we will be checking in with erica in just a few minutes but first. we begin this morning with news out of washington, where the u-s supreme court takes up the first of two cases about same sex marriage today -- with the justices listening to oral arguments on california's ban on gay marriage -- known as proposition 8. rene marsh is live from washington, d.c. with more. >> reporter: proposition 8 has been back and forth in california for years to stick, same-sex couples from california are challenging proposition 8. it banned same-sex marriage in 20 08. however, it challenges argue with the 14th amendment to define marriage between a

man and woman violates their equal rights. there are a majority of americans that support americans of same- sex marriage. >> my son came to us and told us that he was gay and that launched an interesting experience >> this is a interesting number of people including a niece of a high-ranking official. who she is an open lesbian. for same-sex couples this comes down to two different issues the definition of marriage and

having the same rights as a heterosexual couple. reporting live, washington d.c.. >> that was renee marsh. reporting. >> ahead of today's historic u-s supreme court hearings on california's voter- approved ban on same sex marriage, thousands of people marched and rallied in san francisco last night. the march started at castro and market streets at about 6:30 and made its way to city hall. activists says they're optimistic that the ultimate ruling of the supreme court will go in their favor. especially now that a new poll finds that the majority of americans support same sex marriage. >> every day i get more and more optimistic. i feel that if there is a momentum across the country and it would be stupid if there ruled against the marriage. >> in support of l-g-b-t residents in many bay area

cities and elsewhere, the rainbow flag is expected to be unfurled today and tomorrow at the city halls of san leandro, berkeley, oakland, hayward, alameda and san francisco. >> here's a look at what will happening at the hearing today. first, the backers of proposition 8. will get 30 minutes to argue for the ban on same- sex marriage. then the opponents of prop 8, which will be the attorneys for the couples that filed the original challenge, will get 20 - minutes to argue that the ban is unconstitutional. the final 10 minutes are reserved for the u-s solicitor general. who will argue against prop 8. on the behalf of the obama administration. a final ruling will be handed down in june. stay with kron four as we continue to follow the same sex marriage hearings in washington today. we will be providing updates on kron4.com. as well as our 24-seven channel comcast 193. you can also check our facebook and twitter pages as well. watching the weather this morning as we take a look from our mount tam cam.

>> the new tunnels along devil's slide have officially opened to the public. along the pacific coast near pacifica, there was an official ribbon cutting for two new tunnels that will provide a bypass along highway - one at devil's slide. the area has been plagued for years by rockslides. and a harrowing passage through a narrow stretch of roadway. the total cost of the project was 439- million dollars. police are still looking for the suspect who stole a car in san jose with an 11- month old girl in it this morning. baby gabriela was found hours later in the abandoned s-u-v gabriella has been reunited with her mother. san jose police was tipped off about the stolen jeep and officer responded. that was when they found gabriella inside the car. officer acosta rode with gabriella to the hospital. the youngster was given a toy to play with during the ride. then she was reunited

with her mom. >> she started crying but then became very excited when she saw her mother. he was a very dramatic situationan 11-month old girl, taken amber alert cancelled. police discovered baby gabriela hours later in the abandoned s-u-v. today-- the suspect is still on the loose. officer carlos acosta describing the moments when he found 11 month old gabriella quintana late monday morning. gabriella had been missing for several hours a tip was called in about a suspicious jeep and officer acosta responded with his partner. the jeep was parked and the hazard lights were flashing. gabriella was inside. officer acosta rode with gabriella to the hospital. toy to play with during the ride. then she was reunited with her mom. police say, the girl's mother, graciella, noticed a woman who she thought was suspicious. near her car shortly before it was stolen. she described the woman as white or hispanic and in her 30s, wearing a dark top and dark pants.

(male announcer): here's stanley roberts who found some people behaving badly. >> one might think that if a city adopted a ban on plastic bags images like this would be a thing of the past. but the truth is, if you spend just a small amount of time in san francisco's chinatown you would never know there was a ban on plastic bags. because no matter where i looked, people appeared to using the banned items. in some cases the plastic bags were hanging in plain

view at some of the store but in most cases people were toting them around. now i'm not talking about reusable bags that f closely resemble plastic bags. at the lucky dragon gift shop they sell these cloth like re-usuable bag for 20 cents each and they were quick to show me them. however when i asked if they carried plastic bags they said yes when i asked if i could see them i was asked why did i want to see them. typically if anyone in san francisco and many the surrounding communties goes shopping they have to either bring there own bags or pay up to a quarter for a bag. this does not appear to be the case in chinatown, just for the recored the ban does not include produce bags. just single use bags plastic shopping bags, you know the ones you will often see blowing down the street and hanging from a tree. now there was a loophole in the plastic bag ban, merchants were allowed to finish their existing supply. and it would appear that many of the shops in chinatown stocked up in the banned plastic bags for a very long time.

>> take a look at this. a missouri business will have to patch up a massive hole that was left after part of its roof collapsed. police in kansas city say no one was hurt. officers had to help evacuate the "aspen products" building. this happened a day after heavy snow hit the area. it's unclear if weather is to blame. kansas city's dangerous building department and osha are looking into the collapse. we are looking at some cooler weather. traffic and weather. >> good morning temperatures are in the 40's and 50's. overnight we saw some sprinkles and light rain.

store, where former u-s representative gabrielle giffords' husband purchased a semi-automatic rifle. has canceled the transaction. the owner says, a full refund was sent to mark kelly because the former astronaut, did not plan to keep the a-r-15- style rifle for his personal use. kelly bought the gun saying. he wanted to show how easy it is to buy an assault weapon. he planned to turn it in to police. his wife was among 13 people tucson supermarket , that 2011. boeing says a test flight of one of its grounded 787s went "according to plan." the f-a-a pulled all of the 787 dreamliners from the sky in january due to overheating smoking batteries. boeing has been searching for a solution to the battery problem. the jet maker says yesterday's "functional check flight" lasted a little more than two hours out of an airport in everett, washington. a second battery certification flight test is >> there's nothing worse. headache, sore throat, fever and that achy feeling all over. officially, the flu season is winding down. unofficially, you can still catch the flu bug. even now in spring, the chances of coming into contact with the influenza virus are running relatively high. site called flu-tracker, while the flu season is winding down back east. it started later out west and is still with us. you can see by this map that there's a pretty active area around california and the bay area. health officials say a flu vaccine is still the besta new study says that >> parents are feeding their babies solid food way too early. the study was released yesterday in the online issue of pediatrics. it says that forty percent of infants are being fed solid food before the recommended four months. the study also found that early introduction of solid foods can lead to a number of health problems.

americans than ever before say they have a family member or close friend who is gay or lesbian. and that corresponds with an increase in the number of americans who now support gay marriage. a new c-n-n / o-r-c international survey finds 57-percent of americans report someone close to them is gay or lesbian. that's 12-points higher than poll results from 2007. the number of people supporting same-sex marriage has jumped from 40- percent in 2007 to 53- percent today. here's a look at what will if this does not go our way? the country will change forever. >> the reference to say that this is good for all faiths and organizations to come together 57 percent of

francisco. >> a one alarm fire at a san jose apartment complex has left 21 people without a home this morning. the fire broke out late last night. in the 31-hundred block of landess avenue. when authorities arrived they found fire between two united and in the attic space above. fire fighters were able to knock down the fire within minutes and believe the fire is cooking related. the red cross is helping with food, shelter and clothing to the 21 residents. no injuries have been reported. points points.

family members are remembering a marine from the bay area who was shot and killed at a base in virginia last week. the mother and sister of lance corporal sara castromata, of oakley, says the 19-year-old joined the marines in part to pay her own way through college. military officials say castromata was killed thursday by 25-year-old sergeant eusebio lopez, of pacifica at the marine corps base in quantico. lopez also fatally shot 23- year-old jacob wooley, of guntown, mississippi before killing himself. new this morning. italy's highest criminal court overturns the acquittal of amanda knox and orders a new trial.

an appeals court in florence will now re-hear the case against knox and her italian boyfriend for the murder of 21-year-old meredith kercher. kercher's body was found in november of 2007 in her bedroom of the house she shared with knox in perugia, italy. taking a look at the stock market this morning. futures trading shows. all three indexes in positive territory this morning. u-s stocks fall yesterday. despite a bailout deal for the european island of cyprus. here is a look at the closing numbers. the dow fell 64 points to 14-thousand-447 the nasdaq slipped nine points the s & p 500 fell five points. the securities and exchange commission has approved a plan by the nasdaq stock exchange to pay $62 million in reimbursements to investment firms that lost money because of technical problems during facebook's initial public offering last year. facebook went public may 18 amid great fanfare, but computer glitches at the nasdaq delayed the start of trading and threw the debut into chaos. technical problems kept many investors from buying shares that morning, selling them later in the day or even from knowing whether their orders went through. nasdaq has said that it was embarrassed by the glitches, but that they didn't contribute to the underwhelming returns. facebook founder mark zuckerberg is forming a new issues advocacy group to promote immigration reform, education and other policies aimed at growing the economy. zuckerberg will be joining with other high-tech executives and has already

conversion by midnight this wednesday. if you have fastrak, you save a little money. crossing the bridge will cost 5 - dollars instead of six. other options -. you can register your license plate online. make a one-time payment at one of the many kiosks around the bay area. or do nothing and the bill will be sent to your house. san francisco police have made an arrest in the 2010 golden gate park murder investigation of michael ponder. daniel hill, of reno, has been arrested in connection with the murder of ponder-- who was stabbed to death. ponder's body was found in golden gate park, by an officer who was patrolling the area. detectives developed information that linked hill to the murder. after he was arrested for an unrelated murder investigation in reno. hill is currently being held in reno on that local murder charge. santa clara's second gun buyback event on saturday. brought in more than 600 fire arms. the event-- held by santa clara county -- paid out a

total of 61-thousand- dollars. in exchange for 610 firearms. the guns collected included. 17 assault weapons, 225 handguns, 237 rifles, 123 shotguns and eight other weapons -- such as b-b guns-- which did not receive pay outs. the buyback event also included a peace walk. and a resource fair, where 150 gang- related items were collected. president obama is coming to the bay area for four separate fundraising events. the president will be visiting the house of democratic fundraiser tom steyer for a reception on april 3, followed by a dinner that night at the home of philanthropists ann and gordon getty. on april 4, the president will travel down the peninsula to atherton for a brunch at the home of liz simons and mark heising, with tickets costing $32,400. his last fundraising event

will be a lunch at the home of marcia and john goldman, which will cost $1,000 for the cheapest tickets. obama last visited the bay area in october. the mars rover curiosity is in action again after being sidelined by back-to-back computer problems. the six-wheel rover fired up its onboard laboratories and analyzed a sample of rock dust over the weekend. it had been unable to perform science experiments since late last month after experiencing a computer memory problem. mission managers say curiosity will work for a week before it takes another break. in sports. tiger woods is the world's number one golfer again after completing another victory at bay hill. woods captured the weather- delayed arnold palmer invitational. closing with a two under 70 for a 13- under total. this marks woods' eighth victory at bay hill. including a u-s open. the victory puts him back at the top of the world rankings for the first time since 2010.

possibly played a role this was a single vehicle accident. >> new this morning. italy's highest criminal court has overturned the acquittal of amanda knox and has ordered a new trial. an appeals court in florence will now re-hear the case against knox and her italian boyfriend for the murder of 21-year-old meredith kercher. kercher's body was found in november of 2007 in her bedroom of the house she shared with knox in perugia, italy. knox spent four years in prison before a court overturned her murder conviction. she returned to the u-s in 20-11, and was not in italy for today's hearing. an attorney for knox says that she is shocked and saddened by the news.
