(male announcer):this is the bay area news station,kron 4 news starts now. >> happening right now. supporters of same sex marriage gathering in san francisco as the supreme court hears a legal challenge to california's proposition eight. >> "same-sex couples are considered second rate, different, unequal, and not okay" >> pam: kron four has the arguments. the reaction from the court and analysis of how well teach side made its case. our team coverage starts now with kron 4's dan kerman. dan. >> reporter: as expected the court seemed divided on the issue. liberal members of the court appearing to not buy the argument that marriage is about procreation and as such should not be afforded to same sex couples. the court released audio of the hearing. and here is an exchange on the procreation topic between the justices and prop 8 attorney charles cooper.

>> there are lots of people that get married that cannot have her children. to have a state that allows ado what is te justification? >> the concern is that they are defining marriage as a gender. will separate its abiding connection to its historic appropriation and it will refocus the definition of marriage away from the raising of children. into the emotional needs and desires of adults. >> mr. cooper, supposedly because we think that the focus of marriage should be under procreation, we are not going to give marriage licenses anywhere anymore were those people are over the age of 55 years old.

would that be constitutional? if you are over the age of 55? you do not have the regulation of procreation of marriage. why is that different? >> the site of fidelity. you can finish your answer. >> it is desired, your honor to make it less likely that either party will engage in procreative conduct outside of that marriage. on the other side of the coin. on the other side of the coin conservatives sai same sex marriage is relatively new, and not something to rush into and some even questioned if marriage is something that eveyone is entitled to. here's an exchange between the justices and ted olson, the attorney opposing prop 8

>> i am curious when did it become unconstitutional to exclude homosexuality or couples? was it the year, 1791? 1868? was it the 14th amendment. >> was this a form of a rhetorical comment. was it a rhetorical, to unconstitutionally allow the regional---by racial couple. for the equal adoption laws adopted. . >> i cannot answer that question and i do not.. i can tell you now is that the case that is before you today is weather or not california can take the individuals based on their characteristics, their distinguishing characteristics. remove from

them, the privacy, and to discourage orality and identity. >> reporter: we also heard questions from both sides as to whether the backers of prop 8 even have the legal standing to appeal the ruling striking down the ban if they ruled they did not, the lower court ruling striking down the ban in california would likely take hold allowing marriages to resume. as for justice anthony kennedy. his comments appeared to stradle both sides of the aisle. on the one hand voicing his opposition for allowing same sex marriage nationwide. and yet at the same time indicating banning same sex marriage hurts the more than 40-thousand children being raised by same sex couples in california. we'll hear his exact words on that topic coming up tonight at 6. a decsion from the court is expected in june. pam >> pam: joining us now legal analyst - attorney jim hammer.

it seemed like there were all over the map what is your impression? >> i think that what is most surprising is that this was going to be a broad sweeping decision. in history or was it going to be a narrow decision only impacting california. the big surprise today was a mix of left and right justices. about weather or not this should even be there. there was somebody from kennedy perhaps the swing vote. and at the end of the day.. >> pam: thanks jim -- you will be back at 5-30. we'll get more of your reaction to todays proposition eight supreme court hearing. >> catherine: outside the court, a huge crowd waited as the lawyers made their arguments. and emotions were running high.

>> "can two women reproduce? can two men reproduce? let's be respectful and understand the institution of marriage." >> "gay, lesbian, bisexual, transgender -- they deserve equal rights -- they deserve to be able to be married from one end of this country to the other." after the hearing, plaintiffs and attorneys stepped up to the microphone to give their arguments a final spin. today we feel we clearly presented the winning case for marriage. we believe proposition 8 is constitutional. i think the most remarkable thing that happened in there, was that there was no attempt to defend the ban on gay and lesbian marriage.

social networks to this symbol. this pink equal sign over a red back ground is a symbol of support of same-sex the symbol was created this morning by the human rights campaign, their normal symbol is yellow and blue they made it red for today's people started changing their profiles to this symbol. then some big name like actor george takei from star trek, did it and from there. it spread like wild this symbol today essentailly became an online rally. there is a lot more to tell you about happening on the web related to the hearing back at 5:30 with more we will air the full audio channel - tonight at 7-pm. developing right now. a standoff has just ended in morgan hill. kron 4's rob fladeboe is on the scene -- he joins us on the phone with details. what do we know? >> reporter: this couple has. it themselves in an upstairs apartment. and if it looked like a swat team. surrounding this structure. and a man and woman were being led away in handcuffs. they say that he is a

parolees. and he was discovered as part of this information with his bottle registrations. in his automobile -- registration-. and it does not look like he was in custody all the woman refused to leave ou.. to road that was blocked off is now being reopened. reporting live, rob fladeboe, kron 4. >> pam: shall police have released this sketchkron four's terisa estacio big moment. terisa? month old baby. this is that sketch. police say. the woman stole a jeep on amador court around 6:30 yesterday morning. there was an 11- month old baby in the back seat. they say, the suspect is hispanic, in her late

that happened in broad daylight. outside a family market on 12th street near peralta. police are reviewing the stores surveillance video, and say the motive of the shooting is unknown at this time. no word of the victims identity. this is oakland's 19th homicide of the year. an odd story in the east bay tonight. an 8 year old girl is recovering this evening after someone shot her sending an "arrow" through her leg. it happened as the girl was playing outside of the lawrence hall of science at u-c berkeley. kron 4's j.r. stone has the latest from oakland childrens hospital. >> reporter: this-this girl did not lose feeling in her leg after the gunshot. >> we saw that it was a regulation and.. it propelled with the narrow still stuck in her leg.

4:04 a.m.it happened on the monterey highway. near curtner there could of been a suicide associated. a man is dead after he was found on fire. on a just before four a-m, about a fire on a trail just over highway -29 near trancas >> teacher accused of putting sleeping pills. in the 'sippy cups' of children at a childcare center, was in court today. kron four's rob fladeboe tells you about the plea entered by deborah gratz. and what prosecutors are saying say about the case. wearing a black jacket over a pink blouse and free on supervised 'own recognizance' since her arrest earlier this month, 59-year-old deborah gratz, of hollister, stood quietly during her brief arraignment at the south county courthouse in morgan hill. the veteran daycare teacher showed no emotion as her attorney entered a plea of not guilty. prosecutors have charged gratz with ten misdemeanor counts of child endangerment and assault.

gratz was fired from her job here at the kiddie academy daycare center after her arrest earlier this month for allegedly spiking the sippy-cups of at least five one and 2-year-old children with the over-the-counter sleep aid 'sominex.' the judge ordered gratz to have no unsupervised contact with any unrelated minors until prosecutors would not discuss whether there is evidence of any prior drugging episodes but that kiddie academy parents feel betrayed. >> about the trust they placed in this woman. and i am sure that the parents are very concerned for their children. we are concerned with the possibility of this woman that is out there.

>> catherine: it's a sensational murder case that just doesn't go away. today - italy's supreme court ruled that american amanda knox should stand trial again. for the death of her former roommate in italy. meredith kercher was killed in 2007. knox and her former italian convicted - and then acquitted - of kercher's knox has been back home in seattle since 20-11.and does not have to be at the new but - it's not absolutely clear whether she'd be extradited to italy if she's again convicted. one of her attorneys says she's "shocked and saddened - but ready to fight."

another strong report on the housing market lifted stocks today. housing prices rose in january at the fastest pace since the summer of 2006. before the housing bubble burst. here is a look at the closing numbers. the dow had its biggest gain it rose 111 points to close at 14-thousand-559. the nasdaq rose 17 points. and the s-and-p 500 gained 12 points. to close within just one point of its all- time high. and remember you can watc temperatures in the 40's and the '50s. mostly clear skies and spotty shower activity. again on thursday. the chance of steady rain fall and widespread for the weekend. fourth, this time it out. by 5:00 p.m., first, some showers. and in the east bay over oakland. that is when the rainfall will become more widespread. still, spotty and for the bay shore. for the evening
