restaurant. people in restaurant at the time of the shooting. more information, an update from police but one suspect shot in critical condition by a federal agent tonight in richmond. reporting live, kate thompson. now to our other big story tonight. new development. the suggestion speck in the case was supposed to be arraigned in court today, but is outside the hall of justice in san francisco with more. dan. >> reporter: well, pam, we can tell you ben luke was in court to be arraigned on five counts of murder but that was delayed over a dispute of what attorney should represent him, but the headline in today's court hearing was this, his brother brian who was arrested on

time that ben luke was arrested today in court the district attorney announced brian luke the brother will be a wirth nes for the prosecution against his brother. now, we don't know what that means if he was on the scene at the time of the murders or if he has some information. you're looking at video now of the two defendants coming into the courtroom today. we their faces. you see them coming in in the orange jumpsuits shack led at the wrist. the dispute in court has to do with who represents the defendant ben luke. the public defender was representing his brother. they will not be able to as a result. and she will hear more and rule tomorrow morning. at that time, ben luke the brother accused of these multiple murders will be arraigned but right now, the arraignment is delayed but the key thing to note right now is that ben luke's brother brian will be a witness for the

prosecution against him. that is the latest justice san francisco, kron 4 news. >> tonight kron 4 is learning new details about this mass murder. our camera caught these police inspectors gathering evidence at the crime scene this afternoon. several items put into evidence bags were boxes of cigarettes. they have been take when to the lab for processing for possible >> this comes on the heels of learning information about what happened inside the house. sources say the scene was violent. >> reporter: kron 4 news has learned the mass murder of five people here at this san francisco home at 16 house street was extremely gruesome. a source tells us that the suspect

sheriff laurie smith who stopped by, they are focusing on the area within a two mile radius of the home and that may include some criminal background checks going forward. >> from the time she was reported missing friday, we treated this as a crime and while we were still looking at the runaway possibility, we haven't let xl but 40% of the people who abduct children live within a mile of the victim and that is why we're focused on searching houses and really hitting the neighborhood. obviously you can see we're searching further out because we're not ruling that out. we know we have talked to every

the system within a two-mile radius. we have -- i think we exhausted all people who are on probation or parole or that will be done today and we'll start hitting the people who have criminal histories. we we are working as if she is alive. we want to return her home safely. higher priority areas first. at the same time we're doing the lower priorities. we are holding out hope and we want to get her back safely. >> late today the sheriff's office says there was no new physical evidence found by detectives or citizen searchers since the cell phone were found a week ago last weekend. they have received some 400 tips and that 40 detectives are >> one other development to pass on and i just confirmed it from her mother marlene, that the entire family has undergone polygraph tested conducted by the fbi and that information

was confirmed this afternoon although she would not discuss the results of those. more tests are pending but she here, this is a map of the search area. this is sierra's home right there. the water search began yesterday with teams going to the reservoirs and then today the water search expanding to include parkway lakes and u vass res ser very, a ten mile radio around her ú that are specially trained to smell human bones have been going out on boats with their handlers and if the dog smells something then a diver on standby will enter the water and search for sierra lamar. we have video from one of the scenes as this team is ready to head into the water. you see the boat there.

as we scroll ahead, they have already searched six ponds in parkway lake, some 6 to 8 inches deep. they are focusing on the shoreline for anything that can possibly link them to sierra. >> anything associated with the case that we feel might be something, it could be a piece secure the scene and wait for the detectives to make a determination whether they want us to recover the item or if we need to go under water for. we have the equipment to do that. it would be at the request of the detective here. >> they are not done. this water search is expected to continue tomorrow and stay with kron 4 and kron 4.com as we continue to follow the latest on the search + missing teenager sierra lamar. pam. >> the most recent storm system to blow through the bay area left some damage in its wake. a 40-foot limb collapsed on the

driveway of a home. very little structural damage was caused. the roof gutter was smashed and no one was hurt. came down and destroyed part of a tree there. >> you can see how this 100- foot valley oak is engulfing this house here. the people inside were trapped for a short time. luckily they are okay, but they say this tree has destroyed their living room, office, dining room, front porch and front stairs. if you look behind some of broken branches you can get a glimpse of the red tag so this home is uninhabitable. when i pan here you can ski the tree also took down power lines when its fell. right now i'm in the neighbor's yard where the tree came down. from this angle you can see how one big branch split commit pli off when it landed.

when i zoom in you can see the l]9 chimney knocking a lot of the bricks off. from this angle you can see why it fell. take a look. the tree completely uprooted. ann arbor wrist pointed to the foot and a half of water underneath the tree. so much rain in such a short time and the size and age of the tree is what caused this massive oak to fall down. maureen kelly, kron 4 news. a break from the stormy weather. there is a possibility for more rain to come. >> more rain is on the way, but not for the next couple of days. we're seeing a few spotty thunderstorms. that is the yellow you see on your screen but it is well inland right now.

three days of arguments over the president's healthcare overhaul have wrapped up in the supreme court. now they will decide which parts of that law will remain

attack. well, we're taking a live look outside. a couple of areas of thunderstorm activity and this is mainly east of the livermore. you can see right over the 580 a a little rain. heavier rain due to the sun breaks this afternoon, but the threat not over the bay area. into the overnight hours, increased fog close to the coastline. this is associated with our next storm. that will not push in until we head to saturday. it will stay north, but it will bring the sea breeze winds and we'll see fog as a result. for tomorrow morning, i'm not liking the coverage. i think we're going to see it down along the coastline. possibly even a little more coverage here in the north bay. you can see the fog starting to sag down south. more coverage along the coastline. close to the coastline, expect

now at 5:30, a sexual assault suspect targets a woman in a quiet san ramon neighborhood. now police have a sketch of the man who is wanted for the crime. >> here is who investigators are looking for. >> you're looking at a sketch of a suspect wanted. tuesday it happened after 11:00 a.m.. a man walks on the door and he pretends to be looking for gardening work and then it happens. police lieutenant dan pratt takes it from there. >> he forced his way into the house and was able to force her onto the ground. she was screaming.

he covered her mouth, touched her inappropriately before she could fight back and he ran from the resident. >> the victim gave investigators this description of the suspect. >> she described him as an indian male, very straight short black eye, no facial hair wearing a navy blue jacket and brown leather shoes. he was seen in a gray or light blue suv. the most break-ins he changes his mind once he realizes someone is at home, but not the case here. >> this is a little unusual in that he seemed to be intent on attacking this particular victim. >> the prosecution has finished targeting and presenting its case in the trial of a suspected gang member accused of killing a father and two sons in san francisco. he is charged with killing the victims. in 2008 while they were

returning from a family trip. prosecutors say it was a case of mistaken identity and he thought the car he was shooting at belonged to rival gang members. his attorney said he did not shoot anyone and she says the person who committed the murders was a passenger in the car he was driving. >> an elderly woman died after the fire. the 92-year-old woman died not long after being pulled front smoke filled structure. firefighters said the fire may have been started by a floor heater. the cause is still under investigation. a medical examiner will determine the exact cause of her death. >> bomb making equipment recovered from a san carlos business complex. they were found in a storage area on washington street.

the bomb squad was called in and they took the equipment to a remote location where it was eventually deemed safe. they believe the items belonged to a retired plaster who recently died. >> hundreds of pounds of seafood stolen over the weekend. some of the stolen products include about 200 pounds of halibut and 150 pounds of crab. total value of the missing food, $2,100. no arrests have been made. we're still seeing a few areas of rain to the east of us mainly due to the thunderstorm activity this afternoon because of the sun breaks but you can see broken cloud-cover over the bay area. temperatures were up this afternoon. 54 half moon bay. still pretty cool there. 61 oakland. 63 in concord.

his brother, brian, will be a witness for the prosecution. as you mentioned, bin luc in court. he faces five counts of murder with special circumstances. again, due in court to be arraigned. that was delayed due to a dispute over whether the public defender should represent him. the d.a. says it is a conflict of interest because the public defender represented bin luc's brother in the past and now the prosecution says his brother, brian, as i mentioned, will be a witness for the prosecution. it is unclear whether brian look has brian luc has information on the murders. the two brothers arrived in court in orange outfits. they were shackled and the media was not allowed to show their faces. the public defender says they sought out bin luc to represent him, that it is not a conflict of interest and they are suited

to represent him. the judge will make the ultimate decision tomorrow and bin luc will be arraigned on five counts of murder that is the latest. live from the hall of justice in san francisco, dan kerman. we should also mention that the crime scene is still very active. dozens of investigators are back there today. and we have this exclusive video. >> reporter: watch as our cameras caught this exclusive video of police inspectors carefully picking up several pieces of evidence this wednesday. as you can see right here, one of the items was a box of cigarettes. sources say that the evidence gathered will be taken down to the crime lab for processing for possible dna in this case. the inspectors were across the street from 16 help street. the scene of the crime where five people were murdered in what has been described as a very gruesome and bloody crime scene. police tape still blocks off

the home and police keep watch. earlier in the day, about 30 inspectors were out at the home. they would not say why they were there. only that it is a very complicated crime scene. in san francisco. a shooting outside a richmond restaurant. a federal agent was critically bounded. a -- wounded. a suspect arrested. >> reporter: we have learned that the federal agent was an atf agent, that is alcohol, tobacco and firearms. they were in the parking lot of chevy's restaurant. you can see the investigators marking off the evidence with the yellow evidence markers. this is across the street from the hilltop mall. we can show you some video. it happened around 3:00. the police say the atf agents were doing an investigation and had three suspects they were

watching. that is when the federal agent felt that they were in danger and they fired. one suspect in critical condition, two others arrested. one of the suspects fled the scene. there was a 30 minute search for him. the police put up a helicopter and finally located him. they tell us that one of the suspects was 19 and the other two were in their early 20s. we spoke to a man that was inside the chevy's restaurant at the bar, and he described the scene. >> and all of a sudden, people are screaming, like "get on the ground, they are shooting" i turned around, and everyone was on the ground. so i jumped on the ground. and i we want to the back of the restaurant. if you were shooting, i would run. police found 2 guns here they recovered from the parking lot.

it will stay up to the north through all of tomorrow and most of friday. it is certainly going to impact us in terms of fog. definitely going to be seeing fog on the coastline into tomorrow and possibly into the north bay. i think we'll see fog along the san mateo coast line until tomorrow. that will peel back by about 10:00 in the morning. you see here in this fog tracker picture, it will be pretty much back to the coastline and over portions of the north bay but clearing out into the afternoon away from the coast. tomorrow morning, temperatures will be warmer closer to the coast line, reflecting the coverage. 49 in san francisco, 46 in oakland. into the afternoon, temperatures will be warmer than what we saw today. we'll get breaks inland and places like pleasantton, 67

worst destruction. a 100-foot oak tree caused damage to a home in fair fax. the family members inside were not hurt. the family's car was also totaled. and some of the clean up going on is happening at a home in oakland's mont clare district. >> reporter: here you can see accrue that is clearing away branches that have been cut off, this huge portion of a cypress that came crashing down tuesday night around 5:00. a lot of them fell on the roof as well. luckily there has been no real structural damage. just the gutter was smashed. no one was home when the tree came down. luckily, no one was hurt. the homeowners sleep in the room this tree is leaning on. they stayed in a downstairs bedroom to be safe. let me pan the camera over here. you can see how the tree trunk split in two here.

news. right now our top story. >> reporter: here in morgan hill, another search for sierra lamar who vanished on the way to school 13 days ago. on wednesday a small army of citizen volunteers combed the countryside around morgan hill searching for signs of the missing teen. at the same time, investigators are convinced sierra is not a runaway but was rather abducted, possibly by someone that knew her. the search continues on thursday. in morgan hill, kron 4 news. continuing our coverage, the sheriff dive team spent the day searching through reservoirs and ponds in the area for anything connected to sierra lamar. this is video of them in parkway lakes. they have their equipment on the boat but will not go underwater until they get a hit. >> reporter: here at the hall of
