this was the scene just a few hours ago. new york city, a million people range in the new year. we'll be wrapping up all the celebrations from around the world in just a few minutes. before we do that, let's head over to eric who's monitoring the weather situation. are we going to start off dry? >> we don't have any rain in the forecast. we're taking a live look outside. this is our freeway camera in downtown san francisco. more cars on the road. allow yourself a little bit of extra time if you're headed out to work this morning. as we take a look at those

numbers, it is another cold start. mid-30s out the door in santa rosa. it looks like vallejo, you're waking up or staying up to low 40s. a split decision, 30s by the dark purple. this is where we'll be in the 30s. afternoon highs, two colors, light blue and again that purple. i looks like it's a split decision. as we break down those numbers for you, a pretty similar conditions compared to yesterday. 53 in san jose. to the east bay we go. we'll see mostly sunny conditions. pittsburgh, we climb into the upper 40s. as we head to the north bay, a dry day ahead of us for the first day of 2013.

upper 40s in dalely city, overall mild, tranquil, quiet conditions here in the weather department. look forward to pretty cold mornings. in fact, a freeze warning is in effect headed into wednesday. as we look ahead, however, we do have the chance of showers, saturday probably for most of the bay area. then pleasant conditions and mostly sunny skies. over in the traffic department i noticed a lot of cars on the road. you will have more company on the road. you can see a minor wait in one of those lanes here at the bay bridge toll plaza. we have a handful of accidents out there. fortunately none of them obstructing any lanes lanes. the golden gate bridge, not too bad. i have calculated a drive time.

you're coming in at 22 minutes into the city. erica, san francisco police have arrested ten people for public intoxication and other crimes as new year's festivities were in full swing. it's unclear if any arrests have been made in connection to two shootings a.12-year-old boy and a man were hit by gun fire a short time before the new year. according to police, shots were fired near pier 23 at 11:30 at night, striking the boy in the foot and grazing the man in the hip. both men were taken to the hospital with life-threatening injuries. there was no description at this time. one person was also hospitalized after being shot in the hand at san francisco's fisherman's war of last night. it happened at jefferson and

mason street. he suffered nonlife-threatening injuries to his hand. it was an armed male adult who was last seen headed toward a restaurant. police say two people died and three others were injured in a new year's eve shooting. it happened at the sports corner cafe. people were gathered for a fireworks show when the gun hire erupted. officials then canceled the midnight celebration. at this time police are still searching for a suspect or suspects. a deadly head-on collision. four people were killed in the sent. no word yet on the age of the victims. highway 12 east of rio vista river. authorities at this time don't know when they will be able to reopen that section of the highway. we'll let you know throughout

the morning. it went down to the last few hours and the senate finally approved a measure on tax increases and spending cuts avoiding the fiscal cliff. the vote now goes to the house of representatives. ed payne has the story. >> reporter: at the stroke of midnight, many americans were celebrating and ringing in the new year, but the mood in washington was much more serious serious. vp joe biden went to capitol hill after a deal was struck at the white house. the senate went back into session, and around 2:00 a.m. the vote was in. >> the amendment is passed. >> in an 89-8 vote, the measure was approved for two months and keeps bush tax cuts for individuals earning less than $400,000 and couples earning less than $250,000. it was to protect middle class

families. >> middle class families will take up today to the assurance their taxes won't go up $2,200 each. they will decide how they want to pay for groceries, rent next year. >> mitch mcconnell said republicans agreed to the measure rather than let the middle class suffer. >> we don't think taxes should be going up on anyone, but we all knew if we did nothing, they would be going up on everyone today. we weren't going to let that happen. >> the house reconvenes today at noon and is expected to take up the measure at this time. i'm ed payne reporting. doctors are streeting secretary of state hillary clinton for a blood clot that formed in her head. they're confident she'll make a full recovery. the blood clot did not cause a stroke or brain damage. it's located between the base of the skull behind the right

watching wall street as members close for the last day of the year. here's a look at yesterday's numbers. the dow joans closing at 160 points to close at 13,104. the nasdaq closing up 59 points

to 3,019. and the s&p s&p s&p s&p 500 closing up three police departments. the markets will be closed for new year's day. americans went to the theaters in droves this past year with nearly $11 billion in ticket sales. analysts say that's pretty good in this age of video streaming on computer tablets and large screen hd televisions. one analyst think this is year may be even better as high profile movies are expected to hit the big screen. last year was the worst year on record for average gas prices. single day spikes never topped what was seen in 2008. the average price of regular gas it $3.60 in 2012. according to triple a, that's up nine cents from last year's record of $3.50. hurricanes were blamed, refine

i res, tension in the middle east. there's good news. gas prices are expected to be lower this year thanks to rising domestic oil production and increased demand. shutting down several titles as part of a plan to cut down costs at the game company. games such as petville and mafia wars too. the mood is part of a cost cutting plan last october, which involves shutting down titles. it's cutting down 5% of its full time workforce. we'll be right back on the kron 4 morning news. lots going on this morning. we're going to start off this year dry, but it's going to be very cold and cool outside. speaks of outside, there's a look of san francisco. it's going to be a postcard day. we're going have to wait and see what's going to happen over the next several days as rain is expected to head our way,

happy new year, everyone. for those bringing in the new year, there are laws to pay attention to. there will be a 10-cent charge for plastic bags in grocery stores. the waste management authority adopted it last year, banning plastic bags, all in the effort to reduce single carryout bags and promote reusable bags. >> i won't be shopping here without a bag.

i will bring my own bag. >> i need to go and dig them all and put them in my car. that's going to be the key, remember to get them out of the car when i go into the store. >> it's a good idea for the environment. i guess we all have to sacrifice for environment safety. >> according to www.stopwaste.org, plastic bags are the most common litter found in waterways. this is protects creeks and san francisco bay. those klineing out their closet for the -- got a bonus. mission street in san francisco, those who came in to give away their old belongings were assisted by bellhops and given away popcorn. they got free passes to the zoo

good will, they probably want to wear a jacket. >> we have a freeze warning a. frost advisory is in effect for the santa clara valley and bay. it's looking pretty festive. here are the numbers, 36 currently in fairfield, 37 out the door inner saddo. it's chilly in san mateo. here's a look at the weather advisories. we have a frost advisory for the san francisco bay. temperatures will continue to drop. we could see upper 20s later on this morning. icy windshields, sidewalks, black it's certainly a possibility. drive with extra caution and keep that in mind. you can see two shades of purple.

the lighter purple indicates 30s for inland spots. a little warmer. we're talking 40s around the bay. as we put the clock in motion, it's a split decision. it indicates 50s. it indicates where we're going to put it in the 40s. it's going to be cool afternoon. here's a breakdown of your highs. 51 for fairfield in livermore. your kron 4 seven-day show mild weather for the next couple of days. we have cool mornings. keep that in mind. a freeze warning in effect through wednesday morning. this will keep the storm track to the north. partly cloudy conditions as we head into the weekend. now, there's some disagreement with the model runs. about saturday, some models say we could see light rain over the district. others say it will remain

completely dry. we have a 10-20% chance of showers in the forecast. we'll have the full details on what to expect coming up in my next report. meantime, in the traffic center, we're pretty quiet. the approach of the bay bridge toll plaza, more cars on the road out of oakland into the city. i certainly observed that myself. you definitely have more company at the san mateo bridge. your drive time holding steady at 14 minutes from end to end. >> the golden gate bridge, just a couple of cars headed into san francisco. more cars are headed in the northbound direction. i guess they're headed home from the parties. good news is visibility is good and we don't have any accidents to report here. over on the traffic maps, you're good to go. westbound 580 where it meets west 80 interchange, no problems. we have small fender benders out there. drive with extra caution,

especially because you do have a lot more in the way of company if you're just headed out the door. erica, a shock for a man who bought a car off craig's list. hi ride had been stolen from someone else. >> i can't believe i fell for it. >> patrick moore holding a title that looks real enough. a title to a new model chrysler 300. it was supposed to be his daughter's new car. >> i got the papers and car fax on it. >> reporter: patrick thinking he did everything right after finding the perfect car for his daughter on craig's list. he planned to meet the man who owned the car at a nearby mall. >> i called a few times, took the car home. >> reporter: he paid the man in cash. patrick was able to catch this photo as he was paying for the car, just before this man left

with more than $13,000. >> and today when i went to triple a, they told me it's a fake pink slip. he called antioch police. gave them the vin number and sure enough the car came up stolen. >> how much did you buy the car for? >> 13,700. >> reporter: so not only is he out 13,000 for the car, but because it's stolen, antioch police came and took it away, leaving patrick and his daughter with no car. now they will have to search for a different car. patrick says this time he'll go straight to the dealer, but he wants people who might be thinking of buying a car off craig's list not the make the same mistake he did. >> whatever you do, you have to go to triple a, like in my case, and check the paperwork. i wish they're going to catch the guy, and i wish that somebody recognizes his face. tomorrow he's probably going to work on somebody else. >> reporting in antioch, kron 4 news.

police in oakland are looking for a gunman that shot and killed a teenage girl. this is what the came scene look like on sunday night hours after the shooting happened. keep in mind these gunshots range out in the afternoon. jordan was killed and a 14-year- old boy was shot in the foot. the shooter remains on the loose. oakland police chief howard jordan talked about what he plans to do to address the rising crime situation in his city. >> we have more police officers. we become more proactive and deterrent and perhaps these will not occur. the bottom line, this has to stop. we as a community and the police department have to do a better job of protecting our young children. >> the murder that happened on sunday marked the city's 131st 131st murder of 2012. the chief said that more community involvement is also key to fighting crime this

in national news, the funeral has been held for the man who was pushed in front of a subway train last week. families remembered to gather a man who they describe as smart, kind, hardworks. he died on thursday when erica me mendez pushed him onto the tracks because of his ethnicity. she's charged with a hate crime and is undergoing a psychiatric

evaluation. maryland is the first state south of the mason-dixon line to legalize gay marriage. they did not take effect until this morning. nine other states in the district of columbia have approved same-sex marriage. it's not just the fiscal cliff lawmakers need to worry about this morning, although they did reach a deal a couple of hours ago. there's also concern about the nation's debt ceiling. the nation reached its borrowing limit yesterday. it closed 2012. the treasury department is taking measures to buy time. they include suspending benefit funds for federal workers, but after that, the treasury will not be able to pay all of the country's bills in full and on time. growing concern that problems with the new electronic oscar voting system

could lead to low record turnout has pushed to extend the deadlines to vote for oscar nominations, but the extension is only for a day. this friday, any votes received after the deadline will not be counted. by extending the vote deadline, we're providing every opportunity available to make the transition to online balloting as smooth as possible. we'll be right back. erica is following the situation with weather. we're going to give you the late terrell owens fiscal cliff. they reached a tentative deal yesterday, but they will have to go to the house to vote on that and obviously to president obama. we'll let you know what happens with that. here's a live look outside. i can tell you at 4:27 in the morning on any other day would not be as crowded. you can see many cars in that direction still not a problem anywhere in the bay area.

lows, temperatures will continue to drop as we push in closer to sunrise. good news is we will see sunshine, clear skies into the afternoon. however, your temperatures will be in the upper 40s, low 50s and as we head into the evening hours, again, mostly clear conditions as high pressure builds into the area. because high pressure is building in. it's pushing those clouds away. it is clear and cold. in fact, 42 out the door in vallejo. mid-30s in santana rosa. here's a look at the freeze warning. temperatures will be in the upper 20s, low 30s. icy windshields and sidewalks, black ice out on the roadways certainly a possibility. that's in effect until wednesday morning. then it looks like our mornings should be little bit warmer. here's a lock at your afternoon highs for today. south bay, very similar to what

we enjoyed yesterday. 52 for fremont and mountainview. 49, that's your afternoon high, 50 expected in pleasantton. north bay, a dry day ahead of us. looks like 51 common for napa. oakland coming in at 53 degrees. as we take a look at your sierra forecast, if you're headed in that direction, we don't have any chain control in effect. however, be on the lookout for freezing fog. that's going to be the sorry for the next -- story for the next couple of mornings. the highs will be sitting in the 30s. here's a look at the forecast. potential for showers as we i head into saturday. past that, mostly sunny skies, and temperatures in the upper 50s. over in the traffic center, a few minor accidents out there. no surprises. most of them, however, minor in

nature. i have not seen any with injuries. most of them sit tong shoulder, so it's not affecting your drive. if you're taking the bay bridge this morning, bull met with a few cars on the road. traffic is moving well from all the approaches with no metering lights to deal with. on the san mateo bridge no, accidents to report here. no backups on the approach. the golden gate bridge, you're problem free coming into san francisco. two people died and three others were injured in a new year's shooting after a fight in a restaurant in the old sacramento area. it happened last night outside the sports corner cafe. some 40,000 people were gathers in old sacramento for a fireworks show when the gun fire erupted. officials then canceled the midnight celebration. at this hour, police are still searching for suspect or suspects. also, a deadly shooting bring as violent end to what has been a violent year in the

term of murders in the city of san jose. police were called to the sprawling summer breeze apartment where is a man was shot and killed in the parking lot. police did not immediately identify the lone male victim and would not discuss any possible motives, except to say it is not thought to be gang- related. two people were detained for questioning in the city's 46th 46th homicide of 2012, compared to 40 in 2011. that would mark the most since 1991 when there people killed that year. the woman accused of crashing into several pedestrians, killing one, near san francisco's twin peaks lookout point pled not guilty to vehicular manslaughter, dui, and hit and run charges. she struck a 56-year-old woman on december 20th. prosecutors say there was a

blood alcohol content .23 at the time of the collision. we want to be accurate. eunis is being held on $1 million bail. she'll be back in court on january 14th. cold but unhurt after the rescue from big sur. they were not prepared for the snow that fell in the higher elevations over the weekend. the men became lost but were able to get cell phone service and call for help on sunday morning. the hikers were eventually rescued by a helicopter. people who ride on bumper cars and similar attractions on amusement parks can not sue the parks for injuries they occur in normal use of the rides. the court by a 6-1 vote -- a doctor fractured her wrist during a bumper car ride in

and welcome back. more new laws to talk about this morn. the highest minimum wage in the nation as san francisco's low end compensation rate increase to $10.55. the city's minimum wage has increased every year since 2004. in a study, there was no impact on jobs or the propensity of employers to leave this area. it also found that restaurants increased costs to customers with prices rising about 6.2% for fast food and 1.8% for sitdown eaters. california will be getting a lot of new laws.

we highlight a few of those new laws. >> more than 800 new laws from set to take effect at the start of the new year. 800. i scanned through what pass thud the state assembly and senate. here's what the governor signed and what you should know. assemblywoman's bill passed. dealer who is buy metals jumps up bigtime. now $250 in a few days four times that amount. $1,000. >> another bill out of the assembly gives women greater access to birth control. ab2348 will now allow certified nurses, mid wives, nurse practitioners, and physicians assistants to prescribe that medication. and driver lineups for illegals, some 40,000

undocumented immigrants. this applies to federal program supporting immigrants who came do the state as a child and have not broke broken the law. the homeowner bill of rights will also go into effect at the start of the year. it's meant to give homeowners more rights to battle foreclosure. this set of bills will restrict -- when learns act like they're working with the borrower while working with the loan to move forward with the foreclosure. >> a senate bill, public, private universities from forcing students to reveal their user names and pass words for social media. starting today, pg&e gas rates are going down, but electricity is, unfortunately, going up. natural gas prices are falling because wholesale costs have declined, but electricity rates are rising because of pg&e's

you see two colors on the screen. the light blue indicate where is we'll see the low 50s and then the purple you see for some of our north bay and east bay and interior valleys, that indicates some locations that will stay in the upper 40s. it could be another cool afternoon around the bay area. here is a look at your numbers. redwood city at 53 degrees. upper 40s, that's what we're expecting out in pittsburg. 52 in castro valley. warmer conditions today along the coast. we'll see low 50s there. looks like oakland coming in at 53 degrees. 50 expected in santa rosa. satellite and radar shows high clouds streaming in. around the bay forecast, overall, mild, tranquil weather around the bay area. we do have the potential for showers as we head into the

weekend. i will have your full details on your extended forecast coming up in just a bit. meantime, let's take it out to traffic. again, it's a quiet start to 2013. we have a couple of minor accidents out there. we also have more company out on the roads. you will see more cars than usual, especially for a holiday here at the approach of bay bridge toll plaza. westbound traffic moves well. we don't have any lights to deal with. at is san mateo bridge, conditions equal on both conditions of highway 92. now, southbound 101, the golden gate bridge. you will see lots of space between cars. as we turn our attention to the traffic maps, northbound 101 looks good. same thing for 207. as we take it over theto the north bay, speeds over 50 miles an hour. again, public transit still a big concern for today. muni is offering free rides for everyone until 5:00 this morning

up. police say two people died and three others are injured in a shooting after a fight in a restaurant in the old sacramento area. it happened last night outside of the sports corner cafe. 40,000 people were gathered in old sacramento for a fireworks show. a head-on collision shuts down highway 12. four people were killed. no word on the ages of the victims. again the accident happened on highway 12 east of rio vista at 9:00 last night. authorities don't know when they will reopen that section of the highway. and developing news and it went down to the last few hours and in a session, the senate approved a measure on tax increases and spending cuts. the measure now goes to the

welcome back. it is officially 2013. we're waking up to clear skies. it is another cold one here in the bay area and we're picking up right rain. i did see rain reported around sfo. a lot of the showers have pushed their way south so again just a stray passing light shower. i don't think it will affect your ride at all. we could see light rain around the santa cruz mountains. but a clear conditions, sunny skies. the temperatures a little warmer than 24 hours ago. and currently 36 degrees over in fairfield and 43 waking up or staying up in hayward. as we walk you through the timing of the temperatures and
