we'll have a live report coming up to show you what's happening right now at evergreen valley high school on capital avenue in san jose. we'll move on to another developing story. today starts the third day of testimony in the hearing of two men accused of beating brian stow outside of dodgers stadium. witnesses gave detailed and graphic accounts yesterday on what happened when that giants fan was attacked last year. j.r. stone has this story. >> brian stowe attacked suspects louis sanchez and the other man were this court thurs daimplet witnesses who saw the attack outside of the stadium took the stand, saying two men fitting the description of the suspects first went after young giants fans. >> they punched one or two of them and started saying -- >> upon returning to their car the witness described what happened next. as she spoke, louis sanchez, the man prosecutors say attacked brian stowe, reacted >>the shorter one tried to high five me.

i was afraid he was going to hit my face, so i moved out of the way. he said, that's how we do it. >> did you respond to that? >> i said, really, that was stupid they were like 10 years old. >> sanchez reeked to another comments. >> he put his arm around my shoulders. >> when another group of giants fans walked by, the same witness said that the two men chased after them as well. shortly after was when stowe was attacked. >> i heard brian hit the pavement. the parking lot floor. it sounded like a thud, like someone's head was smashing against the pavement on the parking lot. >> while neither witness could identify norwood or sanchez specifically, their descriptions match. the car identifications match and the timing matches. >> they were running toward the white car. they were out of breath.

one of them had his jersey in his hand and that he were saying, drive, drive, drive. >> we'll be covering that hearing today. now we move on to the man accused of killing sierra lamar. he made his second court appearance but did not enter a plea. he a charged with kidnapping and murdering the 15-year-old girl from morgan hill. a legal analyst says the case could take years. just because the victim's dna was found in the suspect's car it is far from a slam dunk for the prosecution. >> if they came into contact with one another, that in and of itself doesn't equal murder. if he's denied he ever had contact with her and the dna shows that's not true, that will certainly be something the district attorney will hammer home that he was evasive and lying. >> outside of the courtroom, supporters of sierra lamar held signs demanding justice. her body has not been found.

in san jose police carried out a massive pros fusion crackdown. authorities conducted four separate operations in different areas of the city. it was all part of what's being called operation bee sting. three of the busts used undercover female office officers to arrest customers soliciting for prostitution. another part of the operation targeted pros tiewtses at an unidentified hotel. police made 32 arrests. a violent jewelry store robbery in the east bay ends with one of the robbers dead. that suspect was just 18 years old. >> he armed himself with a handgun and shot and killed a robbery suspect inside the golden treasures jewelry store. that's what investigators here at the san ramon police department say one of three victims did wednesday after four robbery suspects entered the store, one of them armed with a gun. investigators have now identified that armed suspect as 18-year-old cabron

beru of hayward. he was shot and killed as he was trying to escape the store after the robbery. the otherly suspects got away. investigators say there was one customer in the jewelry store along with store personnel when the incident occurred. however, at this time investigators are not saying or identifying which of the three victims fired the shot that killed the suspect. back to you. james fletcher is in the weather center for us talking about the forecast for today and the weekend. >> good morning. it will be another warm one today. this is a live view from mount tam looking over the bay. visibility is relatively good. ]8pgécloud cover and fog along the coast. it's not penetrating too far inland right now. the ceiling of that marine layer is 800 to 900 feet, which is not tall enough to get over the hills and into the east bay. we're warm in the east bay. cooler along the coast. mid-50s in san francisco, upper

50s near concord and pleasanton. 60 degrees still out in fairfield. the cooldown, it's cooled down but not much in the east bay of the temperatures will jump back up again. in the south bay upper 50s at the moment. temperatures today will play like this. at noon sez is he and 80s around the bay. then 90 degrees already at that point in the central valley. 3:00 p.m., 90 degrees begins to encompass a good bit of the san ramon valley. san jose, south of the city, may very well see 90 degrees again. wave a couple spots in the north bay that are prime candidates for that. fairfield 89, low 90s near antioch. bet that these upper 80s will turn into low 90s this afternoon in livermore, 81 in

san jose. south of san jose temperatures will really spike. downtown san francisco around 66 degrees. that marine air will act as an air conditioner for san francisco, but no relief in the inland valleys. story changes through the weekend. there is some relief in sight for folks that are too warm near the delta. saturday, sunday inland temperatures low to mid-80s. we cool way down monday. we have a system to the north that will bring us cooler air for sure and the possibility of some drizzle at least for monday. tuesday, wednesday, thursday we recover nicely. that's the weather. let's check traffic. no problems no, hot spots to report. westbound 80 moving pretty good. no worries through a lot of east bay to the bay bridge. it's a pretty nice commute into san francisco. across the san mateo bridge,

golden gate bridge also fine. that fog is not really slowing you down at all. no problems on the roads. >> thank you. developing story, a fire at a san jose high school. we're live at the scene to show you what's going on. this must be the dumpster where firefighters say this fire started. >> reporter: one of two locations here at evergreen valley high school, about 2:30 a.m. someone set fire to this dumpster and another one. fortunately, only g[,dcsuperfic damage to the building. there's a a reason they build fences like this around the main part of the building so people can't get in. you can see firefighters inside making sure things don't start up again. they're not saying whether or not a student was involved or anyone who had any problems with the school. they got this out pretty quickly. this dumpster is all metal there. is no wood in the area. so fortunately everything was contained. it's matter of investigating to

see who did this and why here at this school in the middle of the night. back to you. >> do you know if there is going to be school today because of the fire? >> it's too early to tell. i have talked to fire officials. they have yet to talk to school officials. they'll make a decision on that. >> thank you. that's the evergreen high school. we'll update that in 20 minutes and find out if school is happening today because of these fires set by campus. months after legal fighting the video which shows the injured wife of suspended san francisco sheriff ross mirakarimi. it's now out for all to see. several months ago he pleaded guilty to domestic abuse charges. he has been suspended and will face an ethics commission in a few weeks. legal analysts are saying this video is going to be a powerful piece of evidence.

let's give you a quick update on the weather here. mount tam cam looking back over the bay, we have clear skies up above, some general haziness around the coast. we have some fog out there. inland it's pretty clear and warm in some spots. in the 60s in fairfield and in livermore, antioch and brentwood, upper 50s concord and pleasanton, san jose 59 degrees. we got pretty warm yesterday and didn't e=ç1sicool off that overnight. it's comfortable to be outside. some spots in the east bay will be down right hot and could be uncomfortable. at the noon hour we're already looking for upper 60s to 70 degrees around the peninsula, 70s and 80s throughout a good bit of the east bay and the south bay. by 3:00 p.m., you see all that red on the screen indicating the potential for tom nine- degree weather again.

looks like today could be a day just like yesterday. we have ate a ate project ford mountain view, mid-80s near san hose air, warm south toward morgan hill. close to 90 there as it will be in pittsburg and antioch and livermore, pleasanton low to mid-90s. concord and danville 88. those could push up a few degrees. milder along the shoreline. union city low to mid-70s. downtown san francisco mid- to upper 60s. somewhat of a marine push for those folks. it really won't get too far inland because it's -- the wins won't stack up in our direction. we have more of a northerly wind today. north bay in the 80s to potentially 90 degrees up near santa rosa. the weekend is fine. it cools off just enough that it will be comfortable for the

inland valley. monday we expect the chance of some drizzle. cooler temperatures for sure. inland highs up around 69 degrees. we stand the chance of seeing maybe up to a 10th of an inch of rein monday. we'll watch that. tuesday, wednesday, thursday looking pretty good, temperatures back on the climb. now let's look at traffic. not a lot going on. no hot spots to report. bay bridge looking good on westbound 80. no issues from oakland into san francisco. san mateo is good on 92 as is 101 on the golden gate bridge. it's a little foggy, but not slowing you down. things got wild in bakersfield yesterday because a small bear forced a lockdown of two schools. >> cornered inside a storage closet at this east bakersfield

apartment complex, the bear began to snarl and growl. an animal control officer armed with a taser and snare pole and a sheriff's deputy armed with a shotgun kept the bear at bay until backup arrived. they tasered the animal several times as it pawed at the snare looped around its neck. >> with you were your first thoughts? >> that it was a ugly dog. but it was a bear. >> maintenance workers spotted the bear as they painted outside the complex. >> they took two of them and some tasers to get it. >> were you thinking they were going to have to shoot this bear? >> oh, yeah. >> minutes earlier the bear was caught on this surveillance video scampering across the parking lot between garza elementary and sierra middle school. >> some girls came in running, there's a bear right in front of the school. >> it ran through the elementary school playground before heading to the

good morning. a community garden is getting weeded out from a community. stanley roberts explains. >> with you you are looking at is one of nine holes in the ground at the holy rosary chapel community gardens in antioch. niece nine holes can be found behind the higgins funeral chapel. but they're not there by design. >> when i came back in the afternoon to water the trees, they were gone. >> she's one of the volunteers for the garden. >> we're growing them for the community. fruit. >> yes, someone came to the community garden and stole the fruit frees. awful them. >> apple, plums, nectarines, pear tree. >> wait. there's more. as if that wasn't enough. not only did they steal the fruit trees, they stole some. vegetables that are growing in

internal damage or injuries to anyone. the school is shut down, they close on the 25th. it is not like they have to cancel classes. this is a summertime but arson. >>darya: today, friends of bryan stow are expected to take to the stand in the los angeles. this is the third day of a preliminary hearing for defendants luis sanchez and marvin norwood, both are facing multiple felony charges. this is video from yesterday, there were in court and heard an eyewitness account from a woman who said she saw two men assaulting bryan stowe outside dodger stadium. she did not see the confrontation but she says they came running back and jumped in a car and shouted at a woman driver to get out of there. >> i heard rain hit the pavement.

to brace himself and landed on the ground. doctors have said that he will suffer from a lifelong brain damage. he will meet skilled help from nurses for the rest of his life. what makes this case it difficult is that the witnesses all can agree on a time and description of the witnesses however, they cannot give it pinpoint accuracy on the face of the witnesses. that is what the defense attorneys are trying to bank on. this is not a trial. the judge is listening to all of the testimony. >>darya: in a developing story out of the south bay, a fire broke out at a san jose high school this morning. to bring you more news faster, craig sklar, what
