it's a little drizzling out there. we're in the weather center on this tuesday with erica as we track a pretty big storm moving towards the bay area. a lot of people are waking up to rain today. >> it's pretty light in nature, but take a look at the yellow on your screen. it's actually going to sag southward and make its way to the bay later on this afternoon. let's look at current conditions. you see areas of moderate

rainfall just southwest of rafael, you see it raining near the i-4 by pass. you see light to moderate rainfall near 101, but that looking tore the driest spot. rain along highway 101, potentially a break and you see it crossing the san rafael bridge and making its way down the freeway. you can see into the 6:00 hour we'll see periods of moderate rainfall isolated to the north bay. you can see south of the golden gate bridge. heaven rain for the livermore valley. closer to lunchtime you see the rainfall begins to shift southward. you can see it south of the golden gate bridge, hugging the

peninsula. it seem to be the most intense as we head into the 3:00 hour. we could see periods of pretty heavy downpours, hazardous conditions on the roadway. you can see in the south bay waking up tomorrow morning, but for the most part, plenty of cloud cover and residual showers as we head into tomorrow morning. along with the rain, we're dealing with gusty conditions and the wind speeds will actually increase in the afternoon. you can see 25 miles per hour sustained winds. we're seeing gusty conditions for some of our east bay valleys, potentially on the coastline as well. as you look at the bay area forecast, you can see we're not done with the weather just yet. we have showers waking up tomorrow morning, potentially a dry break on thursday and it

looks luke it's going the -- looks like it's going to make its way with hopefully dryer conditions as we start the work week. >> we'll do a quick bridge check for everyone as we take a look at the ride on 80. we saw wind speeds up to 20 miles per hour. be careful out there. a look now at the san mateo bridge. both going towards hayward, not a lot of cars out there this morning. have not heard anything about the wind advisories on the bridge. you're looking at 101. we're seeing the road wet. headlights showing glare. suspected of killing five people in san francisco, and the suspect was not even supposed to be in the u.s. at the time of the crime. this is video of ben thai's arrest. it was shot from a neighbor above. it was then posted on you tube.

the swat team was called to bring him into custody. he was supposed to have been deported back to his home country of vietnam in 2006, but a legal loophole allowed him to stay. and this was not his first run- in with the law. now, we'll show you details of his criminal past and why he was never sent back to vietnam. >> friends and neighbors continue to drop off flowers at the san francisco home where five people were murdered on friday. we're learning more about the man police have arrested for the killings. ben luck was arrested in 1996 for robbing a chinese restaurant and a wholesale business. in '98 he was convicted of robbery and using a gun and sent to state prison. after his time, he was turned over to i.c.e., the immigration

and customs enforcement agency. a judge ordered him deported and in 2006, luck was released from i.c.e. custody because they were not able to secure the travel documents from vietnam. a u.s. supreme court ruling allows them to detain an alien for 120 days after ordered to deport them. after that, i.c.e. must release the alien. that's why luck was on the streets of san francisco instead of the streets of vietnam. investigators were back on the scene monday processing more evidence, but still plenty of questions remain, such as how the five people were killed, whether there was one weapon or more than one weapon. as for the suspect, no formal charges yet. if and when that happens, he'll likely be arraigned later this week. and we still don't know whether he's the only suspect or if police are searching for other suspects. >> and without a passport, the

u.s. can legally not deport someone. an immigration expert says it's not uncommon for some countries to refuse to issue a passport. the university of san francisco law processor explains that leaves the u.s. stuck with a criminal that it can't send back home. >> it's not that they failed to deport him. it's that they could not deport him because they could not get the documents from vietnam. >> i.c.e. could not deport him because vietnam would not issue the documents. >> certain countries like vietnam don't have a relationship with the u.s. and a lot of times they won't issue this paperwork; correct? >> that's correct. although we're on diplomatic terms now with vietnam, we have not been deporting many people to vietnam. from my research i don't think we've deported more than a dozen or so people to vietnam.

i.c.e. has a duty to determine whether or not he's a public safety problem. and apparently they made a determination that he wasn't a public safety problem at some point and they released him. again, that's not uncommon. in fact, every year i.c.e. releases about 4,000 people in this situation, not from vietnam, but from all over the world, that they cannot deport. >> and from outside the house, you can see a small memorial has been set up. people have been stopping by periodically to pay their respects to their victims. and police have released the names of the victims. three of them are female. two or male, all of them between the ages of 30 and 65. flowers have been left at the scene in memory of the victims who were described as quiet,

fun loving, and hopeful. san francisco police say a man tried to use a stun gun on friday in an attempt to kidnap a teenage girl. this happened in the willow glen neighborhood. the man approached the 16-year- old, hit her with the stun gun, and tried to drag her into his car. the girl did manage to break free and run away. >> she described the feeling of having something pressed up against her and feeling an electrical shock. the victim is understandably shaken. anytime something like this happens in a neighborhood, the down side is it's scary. the good side is it brings the neighbors together and they watch out for each other. >> he's in his 30s, 5'7", and he left the scene in a red compact car. >> back with more headlines in a minute. let's give you a lookoutside where we have a view, looking

good morning. 4:11 is the time. we have rain falling. it's light but we look for it to intensify as we head into the later hours. your afternoon commute is going to be wetter than your morning commute. more weather in a moment. now back to the news. this scene is all too familiar for bay area drivers. traffic is crawling or at a stand still. they're trying to help but there's a rush to make improvements on a roadways. it's a 2012 deadline to begin on state funded projects. some of the bigger projects using portions of the $5 billion include some of the following. more than $200 million for upgrades to this portion of the

585 and 880 corridor. also $108 million for a southbound carpool lane on 880 in oakland. plus, $95 million for interstate 80 upgrades to the bay bridge. that will include widening ramps and installingstalling meters. and then bart. $2.3million. on this bart extension and how it's creating jobs -- >> reporter: the bart extension to san jose will create thousands of jobs for bay area residents. >> 18,000 jobs by the time this project is done. >> reporter: when it comes to creating jobs, the valley transportation spokesperson says this project is one for the record books. >> this is the largest infrastructure project that we've had in its history.

we're looking at 2500 average jobs per year each construction year, and the project is going to take five years to construct. it's already under way here on chato road in free mont. -- freemont. >> that translates to a major boost in the economy. it gets people moving. >> all right. a break at 4:13, let's give you another live look as we go. checking the roof camera. it looks calm and clear out there, but there's a lot of cloud cover and light rain coming down. more drizzle actually. but it will grow. we'll give you more details in just a minute.

here on decision 2012. republican presidential candidate mitt romney made a stop in the bay area last night. california could actually play a key role to a romney victory to win the republican nomination. kate thompson has details from the redwood appearance. >> reporter: he did not get exactly a warm welcome. a number of different bay area organizations out here protesting his fundraising drive through the area over the next two days. he is at a 1,000 to $25,000 a plate dinner tonight in redwood city. the organization is taking issue with his stance on many things, including labor and immigration. >> he said the first thing i'm doing is getting rid of access to health care and i'm going to degrade the wages of construction workers. that doesn't work for me.

>> his corporate greed, the fact that he flip-flops, the fact he doesn't worry about the poor. >> security is also very heavy out here this evening. hotel guests are being told to use the back entrance as the protesters begin to walk back and forth, blocking many cars from entering. there's at least a dozen police outside the hotel. reporting in redwood city, kate thompson, kron news. >> rick santorum confronted a reporter. you can see the anger on his face. the issue was whether santorum meant what he said when he said romney was the worst republican to run for president or whether he's the worst to run for

health care issues. he took issue with the statement. >> i've been saying it at every speech, quit distorting our words. if i see it, it's -- come on, man. what are you doing? >> well, santorum defended his outbursts, saying you haven't cursed out a campaign reporter, then you're not a real republican. >> what he said was not consistent with what i said. so he said mitt romney is the worst republican. >> at romney folks say templettally you're not suited to be president. here's a statement they put out. in the final stages of his campaign, rick santorum is lashing out with desperate and flailing attacks, and now he's in full panic mode, his behavior is sad to watch. >> after i won louisiana by 23 points. >> well, the next big primary date is april 3rd, that's this coming tuesday, a week from

today when wisconsin, maryland, and washington, dc will hold their primaries. rick santorum is scheduled to arrive early next week. the tickets will be from $25 to $125. the supreme court is going to hear arguments over president obama's health care law. every american will be affected by the outcome. the court kicked off what will be three days on the argument on whether the law is unconstitutional. now, first up, whether the court should be discussing this. if it's found to amount to a tax, legal challenges would be halted until penalties are imposed in 2014. >> this is not in the internal revenue code but for purposes of collection. so why is is this a tax?

is currently falling around the bay area. take a look at the yellow around your screen. we're getting moderate rainfall. you can see it raining in concord, walnut creek over the bypass, pretty much the livermore valley dealing with that weather. looks like we're getting a break in the south bay. not so much in san jose and for portions of -- you can see pretty dry conditions, maybe some wet roadways. it's really not raining over the bay front freeway, but that will change over the next couple of hours as we'll continue to see on and off showers, just a lot of cloud cover sit waiting there. -- sit situated there. not only are we dealing with the rain right now, but that will be the case as we continue

with future cast 4. it looks to the north of the golden gate bridge. check out 3:00 p.m., heading into your evening commute home, looks like we're seeing yellow and moderate rainfall, especially over 101 and portions of interstate 80. that will continue to push its way into the overtime -- overnight hours and it looks like we'll see windy conditions. as you take a look at your afternoon highs, we'll stay in the upper 60s, low 60s. 59 for santa rosa. cooler than that through downtown san francisco. and your around the bay forecast shows we're not ready for the weather just yet. looks like we could catch a dry break for thursday, but showers headed into friday evening. that will most likely be the case as we head into the

weekend. i've been looking at some of the extended models. looks like we could see dryer conditions as we start the next work week. we'll be monitoring your forecast for you because as we take you over to the traffic center, we'll show you how the wet weather is impacting your commute. there's a lot of accidents out there, but they're not on the freeway, so it's not affecting drive times. same store rate the san mateo bridge. a wind advisory has not been issued just yet, but i wouldn't be surprised if it's issued later this morning. one has been issued for the golden gate bridge this morningment morning. be aware of this as you make your way into san francisco this morning. all is well in the south bay, no problems for highway 101 and interstate 280 is problem free with lots of green on the roadway sensors, indicating speeds over 50 miles per hour.

a former giants employee will go to jail for embezzling from the team. she was sentenced to 21 months in prison. she must also pay back $1.4 million. in november, she pled guilty to wire fraud. she admitted to embezzling $2.2 million from the team and its employees. a break for 24 on the clock. we'll be back with more news in a minute. let's check the ride in the east bay. this is walnut creek. we'll be back in a moment.

weather. we've got a lot of wet weather out there to discuss and more on the way. erica, good morning. >> take a look at fairfield, pretty moderate to heavy rainfall. looks like we're dealing with rainy conditions up in the north bay on highway 101. you can see clear conditions for portions of i80, however it's rain over the bypass into san ramon, you can see the rain extends all along the 880 corridor. looks like we're catching a dry break through the south bay. we could see instances of light drizzle, so you may still need your windshield wipers, and certainly keep your umbrella handy today. you can see dry conditions along the bayshore freeway.

over the san mateo bridge, we had rain in downtown san francisco. looks like another wave is headed our way. all the rain is going to continue to sag southwards, so we'll see things progress in the next couple of hours. you can see into the six hour, actually the rain will become moderate to heavy. now, looks like the moderate rainfall will stay to the north. we could see dry conditions into the 6:00 hour. as we head into lunchtime, it looks like by 12:00 the rain will push through to oakland and san francisco, stretching into the delta. you can see people dealing with a healthy dose of wet weather and that will be the condition as the main front passes

with the law. >> reporter: here in san francisco, investigators were back on the scene of that five- person murder, processing more evidence on monday. in the meantime, we're learning more information about the suspect, ben luck. he has a previous criminal record for robbery and assault. also, he was supposed to be deported in 2006. however, due to an administrative paperwork snafu, he was released instead. also this morning a story of a bay area teen now missing for 12 days. the investigation into the disappearance of sierra lamar continues. so far, crews have only found the teen's cell phone and purse with clothes folded inside. the deputies recan advanced advance -- recanvassed the area around her home. they plan to interview her friends and classmates. they've received 350 tips so

far. they've assigned 40 investigators to the case, and volunteers plan to conduct their own search. it's being organized by the class kids foundation. >> class kids founder mark class is preparing a search team to help find sierra lamar. class met with her parents monday afternoon to discuss the organization's six-day search effort to find their daughter. >> they can ask any questions they might have so we can ask any questions that we might have and also, you know, explain why we do things the way we do so that there is not any confusion as we move forward. we're using volunteers from the community and oftentimes we'll be doing it in larger numbers

the advance team for the cloth kids foundation. they prepare volunteers for the search for sierra lamar. they found the body of nursing student michelle lee nearly four months after she went missing. now her brother michael has come forward, even though it's been difficult for him emotionally. >> it makes me feel like my sister is missing again. it's really hard, but at the same time it gives gives me some sense of -- i don't know what it is, but i feel luke i'm paying -- like i'm paying it forward. it hurts to do it, but it feels good to help the family. i see my family, and i see their minds strained. i see them hurting, and i see them kind of just all over the place. i know exactly how that feels.

good morning and welcome back to the kron 4 news. we're tracking the storm for you. you can see very white. we do have dry breaks with the heaviest rain up in fairfield. drive with extra caution because it's been pretty steady and constant since we've started our newscast. wet roadways there and you can see raining through san ramon, pleasantton. looks like we're seeing dryer conditions for palo alto and southern areas. just because we're not picking up rain on the radar doesn't mean we're not getting light rain. certainly keep an umbrella handy. we do have spots of isolated

showers on the peninsula. you can see it raining right now. last check it wasn't raining over highway 92. it looks like conditions have just changed there. looks like the rain is pushing its way through downtown san francisco over the golden gate bridge. you can see all this rain indicated by the darker green. it looks like heavier rain is going to continue southward. it's near san ra fell. -- san rafael. as we take a look at exactly what's on tap with this storm, looks like today we'll see rainy and windy conditions persist. you can see future cast four shows the heavier rain in the north bay first and as we advance across 12:00 p.m., you can see it cross the golden gate bridge. looks like everyone is dealing with a heavy dose of that wet weather. looking at what's on tap for

tomorrow, the front will pass and looks like we could get rainfall totals. almost an inch through san rafael and san francisco. you can see who and a half inches expected for santa rosa. two for napa and that will be the case into wednesday morning as well. you can see over an inch for fremont and heyward. this is a slow moving system. as we take a look at what to expect for beyond. scattered showers and then things will dry out. hold on to those conditions through thursday and parts of friday. the rain will move back into the forecast friday evening, stretching into saturday morning and as we look into the extended rainfall, models look like we'll see dryer conditions as we see the next work week. over in the traffic center, take a look at the approach.

be a contributing factor. the water is warmer than usual, and that's causing turtles to return sooner than they should. >> the biology has to be right for them, you know, the temperature, the food has to be near for them. so we really have not identified the factor that's affecting them. there could be several. >> well, there were also a lot of deaths last year and it's unclear as to why it's happening. an overpass continues to act as a shelter for homeless people. stanley roberts returns now to the san jose location to see what the city and county are doing about the situation. in this edition of people behaving badly. >> reporter: i returned to the over pass near communications hill boulevard after getting new information. apparently the city of san jose

and the county of santana clara got involved and sent some county outreach people to look around. at least one of the people living under the overpass spoke with the workers. this man had been living here for about three months. he came from chicago. >> you're a veteran, and you can't get in to get a hot meal. >> he accepted help and was transported to the veterans affair center in palo alto. it's admitted there's a systemic problem. >> it's been a problem for our city and most major cities across the country. it's within of the things there's no easy solution. we're sensitive to both the needs of people who need housing and find shelter under bridges, and we're sensitive to concerns over resident who is

will intensify and that will be the story with the rain today. let's focus in on the east bay. we've got problems here at brentwood. walnut creek to san ramon, you will see 580. through dublin and livermore, the east shore free from oakland through alameda and you can see 880 past union city. it's these areas of darker green where the rain could be potentially heavier for you. the latest readings out of a lot of locations is recording this as a heavy drizzle as opposed to rain coming down. things will change as we head particularly into the afternoon. the peninsula, hit or miss, looks like we've got rain around san mateo. little more by the airport and a few bits and pieces of it

this morning. so the chp has issued a wind advisory. keep both hands on the wheel. you can see the conditions on the san francisco side. the drive is just eight to nine minutes towards fremont street. now, we're seeing windy conditions. the wind advisory has not been issued yet, but i wouldn't be surprised if that happened soon. just 14 minutes from end to end, and a quick look here at the golden gate bridge. no problems to alert you to as you make your way into san francisco this morning. dare ya. 5:04, our story out of morgan hill, the 15-year-old girl who's been missing since march 16th. at 8:00 this morning, just a few hours from now, volunteers led by the class kids

foundation are going to spread out and look for her. she vanished before she reached her school bus location. finding her cell phone and a bag with clothes needily folded inside. investigators have not been able to determine if she ran away or was abducted. will tran is in morgan hill with more on the search. >> reporter: as you can see behind me, volunteers will gather about two miles from sierra's bus stop. here's video from yesterday as people showed up for this search which will last until sunday, rain or shine. they've helped with the searches and last year also with the missing nurse. there will be an officer with the sheriff's department on hand to answer any questions the volunteers might have.

sierra's mother called class last wednesday to ask if he could help. the search will go on each day from 8:00 until 1:00 in the afternoon. volunteers are told to dress warm because it will be cold and likely raining during the search. in morgan hill, will tran, kron 4 news. a man accused of killing five people in san francisco, as it turns out, he was not supposed to be in the united states at the time. here is video on sunday. this was shot by a neighbor and posted on you tube. the swat i'm, as you can see, they're rounding the corner, they were called in to bring luck into custody. he was supposed to be deported in 2006 back to vietnam. he was convicted of robbing a chinese restaurant and a wholesale business. he was arrested in 1996 and sentenced to more than 11 years in the state prison. then immigration and customs enforcement took him into custody after he was released.

morning news. tracking a storm that's moving into the bay area. traffic moving smoothly here into san francisco right now. it's been fairly dry over the eastern side of the bay. we're seeing rain continuing to move through. let's go to storm tracker 4. you're seeing trace amounts of rain showing up. rain starting to show up in the north bay. we're expecting heavy rain this afternoon with strong gusty winds. we have a wind advisory posted posted on the bay bridge toll plaza. we'll be back with the team coverage in just a couple of minutes. let's take a live look at the san mateo bridge. looks like it may be windy there. the roadway looks dry. so we're seeing light rain everywhere now. we're going to follow this storm as it develops. we'll be right back.

we want to focus on the weather and traffic. it could get nasty. right now it's just rain. >> the radar is impressive. we took samples and a lot of this is coming down in trace amounts. so far we're getting by with a mild morning commute. a little damp out there, but there's it's not -- at least it's not coming down in sheets. you can see rain coming down potentially wet for highway 4. i want to take a quick sample of rainfall rates we era seeing at -- we're seeing at the moment. 100th of an inch per hour in the light green. sliding the maps down to the pleasantton. you can see some of the darker greens from san ramon down to dublin. maybe that's where we're seeing the 300ths of an inch per hour. you will be driving into it and out of it. your windshield may get

speckled with water and you may need to run the windshield weepers a couple of times and then that's it. you're on your way. there's potential for light sprinkles. the south bay is doing well as is most of the peninsula. it's just in patches. there may be a few more bits and pieces out near dale lee and san francisco. you can see it here from the golden gate bridge all the way up to mo vatto. past santa rosa, you will see potentials but more often than not you're encountering drizzle. the winds are picking up too, so don't be surprised if as you're crossing the bridges you get knocked around a little bit. future cast shows how the rain is going to progress. we've got the clock set for 6:00 a.m. still the majority of the action is up in the north bay.

we're going to push it forward until noontime. you can see moderate to heavy rain. light rain is just about everywhere else. advancing even further now to 5:00 p.m., that's when the moderate to heavy rain will be cutting through the heart of the rain. this is your evening commute. we'll be looking at a wet won. just be prepared for the slow go as you make your way home. people try to navigate through the wet weather. still dealing with moderate to heavy rain through the east bay and south bay. most of the overnight hours, we advance to 6:00 a.m. leaving us with some showers in the wake of it. that's because wednesday we'll have chance for scattered showers, at least few the 2nd half of wednesday. seems you will fair better. thursday actually looks pretty good. models point to it being another dry day for us.

morning news. it's just starting around the bay area. rain is mainly in the north bay. east bay seeing some sprinkles and livermore valley starting to pick up. there's a wind advisory on the bay bridge. presidential hopeful mitt romney is in the area. this is a video of protesters. when romney attended a fundraiser in redwood city, the protesters set up a demonstration outside the hotel where the fundraiser is being held. they're upset with romney because they say he represents the wealthy. and you can see rick santorum pointing in this video. he was campaigning in wisconsin. the issue was when santorum called romney the worst republican in the country to run for president, especially when it comes to the health

next course of hours. we'll see anywhere from an inch around most of the heart of the bay all the way up to three inches or more in the north bay hills. so it could be a pretty decent rainmaker for us. this is what we're seeing on the radar right now. storm tracker showing widespread moisture. is all of this rain coming down? no. that's where it gets tricky. a lot of it is trace amounts. a lot of this is being recorded as trace amounts. looks like we have a little popout in antioch. we've got 500th 500ths of an inch per hour, and that's better than some of these spots here. that's what we're seeing right now. as we slide the maps farther to the south, you will see the dublin and pleasantton areas.

livermore and the east shore seeing rain. it breaks up around haward. the south bay, though, still not seeing a whole lot in terms of rain right now. san jose is doing all right. a lot of the lower peninsula is doing well, palo alto, sun city, doing well at the moment. most of the peninsula continues to be dry. you have to get up to the golden gate bridge and marina before you finally start to pick up some of that light drizzle. that's all it is right now, misty, hanging around the air, and it collects on your windshield as you drive through. 101 through marine county from the golden gate bridge up to nevada we're seeing light sprinkles. it picks up again as you make your way to santa rosa. our future fast 4, as it takes a look at the expected amounts, it shows up like this.

i've got the clock set at 6:00 a.m. i'm going the advance it to 6:00 p.m. we'll look at the 12-hour period, you will see santa rosa could see total rainfall amounts of two and a half inches, especially around the hills. look at eight-tenths of ap inch in oakland. lesser amounts down in san jose. now, i'm going to run the clock from 6:00 a.m. to 6:00 a.m. tomorrow. these are the totals we're expecting. 3 inches possible up and around the hills hills of santa rosa. two in napa and san rafael. 1.3 down in san jose. that's kind of what we're expecting with the system. not a huge rainmaker, but a decent one. obviously with the winter as dry as it has been, we'll take what we can get. now, hit or miss for the rest

suspect is on the run responsible for stabbing another man at the occupy san francisco camp. it happened at the market street camp on sunday. people in the camp say the man got into an argument with someone over a camera and that argument turned into a fight and the man was stabbed, and the attacker ran off and has not been found. a former giants employee is going go to jail for embezzling against the team. robin o'connor was sentenced to 21 months in prison. she must also pay back the club $1.4 million. in november she pled guilty to wire fraud, admitting to embezzling $2.2 million from the team and its employees. and to the south bay where an overpass continues to act as a shelter for the homeless.
