group of men approached another group of men. authorities believe that they could have been gunfire because of it. we can see the police station is literally across the street. . they saw a suspect with a weapon. fearing for safety, he opened fire. however, it was a replica guns that the suspect was holding. >> in this suspect this was going against a police officer. who was feltin be felt in danger. >> what they are still investigating if this

happened to be standing in the area. the officer that fired the weapon of our polls on a paid administrative leave as well as the other officer who was involved. the person that was shot is recovering. mike pelton, kron 4 news. >> concord police are investigating a shooting that took a 25-year-old man's life last night. it happened outside a family party at mi casa court off monument boulevard. police say an argumentoting death of ismael ramirez of brentwood. the suspect fled the scene. but witness information led police to arrest 29-year-old concord resident vincent ochoa as the suspect. he's been booked on a charge of first degree homicide. police say it was a *stray* bullet that killed a former oakland tribune photographer. lionel fluker stopped at

the valero gas station on seminary and macdonald on friday night. he was on his way home from the gym, when he was hit by gunfire intended for another man. police say the intended target was also hit. that 38 year old unidentified victim is in critical condition. meanwhile, fluker's neighbors are heartbroken. this is the second killing >> this is the second killing over there and now, it's affected us because this man you could not ask for a better person everybody knew about have wanting his sweet dog. was a part of our community and it's a great loss for all of us. you couldn't ask for a better person. he minded his own business. everybody knew him for walking with his dog pepper. she was a sweet little dog. everyone on fluker's block says the neighborhood will never be the same without him. they say they are going to band together and make sure

that his dog pepper is taken care of. the case. a traffic note to pass along to you this morning. beale street between mission and howard in san francisco is closed this weekend. crews are working on the transbay transit center. installing huge steel bridges on the busy street. the work will allow traffic to flow while construction on the underground part of the project continues below. the are is expected to be opened by 5 am monday morning. >> secretary of state john kerry is mourning the first death of an american diplomat killed on the job since last year's attack in benghazi, libya. 25 year old anne smedinghoff was one six americans killed yesterday in an attack in afghanistan. she assisted kerry on his visit to afghanistan last month. kerry is in turkey. he's working on restoring diplomatic ties with israel. kerry said smedinghoff died trying to make a difference by providing young afghans with books for their education. >> they are trying to provide people with an opportunity folks that want to kill people and that is

all the want to do are scared and want to shut the door they do not want people to make their choices about the future. >> and u-s officials confirming today that an american civilian adviser was killed in military actvity in eastern afghanistan. that operation also left eleven suspected taliban militants dead. the advisor was one of three u-s civilians killed yesterday. two also died in a suicide bombing in the south along with three soldiers. the attacks come as the chairman of the joint chiefs of staff visited the country to assess security. because of rising tensions with north korea the pentagon announced today that it is delaying an inter-continental ballistic missile test scheduled for next week. the test would take place at the vandenberg air force base here in california. defense secretary chuck hagel delayed the test because he felt that the launch could be misinterpreted and may only worsen the current situation with north korea. coming up on kron 4 news

>> in santa clara county, four juveniles who were lost while hiking on a mountain had to be rescued by the c-h-p. officers were called to the search on mt. umunhum around 5-30 yesterday evening. crews in a search plane spotted the four in rough terrain on the mountain's western side. the juveniles were plucked from the mountainside by a c-h-p chopper, exhausted but uninjured and now, back home. >> just in time for spring

planting. fifteen truck loads of compost were given to san franciscans saturday morning. it's a way to say thanks for participating in the city's curbside compost collection program. hundreds of cars lined up for the opportunity to get a share of the compost made up from their food scraps and plant trimmings. >> the product we make with the organic waste that people put in those green bins is highly nutritious. we're able to sell it to organic farmers and vineyards all around northern california but we want to bring some back to give to the folks in san francisco so they understand what we do with this and encourage them to make even more. >> san franciscans have dropped enough in those green bins to have produced more than one million tons of compostable material since the program began in 1996. coming up on kron 4 news it must be good time to start your spring plantings. maybe tomatoes. >> coming up a reporter in

rain will press east it is mainly the coastal areas. your kron 4 7 day around the bay there is a big warm-up in store. with 80s for your inland areas. forecast. >> families of those killed in the shooting rampage at a small oakland university last year are remembering their lost loved ones. .this, just days after the one-year anniversary of the massacre. the university hosted a benefit concert last night in memory of the victims at saint paul's episcopal church in oakland. seven people were killed in the shooting at oikos university on april second of last year when authorities say the gunman one goh opened fire. investigators say goh -- a former oikos student -- planned the shooting after becoming angry with school officials over a tuition dispute. oikos university professor lia little, who taught all of the victims who were killed including the gunman explains how tough it is to cope with the

losses. >> it is hard. i just hope they find some type of peace. and acceptance of what happened and a way to move on. to give the rest of their lives meetings and honor for the ones they've lost. >> organizers say the proceeds from the event will be donated to the victim's families. this is one of two benefit concerts being hosted by oikos university this month. the next one will take place next weekend in el dorado hills. >> a common theme in the gun rights and gun safety debate is the enforcement of current laws. in california for example there is a law that prohibits certain people, like felons, from carrying weapons. but as jake taper explains there is a problem in tracking down those people. >> reporter: we are on the case with special agent john marsh, who spends most of his time tracking down guns from people everyone seems to

>> "i only focus on people that have been identifed as being prohibited from owning guns, and those are the only people we target, and those are the people that should be worried." >> reporter: felons domestic abusers those with mental problems -- all of whom are armed. for marsh and his fellow agents, danger always lies just beyond closed doors. we start in the city of fontana, east of los angeles. house after house, the person they are looking for is not home, and as day turns to night, it doesn't get easier. inside this house were two young children, two guns, and a man convicted of domestic violence. he admitted to having the guns inside the house, but he would not let the agents search. so? they wait. >> "so now, you're waiting for a judge to grant you a warrant. that could take two or three hours." >> "the agent will have to prepare a search warrant and bring it out to the on- call judge, because

obviously the court systems are closed now." >> reporter: it is a lot of work for sometimes little reward. on our night out with the california agents -- eight of the just 33 who do this kind of work -- they only made contact with a handful of the people they were looking for. inside this house, where our cameras had to wait outside, the agents found a large confederate flag, boxes and boxes of who- knows-what a bunch of guns and a felon not allowed to be near them. he fainted while they were inside. though some of the agents questioned how legitimate the fainting was, they had to call an ambulance >> "most everyone agrees that the gun laws already on the books should be enforced, but it's very labor-intensive and easier said than done. we've been here in san bernardino, california, for more than an hour to go after one felon who allegedly had access to guns and ammunition illegally, and already it's taken not only more than an hour but eight law enforcement agents and of course a fire truck and

paramedics just to go after this one felon." the end result? >> "so what was the haul." >> four rifles and one semi- automatic hand gun, and then corresponding ammuniotion for those weapons." in all, the department of justice in california has confiscated more than 10,000 weapons this way since 2006, but there's still a backlog of nearly 20,000 people because there are just too few agents to go after the weapons. >> "is it worth it? all this to keep him away from guns?" >> "i think so. i think if those guns are in the wrong hands, and we have an opportunity to get them out of those people's hands it's definitely worth it." >> reporter: every year the department sets a goal of taking guns from 2,000 of the people on the armed and prohibited list. and every year the agents say, three- more people are added to the list. >> the california

the san francisco giants will get some new hardware. their world championship series rings. giants fans who packed at&t park for home opening weekend saw former m-v-p winners kevin mitchell jeff kent, willie mccovey and willie mays on hand to congratulate the latest player to join their ranks. buster posey. posey thanked the fans as he received his most valuable player award for last year's season to remember. posey's big day may have been spoiled though by former giant carlos beltran and the saint-louis cardinals. beltran batted in three- runs to lead his team over the giants six-to-three. pablo sandoval and hunter pence each hit a home run but in the end it just wasn't enough. the giants continue the homestand today against the cardinals when giants ace matt cain takes the mound. first pitch is at 1-05 coco crisp. jed lowrie and seth smith all homered to lead the a's over their new division rivals the houston astros six-to-three. this is the second straight

game that crisp has homered -- putting the a's up one- to-nothing in the fourth. bartolo colon pitched a solid six-innings in his first appearance since he got a 50-game suspension for violating the leagues substance abuse policy. the a's are looking for a sweep today as they finish their series with the astros later today. >> now to the latest on men's college hoops. wichita state did everything right for nearly the whole game until louisville battled back. eventually winning 72-to-68. the ninth-seeded shockers saw their hopes for a national tittle slowly slip away as the turnovers started to mount and the shots stopped falling. this was the first time wichita state had advanced this far since 1965. now louisville turns its attention to the national championship game tomorrow.

>> developing story out of san francisco. where police are looking into why someone brandished a fake gun outside a bar overnight. officers ended up opening fire, sending two people to the hospital. kron four's mike pelton has been following this story and brings us an update. >> good morning. you could

still see the markings on the ground from valencia. this stemmed from a confrontation that took place around 2:00 a.m. one group of men approached another group of men. and as someone pulled out this gun. the witnesses saw this and take a look at where the police station is located. the officer came out and because they were fearing for the other men in the other group the officer fired and strafed the suspect. it turned out that leak gun was a replica. >> we never want have to use it to the forest. the officers were out here doing their job. >> the police chief also says that the gunfire struck a second person. they are investigating to see if that

series of similar home burglaries reported in san mateo and hillsborough in recent months. >> hercules police found illegal narcotics, stolen property and cash at this house on the 23-hundred block of redwood road. two men and a woman were arrested on suspicion of stolen property and possession of drugs for sale. neighbors say the owner of the house, 63 year old carlos rivera, has been in and out of jail. but although different cars frequented the home, there has never been a disturbance like this. along with these 3 suspects police arrested another 2 men. kron 4's alecia reid explains how an attempt to use counterfeit cash at a nearby cigarette shop started the entire investigation >> reporter: it all started in cigarettes city. manager harjit mehrok has been in the store 9 years and knows counterfeit bills when she sees them. >> once he starts giving me the money i realized it was a fake bill then i called police. when i told them it wasn't good money he said

he doesn't know how he got that money and he just left. >> there were at least 2 of them. one was inside the other was watching. he came in and said i used this money in here before and she said no no no. he went outside and spoke to the other guy. he must've told him to try it next door. when the police got here they already had a description of who they wanted to talk to. they stepped up on him before his buddy could come out of the other store. >> reporter: when the two suspects left cigarettes city, they walked over to big lots. that's where police ran into them. 25 year old brandon thomas- harris had 3 fake 20's on him, and 27 year old justin conlon - who's wanted on a 25k felony warrant out of napa for possession of stolen property was also held.

china is reporting two more cases of the new strain of bird flu. that raises the number of cases in shanghai to 20. the death toll among those who contracted the virus remains at six. health officials believe people are contracting the virus through direct contact with infected poultry. they say there's no evidence the virus is spreading easily between people. shanghai has been ordered to stop its live poultry trade. and slaughter birds in markets where the virus has been found. >> nine people are facing homicide charges following the *worst* building collapse india has seen in decades. the illegally constructed residential building killed 74 people when it crashed thursday in mumbai. police say some officers and city officials took

bribes to allow construction of the eight-story structure. if convicted, all nine suspects could face life in prison. >> a new controversial law proposal in uganda may prevent woman from wearing mini-skirts. it started as an anti- pornography law -- which is still being debated. the law would ban what can be shown on t-v and in the movies. but the law would also limit what women can wear. and if it is passed -- wearing a mini-skirt would become a crime. violators would have to pay thousands of dollars in fines and could spend up to 15-years in jail. the ban is being proposed by uganda's ethics minister. up next, a interesting story of survival. >> and also this approach to the bay bridge
