged with this one as well.

again, san francisco police not releasing a lot of information that the point. they say it's an ongoing investigation. for details to come later. binh luc will not be arraigned tomorrow. that will likely take place on wednesday. reporting live in san francisco, kron 4 news. police released the names of the five victims today. you see them on your screen. all are san francisco residents three are family, two are male, all between the age of 30 and 65. today, santa clara sheriff deputy recanvassed this area. they plan to reinterview her family and friends and classmates as they search for new leads in the case. investigators say that they have received more than 350 tips so far. that as a new search effort begins tomorrow morning. marine kelly shows us what's

being done. >> reporter: you can class hanging up a sign out in front of the school. inside, is the advance team which will yous founder mark class. his daughter polly was killed 19 years ago. he will be meeting with sierra's family. >> when you have your child disappearing on you at that. you're at a lost. you don't know what the next steps are. any time you can get somebody to come in and help you through that process, i think you become thankful for it. >> reporter: the happy is getting the school auditorium -- the team is getting the school auditorium ready. >> if there's anything suspicious out there what so ever, the teams will be taught what to do with that. we will notify law enforcement so they can do an investigation of that. >> reporter: people are already showing up to find out how to help. some bringing supplies as the volunteers will need. >> hopeful it will will help people. i work all day tomorrow.

>> there have been rallies all across the country and in the bay area for trayvon martin. he is the unarmed teenager. he was killed last month by a neighborhood guard, a volunteer. he was unarmed. there is new information becoming public today it is suggesting that trayvon martin might have been the initial aggressor. the teenager was shot to death by george zimmerman. who has claimed he fired in

self-defense. >> it's been 1 month since his death, this huge rally in sanford, florida a show of support for trayvon martin. he shot martin in self-defense. police say george zimmerman had cuts to the back of his head and broken nose. now law enforcement authorities told the orlando sentinel details of zimmerman stories to them. they say zimmerman told them the teenager was the aggressor, that he decked zimmerman with a blow and began slamming his head in the sidewalk. meantime, members of the new black panther party issued this wanted poster offering a $10,000 bounty for zimmerman's capture. police know where zimmerman is and have not captured him.

the rain is approaching. if you are inland valley, notice the rain staying up in the north baby 10:00 in the morning, seeing some more moderate rain of santa rosa. little rain over in the san francisco and still dry down in south bay. that is until about 3:00 in the afternoon. moderate rain, this overtakes the north bay. as we move through the evening commute, the 6:00 hour, moderate rain continues through the north bay now along the coastline. san francisco, oakland and hayward catching some moderate rainfall. by 9:00 in the evening, rain starting to catch a little bit of break. as we step through later evening hours until wednesday morning, the 2:00 hour, we will see rain continuing down in the south bay but drying out for the rest the bay area. few spotty showers will be possible into wednesday morning. we will be seeing gusty winds as this storm pushes through.

california. the republican presidential nomination process kind of dragging along mitt romney does have a significant lead. romney not even half way to the 1144 delegates needed to lock up the nomination. you got 15 states and d.c. voting in april and may. bidcy couple months, states in the northeast and western area of the country have been voting romney. so far southern midwestern states they're going santorum. the two states with the most delegates up for grabs, texas and california. now, texas votes on may 29th. santorum could take the more conservative texas but it's virtually impossible for santorum to collect the 1144 delegates. romney have a much better

chance to get the delegates. california voters hitting the polls on june 5 and romney is heavily favored. this nomination process usually over by the time california votes. but, that may not be the case this year. you are looking at a live picture here. this is in downtown oakland, that's where a rally is about do get under way in support the family of trayvon martin. he is the unarmed black teenager who was killed by a neighborhood volunteer in sanford, florida. several groups organized this rally including the naacp, they are just gathering. we will keep an eye on developments there. san jose police say that a man tried to use a stun gun on friday in an attempt to kidnap a teenage girl. police say it happened in willow glyn neighborhood. a man approached the 16-year- old, hit her with a stun gun and tried to drag her in his car. the girl managed to break free

and run away. >> she described a feeling of electrical shock. >> the victim was shaken. she's getting cured. any time something like this happens in the neighborhood, the downside it very scary. the upside it tend to bring the neighbors closer together. >> the suspect is described as hispanic in his 30s about 5'7". police say he left the scene in a red compact car. a suspect on the run tonight responsible for stabbing another man at an occupy san francisco encampment. it happened late last night in the market street camp. people think the camp say the man got into an argument with someone else over a camera. that argument turned into a fight. the man was stabbed. the suspect ran off and has not been found. a former giant employee will go to jail for embezzling from the team.

today o'connor was sentenced to 21 months in prison. she must pay back the club more than $1.4 million. she admitted to embezzling about $2.2 million from the team and employees. in news now around california, police are investigating a possible hate crime in a suburb of san diego. that's where an iraqi american woman was found murdered. police say she'd been beaten with a tire iron and left for dead in her home. the 32-year-old mother was taken off life support over the weekend. a note left next to the woman's body which read go back to your country you terrorist. the woman immigrated to the united states 20 years ago. no word on the suspect. a california assembly man pleaded no contest top tim donnelly was fined $2200 for

>> yes. five murdered people. it's a sad thing. >> reporter: tony brown said he was here with police stormed in to arrest his next door neighbor. he said he can't believe it. >> he was a pretty cool nice guy. there were times he would walk up and down the street, and he would speak. pretty much everybody on this block know him and speak to him. he was a real cool guy. >> reporter: in san francisco, kron 4 news. we're back live on health street where the murder occurred on friday. we can tell you investigators were back on scene today. we still don't know how these five people were killed. the medical examiner released the names but not how they were killed. police say blunt trauma they also indicated there was some
