know who she is put at this time they're not telling her identity until her family or the first of can has been notified. she is a 19 year-old woman that was shot and the face. ask the officer how many shots were fired and he said at least one. what we do not know what this time and investigators are still talking with witnesses to see whether or not the person was shot or if someone was in the room at the time. we know this is the 63rd murder in oakland so far this year. at this point the police to have any suspect or any motive. homicide investigators are continuing to show up. i will try to get information from them once they come down to the ground level and when i do i will pass along to you. >> darya: thanks a lot now look at the numbers here will was adding up the numbers of the shootings and oakland and it coming up in about 15 minutes we want to take a look at what mayor

jean kron is not saying about the rash of violence and exactly who it is commenting. >> mark: suspended sheriff ross mirkarimi is taking another ugly turn. he is sending out blasting allegations that the mayor relied while on the stand at the allegations hearing. sheriff ross mirkarimi is a lawyer who believes that the mayor did lie and he calls his credibility into question. >> i do believe the mayor was not truthful in the testimony to the commission. a ultimately this entire case is built on the mayor's credibility and if they shown or if there is a reasonable doubt about the mayor's credibility than the ethics committee must look into that. sheriff ross mirkarimi had absolutely nothing to do with where they're not the mayor committed perjury. no one told the mayor to get on the stand and say something that was not true. >> mark: mayor ed lee issued

unit shot one time in the face. they do not know of someone came in and fired a shot or if someone was inside with her, they got into it and then the fire-- and then the shots were fired, they're not sure. this is not a tourist motel. this is where people stay for days. crime scene tapes are still his investigators are looking and i'm looking for any possible evidence. we do not know when the crime scene tape will be lifted so that people can come and go. this is the 63rd murder in oakland so far this year. >> mark: now if you look at the weekly statistics this woman is the 14th person that has been shot in oakland since sunday and a fifth that was killed. >> justine: more on the

jerry sandusky scandal it concludes that the hall of fame coach joe paterno and other senior officials concealed critical facts related to sandusky's child abuse because they were worried about bad publicity. this report just came out as 6:00 a.m. that was done by a former fbi director. this says that joe paterno, the president and the athletic director and vice president gary shoats failed to protect against a child sexual predator who harmed children for over a decade. it says all four of them knew about a 1998 investigation into jerry sandusky that the not a soul into criminal charges at the time but none of them other than the trusties and none of them took further action against sandusky. it also shows that administrators who filed a 2001 complaint about him created a dangerous situation for future victims by not reporting that matter. at 7:00 a.m. we will hear from

regularly. along the west coast there are a pot of dolphins in the monterey bay area. they believe that this is dolphin is a part of that hot. we talk with someone from the marine animal center he says that he walked along the banks and he believes that it is gone. >> i came here at 5:30 a.m. to check on the dolphin that was swimming back and forth yesterday i am not sure why he was here, he seemed pretty happy as today clinton make sure nothing weird happened. after about a half hour walking up and down i did not see him. we will keep monitoring the situation. >> reporter: the good news is that at no time yesterday did they think the animal was in distress. they thought was just up here looking for food. they believe the dauphin has left
