the object of the amber alert, this white 2006 jeep liberty was located just before noon here in the parking lot of a southside apartment complex on amargoza court with the baby still inside. about 5 hours earlier, just after 6:30 monday morning, 11-month old gabriella quintero was in her carseat in the back of that s.u.v. parked here in the driveway of the family residence on amador court. as her mother went inside for something, police say a woman on foot got behind the wheel of the jeep and sped away. an amber alert and the child's photo and susepct vehicle information was flashed across the bay area. one of many tips led police to where gabriella was found. christina calleros saw the rescue unfold. it's not clear what led the suspect vehicle here to amargoza court, some five miles from the baby's home in east san jose. police could be seen going door to door canvassing the neighborhood, taping off large section of the sprawling complex. the white s.u.v. hauled away for a more thorough inpsection. the disticntive markings on the rear window and detailed description of the vehicle helping to generate the amber alert tips that in turn led police here. moments after the baby was found. she was rushed to santa clara valley medical

center. here you can see video from our helicopter partnership with abc7 news. that shows the baby being carried in by a paramedic from an ambulance. to the emergency room. soon after. the infant's mother was escorted in by police detectives. where the two were reunited. the baby was checked out by doctors, and is in good health. the hospital spokesperson says the mom seems to being doing a lot better as well. >> "very relieved" little gabriella was discharged at around 3:30 this afternoon. the so we can see that the mother was escorted and. or the two were reunited. she generally seems very relieved. >> she was discharged at

on the white house. >> the professor royal little things that this is significant. >> this is a level of seriousness this is not just a state case it is raised to the level of national significance. >> reporter: the justices will not rule until the month of june but they will not present this as this could likely lead to the legalization of proposition 8 only in the state of california or make this just in california. or they could rule that proposition 8 would be unconstitutional. or, they could make it proposition 8 would be national or it could be upheld as a band of same-sex marriage. >> i would say that they would say that proposition 8 is not valid. anthony

have not discouraged these people. they've been camped out for days.and they're not about to budge. there aren't that many seats available. one of the people who will almost definitely get a seat. the san francisco cousin of chief justice john roberts. jean podrasky is a lesbian - and plans to attend the hearings with her partner. she actively campaigned against prop 8 as it made its way through the courts in california. she says she's confident that roberts will rule in favor of same-sex marriage. karl rove - the republican strategist - has some thoughts on the issue. he says he 'can' imagine a republican candidate in the next presidential campaign -- supporting same sex marriage. rove is the former adviser to president george w. busy. he is apparently acknowledging that opposition to same sex marriage is ebbing -- even in some conservative circles. >> pam: and although support is growing, there is still strong opposition. in a recent national c-n-n

result of the cloud coverage in the marine air. temperatures are mainly in the 50s. still, 57 degrees in antioch. cooler near the coast. 49-in daly city. and here is what we can expect for tonight. the sea breeze and the fog mainly for the coast and the bayshore. tomorrow, partly/mostly cloudy with light rain. we will time it out. the notorious stretch of highway- one near devil's slide - was the scene of a big celebration today. hundreds of people gathered to mark the opening of two tunnels. as kron four's terisa estacio reports, these tunnels are being hailed as historic accomplishments. >> reporter: this is one of the two tunnels, that will provide a bypass for those traveling through the area along highway 1 at devil's slide. both tunnels are

nearly one mile long and at a private ceremony monday. officials and others hailed the project as monumental. >> this is the latest for the golden gate bridge! the transportation improvement that said could not be done. >> they said we couldn't do >> reporter: here is one reason why so many said it couldn't be done. this is video from a slide this past december. since this stretch of highway 1 opened many years ago, it has been riddled with problems, such as a crumbling hillside and extremely narrow passage with steep cliffs along the pacific. >> this has been claiming that the land where we are for decades and decades and decades. today, we celebrate something that is it truly historic. the first tunnel and 50 years built by the state of california. >> reporter: the tunnels are named after the late former us representative tom lantos. who helped secure 50 million dollars. his widow and daughter were in attendance. the total sum

illinois.where roads are a mess. today.there was a string of accidents. on-ramp had to be shut down fan for a time. and this is pennsylvania. this man said he didn't expect to be clearing sidewalks this late in late march. a storm is causing problems across much of the northeast.slowing traffic and causing flight delays. in parts of pennsylvania - they got nearly a foot of new snow. and look how miserable the roads are in pennsylvania. drivers were struggling with the morning commute.and it's not much better tonight. it's not a lot of snow here.but it's slushy and icy. and more snow is expected. and it's not just snow. this is florida -- where a storm blew the rooftopsthese ho at least there are no reports of serious injury. it also knocked down trees.destroyed cars.and filled the streets with debris. the national weather service is trying to figure out if tornadoes were to blame. more bay area news.

see a wayward. shower. >> pam: a coast guard and sheriff's search for a 22- year-old man who disappeared from a half moon bay beach on sunday afternoon. has been called off. police say, the man was playing soccer with friends at roosevelt state beach near pillar point. when members of the group realized he was gone. police say, it has not been confirmed that the man ever entered the water >> - a cal-train struck and killed a pedestrain in palo alto this morning. this is video of the scene from our helicopter partnership with abc 7 news. at the charleston road crossing near alma street. there were major delays and all trains stopped at all stations to accommodate the riders. no word on what caused the accident or the identity of the victim. this marks the fifth fatality for caltrains this year. >> catherine: the two

teenagers in georgia - charged with killing a baby boy in his stroller - and shooting his mother - were in court today. it's a crime that has left the baby's family heartbroken. and upset parents everywhere. late today - 17-year-old de marquis elkins appeared in a georgia courtroom. he's accused of demanding money from a woman who'd taken her baby out in his stroller for a walk last thursday. police say that after she explained she didn't have any money with her. elkins shot the baby in the face - killing 13-month old antonio santiago. he also shot the mother - sherry west - grazing her head and shooting her in the leg. a neighbor had called 9-1-1 also charged -- a 15-year- old. >> this baby has been shot?? >> catherine: his face not shown because he's a minor. earlier today - it was his turn to appear in court. where a judge told him he'd be charged with murder. the case has made national

headlines. the broken hearted mother - has been talking to reporters. >> you killed an innocent human life. and i hope you die for it. that is how i feel. >> catherine: it wasn't immediately clear whether the 15-year-old will be tried as an adult. the 17-year-old declined an opportunity to enter a plea monday. a public memorial service was held today for colorado's prison chief. tom clements was gunned down last week after opening the front door of his home. investigators believe a former member of a white supremacist prison gang may have conspired with other inmates to kill clements. the service was attended by hundreds - including state lawmakers and the governor. the prison parolee was killed in a shoot-out with police. amanda knox is waiting to hear whether she faces a re- trial in italy. she's the american student who along with her former boyfriend - was acquitted of killing her roommate 2 years ago. now - italy's highest court is deciding whether to overturn that acquittal and re-try her. the decision will be announced tuesday morning. knox is now back at college in seattle. if she were to be tried again and convicted -- italy could try to extradite her. >> the irs does usually not

(male announcer):this is the bay area news station,kron 4 news starts now. >> pam: at 5-30. we are following developing news. a stolenaby found safe. here is the 11 month old being taken into a hospital. this is video from our helicopter partnership with abc7 news. it all started this morning -- a theif took a car from a san jose neighborhood. and that car had a baby in back. kron 4's rob fladeboe is at the scene. where the 11- month old girl was found,

along with the stolen car. rob -- what do we know about any suspects tonight? >> reporter: the suspect is described as a woman in her 30's. in this neighborhood was on foot. and i can tell you that mother, baby are doing fine. there were at the hospital and were checked out. they are convinced that the mother and the baby will have a reunion with the friends, family sometime this evening. the amber alert out of san jose has now been canceled since the 11-month-old girl helicopter partnership with abc 7 news. here's how it all unfolded. at 6:40 this morning, a white jeep liberty was stolen from the driveway of graciella quintero -- with her baby gabriella inside. quintero says, she stepped away from her car momentarily -- and when she returned, it was gone. hours later at 11:22 a-m-- officers found the stolen jeep, with baby gabriela still in the backseat at an apartment complex near the seven trees community center.

community center. the baby was taken to the hospital as a precaution. at 4:30, the bbc and the mother were reunited a hospital. stay with us as we continue to follow this developing story. we'll have more tonight at six -- and we'll bring you and new information as soon as it comes in. >> now at five. the former penn state assistant football coach, convicted of molesting young boys. speaking out from behind bars. for the first time. catherine heenan is standing by with the story. >> catherine: jerry sandusky is serving no less than 30- years in prison for sexually abusing young boys over a 15-year- period. jerry sandusky gave his first interview from prison to a filmmaker who is making a documentary with the goal of clearing penn state's long-time football coach, the late joe paterno's name. excerpts aired on nbc's today show. when asked about coach mike mcqueary's testimony that he saw sandusky sexually

abusing a young boy in a penn state locker room shower, sandusky says there were inconsistencies in mcquery's story: >> i don't understand how anybody would have walked into that locker room from where he was and heard sounds associated that was sex going on laughter.you know, like he said that could've been, i mean, there was.that would have been the last thing i would have thought about. i would've thought maybe fooling around or something like that >> catherine: sandusky said he doesn't believe paterno, would have allowed him to continue working if he thought sandusky was a danger. >> if he absolutely i was , i'd say no. if he had a suspicion, i don't know the answer to that >> catherine: paterno's family says it had no part in this interview and calls it an "unfortunate development". a statement said in part: releasing a recording at this time, nearly ar he was foun 45 counts, is transparently self-serving and yet another insult to the victims and anyone who cares about the

truth in this tragic story. earlier this year a judge denied sandusky's request for a new trial. last month, he filed an appeal against his conviction and sentence. penn state also released a statement saying: "jerry sandusky's statements today continue to open wounds for his victims, and the victims of child sexual abuse everywhere. it goes on to say that the school has tremendous respect for the men who came forward to tell their stories publicly. >> pam: a relationship dispute could be to blame. for a deadly marine base triple shooting. and there's a bay area connection. the tragedy happened last week in virginia -- both the shooter, and one of the two people murdered are from the bay area. government officials say, sergeant eusebio lopez, of pacifica, is accused of shooting to death corporal jacob wooley, from massachusetts. as well as lance corporal sara castro- mata, a 19-year-old from oakley. lopez joined the marines seven -years ago. serving in

both the afghanistan and iraq wars. this is the oakley victim -- lance corporal sara castro-mata. she joined the marine corps in december 20-11, serving as a warehouse clerk. last month, she was promoted to her current rank. though she was not deployed, she earned a number of awards, including the national defense medal and global war on terrorism service medal. >> catherine: some people in newtown connecticut are very upset about robo-calls from the n-r-a. the calls are asking people to vote against proposed gun control legislation. of course, it was in newtown - where children and teachers were gunned down and killed back in december. >> to have this pushed on us without permission or any discussion. >> catherine: that's a resident who didn't want his identity revealed. he says many of his neighbors feel the same way. >> a lot of big names and

girl, who was inside a car that was stolen from this san jose neighborhood, is safe tonight.and woman police say took the baby is still on the loose. the mother, graciella quintero. had placed her daughter, gabriela. in the backseat of her car with the key in the ignition. she went back inside the house. and when the mother returned to the driveway, the car and the baby were gone. kron4's rob fladeboe is live in san jose. rob, do police have any leads on a suspect? >> reporter: this suspect is a woman in her 30's. this is where it happened. around 6:30 this house and across the street. this s u v was parked with the d b in the back. you can see with the- baby in the back seat.
