working crews are round it and did almost went over that fence into a neighbor's yard. this is another view that tree. it looks like it hit that tree. you can see it looks like a bullet hole this victim is fighting for his life after being shot and careening down an embankment. i >> pam: the man is shot by police outside a home in a quiet east bay suburb investigators tell kron4's haaziq madyun the shooting was an act of self defense. >> "bang bang bang bang" >> "i saw someone taken away in an ambulance" >> reporter: those gun shots were fired by lafayette police just after 7am tuesday morning here outside of this home on woodview drive2 officers came to this location after several unusual 911 calls were called into the station >> "that would come into our dispatch center as a 9- 1-1 call then there is a click"

>> reporter: a click because the caller hung up without speaking.as reutine lafayette police responded to the address where the calls were made to check things outwhen they arrived they found the home windowsthen the two officers were confronted by a man allegedly holding a weapon >> "the subject came out of the home who had a knife, the officers ordered him to drop the knife, several minutes later shots erupted from the officers" lafayette police investigators say a 28- year-old male resident was wounded during the shootingthe contra costa county d.a. and sheriff's office will both conduct investigations into the incidentlafayette is known as a quiet east bay towncalling an officer involved shooting rareis an understatement >> "i am unaware of any officer involved shooting in the city of lafayette, i have been here a year and throughout my history in the sheriff's office i am unaware of any" >> reporter: in lafayette haaziq madyun kron4news >> pam: new details tonight. surrounding construction on the new span of the bay bridge. as we first reported, bad bolts were found already

installed in the bridge. bolts that could break in an earthquake. today. kron 4's justine waldman got to see those bolts. and found out if the new span will open on time. she is live from treasure island. justine? >> reporter: the new span. which you can see behind me. is supposed to open after labor day weekend. that is 153 days from now. and despite the bad bolts. i'm told it will open on time. and be safe for drivers. >> these are supposed to withstand the force of an earthquake but they did not meet the specifications >> reporter: this is one of the brittle bolts used to put together the new span of the bay bridge. dozens of these heavy, steel bolts are bad. they seperated during an earthquake test. you can see here where the bolts are supposed to go. under one section of the deck. those in charge of the construction tell me the bolts cannot just be replaced. >> the bottoms are in concrete and hard to get out. >> reporter: engineers are working now to come up with a solution.

one option is to order collars that would put the bolts back together. that could cost about 1- million dollars. even with this set-back kron 4 is assured this will not cause any delays. >> we believe that we will be able to come up with a solution that keep bridge safe, motorist safe and allow it to open on time. >> reporter: caltrans also figuring out now. who is reposnible for these bad batch of bolts. we are still trying to figure out a and will hold it accountable. they were american made. was it during the construction? or the bulls, themselves?live on treasure island justine waldman kron 4 news. now at five >> what message does that send if there is a person 88

school with a gun. >> pam: nearly four months after the newtown school massacre, a group funded by the national rifle association says the best way to protect children is to have more guns in schools. >> if you have a firearm in the presence of someone in the school that can reduce the response time and save lives. >> at least one armed teacher or security guard. on every campus of every school in the country. the idea is getting an "f" from the country's two largest teachers unions. catherine heenan is here with a closer look at the controversy. >> catherine: the n=r=a set up a school safety task force right after the newtown shootings. the 2=hundred= plus page report includes common=sense recommendations on surveillance systems and securing doors. the fuss is over the proposal to arm school personnel. task force chairman asa hutchinson says he doesn't understand why anyone would object.

>> "in reference to newtown, what was the first thing the school did? they got armed officers there to protect the children." >> catherine: the recommendations include a "model training program" to train school personnel to use firarms to deal with crisis situations. changes in state laws where necessary -- so that teachers or other staff members would be allowed to carry firearms in school. increased coordination between law enforcement and schools on security matters and a pilot program on "threat assessment and mental health." the report has the backing of at least one newtown parent. >> "i think politics needs to be sort of set aside here. and-hope it doesn't, you know, lead to name- calling >> catherine: no sooner had he spoken than the american federation of teachers was doing just that: calling the proposal a cruel hoax designed to assist gun manufacturers to flood the nation with more firearms. the national education association slammed the report even before its release, saying: "guns have no place in our schools.

period." they are estimating that this farm cart prize at 2 billion-$3 billion. >> pam: local gun control advocates are now speaking out about this latest proposal from the n-r-a. the spokeswoman for "organizing for action". questions the logic of putting more guns in the hands of school staff. >> it does not have anything to and they are taking a big chance with a person in the classroom with a firearm. we do not know how stable they are. what if they get angry about something? they have the gun available right there at the school. i do not think that more guns are the answer. >> pam: that group says, the money the n-r-a is suggesting be spent on guns and training. would be better spent on mental health counseling and outreach. >> a somber anniversary--

today marks the one- year anniversary of the oikos university shooting rampage in oakland. seven people were killed. and three others wounded in the shooting. a memorial sign with the victim's names. and flowers were placed on the oakland campus this morning. no events were held today. but two concerts are scheduled for this saturday and the next. meantime, the suspect. former student one goh. is accused of coming on to campus and opening fire. he then fled in one of the victims cars. and was arrested in alameda a short time later. goh has been deemed incompetent to stand trial. and remains in a mental hospital. >> jacqueline: that fog has been discovered to clear. we did have some high clouds we can still see the fog lingering at the golden gate. closer to the coast we have seen reduced visibility in places like

>> brand new video showing the frantic scene easter sunday at the walmart in san jose after a man drove his car into the store and then attacked people. bystanders helped subdue the man before police arrived. take a closer look and listen to this new cell phone video that was posted to you tube. >> oh my gosh!

>> what happened? >> this person first started hitting people in the parking lot. with and this lady, and then another car over here. >> a surreal scene for employees and customers. you can see the marron car inside the store. shattered glass and debris all over. the car's was driven up on a display here.the front end in the air. police say haamiz zaid of seaside attacked customers with a pipe after he crashed. people in the store restrained the 33-year old suspect.using belts, a cane, anything they could. four people were injured.including one victim with seriously injuries. police have not said what may have motivated zaid to do this.other than was on drugs at the time.

>> pam: the walmart rampage suspect haamid zaid was in court today. but *not to answer for what happened at the store. kron 4's rob fladeboe has new information. that points to a pattern of behavior. >> reporter: it turns out the man who police say was on drugs when he terrorized people here at this walmart on easter sunday has been in trouble with the law before, a lot of trouble. kron 4 news has obtained court records that show zaid was charged with possessing drugs and vandalism in october of 2012. then another drug charge and a hit and run the following december. in january of this year, still more drug charges and resisting arrest. the records show another drug charge in february. legal analyst steve clark. >> certainly, the other stuff is a serious. but what is more serious is driving your car into a crowd of

walmart and attacking patrons were apparently, no reason. that is a person who is a danger to society. that is what the d.a. is going to focus on and not necessarily his prior drug history. >> reporter: in the december 2012 case, the court records show zaid was charged with a felony after crashing his car into this chevron station on capitol expressway in san jose. he told police he has snorted meth that day. the october 2012 vandalism charge stemmmed from an incident when zaid, high on cocaine, through a chair through a window here at rosie macann's pub at santana row. zaid faces yet more drug charges, four counts of assault and hit and run in the walmart rampage. zaid is expected to be arraigned on thursday in the walmart case and will return to court later this month to answer for the earlier charges. in san jose rob fladeboe kron 4 news. >> pam: new tonight at five-- safeway wants to build a huge, new shopping center along ygnacio valley road in walnut creek. kron 4's charles clifford

shows us the plans. and explains why the project has some neighbors concerned. >> reporter: safeway is calling this proposed development the orchards at walnut creek. the grocery store chain wants to put in more than 200,000 square feet of commercial and residential space on this 24 acre site... which sits along ygnacio valley road at oak grove road. this is a google earth view looking north across the site as it is now. the anchor store of the development would be a new 55,000 square foot safeway grocery store located here. but that's just the beginning...there would also be a junior anchor store next door as well as 7 other commercial buildings around the site. to the north of the safeway there would be a new residential development and there are also plans to put in a fitness center here. in additional, large parking lots would be built through out the site. the remaining space around these buildings would be landscaped with parks, trees, and trails.

now, one of the biggest concerns for neighbors in the area is that a project this big could create a traffic nightmare along ygnacio valley road, which is already one of the busiest roadways in walnut creek. but this plan is far from being a done deal. the walnut creek city council still needs to study the project and the final plans, if they're ever approved, could look very different from what they are now. in the newsroom, charles clifford kron 4 news. >> jacqueline: now the we have seen the fog clear we can see it a decent day. as the rain fall approaches late wednesday and early thursday. temperatures taking a dive. the rain with lingering showers chances on friday. first, the fog of the the south bay, the inland valleys and delta experience out relieve

>> catherine: prosecutors say a particularly brazen plot to 'buy' a spot in the race for new york mayor. has led to the arrest of this man. new york state senator malcolm smith. he's accused of being the central figure in series of bribery and corruption schemes. investigators say he conspired with a city councilman - daniel halloran - to get his name on the ballot for mayor as a republican. 4 other politicians have also been arrested. the complaint details clandestine meetings in hotels - with cash passing hands in parked cars. a never-before-seen photo of newtown killer adam lanza has been released. it's from his brief time at a state university -- and features that same strange wide-eyed expression. the records just released include his college admission forms. in which he refuses to even identify his gender. when asked his gender - he wrote "i choose not to answer." the same reply he gave when asked to describe himself. last week - documents revealed how the 20-year-old lanza sprayed 155 bullets at innocent children and

violence started there are some shell casing markings. the victim tried to get away after the driver from the other car pulled up next to him in and started firing. the victim losses bumper. he continued to cross of posing lanes of keller down this embankment before the victim and his car came to a rest right there. kron four's terisa estacio is live at the scene with details. and what we're terisa? >> reporter: they are focusing on the suspect. as i mentioned the victim was traveling southbound on keller avenue. take a look

at that tree. he plowed through and went over the embankment. this is video of the honda civic. as it crashed over. they recently pulled it out as they can examine the evidence. the driver was critically injured with multiple gunshot wounds. he is also recovering at a local hospital. one resident who runs a neighborhood safety watch cannot believe this has happened. >> she said that there was a shooting on keller and hanson tried. i was shocked. and i said what happened. she told me she knew at that moment and a car had careened over in that ravine. the fact that it happened we are going to want some answers and we will hear the voices of the residence on what more can we do. we are frightened to.
