>> there are lots of people that get married that cannot have her children. to have a state that allows ado what is te justification? >> the concern is that they are defining marriage as a gender. will separate its abiding connection to its historic appropriation and it will refocus the definition of marriage away from the raising of children. into the emotional needs and desires of adults. >> mr. cooper, supposedly because we think that the focus of marriage should be under procreation, we are not going to give marriage licenses anywhere anymore were those people are over the age of 55 years old.

would that be constitutional? if you are over the age of 55? you do not have the regulation of procreation of marriage. why is that different? >> the site of fidelity. you can finish your answer. >> it is desired, your honor to make it less likely that either party will engage in procreative conduct outside of that marriage. on the other side of the coin. on the other side of the coin conservatives sai same sex marriage is relatively new, and not something to rush into and some even questioned if marriage is something that eveyone is entitled to. here's an exchange between the justices and ted olson, the attorney opposing prop 8

>> i am curious when did it become unconstitutional to exclude homosexuality or couples? was it the year, 1791? 1868? was it the 14th amendment. >> was this a form of a rhetorical comment. was it a rhetorical, to unconstitutionally allow the regional---by racial couple. for the equal adoption laws adopted. . >> i cannot answer that question and i do not.. i can tell you now is that the case that is before you today is weather or not california can take the individuals based on their characteristics, their distinguishing characteristics. remove from

them, the privacy, and to discourage orality and identity. >> reporter: we also heard questions from both sides as to whether the backers of prop 8 even have the legal standing to appeal the ruling striking down the ban if they ruled they did not, the lower court ruling striking down the ban in california would likely take hold allowing marriages to resume. as for justice anthony kennedy. his comments appeared to stradle both sides of the aisle. on the one hand voicing his opposition for allowing same sex marriage nationwide. and yet at the same time indicating banning same sex marriage hurts the more than 40-thousand children being raised by same sex couples in california. we'll hear his exact words on that topic coming up tonight at 6. a decsion from the court is expected in june. pam >> pam: joining us now legal analyst - attorney jim hammer.

it seemed like there were all over the map what is your impression? >> i think that what is most surprising is that this was going to be a broad sweeping decision. in history or was it going to be a narrow decision only impacting california. the big surprise today was a mix of left and right justices. about weather or not this should even be there. there was somebody from kennedy perhaps the swing vote. and at the end of the day.. >> pam: thanks jim -- you will be back at 5-30. we'll get more of your reaction to todays proposition eight supreme court hearing. >> catherine: outside the court, a huge crowd waited as the lawyers made their arguments. and emotions were running high.

>> "can two women reproduce? can two men reproduce? let's be respectful and understand the institution of marriage." >> "gay, lesbian, bisexual, transgender -- they deserve equal rights -- they deserve to be able to be married from one end of this country to the other." after the hearing, plaintiffs and attorneys stepped up to the microphone to give their arguments a final spin. today we feel we clearly presented the winning case for marriage. we believe proposition 8 is constitutional. i think the most remarkable thing that happened in there, was that there was no attempt to defend the ban on gay and lesbian marriage.

there was no indication of any harm. two of the plaintiffs challenging the law are a couple from berkeley raising their four boys together. we look forward to a day when proposition 8 is finally and officially eliminated and equality is restored to the state of california. it hurts gays and lesbians in california, it hurts the children we are raising and it does so for no good reason on behalf of myself and twin brother, say how incredibly proud we are of our parents. we love them, we love our family, look forward to the day when treated equally, families >> catherine: many of the same partisans will be back outside the court tomorrow: that's when the justices will hear arguments for and against the defense of marriage act. doma, as it's known - is the federal law defining marriage as a legal condition available only to >> pam: right now -- a rally is underway in support of same-sex marriage. kron 4's vicki liviakis is there tonight -- vicki? >> reporter: we can get a sense of the same right know it is a small gathering it with only 30-40 people but it is growing. i spoke with the organizer, billy

4:04 a.m.it happened on the monterey highway. near curtner there could of been a suicide associated. a man is dead after he was found on fire. on a just before four a-m, about a fire on a trail just over highway -29 near trancas >> teacher accused of putting sleeping pills. in the 'sippy cups' of children at a childcare center, was in court today. kron four's rob fladeboe tells you about the plea entered by deborah gratz. and what prosecutors are saying say about the case. wearing a black jacket over a pink blouse and free on supervised 'own recognizance' since her arrest earlier this month, 59-year-old deborah gratz, of hollister, stood quietly during her brief arraignment at the south county courthouse in morgan hill. the veteran daycare teacher showed no emotion as her attorney entered a plea of not guilty. prosecutors have charged gratz with ten misdemeanor counts of child endangerment and assault.

gratz was fired from her job here at the kiddie academy daycare center after her arrest earlier this month for allegedly spiking the sippy-cups of at least five one and 2-year-old children with the over-the-counter sleep aid 'sominex.' the judge ordered gratz to have no unsupervised contact with any unrelated minors until prosecutors would not discuss whether there is evidence of any prior drugging episodes but that kiddie academy parents feel betrayed. >> about the trust they placed in this woman. and i am sure that the parents are very concerned for their children. we are concerned with the possibility of this woman that is out there.

>> it was one from president obama it was a bit surprising dodamayer.. >> and what happened going forward from today and the month of june. are they going to have a meeting? >> those nine different justices. they will have a conversation and they will have the votes. that vote will tell us whoever is in the majority will have the most senior justice. he/she. and another surprise is that they could make a change of their mind. perhaps june, july we will hear something. >> pam: supporters, in san francisco should they be optimistic or quarter optimism? >> i think that going forward if they should-- quarter optimism. --. cool

their optimism --. perhaps a bit more limited.. comes california state has been fighting this maybe they will be a bit more limited but this issue is not going to go away. this year? the supreme court will decide if same-sex marriage will have this right. >> pam: jim, thank you for your analysis, jim hammer. >> catherine: former san francisco mayor gavin newsom is considered a pioneering politician on the issue of same sex marriage. he famously allowed same sex marriages in the city - until shot down by the courts. newsom has been talking about his role.and whether he thinks his support has brought the issue to where it is now. >> not a chance. i would love to say that i did. i thought in my lifetime maybe. but the idea well within a decade we'd see the kind of progress we've seen. we've seen the courage of

(male announcer):this is the bay area news station,kron 4 news starts now. >> pam: same-sex marriage supporters gathering in san francisco tonight. this is a live look in front of the california supreme court building where a rally is underway. a two-day showdown over same-sex marriage began today in washington d-c. faxthe supreme court heard oral arguments on prop 8, approved by california voters, that banned same- sex marriage in that state after courts had previously ruled they were legal. kron4's dan kerman has audio recordings from today's supreme court hearing. dan? >> reporter: a very divided supreme court peppered attorneys on both sides of the issue with questions for an hour and 19 minutes. the court released audio of

the hearing. among the more heated exchanges was this one between the chief justice and ted olson, the attorney opposing prop 8 the topic the word marriage and whether it's really that important >> it is just about the label in this case? >> is just above the label. >> the label, marriage means something. if you tell it a child that somebody has to be their friend. do you suppose that you force them but it changes the definition of a friend. that, seemed to be up what supporters of proposition 8. they just insist on changing the definition. >> it is like that you can say you can travel but you can probably cannot be a citizen. there are certain labels in this country that are very, very critical. you cannot get married but you can have an interracial

unions everybody knows that that is wrong because marriage as a status. >> pam >> the justices and prop 8 attorney charles cooper also had an exchange about whether allowing same sex marriage nationwide could harm children while justice antonin scalia makes the point that it's too early to tell justice anthony kennedy who is believed to be the swing vote seems to be stradling both sides of the issue. on the one hand saying we don't the potential harm of legalizing same sex marriage and on the other hand saying children of same sex couples are already being harmed because their parents are not allowed to marry. >> if you read the fine marriage to include same-sex marriage is you must follow adoptions. >> there are room for disagreements among sociologists of what the benefits would be to raise a child with a single sex

parent. if that is harmful to the child or not. i take no position on weather or not it is harmful or not. it is certainly true that there is no scientific answer to that question at this point in time. >> that, your honor is what the point that i'm trying to make. it is the despondent, to prove a russian oil you bet on irrational -- view. that is beyond debate. >> i think that it is substantial debate on weather or not that history should play a role on this. on the other hand, there is an immediate legal injury or legal what could be a legal injury and that is the voice of these children. there are 40,000 children in

california or according to the statistics. that live with same-sex parents and, they want their parents to have full recognition and status. what is important for their children is important in this case. >> we would not dispute the importance of that situation. >> reporter: the liberal wing of the court also suggested procreation is not a legitimate argument for keeping marriage as it is now. now the court could rule same sex marriage legal just in california, or all over the nation they could rule the ban is legal. but there is also a 4th option. that backers of the ban don't have the legal standing to appeal in the first place there was a lot of talk about that during the hearing. if the court rules that way, the lower court ruling over turning the ban would likely take effecting and marriages would be allowed to begin in california. a decision is due sometime in june. pam
