happening right now. inside the stadium with a right now? and down in los angeles. the san francisco giants played the dodgers in the season hundreds of fans flocked to at&t park this afternoon to sporting their giants gear the new season. on baseball's opening day. about giants fan bryan stow. the santa cruz man was almost beaten to death on the giants opening day two kron 4's justine waldman got us an update on his condition. she joins us now with what she learned. >> reporter: i spoke with his mother ann today who told me.she was on her way to go visit him. the family is still holding on to hope that he will get better. bryan stow a former paramedic and a father of two. suffreed serious head trauma when he was attacked in the parking lot of dodger stadium in the spring of 2011. the family just posted this on their blog today. saying that on march 31st 2011 "our lives changed forever." "he amazes us daily and even though he doesn't see how far he's come, we do." and. "we still don't know how things will be in the next two years but we do know, no matter what, bruyan has us by his stide every step of the way." the two suspects in the stow assault, louie sanchez and marvin norwood, are still behind bars in los angeles county. their next court date is later this month. if concivted on all chargges.sanchez faces a

>> catherine: a chilling mystery in texas. the question -- who's killing texas prosecutors? a second law enforcement official has been killed in a matter of weeks. two months ago -- someone assassinated this man - mark hasse - the deputy district attorney of kaufman county, texas. people in the largely rural area were shocked at the daylight shooting. right outside the courthouse. but hasse's boss and friend - d.a. mike mclelland - responded with anger and bravado. calling the perpetrators 'scum' - and vowing to hunt them down. this is what he said 8 weeks ago. >> " we're gonna find you, we're gonna pull you out of whatever hole you are in and we are going to bring you back and let the people of kaufman county prosecute you to the fullest extent of the law." it's a promise he wouldn't live to keep. saturday night - police found the bodies of the d-a and his wife cynthia at their home. police found shell casings from a high-powered rifle. there's been increased security at the courthouse. everyone here is on guard. sheriff says they're protecting other officials lawyer.shock waves through the community one of several angles investigators are exploring - whether members of a vicious white supremacist group is involved. kaufman county prosecutors had helped in the indictment of 31 members of the 'aryan brotherhood of texas' prison gang. in december - texas

".to somebody else." investigators are also looking into a possible link between the killing of the texas prosecutors -- and the murder of the colorado prison chief in march. the suspect in that shooting died in a police shoot-out. there were reports that evan ebel had joined a white supremacist gang while in prison. >> catherine: colorado prosecutors say they're going after the death penalty for james holmes. he's the man charged with killing a dozen people in a movie theatre last july. this is holmes at an earlier hearing -- no cameras were allowed inside court today. the prosecutor says he talked about the penalty with the 60 people who lost relatives in the shooting. and decided that "justice is death". if it happens -- a friend of one of the victims says he wants to be there. >> and want to a front-row seat. >> reporter: why? >> he took my friend. >> catherine: this was the arrival of james holmes' parents today. his mother began crying in court today. but holmes showed no reaction. his attorneys had tried for a deal that would have meant life in prison -- but the prosecutors refused.

hospital. this is westbound we will continue to follow this story and to bring you updates. >> pam: new tonight at five. a veteran san jose firefighter, who collapsed while battling a blaze last august, is back on the job. firefighter frank ryan was treated to a 'welcome back breakfast' at station- one this morning. ryan suffered a heart attack on august 30th. as crews were gaining the upper hand on a stubborn 3-alarm fire at st. patrick's church, on east santa clara street. ryan tells kron four's rob fladeboe. he began to feel faint, and the next thing he remembers is waking up in the hospital. >> we came out side and i felt exhausted. i felt that feeling of nausea and it was overwhelming. i want and ask for help and i guess minutes after i was once to get some help i collapsed.

up at that point i felt that it was in a self induced coma for five days. ".for five days" >> ryan received round-the- clock support from his fellow firefighters. they slept in cots at the hospital until he woke up. he has since made a full recovery. >> after a long strike. the san francisco symphony will begin playing again. the symphony's administration and musicians reached an agreement on a new 26- month contract. the contract may change, once the full orchestra and board of governors take a look at it. that is when details of the contract will come out. meantime, tomorrow night. the musicians will return to the stage at davies symphony hall. for the first of a week- long series of free concerts for san francisco elementary school children. those of you who had tickets to shows that were cancelled because of the strike, can either exchange them for an upcoming concert or get a refund. this quick check of traffic at the golden gate.

happening right now. an encouraging update after a gruesome injury yesterday in the n-c-a-a tournament. louisville sophomore kevin ware is up and moving around today in his hospital.less than 24 hours after he broke the lower portion of his right leg. we're not going to show you the injury because it was so graphic. but you can see the emotional toll the ordeal took on ware's teammates, coaches, fans, and even the opposing duke players. surgery yesterday took just two hours.the bone was reset and a rod was inserted into ware's right tibia to hold the bone together. doctor's expect a long but i f all goes well, the young man should be able to resume a basketball career. ware plans to reunite with his teammates later this week at the final four in atlanta - which is ware's hometown. >> jacqueline: the rainfall is coming to an end. with clouds in the distance. a look at the san mateo bridge with also sumcloud coverage but also as we take a look at the stormtracker 4 radar.

thinking god and so happy. >> catherine: owen says she survived on melted snow, chia seeds, some dried noodles and nutri-grain bars. she burned the wrappers of the bars to stay warm. she now admits that hiking alone was a big mistake. >> you've heard of the avian flu -otherwise known as the bird flu. now there's a new strain never seen before in humans. and it's already killed two people in china. it goes by h-7 n-9 avian influenza. two people from shanghai have died from it. another in a different city is in critical condition. the victims all had initial symptoms of fever and coughing that then developed into severe pneumonia and difficulty breathing. investigators haven't figured out how they caught the virus. but so far, it doesn't seem to be very contagious.at least among humans. that's good news because right now there's no vaccine against the virus. >> we know that stress can lead to high blood pressure and even a stroke. but on the flip side.could a belly laugh a day possibly keep a heart attack away?

(male announcer) this is the bay area news station, kron 4 news starts now. >> pam: five people were hurt in the mayhem, including one victim who remains in the hospital with serious injuries. here's the man police who say is to blame. he is 31- year-old haamid zaid, of seaside. he has been charged with assault with a deadly weapon, resisting arrest. and hit and run. police suspect zaid was under the influence of drugs, but did not disclose anything else about a possible motive for what happened. the busy wal-mart on story road. re-opened this morning with sheets of plywood covering the doors and windows which shattered. when zaid allegedly crashed his car on sunday afternoon. police say, the suspect first rammed into two cars in the parking lot, before heading for the front doors, which were blocked by several concrete- filled posts. >> what he did his he made

two suspects. >> a north bay city is deploying a different tactic to try and deal with the homeless. some downtown businesses have complained about homeless individuals taking items from dumpsters, urinating on property and other problems. in response, the police department and a local charity have created a hot zone map, three areas where they are asking the homeless to avoid. or be respectful if they do decide to loiter in the designated spots. the mayor calls it the first step in trying to humanely cope with the homeless. however, others says it is the wrong move. >> it is cruel because it is not their fault because they're homeless. they should not be asked to leave because it disturbs people to see homeless people. it is nobody's fault. i think everybody deserves a place on the streets is a free country. why cannot we think about opening places for

>> reporter: the presidio coastal trail, which is part of the much longer california coastal trail, stretches from ocean beach...along the coast... to the golden gate bridge. this is the northwestern edge of san francisco. over the past few years this trail has been improved as part of a larger effort to upgrade trails through out the presidio. but after heavy rains last november and december, maintenance crews noticed that a section of the trail... here... just north of baker beach..had become unstable. here's a picture of the damage. you can see cracks in the ground and the railing had become uneven for safety reason, the park service closed down the trail. they've since removed rocks and dirt from the site to prevent further damaged and also to figure out what was going on. the black plastic here is to keep water from saturating the unstable ground. in the meantime, warning signs and fences are keeping people out of the area. foot and bike traffic can go around this spot using lincoln boulevard. the national park service has not said when or even if this section of trail will
